1. PUBLIC HEARING: PLANNED DEVELOPMENT PERMIT NO. 22-004; RESOLUTION NO. 2309-23
Mayor Pearl opened the Public Hearing. Senior Planner Sinkula presented a request to approve Planned Development Permit (PDP) No. 22-004 authorizing an interior and exterior remodel and the construction of a new 1,062 square foot addition of habitable space to an existing single-family residence located at 4040 Whitesail Circle.

Providing background, Ms. Sinkula reported that on March 9, 2023 a PDP application was filed by Susan Nason that requests authorization for an interior and exterior remodel and the construction of a 1,062 square foot addition of habitable space to an existing 2,432 square foot, two-story single-family residence. The applicant is proposing to add 322 square feet to an existing bedroom, enclose an atrium of 208 square feet, add a new 371 square foot bedroom, a new 161 square foot bathroom and walk-in closet, expand the existing ground floor and second floor decks, and install a new cable handrail around the second-floor deck, two skylights, a patio cover, a trellis, a covered walkway, HVAC system, fencing to enclose the HVAC equipment, and a gate. The project also includes the replacement of the roof and all windows and doors and new landscaping. The applicant is proposing to paint the exterior of the residence in "Swiss Coffee" with "Black" accents and install a new slate roof, new Kolbe vista lux windows and doors, and new tinted glass garage doors on the existing two-car garage.

Senior Planner Sinkula said the proposed new design is compatible with the varied architectural styles of existing residences in the Westlake Island neighborhood, and the Westlake Island Homeowners Association and adjacent neighbors of the project have approved the proposed project.

On May 2, 2023, the Land Use Committee (Davis/Honig) reviewed the request and recommended that the matter move forward to a public hearing.

Ms. Sinkula reported that on May 24, 2023, the request was considered by City Council during a public hearing. With two Councilmembers absent, the City Council was unable to reach a consensus regarding the proposed exterior paint color and contemporary design. No vote was taken by City Council. PUBLIC HEARING: CONDITIONAL USE PERMIT NO. 97-004, MODIFICATION NO. 3, CONDITIONAL USE PERMIT NO. 07-005, MODIFICATION NO. 1, AND PLANNED DEVELOPMENT PERMIT NO. 23-001; RESOLUTION NO. 2311-23.

RESOLUTION NO. 2312-23, AND RESOLUTION NO. 2313-23
Mayor Pearl opened the Public Hearing. Senior Planner Sinkula presented a request to approve Modification No. 3 of Conditional Use Permit No. 97-004 and Modification No. 1 of Conditional Use Permit No. 07-005 to increase maximum enrollment on the middle school campus located at 31829 La Tienda Road from 300 to 600 students, add elementary school grades, and revise conditions of approval related to traffic management measures and approving Planned Development Permit No. 23-001 to authorize the installation of seven modular classrooms on the middle school campus.

Senior Planner Sinkula stated that on November 12, 1997 the City Council approved CUP No. 97-004 to authorize the operation of a private four-year high school at 31717 La Tienda Road, setting the maximum student enrollment of 1,200 students.

This CUP has been modified twice to authorize expansions of the campus into new buildings and the use of student housing on Cedar Valley Drive. On February 27, 2008, the City Council approved CUP No. 07-005 to authorize the operation of a private middle school on an adjacent property located at 31829 La Tienda Road, setting the maximum student enrollment of 300 students.

CUP 07-005, Modification No. 1
Ms. Sinkula noted that in February of 2023, staff became aware that the applicant added fifth grade classes and exceeded the maximum enrollment of 300 students for the middle school. For the 2022-2023 school year, 550 students were enrolled in grades 5 through 8. Staff further became aware that for the 2023/2024 school year, the applicant plans to add fourth grade classes to the middle school campus and increase the enrollment to 598 students for grades 4 through 8. A CUP modification is required to authorize the operation of an elementary school; the applicant has requested a modification of CUP No. 07-005 to increase maximum enrollment from 300 to 600 students and add elementary grades to the school.

