RESOLUTION ADDRESSING NOVEMBER 5, 2024 GENERAL MUNICIPAL ELECTION WITH NO MORE CANDIDATES THAN OFFICES TO BE ELECTED; RESOLUTION NO. 2361-24 OR RESOLUTION NO. 2362-24
City Clerk Mann reported that on May 22, 2024 the City Council adopted the Resolutions Calling the General Municipal Election on November 5, 2024 for two City Council seats. The nomination period was conducted July 15 to August 9, 2024 which resulted in two qualified candidates for the two seats to be elected:

Kelly Honig and Ned E Davis. A Statement of Facts was issued to the City Council following the close of the nomination period stating there were not more qualified candidates than seats.

California Elections Code Section 10229 states City Council has the following actions to consider:

1. Appoint to the office the person who has been nominated.

2. Appoint to the office an eligible elector if no one has been nominated.

3. Hold the election as scheduled
A Notice was published on August 16, 2024 and posted on the website, advising the public of these facts and that a Special City Council Meeting would be held on August 21, 2024 to consider these actions.

If the City cancels the November 5, 2024 General Municipal Election, the City will not be assessed for printing and mailing the ballots, resulting in a $37,000 savings.

Appointed individuals will start their term of office on December 11, 2024, the same date as if they were voted into office.

City Council discussion included the public perception of the City canceling the General Municipal Election, clarifying that the City is following Election Code requirements, and that voters will still receive ballots for other election items.

Councilmember Halpern moved that the City Council adopt Resolution No. 2361- 24 making appointments to two City Council offices for a four-year term and canceling the November 5, 2024 General Municipal Election and directing the City Clerk to file a certified copy of such Resolution with the Los Angeles County Election Division.
