Public Hearing 5a
August 6, 2026
Mike Pitcock, City Manager
City Council Staff Report
Ordinance: Introduction and First Reading of Ordinance 2026-05 Amending Waterford Municipal Code Title 9, entitled “Public Peace, Morals and Welfare,” by adding Chapter 9.25 entitled “Nudity of Public Lands.”
SUMMARY:
The Council is being asked to consider adding Waterford Municipal Code Ordinance related to prohibiting nudity on public lands. If approved, it would make it illegal for anyone over 10 years of age to be nude or exposed to public view in or on any public right-of-way, public park or other public land, or in or on any private property open to public view from any public right-of-way, public park or other public land.
ANALYSIS:
Recently, several cities in the region have had discussions regarding public nudity and jurisdiction restrictions. The city of Waterford, at the request of the mayor, would like to proactively give law enforcement additional tools should public nudity become an issue in Waterford.
State law does not prohibit nudity per se but does provide Section 314 of the Penal Code which prohibits a person from “willfully and lewdly” exposing “his person, or the private parts thereof, in and public space, or in any place where there are present other persons to be offended or annoyed thereby.” Courts have historically upheld municipal ordnances regulating nudity when they use clear, specific anatomical definitions. These requirements are rooted in due process principles, ensuring that individuals are not left to guess at the law’s meaning or subject to arbitrary enforcement. McIntosh v.
Washington (1978) 395 A.2d 744. The ability of municipalities to restrict public nudity thus focuses on a well-defined definition. Eckl v. Davis (1975) 51 CA3d 831; Elysium Institute, Inc. v. County of Los Angeles (1991) 232 CA3d 408;.
The proposed Municipal Code has a definition taken from other jurisdiction(s) who have successfully put public nudity restrictions in place. The proposed amendment would make it illegal for persons who are nude and exposed to public view in or on public rights-of-way, public park or any other public land, or in or on any private property open to public view from any public right-of-way, public park or other public land, is offensive to members of the general public unwillingly exposed to such persons. The provisions of this section are enacted for the purpose of securing and promoting the public health, morals and general welfare of all persons in the city of Waterford.
FISCAL IMPACT:
The ordinance amendment itself will not impact the General Fund.
ENVIRONMENTAL REVIEW:
The City finds and determines with certainty that Code Text Amendment 2019-02 is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), and that the activity is covered under the general rule that CEQA applies to only projects which have the potential for causing a significant effect on the environment.
PUBLIC NOTICE:
In accordance with the City’s Municipal Code, a Public Notice was published in the Waterford News on July 14, 2019.
ODINANCE REVISION PROCESS:
Ordinance 26-05 is before the City Council for a public hearing to consider approving the Introduction and First Reading by title only. A summary of the Ordinance will be published in the Waterford News and will come back to the City Council as a public hearing item at the next council meeting to consider the Second Reading by title and Adoption. After adoption, an Ordinance Summary will be published in the Waterford News and will become effective and in full force on and after thirty (30) days of its passage and adoption.
ALTERNATIVES:
1. Not approve the ordinance revision.
2. Defer approval of the ordinance to a future council date and provide staff direction on council desired changes.
