Agenda Item Summary
Meeting: City Council - 12 Feb 2026
Department: February 12, 2026
From: Justin Mayberry, Chief of Police
Subject: Weed Municipal Ordinance: Military Equipment
Staff Recommendation:

Approve or deny Resolution No. 06-2026 as the council deems necessary.

Analysis:

The Weed Police Department does not possess any tactical equipment that it has obtained from the military, nor does it possess any equipment that was designed specifically for military use.

Regardless, with the passage of California Assembly Bill 481 in September of 2021, the California Government Code §7071(b) requires that law enforcement agencies submit a list of owned or maintained "Military Equipment" to the governing body; with yearly reports hereafter as to the owned or maintained equipment and use during the reporting period. Previously, the governing body adopted an ordinance specific to the use of "Military Equipment." The Police Department also adopted a policy specific to the use of "Military Equipment."

RESOLUTION 06-2026

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEED RENEWING THE WEED POLICE

DEPARTMENT'S MILITARY EQUIPMENT USE POLICY
WHEREAS, in 2022, the City adopted Ordinance No. 468-2022, approving the use of military equipment by the Weed Police Department;
WHEREAS, the Police Department must submit an annual report to the City Council on its use of military equipment;
WHEREAS, the City Council must review the Police Department's use of military equipment for compliance with the department's military equipment policy and the City's ordinance authorizing the use of military equipment; and
WHEREAS, the City must renew the ordinance authorizing the use of military equipment every year;
NOW, THEREFORE, the City Council finds and resolves as follows:

The City Council has received a report on the Police Department's use of military equipment;
The City Council finds the Police Department's use of the military equipment as described in its report complied with the following standards:

A. The military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.

The proposed military equipment use policy will safeguard the public's welfare, safety, civil rights, and civil liberties.

If purchasing the equipment, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.

D. Prior military equipment use complied with the military equipment use policy that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.

Based on the City Council's review of Ordinance No. 468-2022 and the Police Department's Military Equipment Use Report, the City Council hereby reauthorizes use of military equipment in accordance with Ordinance No. 468-2022. 342461.1

2026 Weed Police Department Military Equipment Use Policy Report California Government Code §7071(b) requires that law enforcement agencies submit a proposed Military Equipment Use Policy to their governing body for approval.

California Government Code §7070(d) describes a Military Equipment Use Policy as a publicly released, written document that includes, at a minimum, all of the following:

1. A description of each type of Military Equipment, the quantity sought, its capabilities, expected lifespan, and product descriptions from the manufacturer of the Military Equipment.

2. The purposes and authorized uses for which the law enforcement agency or the state agency proposes to use each type of Military Equipment.

3. The fiscal impact of each type of Military Equipment, including the initial costs of obtaining the equipment and estimated annual costs of maintaining the equipment.

4. The legal and procedural rules that govern each authorized use.

5. The training, including any course required by the Commission on Peace Officer Standards and Training, that must be completed before any officer, agent, or employee of the law enforcement agency or the state agency is allowed to use each specific type of Military Equipment to ensure the full protection of the public's welfare, safety, civil rights, and civil liberties and full adherence to the Military Equipment use policy.

6. The mechanisms to ensure compliance with the Military Equipment use policy, including which independent persons or entities have oversight authority, and, if applicable, what legally enforceable sanctions are put in place for violations of the policy.

7. For a law enforcement agency, the procedures by which members of the public may register complaints or concerns or submit questions about the use of each specific type of Military Equipment, and how the law enforcement agency will ensure that each complaint, concern, or question receives a response in a timely manner.

California Government Code § 7070(c) defines Military Equipment as any of the following:

1. Unmanned, remotely piloted, powered aerial or ground vehicles.

2. Mine-resistant ambush-protected (MRAP) vehicles or armored personnel carriers. However, police versions of standard consumer vehicles are specifically excluded from this subdivision.

3. High mobility multipurpose wheeled vehicles (HMMWV), commonly referred to as Humvees, two and one-half-ton trucks, five-ton trucks, or wheeled vehicles that have a breaching or entry apparatus attached. WEED
Agenda Item Summary
Meeting: City Council - 12 Feb 2026
Department: Administration
Agenda Item Title: Consider Resolution No. 07-2026 Accepting Grant Deeds for Four Properties
Staff Recommendation:

Adopt a Resolution accepting the enclosed grant deeds from Mr. Mark Juarez and authorizing recordation with the Siskiyou County Recorder.

