Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: N/A Summary of Request: On October 13, 2021, the City Council approved Resolution No. 2021-37 in accordance with AB 361, ratified again on November 10, 2021, December 8, 2021, and December 20, 2021 for an additional 30 days. The Resolution requires the City Council to decide by majority vote that the state of emergency still exists and continues to directly impact the ability of the members to meet safely in person, or that health officials continue to impose or recommend measures to promote social distancing. AGENDA SUMMARY REPORT
To: City of Willits Successor Agency Board Members
From: Manuel Orozco, Finance Director
Agenda Title: ADOPT A RESOLUTION TO APPROVE THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE 22-23 AND ADMINISTRATIVE BUDGET FOR JULY 2022 THROUGH JUNE 2023.
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 10 min.
Summary of Request: The Successor Agency is being asked to consider:
ROPS 22-23 and July 2022 through June 2023 Administrative Budget The Dissolution Act requires the Successor Agency to approve a Recognized Obligation Payment Schedule (ROPS) annually. The ROPS is a document that includes all the anticipated “enforceable obligations” of the former Willits Redevelopment Agency that must be administered by the Successor Agency. The remaining obligations include bond payments, related fees, and Successor Agency administrative costs.
The Successor Agency Board is meeting to consider adoption of the ROPS 22-23 for obligations anticipated in the July 1, 2022 through June 30, 2023 period. Next, the Mendocino Countywide Oversight Board (Oversight Board) receives the ROPS 22-23 for its consideration at their January 27, 2022 meeting.
The State Department of Finance and the County-Auditor Controller will receive the final ROPS 22-23 by February 1, 2022. Failure by the Successor Agency to submit by February 1st exposes the Agency to a late-fee of up to $10,000 per day. The distribution of former property tax increment funds the ROPS in June 2022 and January 2023 based on the final amounts approved by the Oversight Board and DOF.
Enforceable Obligations
The requested enforceable obligations consist of debt service payments and administrative costs to wind down the Successor Agency. The ROPS 22-23 requests $365,646 in Redevelopment Property Tax Trust Fund (RPTTF) funds to fund the following items:
• Debt service payment on the 2020 Tax Allocation Refunding Bonds ($321,146) • Bond trustee fees ($500); and
• Administrative cost allowance ($44,000).
The Successor Agency is also required to adopt an annual administrative budget. The Successor Agency is proposing an Administrative Budget of $44,000 for Fiscal Year 2022-23, as shown under Item #2 on the ROPS 22-23. The proposed budget stems from the actual administrative costs incurred by the Successor Agency in prior ROPS periods and estimates for costs for the upcoming period. An Administrative Budget is provided for the Successor Agency Board’s approval.
Prior Period Adjustment
The Successor Agency will be submitting a Prior Period Adjustment (PPA) for the ROPS 19-20 to the County Auditor-Controller by the time the State receives the ROPS. The PPA compares the difference between approved versus actual expenses made on ROPS 19-20 obligations. During this period, the Successor Agency expects to have a PPA of $47,346, which is expected to be adjusted into the Department of Finance’s final ROPS determination.
Recommended Action: Adopt the Resolution approving the ROPS 22-23 and Administrative Budget for the period July 2022 through June 2023.
Alternative(s): The Successor Agency Board could approve the ROPS 22-23 with revisions. The DOF must receive the approved ROPS by February 1, 2021 to avoid financial penalties.
Fiscal Impact: The ROPS must include all anticipated Successor Agency expenditures for each fiscal year for approval by the Oversight Board and Department of Finance in order to receive funding.
Personnel Impact: Some staff time (City Manager, City Clerk, Finance Director, and Community Development Director) will be involved in the continuing business of winding down the affairs of the former redevelopment agency, but the details of those processes are difficult to quantify because of changing rules, forms and reporting requirements for administering the Successor Agency.