Senior Planner Sinkula reported that at the request of the Land Use Committee, the applicant prepared a Traffic Study to analyze the existing traffic conditions and potential adverse impacts of increased enrollment. The Study, presented on June 6, 2023, analyzed existing issues, provided traffic management measures currently in place, and proposed additional measures.

Ms. Sinkula reported that City Traffic Engineer Wessel reviewed the Traffic Study and recommends that enrollment only be increased to 600 students to align with the applicant's planned enrollment for the 2023/2024 school year. Staff further City Council Minutes
City of Westlake Village June 28, 2023 9
PUBLIC HEARINGS (continued):
recommend conditions of approval to require the traffic management measures identified in the Traffic Study dated June 6, 2023, be implemented by the start of the 2023/2024 school year. Additional recommended conditions of approval include a requirement for the collection and submittal of traffic data to evaluate the effectiveness of the suite of mitigation measures included in the Traffic Study and submittal of a Traffic Management Plan for future proposed increases to maximum enrollment. Any proposed increases to maximum enrollment beyond 650 students would require the approval of a CUP modification. There is adequate parking available at the site to accommodate the required parking for the subject land use.

CUP No. 97-004, Modification No. 3
Ms. Sinkula reported that the applicant is currently in compliance with the maximum allowed enrollment of 1,200 students for the high school and is not requesting to increase that number.

Condition of Approval No. 7 for CUP No. 97-004 requires the development and implementation of a Trip Reduction Program as a traffic mitigation measure, and City Traffic Engineer Wessel has recommended that this requirement be removed and replaced with the suite of measures identified in the Traffic Study dated June 6, 2023. The recommended conditions of approval for CUP No. 07-005 include these new measures since they are intended to address increased enrollment on the middle school campus and allow the traffic impacts from the middle school and high school to be addressed under a single comprehensive Traffic Management Program.

PDP No. 23-001
Ms. Sinkula reported that the temporary installation and use of six approximately 953 square foot modular buildings on the middle school campus were authorized pursuant to a Temporary Use Permit during the COVID-19 pandemic to facilitate social distancing. The applicant is requesting authorization for the permanent installation of the six modular buildings and addition of one modular building of the same size to accommodate the increase in enrollment. She mentioned that these buildings are consistent with the applicable development standards and are not visible from the freeway or La Tienda Road.

Land Use Committee
On April 5, 2023, the Land Use Committee (Davis/Honig) reviewed the subject requests and directed the applicant to prepare a Traffic Study to analyze the potential impacts of increased enrollment.

City Council Minutes
City of Westlake Village June 28, 2023 10
PUBLIC HEARINGS (continued):

The applicant prepared a Traffic Study, and the permit requests were reviewed again by the Land Use Committee on June 7, 2023. The suite of traffic management measures identified in the Traffic Study dated June 6, 2023 were discussed and although the Committee expressed support for the implementation of these measures and the recommended conditions of approval, the Committee emphasized the importance of condition compliance and communicating changes to their operation going forward. The Committee recommended that the request be moved forward to the full City Council for hearing.

City Traffic Engineer Wessel addressed the Traffic Study and the new conditions added to the CUPs. Mr. Wessel reviewed the queuing process, pickup process and how with future growth, other measures may need to be considered.

Applicant Bill Brown, on behalf of Oaks Christian School, addressed the City Council.

Mayor Pearl closed the Public Hearing.

City Council discussed busing services if student enrollment continues to increase with the new traffic study requirements, enrollment numbers, emergency operations plan, being a good business partner, and the value of education that is provided by Oaks Christian, an asset to the City.

