PUBLIC HEARING FOR CONDITIONAL USE PERMIT NO. 23-001; RESOLUTION NO. 2300-23
Mayor Pearl opened the Public Hearing. Senior Planner Sinkula presented the request for approval of Conditional Use Permit No. 23-001 to reauthorize an existing wireless telecommunications facility located at 32129 Lindero Canyon Road. Ms Sinkula reported that the operation of this facility was originally authorized by CUP No. 16-005 on January 25, 2017 for a permit term of five years, and then extended on March 13, 2019 for a permit term of five additional years. Both approvals for this facility listed an incorrect address (32123 Lindero Canyon Road) for the subject site, and accordingly, a new CUP was required to approve the existing facility at the correct address. Ms. Sinkula noted that the applicant has filed a request for a new CUP for the correct address, which is located within the cupola on the rooftop of The Yacht Club in The Landing commercial center at 32129 Lindero Canyon Road. The applicant did not request any modifications to the equipment or the cupola screening structure at the site. The existing facility consists of eleven antennas, eleven remote radio units, and two equipment cabinets. The cupola that screens the equipment from public views has been well maintained and fully screens all the equipment at the site. Staff does not recommend any modifications to the existing screening for this facility.

Senior Planner Sinkula said the applicant has requested a 10-year permit term, consistent with requirements of State planning law for wireless telecommunications facilities. Ms. Sinkula said that staff are unaware of any complaints associated with the facility, the operation of the facility has remained the same since installation, and the facility was constructed in accordance with the original conditions of permit approval. Staff recommended approval of the CUP with a 10-year extension of the permit term with an expiration date of May 24, 2033.

On May 2, 2023, the Land Use Committee (Davis/Honig) reviewed the CUP request and recommended that the request move forward to a public hearing.

Applicant Andrea Liu, on behalf of Verizon Wireless, was a virtual attendee; however, she did not address City Council.

Councilmember Davis commended the applicant on the improved appearance of the antenna.
