PUBLIC HEARINGS:

1. INTRODUCTION OF ORDINANCE NO. 307-25 PERTAINING TO A ZONING

TEXT AMENDMENT FOR LARGE RESIDENTIAL CARE FACILITIES
IMPLEMENTING PROGRAM 4.8 OF THE 2021-2029 HOUSING ELEMENT Mayor Honig opened the Public Hearing. Planning Director Asp presented a request for approval to waive the full reading and introduce Ordinance No. 307-25, a Zoning Text Amendment to amend Chapters 9.2, 9.5, and 9.6, and to add a new Chapter 9.46 to the Westlake Village Municipal Code for Large Residential Care Facilities implementing program 4.8 of the 2021-2029 Housing Element and schedule the second reading for May 14, 2025.

Providing background, Ms. Asp stated that as part of the City's 6th Cycle Housing Element certified by the State Department of Housing 1 and Community Development (HCD) in 2022, the City was required to process a Zoning Ordinance amendment to allow Large Residential Care Facilities in all residential zones to be consistent with State law. Program No. 4.8 of the City's 6th Cycle Housing Element states: "Review Zoning Ordinance for provisions for large group homes (7+ persons) and amend the Zoning Ordinance to develop mitigating strategies to review potential constraints and facilitate the development of large group homes." Ms. Asp stated that failure to amend the Zoning Ordinance to comply with Program

4.8 of the City's Housing Element can result in HCD decertifying the Housing Element. HCD has asserted that the State does not permit significant local discretion in this area, making the City's capacity to regulate them effectively quite limited under current law.
