OBJECTIVE
This item seeks City Council approval of Resolution 25-81 (see Attachment 1), approving Final Map 5235, “Marshall Road Subdivision” (see Attachment 2), and the associated Subdivision Improvement (see Attachment 3).

RECOMMENDED ACTION
Staff respectfully recommends that the City Council adopt Resolution 25-81 approving Final Map 5235, “Marshall Road Subdivision”, and the associated Subdivision Improvement Agreement.

BACKGROUND
Tentative Subdivision Map No. 5235, “Marshall Road Subdivision”, was conditionally approved by the City Planning Commission on April 20, 2023. Said map creates 9 residential parcels and two public roads. The map is located at the westerly terminus of Marshall Road (see Attachment 4).

ANALYSIS
All applicable conditions of approval of the tentative map have been satisfied. As a condition of approval of said map, a Subdivision Improvement Agreement (SIA) has been prepared which obligates the developer to complete all required improvements necessary to serve the property. The required improvements include public roadways, water, sanitary sewer, and storm drainage improvements located within the boundary of the Map. Securities have been provided per City Ordinance and State Law to secure the obligations set forth in the SIA.

Environmental Considerations
The Planning Commission found the tentative map to be compliant with CEQA at the time of its approval. No additional findings are required with approval of this map.

Commission Recommendation
The Planning Commission conditionally approved Tentative Subdivision Map No. 5235, “Marshall Road Subdivision”, on April 20, 2023.

Strategic Plan Integration
Approval of Final Map 5235 promotes the City’s Strategic Plan goals of creating a “Range of Quality Housing Choices” and “Comfortable Lifestyle and Living”.

Alternatives
In accordance with Section 66458 of the Government Code, if the map conforms to all requirements of the Subdivision Map Act and local subdivision ordinance applicable at the time of tentative map approval or conditional approval and any rulings made thereunder, the map shall be approved at the meeting at which the map is received or at the next meeting.

Coordination and Review
The Final Map was reviewed by the Community Development Department.

Budget/Cost Impact
The map proponent pays for costs associated with the review and approval of this map per the approved fee schedule.

CITY COUNCIL AGENDA REPORT
MEETING DATE: August 6, 2025 ITEM # 6
SUBJECT:

CONSIDERATION OF RESOLUTION 25-82 ACCEPTING THE PUBLIC IMPROVEMENTS COMPLETED TO DATE FOR SUBDIVISION 5211 AND SUBDIVISION 4936, "FOUR40 WEST"
INITIATED OR REQUESTED BY: REPORT COORDINATED OR PREPARED BY:
[ ] Council [x] Staff

Community Development Department
ATTACHMENT [X] Yes [ ] No [ ] Information [ ] Direction [X] Action

OBJECTIVE
To accept public improvements completed to date constructed for Final Map 5211 and Final Map 4936.

RECOMMENDED ACTION
Staff respectfully recommends that the Council adopt Resolution 25-82, accepting the public improvements completed to date for Subdivision 5211 and Subdivision 4936.

BACKGROUND
Final Map 5211, Final Map 4936 and the associated Subdivision Improvement Agreement were approved by Council on August 16, 2023. As a condition of approval of said map, a Subdivision Improvement Agreement (SIA) was executed which obligates the developer to complete all required public improvements necessary to serve the property. The required improvements included public water and sewer improvements as well as frontage improvements to meet current City Standard specifications and the Washington Specific Plan on E Street and 6th Street across the map frontages.

ANALYSIS
The required public improvements for Final Map 5211 and Final Map 4936 have been substantially completed to the satisfaction of the City Engineer and Community Development Department except for a few minor frontage improvements on E Street. Acceptance of the completed improvements will allow for the release of posted securities per the terms outlined in the applicable Subdivision Improvement Agreement.

Outstanding improvements remaining on E Street are limited to planter box improvements, landscaping and a small retaining wall. Staff has been working with the developer to refine the ultimate design solution for the frontage which complies with City Standards while also taking into consideration unique features which exist such as heritage trees. The final plans have recently been approved, and an Encroachment Permit will be issued to complete the remaining work.

The developer has asked that the completed improvements be accepted at this time and the remaining minor improvements be deferred to allow for occupancies within the Subdivision. The approved SIA prohibits occupancies prior to acceptance of the improvements. None of the outstanding improvements create an access obstruction to any of the new parcels within the Subdivision or create a safety risk to new residents of the Subdivision.

