causing additional property damage to the applicant's property and the neighboring property. Accordingly, the applicant's oak tree report recommends removal of the tree.

Staff requested the preparation of a peer review of the applicant's oak tree report by the City's consulting arborist, Dudek. The peer review concluded the tree has the potential to almost double in size over the next ten to twenty years, the tree will continue to adversely impact surrounding driveways, walkways, and foundations of both residences as it grows. Additionally, the discoloration of the leaves indicates a potential disease that could lead to poor tree health and senescence.

The peer review concluded that the recommendation to remove the tree was reasonable.

The proposed project is exempt from the provisions of the California Environmental Quality Act as a Class 4 (Minor Alterations to Land) Categorical Exemption.

On November 2, 2022, the Land Use Committee (Pearl/Honig) recommended that the request be moved forward to the full City Council for a public hearing.

3. PUBLIC HEARING FOR AN ORDINANCE TO AMEND THE WESTLAKE

VILLAGE MUNICIPAL CODE PERTAINING TO ACCESSORY DWELLING UNITS; ORDINANCE NO. 297-22
Mayor Halpern opened the Public Hearing. Planning Director Forbes introduced Ordinance No. 297-22 to amend the Westlake Village Municipal Code pertaining to Accessory Dwelling Unit (ADU) development standards and application processing requirements. The amendments are required due to changes in State law effective January 1, 2023.

On September 28, 2022, the Governor signed Assembly Bill 2221 and Senate Bill 897. Both bills take effect January 1, 2023 and amend State law pertaining to ADUs. All cities are required to update their ADU standards to reflect the new legislation. The practical effect of the required changes will be minimal for Westlake Village, as described below.
• Height: There are no properties in Westlake Village within one-half mile of a major transit stop or high-quality transit corridor, so the height increase for detached ADUs will not be applicable. The City's existing ADU standards already allow attached ADUs of the same height allowed for the primary residence, so the required change would only apply in situations where someone desired to build a two-story ADU attached to a single-story primary dwelling. This scenario is not allowed under the current standards but would be allowed under the new State-mandated standards. However, the attached two-story ADU would be limited to 25 feet in height. Detached ADUs would still be limited to 16 feet.
• Front setback: Most or all properties in the City have adequate space in rear or side yard areas to accommodate an ADU, which makes it unnecessary to encroach into the front yard setback.
• Junior ADUs: While an attached garage may now be converted into a Junior ADU, the same space could be converted into an attached ADU under current standards, so this change is minor.
• Processing: The required changes to how an application is processed are entirely procedural and have no practical effect on the approval or construction of an ADU, or on the City's ability to regulate ADU construction and enforce other applicable requirements.

PUBLIC HEARINGS (continued):

Ordinances implementing State ADU law are exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 15282(h) of the State CEQA Guidelines.

Mayor Halpern closed the Public Hearing.

Mayor Pro Tern Pearl moved that Ordinance No. 297-22, 'An Ordinance of the City of Westlake Village Regarding Accessory Dwelling Unit and Junior Accessory Dwelling Unit Regulations, Amending the Westlake Village Municipal Code,' be introduced by title only and that further reading be waived with a second reading on December 14, 2022 and determining that adopting this Accessory Dwelling Unit Ordinance is exempt from CEQA pursuant to CEQA Guidelines Section 15282(h). AND EXISTING BUILDING CODES: AND THE 2022 CALIFORNIA FIRE CODE: TOGETHER WITH CERTAIN AMENDMENTS, DELETIONS, AND ADDITIONS; AND INCLUDING FINDINGS, FEES. AND PENAL TIES; ORDINANCE NO. 298-22
Planning Director Forbes introduced Ordinance No. 298-22, to adopt by reference the 2022 editions of the Los Angeles County Building, Electrical, Plumbing, Mechanical, Residential, Green Building Standards, and Existing Building Codes, and the 2022 California Fire Code. Without City Council action, the California Building Standards Code will automatically become effective on January 1, 2023, without the benefit of local amendments.

Every three years, the California Building Standards Commission adopts a new version of the California Building Standards Code, codified in Title 24 of the California Code of Regulations. The California Building Standards Code governs the construction of all structures in the state and consists of the California Building, Residential, Electrical, Mechanical, Plumbing, Energy, Historical Building, Fire, Existing Building, Green Building Standards, and Referenced Standards Codes.

With each triennial update of the California Building Standards Code, Los Angeles County adopts by reference the updated code along with local amendments.

These amendments are developed with consideration for the County's unique climatic, geologic, and topographic conditions.

The proposed ordinance adopts by reference all the County codes referenced except the Fire Code. The County is still in the process of drafting local amendments to the 2022 edition of the California Fire Code. Once the County has --- ---- ---- --- --------------- - - -- -·--- --

City of Westlake Village
NEW BUSINESS (continued):

City Council Minutes
November 9, 2022 14
The bid opening was held on October 27, 2022, where the City received one bid for the project. This bid is 3% below the engineer's estimate of $192,000. The total bid amount includes all three additive alternates. Although only one bid was received, readvertising the project likely would not result in additional bids and would therefore not be in the City's best interest.

The Traffic Signal Painting Project, Phase 2 is exempt from California Environmental Quality Act ("CEQA") review pursuant to the Class 1 categorical exemption of the State CEQA Guidelines (14 C.C.R. § 15301). Among other things, that exemption applies to maintenance of existing facilities involving no expansion of use. The project also is exempt as an activity having no potential for causing a significant effect on the environment (14 C.C.R. § 15061 (b)(3)).

Mayor Pro Tern Pearl moved to determine the Traffic Signal Painting Project, Phase 2 is exempt from CEQA pursuant to CEQA Guidelines Sections 15301 and 15061 (b)(3), award a construction contract for the Traffic Signal Painting Project, Phase 2, consisting of the base bid items plus all three additive alternates, to Streetlight Restoration Specialists in the amount of $186,000 with construction contingency of $9,300; and authorize the Mayor to execute the construction contract on behalf of the City.
