Agenda Item Summary
47 Meeting: City Council - 10 April 2025
Department: Brian Carter, Acting - Fire Chief
Agenda Item Title: Approval of applying for the 2025 Volunteer Fire Capacity Grant
Recommendation: Approve the Fire Department to apply for the Volunteer Fire Capacity grant, due by May 5th, 2025.
Summary:
The Volunteer Fire Capacity (VFC) Program is a federally funded grant program that allows California to provide local and rural fire departments with minor firefighting, training, communications and safety equipment for their volunteer firefighters. The VFC Program is not intended for major equipment purchases (fire engines, vehicles, etc.) or capital repairs. The VFC Program has a 50/50 match provision, which requires the applying department to be able to meet the intended grant award, dollar for dollar.
Awards for departments are set at a minimum of $500 with a maximum of $20,000.
Amounts may be adjusted based on the grant funding available.
The city would be reimbursed from the grant after purchasing all approved equipment.
The Fire Department plans to request mobile and portable radios, structure nozzles and wildland Nomex shirts.
Fiscal impact: If awarded, the city would be responsible for the 50% match of the award amount given, up to $10,000.
Actions:
1. Apply for the grant
2. Delay the action
3. Adjust as deemed necessary by the City Council
CITY COUNCIL
CALTFORNED AGENDA MEMORANDUM
Meeting Date: April 10, 2025
From: Justin Mayberry, Chief of Police
Subject: Steampunk Festival 2025
Staff Recommendation:
The event will require road closures for 34 consecutive hours with temporary implementation of traffic control actions to include maintaining a fire lane through the event for emergencies. A waiver of 9.16.010 and 9.16.030 WMC by council will be necessary for any sales and consumption of alcohol within the event boundaries (consumption of cannabis within the event remains illegal per 11362.3 H&S).
Staff recommends implementing "No Parking" on Clay St., along the the west curb (southbound) from 8:00am on 5/17/2025 until 18:00pm on 5/18/2025.
Analysis:
Staff, after receipt of an encroachment request from Weed Chamber of Commerce, have determined the following street closures and traffic control measures may be implemented for 5/17/2025 and 5/18/2025. (see map) a. Closure of Main St. from the intersection of Main St. at W. Inez St./E.
Inez St., north to the to the southern sidewalk apron of Division St.
The closure would eliminate vehicular traffic use of the 200 block of Main St. The closure will have some impact on residents and businesses.
b. The Weed Chamber of Commerce has requested a two-day event beginning on 5/17/2025, with a requested street closure from 8:00am until 18:00 5/18/2025. Without the complete removal from the street and sidewalk of tables, tents or any other structures related to the event, it would not be possible to open the roadway. The street will need to remain closed overnight. Road closure will need to be for 34 consecutive hours total.
*Weed Fire Department has requested that a fire lane be maintained through the event for emergency response.
Discrepancies:
Requested roadway closures for the two-day event may differ from recommendations for such closure by staff.
The provided event site plan shows intended use of private property. The City may not grant permission for use of private property.
Fiscal Impact:
Some associated costs are foreseen currently:
• Use of City of Weed traffic control devices will be necessary. City employees will need to distribute traffic control devices no later than the morning of 5/16/2025 to allow for 24-hour notice posting before closure. • City employees will need to print notice of road closure and physically set up city owned barricades to allow for required posting. • City employees will need to affect the closure on 5/17/2025 by placing traffic control devices throughout the area of closure. • City employees will need to remove and compile traffic control devices on the night of 5/18/2025 allowing the roadway to reopen.
• City employes will need to collect city traffic control devices on 5/19/2025.
Requested:
a. Weed Chamber of Commerce requests the use of the closure area on 5/17/2025 from 08:00am thru 18:00pm on 5/18/2025 to allow for set-up, teardown, clean up and event activities.
b. Weed Chamber of Commerce has made a verbal request for council waiver of 9.16.010 and 9.16.030 WMC to allow for sales and consumption of alcohol within the event boundaries. No alcohol catering applications have been submitted for the event at this time but are anticipated.
Options:
Approve the closures and waivers of WMC.
1. Reject the closures and waiver of WMC.
2. Such other action as the Council may deem appropriate.

"Special event" means any street festival, sidewalk sale, community- sponsored activity, or community-approved activity."
An encroachment permit is a contract between the City and an encroachment permit holder, (permittee), that describes the terms and conditions under which you are granted permissive authority to enter onto State right-of-way to perform the activity.
An encroachment permit grants permission to the permittee or their agent (a contractor) to perform the within the City's right-of-way, and assignment to another party is prohibited.

• Protect the city's and public's investment in the roadways, and • Ensure that temporary uses of city roads, right-of-way for special events, filming, etc. are conducted safely and with minimum inconvenience to the traveling public.

CITY COUNCIL
CALIFORNTA AGENDA MEMORANDUM
Meeting Date: April 10, 2025
From: Justin Mayberry, Acting City Manager
Subject: Encroachment Permit Review for Completeness and Possible Revocation - 420 Festival 2025
Staff Recommendation:
Previously, the Council reviewed an Application for Encroachment Permit for an event that would require road closures for 16 consecutive hours with temporary implementation of traffic control actions to include maintaining a fire lane through the event for emergencies. A waiver of 9.16.010 and 9.16.030 WMC by council would be necessary for any sales and consumption of alcohol within the event boundaries (consumption of cannabis within the event remains illegal per 11362.3 H&S).
In March, the Council approved the permit with the stipulation that the applicant would provide a site plan for the event and proof of liability insurance 15 days prior to the event.
Staff recommend Council review of the previously approved encroachment permit for completeness and possible revocation based on stipulations set by the council.
Analysis:
On 4/7/2025, staff received a new Application for Encroachment Permit request from La Florista. Based on the new application staff determined the following street closures and traffic control measures would need to be implemented for 4/20/2025.
a. Closure of Main St. from the intersection of Main St. at W. Inez St./E. ez St., north to the south prolongation (intersection) of Main St an V. Division St./E. Division St. The closure will have some impact o residents and businesses; La Florista is responsible for obtaining a waiver from those businesses within the closure to allow for the event. b.