Item No. 8a
Meeting Date: January 12, 2022
AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Brian Bender, City Manager
Agenda Title: ADOPT A RESOLUTION AUTHORIZING THE INSTALLATION OF 195 LINEAL FEET OF RED
CURB MARKING NO PARKING ZONE ALONG THE EAST SIDE OF HUMBOLDT STREET NORTH FROM THE INTERSECTION WITH COMMERCIAL STREET.
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 10 minutes Summary of Request: The Little Lake Fire District seeks approval from the City Council to alter the on-street parking configuration adjacent to the newly, operational Fire Station #54. The request consists of eliminating the existing 100 lineal feet of angled parking reserved for Fire Personnel on the south side of E. Commercial Street and immediately west of the intersection with Humboldt Street. To compensate for the loss of parking along E. Commercial Street, the Fire District wants to have approximately 195 lineal feet of red curb along the east side of Humboldt Street to denote parking reserved for District personnel. This parking will be parallel to curb. The revised parking allows better access to the Station for personnel since Humboldt Street conveys far less traffic compared to E. Commercial. The proposal also opens up convenient parking for the Noya Theatre and Arts Center. The accompanying site plan depicts the proposed changes.
The Traffic Safety Committee reviewed the request during the Committee’s December 15th meeting and by consensus, agreed it is an acceptable plan to accommodate parking at the Fire Station. The City Council is acting through the provisions contained in Municipal Code Section 10.32.100 that authorizes the Chief of Police through a Council Resolution to apply curb marking to indicate parking or standing regulations. Chief Lizarraga supports the request as he chaired the said December 15th meeting.
Recommended Action: Accept the recommendation of the Traffic Safety Committee and adopt the accompanying Resolution.
Alternative(s): Request the Traffic Safety Committee to reconvene to consider alternative proposals from the Fire District.
Fiscal Impact: Negligible. Only the expense of painting materials and supplies.
Personnel Impact: Negligible. Only a few hours of staff time.

RESOLUTION NO. 2022-
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WILLITS AUTHORIZING THE INSTALLATION OF 195 LINEAL FEET OF RED CURB NO PARKING ZONE ALONG THE EAST SIDE OF HUMBOLDT STREET NORTH FROM THE INTERSECTION WITH E.
COMMERCIAL STREET.
WHEREAS, the Chief of Police is authorized pursuant with a resolution of the City Council as outlined in Municipal Code Section 10.32.100, to place a red curb marking prohibiting stopping, standing or parking except as permitted by the Vehicle Code of the State; and
WHEREAS, the red curb along Humboldt Street will accommodate parking for Little Lake Fire District personnel at the newly, opened Station #54; and WHEREAS, the Little Lake Fire District no longer has a need for the parking designated for District personnel along the south side of E. Commercial Street; and WHEREAS, the Traffic Safety Committee at their December 15th session reviewed the proposed no parking request submitted by the Little Lake Fire District and agreed the proposal is the best arrangement to accommodate parking for District personnel.
NOW, THEREFORE BE IT RESOLVED, that pursuant Section 10.32.100 of the Willits Municipal Code, the Willits City Council does hereby approve the following:
a. The placement of a No Parking/No Stopping sign(s) on the east side of Humboldt Street immediately opposite Station #54 and apply red curb marking along the east side of Humboldt Street for 195 lineal feet in a northerly orientation starting from the intersection with E. Commercial Street.
b. Eliminate the No Parking/No Stopping signs and the 100 lineal feet of red curb marking on the south side of E. Commercial Street starting from the intersection with Humboldt Street.
BE IT FURTHER RESOLVED the City Council authorizes and directs the Chief of Police in coordination with Public Works to install the red curb marking and sign(s) as described and illustrated in Exhibit A.

AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Brian Bender, City Manager
Agenda Title: ADOPT A RESOLUTION ANNOUNCING THE SUPPORT BY THE WILLITS CITY COUNCIL
TO THE EFFORT OF TROUT UNLIMITED TO PURSUE GRANT FUNDING TO INITIATE A PILOT STUDY TO
EXPLORE THE FEASIBILITY OF RELEASING LIMITED AMOUNTS OF WATER FROM MORRIS RESERVOIR TO IMPROVE THE FISHERIES OF DAVIS AND OUTLET CREEKS.
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 10 minutes Summary of Request: On December 8, 2021, the City Council received a presentation from Trout Unlimited explaining their intent to coordinate with the City to organize a pilot study to determine if a measured release of water from the Morris Reservoir improves the fisheries of Davis and Outlet Creeks. The goal is to release water during the summer and early fall of 2022 to aid the rearing of Steelhead and Coho Salmon as they navigate the creeks.
Trout Unlimited fully acknowledges the release of water will only take place when the City verifies there is sufficient reservoir volume to guarantee an unrestricted municipal supply. If the pilot study proves beneficial, Trout Unlimited will obtain a longer-term agreement with the City calling for annual releases when sufficient volumes are present. The City would receive compensation for the released water at fair market value. The said long-term agreement could contain provisions that have Trout Unlimited partnering with the City to obtain funding to upgrade Surface Water Production Facility to supply municipal needs simultaneously enhancing the fisheries.
The purpose of the Resolution packages the City Council’s support for the pilot study for the benefit of Trout Unlimited as they compose a grant application.
Staff encourages the City Council to adopt the accompanying Resolution since collaborating with Trout Unlimited is an advantageous proposition for both entities.
Recommended Action: Adopt the accompanying Resolution.
Alternative(s): None Recommended.
Fiscal Impact: The City would receive financial reimbursement for water purchased by Trout Unlimited.
Personnel Impact: Negligible, as Trout Unlimited only requires minimum level of assistance from staff to prepare the grant application. Assistance from staff will increase if Trout Unlimited receives grant funding to proceed with the pilot study.

AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Jeremy Ronco, Project Manager
Agenda Title: ADOPT RESOLUTION ACCEPTING THE CONSTRUCTION COMPLETION OF THE 2021 PAVEMENT PRESERVATION PROJECT, PROJECT NO. 2021-02, AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION.
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 10 min.
Summary of Request: On July 28, 2021, the City Council awarded a Construction Contract to American Asphalt Repair, Inc., for the 2021 Pavement Preservation Project, Project No. 2021-02, for $209,454.52.
This year’s asphalt maintenance project completed asphalt dig-outs on Baechtel Road, Poplar Avenue, McKinley Street, South Lenore Street, East Commercial Street, Marin Street, and State Street (Please see the accompanying map). These dig-outs repaired failed sections of roadway, which reduces the need for pothole filling and other maintenance by City staff. Baechtel Road requires additional dig-outs, but once they are complete, it could be a good candidate for slurry sealing. The sections of East Commercial and South Lenore Streets that received dig-outs are now good streets to seal, which will extend their life by five to seven-years.
The other streets are sources of frequent potholes and the dig-outs will reduce the need for maintenance significantly. Staff agreed to increase the dig-out areas on Baechtel and State Streets due to further road deterioration mid-project. The additional work added approximately $18,000 to the contract total.
The City of Willits Engineering Department reviewed the project and determined that the work is in substantial compliance with the project plans and specifications. The total cost of construction under this contract was $227,703.82.
Recommended Action: Adopt a Resolution accepting construction of the Pavement Preservation Project, Project No. 2021-02, and authorize the City Manager to file the Notice of Completion.
Alternative(s): None Recommended.
Fiscal Impact: The funding for this project came from Half-cent Sales Tax. Reimbursement of $100,000 of the project’s cost is eligible through the SB1-Local Partnership Program. The City can release retention 30-days after filing the Notice of Completion. After the retention is paid, the project is complete and staff will then file the necessary paperwork to receive reimbursement.
Personnel Impact: Negligible as only minimum amount of staff time is necessary to file the Notice of Completion and administer final payment.