Summary:

The City is bringing this item forward because California law requires a formal action of the City Council to accept real property conveyed to the City before the deeds can be recorded. The grant deeds for the four properties have been executed and delivered to the City pursuant to a court-approved settlement, and this resolution is the final procedural step needed to place legal title in the City's name.

Acceptance of the grant deeds allows the City to move forward in a legally compliant manner and prevents further delay in addressing long-standing public nuisance and safety conditions associated with the properties. This agenda item is limited to acceptance of title only and does not authorize any rehabilitation work, expenditure of funds, or future disposition of the properties.

Fiscal impact:

Acceptance of the grant deeds does not, by itself, authorize the expenditure of funds. However, once the title is accepted, the City becomes responsible for the properties.

The City currently has an active Request for Proposals (RFP) for mitigation and cleanup of the fire-damaged properties. Costs associated with mitigation, cleanup, and stabilization will depend on the responses received through that process and will be brought back to the City Council for consideration and authorization under separate agenda items.

Additionally, upon acceptance of title, the City may assume responsibility for ongoing property- related obligations, including but not limited to property taxes, insurance, and site security. Staff will continue to evaluate these liabilities and will return to the City Council with recommended actions and funding strategies as appropriate.

Discussion:

City legal counsel has reviewed the original grant deeds and confirmed they are suitable for recordation. Under California law, acceptance of real property by a public agency must occur in an open meeting of the governing body. This Resolution serves as the formal acceptance required to record the deeds with the County Recorder.

Acceptance of the properties does not currently authorize rehabilitation, sale, or disposition actions. Those matters will be brought forward separately as part of a future policy discussion, including cleanup, stabilization, funding strategies, and long-term redevelopment options.

Staff have coordinated closely with the City Prosecutor, Curtis Wright, by Serviam by Wright, outside counsel, and the City Clerk to ensure all procedural and legal requirements have been met prior to Council consideration.

Environmental Review:

This action has been reviewed by the City Prosecutor and outside legal counsel and is consistent with the court-approved Stipulation and Judgment.

RESOLUTION NO. 07-2026

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEED

ACCEPTING THE SURRENDER OF THE PARCELS OF REAL PROPERTY AT ASSESSOR'S PARCEL NUMBERS 060-292-080-000, 060-301-070-000, 060-292-060- 000, AND 060-292-050-000
WHEREAS, the City of Weed ("City"), a municipal corporation, has jurisdiction over the four parcels of real property located at the addresses and Assessor's Parcel Numbers ("APN") listed below ("'Nuisance Properties"):

1. 219 Main Street, Weed, California 96094, APN 060-292-080-000.

2. 234 Clay Street, Weed, California 96094, APN 060-301-070-000.

3. 247 Main Street, Weed, California 96094, APN 060-292-060-000.

4. 259 Main Street, Weed, California 96094, APN 060-292-050-000.

WHEREAS, the City recognizes that responding to and abating public nuisances and other violations of law is in the best interests of its citizens and the general public.

WHEREAS, Health and Safety Code section 17980.7 permits the City to seek the appointment of a receiver to take control of and rehabilitate a property when the property is maintained in a manner that violates the law, and the violations substantially endanger the health and safety of residents or the public.

WHEREAS, pursuant to Government Code section 27281(a), deeds conveying an interest in real estate to a governmental agency for public purposes cannot be recorded without a Resolution of Acceptance from the grantee consenting to the conveyance.

WHEREAS, the City Council has determined it would be in the best interests of the City to approve and authorize the action outlined in this Resolution.

Section 1. The City Council hereby finds and determines that it is in the best interests of the City's citizens, residents, and the general public to use any and all legal authority granted to the City, including but not limited to receiverships, to promptly abate public nuisances and other dangerous violations of law occurring within the City.

Section 2. The City Council hereby finds and determines that the following recitals are true and correct regarding the Nuisance Properties.

1. The Nuisance Properties are currently being maintained in a manner that violates numerous provisions of State and local law, to the extent that they substantially endanger the health and safety of occupants, entrants, and the general public. 1 of 3

2. The Nuisance Properties have been the focus of City code and law enforcement efforts for over 10 years. During this time, the City has exhaustively attempted to gain voluntary compliance from the owner of the Nuisance Properties ("Owner") in rehabilitating the Nuisance Properties.

3. Dué to Owner's failure to cure the numerous violations of law present on the Nuisance Properties, the City filed an action in 2024 in the Superior Court of California, County of Siskiyou, seeking the appointment of a receiver to take control of and rehabilitate the Nuisance Properties ("Receivership Action").

