2. Resolution - Limiting Use of City Facilities.pdf
Elizabeth Gasster
I support this resolution, it reinforces Watsonville as a sanctuary city. We cannot rely on federal immigration enforcement to be conducted in a constitutional manner. It protects our immigrant population and encourages residents to report crimes and cooperate with police without fear of triggering immigration actions. This improves safety for everyone in our city.

ORDINANCE AMENDING EXISTING SECTIONS 4-5.1301 & 4-5.1302 OF ARTICLE 13 OF CHAPTER 5 OF TITLE 4 & ADDING A NEW SECTION 4-5.1306 OF ARTICLE 13 OF CHAPTER 5 OF TITLE 4 OF THE WATSONVILLE MUNICIPAL CODE Attachments

1. Ordinance - WMC 4-5.1300 Oversized Vehicle Parking.pdf Peter Gelblum
The proposed Ordinance will cause undue and unnecessary harm to people whose only home is their oversized vehicle. The Ordinance does not even take them into account. It does not balance their substantial interest in having a safe place to live with the interests listed in the ordinance. There are not nearly enough safe parking spaces in Watsonville to accommodate everyone who needs one.
Moreover, the Ordinance allows for CVC § 22660-22662 tows (commonly called nuisance abatement tows) from the "public roadway," when CVC §22660-22662 limits such tows to vehicles stored on "public or private property." The proper tow authority for tows of vehicles from the public roadway is CVC § 22669 which is distinct from public property. Compare CVC § 22669 (setting forth vehicle tows of abandoned or dismantled vehicles from “a highway or from public or private property,” where highway is defined as “a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Highway includes street.”) with CVC § 22660-2 (setting forth vehicle tows of abandoned or dismantled vehicles from “public or private property”). The distinction between public roadway and public property is made more stark when comparing the different notice requirements for abandoned vehicle tows from each location. CVC § 22669 tows require significant post-removal storage and property owner notice. See CVC § 22851.3, Civil Code §§ 3071-2 (setting forth post-removal storage and notice requirements for vehicles towed from the public roadway).
In addition, a portion of the City appears to be within the confines of the Coastal Zone under the jurisdiction of the Coastal Commission. The Ordinance would deprive vehicularly housed people of coastal access and permit the City to perpetuate its discriminatory treatment of this population. The Ordinance is also inconsistent with the Coastal Commission’s environmental justice mandate by failing to remedy the principal environmental justice issue posed by the requested permit: discrimination against people because of their disability, race, or income status. See Pub. Res. Code § 30013.
At a minimum, if the ordinance proceeds, it should expressly state that WPD Policy 510 applies to tows under the new ordinance, including Policy 510.2, .4, and .5.
PASS AN ORDINANCE AMENDING EXISTING SECTIONS 4-5.1301 & 4-5.1302 OF ARTICLE 13 (RESTRICTED USE OF CERTAIN STREETS) OF CHAPTER 5 (TRAFFIC) OF TITLE 4 (PUBLIC SAFETY) OF THE WATSONVILLE MUNICIPAL CODE TO AMEND EXISTING RESTRICTIONS RELATED TO USE OF PUBLIC STREETS & AMEND EXISTING RESTRICTIONS RELATED TO ADVERTISING VEHICLES EQUIPPED WITH SOUND-AMPLIFYING DEVICES; & ADDING A NEW SECTION 4-5.1306 OF ARTICLE 13 (RESTRICTED USE OF CERTAIN STREETS) OF CHAPTER 5 (TRAFFIC) OF TITLE 4 (PUBLIC SAFETY) OF THE WATSONVILLE MUNICIPAL CODE TO ESTABLISH A PROHIBITION ON PARKING OF OVERSIZED VEHICLES
