Public Hearing for Community Development Block Grant Closeout 22-CDBG-00015 City of Weed Water/Sewer Project
7/10/2025
With the City of Weed's Community Development Block Grant, the city successfully addressed critical water infrastructure needs by replacing water and sewer lines and making improvements to the SCADA system.

Sewer system improvements included installation of +1,050 feet of 6-inch sewer main along White Avenue, generally between White Court and S. Davis Avenue. Water System improvements included: Replacement of a 6-inch water main with a 12-inch main in a t500-foot segment in N. Davis Avenue. Replacement of a 6-inch water main with a 12-inch main in a 1,450-foot segment in Roseburg Parkway. Replacement of a 6-inch water main with a 12-inch water main in a t425-foot segment in Broadway Avenue and in a t550-foot segment in E.

Lincoln Avenue. Installation of a 6-inch water meter on the south end of an existing water main to facilitate the metering of Roseburg Forest Product's water usage. A Reduced Pressure Principle (RPP) backflow prevention device installed on the water service line adjacent to the new water meter. The north end of the existing water main through the Roseburg parcel would be capped.

The Supervisory Control and Data Acquisition (SCADA) system improvements included placing or integrating existing equipment to the system at 5 water tank sites and 3 well sites, including purchasing a laptop with software to monitor and control the systems.

As of July 10, 2025 the water/sewer portion of the project is complete. The SCADA system improvements are 99% complete and will be completed by the expenditure deadline of August 7, 2025.

The procured City Engineer, PACE Engineering, Inc., oversaw the procurement and performed construction management of the construction contractor, M. Peters, Inc. for the Water/Sewer portion of the project and Gierlich-Mitchell, Inc. for the SCADA portion of the project. Great Northern Services, a subrecipient, assisted the city with grant and project administration.

For the 2022 grant cycle the City of Weed had 1740 low/moderate income residents or 65.41% of the population. Completing this project without increasing fees was crucial as additional fees Weaving a stronger community, together….

Access to Capital • Portfolio Management • Economic Development • Energy Assistance • Home Weatherization Community Food Projects • Community Services - HIV/AIDS Case Management • Community Development on resident's city utility bills would have placed an unsustainable financial burden on residents, many of whom risk losing water service due to the inability to pay.

This project meets the national objective by serving a community determined to be a low- moderate income area.

The budget for the project was $2,744,000 of which approximately $2,500,000 was expended as of May 2025. Of the expenditures approximately $45,000 was to support general administration for the grant and $2,500,000 was expended to support the construction of and to perform the construction. The City expects to disencumber approximately $160,000 when all reporting is complete.

Department: July 10, 2025
From: Justin Mayberry, Acting City Manager/Chief of Police Subject: Admin Citation Appeal - 153 Main St. Property Blight Staff Recommendation:

Uphold the citation.

Summary:

On 8/9/2022, the Weed Building Department deemed the two-story property located at 153 Main St. (parcel 060-312-120-000) as unsafe to occupy. The building was posted at that time.

Since that posting, City staff have addressed various incidents related to securing the building from trespassers (adult and juvenile), hazardous situations including windows falling on to the public sidewalk and neighboring properties, and a general condition meeting the definition of "Blighted Property" per 8.24.030(K) Public Nuisance Defined.

On 3/18/2025, the property owner was cited (#A1360) for the ongoing public nuisance.

This initiated a walkthrough with the Weed Building Department, Public Works, and Weed Police Department on 3/20/2025, at the request of the property owner. Also present that day was a structural engineer, retained by the property owner.

As of 5/20/2025, the City of Weed had received no plan to correct the ongoing public nuisance and additional citations were issued: #A1427 on 5/20/2025, #A1431 on 5/30/2025, and #A1452 on 6/11/2025.

The Property owner, Joyce Oliver, completed a citation appeal on 6/17/2025 requesting Options:

1. Uphold the citation.

2. Void the citation.

3. Such other action as the Council may deem appropriate.

Fiscal Impact:

Unknown. Ongoing staff time for public nuisance, abatement, and remediation of building code violations. Repeated inspections of blighted property by building department, public works, fire department and police department.

Discrepancies:

The citation appeal form has been completed for citation #A1360, which was issued on 3/18/2025. Per municipal code, the time allowing for appeal of this citation (15 days) had passed.

As of July 3r°, the property has not been registered as "vacant," required per Chapter 16.30 of the Weed Municipal Code.

Re: Resignation from a potential project;
153 Mäin Street, Weed, California
Receiving your call today, I'm writing to communicate that I am unable to assist in the above reference project. My health has deteriorated, and I am unreliable, professionally.

This week, I had three calls for future potential business. I had to refuse them all for health, due to my unreliability. I referred them all to Jake Cole Engineering in Mt. Shasta 530-239-4325. Said sickness also caused me to fall behind on projects prior to your first contact. The problem with my health is that days are "hit and miss" , meaning some days, I am functional, other days half-way functional. This makes me unreliable for any new or future substantial projects. I have also had to cancel/postpone personal engagements.

On March 20th ', 2025 I was present when the City of Weed inspectors et al did a site visit of the above referenced property. I wasn't feeling my best that day, and prior. In early April, I had a scheduled exploratory procedure, and the results were not good.

I do sincerely apologize for not communicating this sooner. The best I can assist you with is by providing a referral for you of Jake Cole Engineering 530-239- 4325.

Although this letter contains personal information, you may provide this letter to the Weed Büilding Department. This in the hopes that they will grant you an extension of time.

Sincerely,
Daniel F. Simon, PE. - Calif. RCE#58237

Notwithstanding the foregoing, to the extent such agreement is a "construction contract" as defined by California Civil Code Section 2783, as may be amended from time to time, such duties of permittee to indemnify shall not apply when to do so would be prohibited by California Civil Code Section 2782.

12.06.210 Acceptance of permit by applicant.

In determining what is a reasonable time under this section, the public works director shall take into consideration the nature of the encroachment, the urgency of the need for its removal, the cost of its removal, the difficulty of its removal, the value of the property to the owner, and other facts peculiar to the particular situation. If the permittee fails to comply with such instructions, the city may relocate or remove the encroachment at the expense of the permittee.

C. The provisions of this section shall apply to all permittees, including public agencies and public utilities having authority to occupy public rights-of-way pursuant to a franchise or an express provision of state statute, unless in conflict with a franchise agreement with the city, or in conflict with applicable state or federal law or regulation.

Accordingly, under the provisions of sections 15061(b)(3) and 15378(b)(2) of Division 6 of Title 14 of the California Code of Regulations, the CEQA Guidelines, the adoption of this ordinance is not subject to the requirements of the California Environmental Quality Act.