Environmental Considerations
The Planning Commission found the tentative map to be compliant with CEQA at the time of its approval. No additional findings are required with acceptance of the public improvements.

Commission Recommendation
The Planning Commission conditionally approved Tentative Subdivision Map No. 5211, “Four40 West”, and Modifications to the previously approved “Alura at Washington Square” Vesting Tentative Subdivision Map No. 4935, on July 15, 2021.

Strategic Plan Integration
Approval of the Final Map of Subdivisions 5211 and 4936 promotes the City’s Strategic Plan goals of creating a “Range of Quality Housing Choices” and “Comfortable Lifestyle and Living”.

1. Accept the public improvements completed to date, as recommended by staff. This will allow for occupancies to occur within the Subdivision prior to completion of the outstanding minor improvements; or,

2. Council may choose not to accept the public improvements completed to date at this time and require that all improvements be completed prior to acceptance.

Coordination and Review
The completion of the required improvements has been approved by the City Engineer and the Community Development Department.

Budget/Cost Impact
Once the City accepts improvements, the City must pay for maintenance and operation of those improvements. The maintenance and operation of the improvements will be funded from the appropriate funding source (ie: water fund will cover the cost of maintaining and operating water improvements).

CONSIDERATION OF ADOPTION OF RESOLUTION 25-86 REGARDING THE

EMERGENCY CONTRACT AND AWARD OF A CONSTRUCTION CONTRACT WITH

EXPRESS SEWER & DRAIN FOR THE SUTTER STREET SEWER LINE COLLAPSE (CIP 31007)
INITIATED OR REQUESTED BY: REPORT COORDINATED OR PREPARED BY:

OBJECTIVE
The objective of this report is to provide the City Council with sufficient information to adopt Resolution 25-86 regarding the Emergency Contract and award the Emergency Contract with Express Sewer & Drain for the sewer line collapse occurring at Sutter Street.

RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1) Find that the Sutter Street Sewer Line Collapse Repair Project is exempt from CEQA analysis under CEQA Guidelines Section 15269. According to the CEQA Guidelines, an emergency includes emergency repairs to public or privately owned service facilities necessary to maintain service essential to the public health, safety, or welfare;
2) Adopt, by a minimum four-fifths vote of the Council, Resolution 25-86 regarding the Emergency Contract with Express Sewer & Drain for the Sutter Street Sewer Line Collapse Repair; 3) Approve the contract with Express Sewer & Drain to provide emergency sewer line repair at Sutter Street; 4) Authorize the City Manager or designee to execute an emergency contract for service in an amount not to exceed $39,000.00;
5) Authorize the City Manager or designee to execute amendments or change orders on the contract; and 6) Authorize the City Manager or designee to execute non-substantive changes and modifications, with approval from the City Attorney; and
7) Authorize the City Manager or designee to extend the contract term and adjust compensation, within the limits of the Council-approved budget of CIP 31007.

BACKGROUND
Sutter Street is a north-south side street approximately 0.2 miles in length. This street contains commercial and residential properties, and the street and its infrastructure were inherited from Yolo County when the City incorporated in 1987.

A private contractor is currently working at the north end of Sutter Streer for an Idealease Commercial Truck Leasing location. As part of the agreement, the developer has responsibility for the west half of the north end of the street to the frontage on First Street. The contractor discovered an issue with the sewer system while paving.

The contractor made a few minor repairs as issues were discovered. However, this is a shallow, old, concrete sewer line and while attempting to run CCTV to review additional damage, they found at least one and possibly more locations on Sutter Street where the line has collapsed completely, necessitating immediate repair. Express Sewer & Drain has been contracted to provide the repair which may consist of inserting a liner into the existing pipe and/or replacing part or all of the pipe.

ANALYSIS
For the purposes of contracting, Section 1102 of the Public Contract Code (PCC) defines an emergency as “a sudden, unexpected occurrence that poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential services.” PCC 20168 allows cities to enter into no-bid emergency construction contracts following the procedure set out in PCC 22050. PC 22050 allows a city to delegate this authority to a non-elected public official. West Sacramento Municipal Code 3.04.090 delegates this authority to the “purchasing agent,” which is elsewhere defined as the City Manager.

Once the contract has been approved, the City Manager is required to report on the contract at the next City Council meeting (PCC 22050(b)(3)). If this work is continuing, the Council needs to authorize continuing the work 150

by a 4/5 vote (PCC 22050(c)(2)). Because the work involved in the emergency repair may extend beyond the August 6, 2025 City Council meeting, the Council is asked to adopt Resolution 25-86.

Environmental Considerations
This emergency repair is exempt from CEQA analysis under CEQA Guidelines 15269. According to the CEQA Guidelines, an emergency includes emergency repairs to public or privately owned service facilities necessary to maintain service essential to public health, safety, or welfare.

Commission Recommendation
Not applicable.

Strategic Plan Integration
Not applicable.

Alternatives
The Council’s primary alternatives are summarized below:
1) Approve the recommended actions as stated above.
2) Delay or revise the recommended actions.
3) Not approve the recommended actions.

Alternatives 2 and 3 are not recommended as approval of this contract is required for the contractor to complete the emergency work detailed in this report.

Coordination and Review
This report was prepared by the Public Works Operations & Maintenance Department and coordinated with and reviewed by the Capitol Projects Department, Finance Department, and the City Attorney.

Budget/Cost Impact
The emergency work identified in this report is not eligible for reimbursement by YCPARMIA. Capital Improvement Project 31007, Major Sewer System Emergency Repairs, will be utilized to fund these repairs. This project currently has an available budget of $436,700, which is sufficient for the proposed amount of the repair contract.

4. Approve Resolution 25-89 authorizing budget appropriations to fund the changes proposed in the Benefit Summaries, revised APL, and revised Classification Plan.

BACKGROUND
The Authorized Position List (APL) identifies the number of positions and their respective classification titles by budget unit. Staff must bring an updated Authorized Position List to the City Council for approval whenever there are changes to the number(s) of positions or budget unit(s).

The Publicly Available Pay schedule (Classification Plan) establishes the monthly and annual salary ranges for all regular authorized positions as well as the pay schedule for the Mayor, City Council members, and all extra help positions in the City. CalPERS requires the City bring updated salary ranges (Classification Plan) to the City Council whenever there are changes to the salary ranges or job titles.

The City also maintains Benefits Summaries which contain information regarding benefits offered to the various employee groups. When updates to Benefits Summaries are proposed, they are presented to the Council for consideration and approval. The Benefits Summaries attached include updates to the salary and benefits for the unrepresented employee groups.

ANALYSIS
Publicly Available Pay Schedule (Classification Plan):

The City of West Sacramento’s (City) publicly available pay schedule identifies job classifications that have been approved by City Council (e.g., accountant, administrative assistant) and the hourly rates of pay for each classification at each step. The requested change to the publicly available pay schedule is a result of the changes outlined below under the benefit summaries section.

OBJECTIVE
The objective of this report is to seek feedback from the City Council on the proposed Bryte Park Master Plan Implementation funding strategy.

RECOMMENDED ACTION
Staff respectfully recommends that the City Council conduct a workshop on the proposed Bryte Park Master Plan Implementation funding strategy and provide direction to staff.

BACKGROUND
Bryte Park is located in the northern portion of the City and is the most heavily used and programmed park in the City. The property is owned by Washington Unified School District (WUSD) but is improved and maintained by the City through a Joint Use Facilities Agreement. On January 9, 2013, the City Council adopted the BPMP (Attachment 1), which was the result of a robust community engagement effort, developed in coordination with over 200 community members and stakeholders. The original Master Plan spanned three properties: Bryte Park, Alyce Norman Playfields/Bryte Career and College Training Campus, and Holy Cross School. The 2013 BPMP served as a roadmap to help the City leverage local, state and federal resources to implement improvements. In early 2015, the City partnered with the Walt Disney Company, KaBoom! and over 500 volunteers to plan and build a new playground in Bryte Park (Phase 1). In spring 2016, the City constructed another phase of improvements, including on-site parking, lighting, landscaping, new restrooms, a covered BBQ and picnic area, shade structure for the play area and road crossing improvements on Carrie Street (Phase 2).

The City’s Parks, Recreation and Open Space (PROS) Master Plan was approved by City Council on April 17, 2019, and provides a comprehensive approach for planning, funding, developing, and maintaining parks and recreation facilities and programs over the next 10 years. Updating and implementing the BPMP was included in the PROS 10-Year Capital Improvement Program. To further support this work, the City’s 2019 Strategic Plan included as a Management Agenda High Priority item: “Parks, Recreation and Open Space Master Plan Implementation.

In 2021 Staff worked with Quadriga to make minor refinements and develop a proposed phasing plan for the ongoing implementation of the Bryte Park Master Plan Implementation. Significant changes included the Holy Cross playfields and Alyce Norman playfields excluded from the Master Plan, the completion of 36 accessibility barriers that were previously identified in an ADA Transition Plan and various amenities were added to include:
a new dog park, a new all-weather soccer field with lighting, angled street parking along Riverbank Road, agefriendly fitness stations and a walking loop with seating, pathway lighting, pickleball courts, hydration stations and a maintenance/storage shed to ensure required maintenance.

In June 2023, the City Council approved a contract with Verde Design Inc. to complete 100% Design and Construction Documents for the Bryte Park Master Plan Implementation Project. Following this approval, additional community engagement meetings and discussions with City staff led to several key refinements to the plan, including expanded landscape and green space, increased accessible walking and running paths, adjustments to the locations of the pool and splash pad seating, and the inclusion of an outdoor amphitheater.

Other updates included additional restrooms, a larger maintenance yard with a separate entrance, a handball court, and a relocated outdoor classroom. Throughout this time, City staff actively pursued funding opportunities and, in 2024, were awarded a $15 million grant through the Outdoor Recreation and Legacy Program (ORLP), funded by the Land and Water Conservation Fund (LWCF). This grant presented a unique opportunity, providing funding for both land acquisition and development. Since receiving the grant award notification, the City has been working through the post-award requirements, including Section 106, NEPA, and CEQA compliance, while 219

also collaborating with the Washington Unified School District on the potential acquisition of land for Bryte Park.

Verde Design Inc. has completed the 100% Design and Construction Documents, which are currently pending final approval from the City’s Building Division.

On January 31, 2024, the Washington Unified School District (WUSD) and the City jointly signed a Letter of Intent outlining the City’s proposal to purchase approximately 24.12 acres of land from WUSD. This agreement is contingent upon the City securing an Outdoor Recreation Legacy Partnership (ORLP) grant. The Letter of Intent also identifies the steps required for the acquisition, including compliance with the Subdivision Map Act, Surplus Land Act, and Naylor Act. On Thursday, July 24, WUSD adopted Resolution No. 2526-50, officially declaring the Bryte Park property as surplus. The City continues to collaborate closely with WUSD to ensure full compliance with all applicable legal requirements throughout the acquisition process.

The City anticipates initiating the Invitation to Bid process in Fall 2025, with all post-award grant conditions expected to be met by November 2025. In accordance with ORLP grant guidelines, construction cannot commence until all conditions have been fulfilled.

ANALYSIS
On June 28, 2023, the City Council approved amendments to the Bryte Park Master Plan Implementation Capital Improvement Project (CIP) 62138 providing a total budget of $15,525,000 and directed staff to proceed with the completion of the 100% design for the Bryte Park Master Plan (BPMP). A contract was awarded to Verde Design, and to date, approximately $2,896,327 has been spent on design services, environmental review, and project management. This leaves a remaining balance of $12,628,673 in CIP 62138.

In 2024, the City was awarded a $15,000,000 million Outdoor Recreation Legacy Partnership (ORLP) grant, funded by the federal Land and Water Conservation Fund (LWCF). The grant requires a local funding match, and federal funds cannot be used to meet this requirement. The table below summarizes the current funding sources available for construction:

BRYTE PARK BUDGET
CIP #62138 $15,525,000
Design Contracts, Environmental, Staff, ICAP ($2,896,327) Remaining Construction Subtotal $12,628,673
ORLP Grant $15,000,000
ORLP Grant Land Acquisition (half of appraised value) ($2,250,000) Construction Subtotal $12,750,000
Total Construction Funds $25,378,673
Verde Design has completed the 100% Design Plans and estimates the total construction cost for the Bryte Park Master Plan at approximately $62,108,976. In addition, the ORLP grant will reimburse the City for half of the appraised land value to acquire Bryte Park which is estimated to be a total of $4,500,000. This brings this project total combined with land acquisition to $64,358,976. The funding gap between total project cost combined with land acquisition and allocated funds is $36,730,303. To address this shortfall, the City has identified the following implementation strategies:

1. Full Implementation of the Bryte Park Master Plan
This approach involves constructing the entire park over a three-year period. Two financing options are under consideration:
 Option A: Fully finance the remaining $36,730,303 through City financing mechanisms. Annual repayment costs would vary based on prevailing interest rates. 220

Page 3 ends

 Option B: Use a combination of local funding and City financing to cover the project variance. The specific local funding contribution and financed portion are still under evaluation. Annual repayment would similarly depend on interest rates.

2. Phase the Softball Fields
Under this scenario, construction of the softball fields with sports lighting would be deferred to a later phase, reducing the current construction budget by approximately $5,728,000 and leaving $31,093,514 to be financed.

This option would include purchasing the land from Washington Unified School District and adhering to the ORLP grant requirements. While this option lowers immediate costs, staff does not recommend it. Delaying the softball fields is expected to increase future construction costs, create a deficit in playfields, and negatively impact local organized sports leagues.

3. Phase the Community Pool
This option would delay construction of the community pool, reducing current costs by approximately $18,685,000 and reducing land acquisition costs by half the property value (City funded portion) at approximately $2,250,000, resulting in a total savings of $20,935,000. However, it would require the City to request a significant downscoping of the $15,000,000 ORLP grant—potentially jeopardizing the entire grant award. The City has consulted with California State Parks, who advised that this approach would risk not only the $15,000,000 grant but also future grant eligibility. Additionally, deferring the community pool would lead to higher future construction costs and would preclude the City from acquiring the Bryte Park property from the Washington Unified School District. This scenario would leave $30,925,000 to be financed.

Operating Cost Projections
Verde Design Group has completed an operational analysis that includes an estimated annual allocation of $638,828 for a 30-year lifecycle replacement plan for Bryte Park. The annual operating costs associated with the operations, staffing, and maintenance of the improved Bryte Park facility are estimated at $2,100,000. Of the $2,100,000 approximately $730,000 goes towards the staff, operations and maintenance of the community pool. Escalation costs are estimated at 3% annually. While there are potential revenue-generating opportunities—such as facility rentals, recreational programming, and swim lessons, these are estimated to generate approximately $220,000 in annual revenue to help offset overall park operating costs.

Environmental Considerations
To comply with the funding source requirements for this project all, NEPA and CEQA requirements will be met prior to construction approval.

Commission Recommendation
On June 6, 2023, the Parks, Recreation and Intergenerational Services (PRIS) Commission received a presentation on the BPMP. The PRIS commission supported the BPMP Implementation Project and encouraged staff to seek additional funding sources to fully implement the plan.

Strategic Plan Integration
The Implementation of the BPMP aligns with the City’s 2019 Strategic Plan Management Agenda High Priority item: “Parks, Recreation and Open Space Master Plan Implementation,” and the City’s Strategic Plan goal “West Sacramento: Preferred place to live, work, learn and play.” The project further supports the City‘s mission statement: “To provide Quality Municipal Services, Quality City Infrastructure and Facilities, and to Inspire Community Improvements that add value to the lives of our residents.” Alternatives
In addition to the recommended action, the City Council may also choose to:

1. Elect not to conduct a workshop.

2. Provide alternative directions to staff not presented in the workshop.

The 1st alternative is not recommended, as the BPMP has been identified as a City Council Priority for multiple years and the workshop will allow staff to receive direction form City Council.

Coordination and Review
This report has been prepared in collaboration with Capital Projects, Community Development, Finance, City Manager’s Office, and the City Attorney.

Budget/Cost Impact
Staff will present 3 funding approaches to City Council and there are varying degrees to the budget impact based on which option is chosen.

Gap Financing Strategy
To fund the project gap of $30-37 million, the City Council adopted Resolution 25-40, providing authority for staff to submit an application to the state’s iBank, tax-exempt bond infrastructure funding program. A $40 million financing at today’s interest rates (sized to cover project funds, cost of issuance and any required reserve fund) would result in an estimated annual payment of approximately $2.6 million over 30 years. The proposed funding source for the iBank financing annual debt payment would be Measure N funds. To free up sufficient Measure N revenues to cover the debt payment, staff proposes reallocating or pausing the $1 million annual appropriation for the Small Business Assistance program (staff has determined that this program has sufficient current funding balance to operate for multiple years, which could be supplemented in the future by other one-time funds) and shifting $1.6 million in public safety costs to the Measure O fund.

Staff are in process of completing the application for submittal and review by iBank staff. The review and approval process from application submittal to availability of funds is typically 5-6 months. If the application is finalized and submitted by the end of the month, funds should be available for the project around February 2026.