Councilmember McSweeney moved that City Council adopt Resolution No. 2311- 23, Resolution No. 2312-23, and Resolution No. 2313-23 'Resolutions of the City Council of the City of Westlake Village determining Conditional Use Permit No. 97- 004, Conditional Use Permit No. 07-005, and Planned Development Permit No. 23- 001 are exempt from CEQA and approving Modification No. 3 of Conditional Use Permit No. 97-004 and Modification No. 1 of Conditional Use Permit No. 07-005 to increase maximum enrollment on the middle school campus located at 31829 La Tienda Road from 300 to 600 students, add elementary school grades, and revise conditions of approval related to traffic management measures' and approving Planned Development Permit No. 23-001 to authorize the installation of seven modular classrooms on the middle school campus. OLD BUSINESS:

DISCUSSION AND DIRECTION REGARDING EXTERIOR COLORS OF

RESIDENTIAL AND NON-RESIDENTIAL BUILDINGS
Planning Director Forbes introduced the item which seeks Council direction on desirable and undesirable colors and shades and regulation of colors. Mr. Forbes stated that before 1991, the Municipal Code stated that building colors had to be "consistent with the prominent 'earthen' colors of the hills surrounding the Westlake Village community during the bulk of the year and colors traditional to architectural themes previously approved in Westlake Village"; no specific colors were mentioned; and the Code also authorized City Council to establish specific color standards for use in Zoning Clearances. He said that in response to a business request, the City Council determined that gray was not an earthtone color and adopted Ordinance No. 113 to specify that earthtone meant "subdued shades of brown, beige, tan, and off-white".

Planning Director Forbes noted that the color palette has remained largely beiges and browns throughout the City. White, gray, blue, and other non-brown colors have a greater variation in custom home neighborhoods. Residential color approval is part of the Planned Development Permits (PDPs) process and approved by City Council for new houses. Zoning Clearances are approved by staff for remodels and additions, and no City approval is required if painting is not in conjunction with other work. Mr. Forbes stated that commercial color approvals, a Zoning Clearance is required to paint commercial buildings.

Mr. Forbes discussed current practices and stated a 2023 City Council goal was to "enforce" an earthtone color palette. Following the City Council's direction at the January goal setting session, he noted that staff has not approved houses that are white or very light shades of off-white and mentioned that staff has received pushback from residents who argue that the color is off-white and therefore consistent with the code, or that the City should allow white. Staff solicited approved color palettes from Homeowner's Associations (HOA's) and found that many include white and gray in their approved palettes. Mr. Forbes presented approved color palettes from First Neighborhood, Westlake Cove, Renaissance, Lakeshore Community, and Westlake Canyon Oaks HOA's.

Planning Director Forbes discussed issues to consider including homeowner preference and personal taste, neighborhood character, tract homes versus custom homes, existing versus desired future character, HOA role, architectural styles, and applicability in reference to residential versus non-residential; trim, accent, roof colors; and the approval process.

City Council Minutes
City of Westlake Village June 28, 2023 15
OLD BUSINESS (continued):

Mr. Forbes presented a color palette of whites and off-whites and discussed possible approach options:

1. A palette of approved colors is limiting with no flexibility, does not account for differences in neighborhood character, and is difficult and complicated to administer given paint brands and variations.

2. A palette of prohibited colors does not remove subjectivity or conflict from the review process, suggests anything not prohibited is permitted, and is difficult and complicated to administer given paint brands and variations.

3. General direction based on City Council consensus provides more flexible combination of other options and not overly prescriptive, would provide more flexibility to City Council, staff, homeowners, and architects, and accommodate different paint brands and variations.

4. A final option is to continue with the current practice.

Planning Director Forbes requested City Council guidance on whether to pursue a general consensus approach and schedule a City Council Study Session for more in-depth discussion and Council direction. Mr. Forbes noted additional issues for City Council consideration including:
• Applicability: residential versus non-residential, tract homes versus custom homes
• Scope: trims, accents, roofs
• Process: whether to require Zoning Clearance for painting • Public input: level of HOA involvement
