Members of the City Council:
Subject: Mill Fire Storm Drainage Infrastructure Replacement Project The bid opening for the subject project was held on June 25, 2026. PACE Engineering, Inc. (PACE) has reviewed the bids received, and enclosed is the Bid Summary.
Mt. Shasta Paving, Inc. dba Buzy Bee Paving Company submitted the apparent low bid of $1,045,897.
PACE identified bid-document and responsiveness issues, including omitted or incomplete required bid documents and a separate proposal adding terms, conditions, disclaimers, and limitations. In accordance with City Attorney guidance, the City has provided Buzy Bee Paving Company written notice of the finding of non-responsiveness. PACE recommends that the City reject Buzy Bee's bid as nonresponsive.
The next lowest bidder is Tullis, Inc., with a total bid amount of $1,113,269. PACE has examined Tullis, Inc.'s bid proposal and finds it complete and acceptable. Subject to City Council rejection of Buzy Bee's bid, PACE recommends that the City award the Contract to Tullis, Inc. in the amount of $1,113,269.
Once PACE is notified that the Contract has been awarded, a Notice of Award will be sent to Tullis, Inc. together with the Agreement and Bond forms. Instructions will be included for the Contractor to sign and complete the necessary documents and return them to PACE for review. PACE will then forward them to the City of Weed for signature, which will constitute execution of the Contract.

RESOLUTION NO. 31-2026
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEED TO AWARD A
CONTRACT FOR THE MILL FIRE STORM DRAIN INFRASTRUCTURE
REPLACEMENT PROJECT
WHEREAS, the Council authorized the City Engineer to solicit bids for the Mill Fire Storm Drain Infrastructure Replacement Project; and
WHEREAS, the bids were advertised and opened pursuant to California law; and WHEREAS, the City Engineer, after reviewing such bids, has determined that Tullis, Inc nas submitted the most competent bid and, thus recommends that a contract to complete suct project be awarded to Tullis, Inc.; and
WHEREAS, Council finds good cause to accept the recommendation of the City Engineer,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Weed:
SECTION 1: That Tullis, Inc. is hereby awarded a contract to perform and complete the Mill Fire Storm Drain Infrastructure Replacement Project in the amount of $1,113,269.00.
SECTION 2: A copy of the bid summary is attached hereto and made a part hereof.
SECTION 3: The City Manager or Mayor is hereby authorized to execute a contract with Tullis, Inc., pending legal review, for the project.
I HEREBY CERTIFY the foregoing resolution was introduced and adopted at a regular meeting of the City Council of the City of Weed held the 9h day of July 2026 by the following vote to wit:
