OBJECTIVE
The objective of this report is to provide the City Council with sufficient information to approve the need of an Emergency Contract and make a finding, based on substantial evidence set forth in the minutes of its meeting, that the emergency will not permit a delay resulting from competitive solicitation of bids, and that the action is necessary to respond to the emergency.

RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1) Find that the Ramco Street Emergency Valve Installation Project is exempt from CEQA analysis under CEQA Guidelines Section 15269. According to the CEQA Guidelines, an emergency includes emergency repairs to public or privately owned service facilities necessary to maintain service essential to the public health, safety, or welfare;
2) Determine that the Emergency Valve Installation Project qualifies as an emergency and authorize the City to proceed with a no-bid emergency contract in accordance with PCC 22050; 3) Approve the Ramco Street Emergency Valve Installation Project contract to provide emergency water line repair at Ramco Street;
4) Authorize the City Manager or designee to execute an emergency contract for service with approval from the City Attorney;
5) Authorize the City Manager or designee to execute amendments or change orders on the contract; 6) Authorize the City Manager or designee to execute non-substantive changes and modifications, with approval from the City Attorney; and
7) Authorize the City Manager or designee to extend the contract term and adjust compensation, within the limits of the Council-approved budget.

BACKGROUND
Mulvany Place is an east-west urban street of 0.9 miles, connecting to Ramco Street. Businesses on this street include Saladino’s Foodservice Warehouse and Nichirei Sacramento Foods.

There is an existing low-end blowoff valve that began to leak at the intersection of Ramco Street and Mulvany Place. In staffs’ initial investigation, the leak is not coming from the actual valve. Rather, the leak is in the pipe at the connection to the main water line. The leak has been constant and is increasing in size, and there is concern that the connection will fully break and cause a break in the connection at the 12” main which is currently 12 feet underground. This pipe supplies all of the businesses on Mulvaney Place, several of which rely on continuous water flow to maintain their refrigeration operations. Based on this information, staff has determined the best way to address the issue and maintain business services is to install a new valve on Ramco which will allow water to continue to flow to Mulvaney and shut the water off at the site of the leak, allowing for repair.

ANALYSIS
For the purposes of contracting, Section 1102 of the Public Contract Code (PCC) defines an emergency as “a sudden, unexpected occurrence that poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential services.” PCC 20168 allows cities to enter into no-bid emergency construction contracts following the procedure set out in PCC 22050. PC 22050 allows a city to delegate this authority to a non-elected public official. West Sacramento Municipal Code 3.04.090 delegates this authority to the “purchasing agent,” which is elsewhere defined as the City Manager.

Once the contract has been approved, the City Manager is required to report on the contract at the next City Council meeting (PCC 22050(b)(3)). If this work is continuing, the Council needs to authorize continuing the work 3 Ramco at Mulvaney Emergency Water Valve Installation

by a 4/5 vote (PCC 22050(c)(2)). Because the work involved in the emergency repair will be completed prior to the September 17, 2025 Council meeting, no resolution is included at this time.

Environmental Considerations
This emergency repair is exempt from CEQA analysis under CEQA Guidelines 15269. According to the CEQA Guidelines, an emergency includes emergency repairs to public or privately owned service facilities necessary to maintain service essential to public health, safety, or welfare.

Commission Recommendation
Not applicable.

Strategic Plan Integration
Not applicable.

Alternatives
The Council’s primary alternatives are summarized below:
1) Approve the recommended actions as stated above.
2) Delay or revise the recommended actions.
3) Not approve the recommended actions.

Alternatives 2 and 3 are not recommended as approval of this contract is required for the contractor to complete the emergency work detailed in this report.

Coordination and Review
This report was prepared by the Public Works Operations & Maintenance Department and coordinated with and reviewed by the Capital Projects Department, Finance Department, and the City Attorney.

Budget/Cost Impact
The emergency work identified in this report is not eligible for reimbursement by YCPARMIA. Early cost estimates for the work are approximately $15,000. Capital Improvement Project 21007, Major Water System Emergency Repairs, will be utilized to fund these repairs and has sufficient funding to cover this work.
