13. PUBLIC HEARINGS

13.A. Extension of Urgency Ordinance Temporarily Prohibiting Approvals Authorized by Urgency Ordinance No. 3132 to Thereby Temporarily Prevent Approval of Certain SB 9 Housing Projects and Subdivisions Recommendation: Adopt Urgency Ordinance No. 3157, extending the term of a temporary moratorium on Urgency Ordinance No. 3132 by 10 months and 15 days, to thereby temporarily prevent approval of certain SB 9 housing projects and subdivisions, and find that such action is categorically exempt pursuant to Section 15061(b)(3) of the California Environmental Quality Act Guidelines.

Environmental Review
Staff has determined that the proposed moratorium ordinance is exempt under CEQA Guidelines section 15061(b)(3) (the “common sense exemption”) as “it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.” This ordinance does not have the potential to cause significant effects on the environment because: (1) it reduces the amount of construction that might otherwise occur; (2) this ordinance is temporary in duration and therefore will not have a significant effect on the environment; (3) this ordinance will affect a limited number of housing units in single family zones and the construction of a limited number of single family homes is exempt from CEQA; (4) any effect on the environment as a result of this ordinance would be speculative at best and cannot currently be analyzed; (5) there is no evidence that this ordinance involves any unusual circumstances that might cause a significant effect on the environment; and (6) there is no evidence that the ordinance would cause changes in the environment which would result in cumulative impacts.