4. In recognition of the importance of promptly rehabilitating the Nuisance Properties, the City settled the Receivership Action by having Owner surrender title for the Nuisance Properties to the City, thereby allowing the City to immediately begin rehabilitating the Nuisance Properties.

5. On January 16, 2026, Owner delivered signed and notarized deeds ("Grant Deeds") for the Nuisance Properties to the City, thereby conveying free and clear title for the Nuisance Properties to the City.

Section 3. The City Council hereby directs that, in accordance with Government Code section 27281, the interest in real property conveyed by the Grant Deeds dated January 8, 2026, from Mark Juarez to the City of Weed, a political corporation and/or governmental agency, is hereby accepted by order of the City Council of the City of Weed, and the City consents to recordation thereof by its duly authorized officer. The City shall promptly record the Grant Deeds, along with this Resolution of Acceptance attached, with the Office of the Siskiyou County Assessor-Recorder.

Section 5. It is further resolved that if any section, subsection, part, clause, sentence, or phrase of this Resolution or application thereof is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, the validity of the remaining portions of this Resolution, and the application thereof, shall not be affected thereby but shall remain in full force and effect, it being the intention of the City Council to adopt each and every section, subsection, part, clause, sentence, and phrase regardless of whether any other section, subsection, part, clause, sentence, or phrase, or the application thereof, is held to be invalid or unconstitutional.

Section 6. The City Manager, the Chief of Police, and all other proper officers and officials of the City are hereby authorized and directed to execute such other agreements, documents, and certificates, and to perform such other acts and deeds, as may be necessary or convenient to affect the purposes of this Resolution and the transactions herein authorized.

City of Weed
WEED
Agenda Item Summary
Meeting: City Council - 02/12/2026
Department: Administration/Public Works (Facilities)
Agenda Item Title: Consider Resolution No. 08-2026 approving Change Orders for City Hall Restoration Completion and
Insulation Installation
Staff Recommendation:

Approve Change Order No. 1 and Change Order No. 2 with WIKE Restoration, Inc. for additional City Hall restoration work and installation required to complete previously authorized remediation and rebuilding efforts fully.

Summary:

The City has undertaken a comprehensive, multi-phase effort to remediate and restore City Hall following the discovery of water intrusion and its related impacts on the building. Work completed to date has included removal of all water-damaged materials, access into attic and ceiling spaces, and remediation of affected interior areas. In parallel, the City conducted extensive environmental testing to ensure the building was safe for continued use.

Independent third-party air monitoring, asbestos clearance testing, and microbial (spore trap) sampling were performed throughout City Hall following demolition and remediation activities.

These tests confirmed acceptable airborne asbestos fiber levels and provided baseline and post-remediation air quality data across offices, council chambers, corridors, restrooms, and exterior reference locations.

As remediation and testing were completed and additional building areas were opened, staff identified remaining work necessary to restore City Hall to a finished, fully functional condition.

The proposed change orders represent completion work that could not be fully scoped until remediation, demolition, and clearance testing were finalized.

The requested action is intentionally divided into two components:

Change Order No. 1 - Additional Restoration Work
This change order addresses additional framing, drywall installation and finishing, floor preparation for carpet installation, door modifications to accommodate new flooring, insulation of newly exposed exterior wall cavities, additional painting, and reinstallation of existing lighting in areas impacted by expanded ceiling removal and demolition. These items are necessary to properly close out spaces affected during remediation and return all rooms to usable condition.

The total cost of Change Order No. 1 is $89, 182.24.

Change Order No. 2 - Attic Insulation Installation
This change order provides for the installation of blown-in R-30 insulation throughout approximately 12,000 square feet of City Hall attic space. With complete remediation and environmental clearance confirmed, this work ensures the building envelope is fully restored, energy-appropriate, and consistent with current building standards. The total cost of Change Order No. 2 is $24,640.00.

Together, these change orders complete the City Hall restoration effort previously authorized by the City Council and ensure the facility is fully repaired, tested, insulated, and ready for continued safe occupancy.

Fiscal impact:

The total fiscal impact of the proposed action is $113,822.24, representing the combined cost of Change Order No. 1 ($89,182.24) and Change Order No. 2 ($24,640.00). Costs are associated with the previously approved City Hall remediation and restoration project. They will be pulled from our reserves.

Alternative Actions:

1. Decline to approve one or both change orders, resulting in unfinished interior areas or incomplete insulation.

2. Direct staff to rebid the additional work, which would delay completion and may increase overall project costs.

Environmental Review:

The proposed action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines §15301 (Existing Facilities), as the work involves repair and restoration of an existing public facility with no expansion of use.
