City Council Meeting Update October 2025
Fire Department Update
Around the Firehouse
The Haunted Fire House was a success I hope everyone got a chance to walk though, it was a great event for the community. Michelle has been working diligently for funding on the fire safety educational inflatable. Special thanks to Jen from 101 Trailer. Jen was able to secure funding from the Willits Educational Foundation. The Little Lake Fire association and the district will also donate $1,000.

Training
For the month of October training consisted of 5 man engine company drills to simulate structure fire tactics and operations as we move into the winter months. EMT refresher covered trauma assessment (considering MOI’s, splinting, obtaining vital signs, PT packaging). Community training consisted of hosting 3 days of Brookside little ones to go over fire and life safety education. CPR and AED awareness was taught to the Brookside staff (40 members attended). If anyone in the community is interested in fire extinguisher training please reach out to us at the fire house. As of the current date we have responded to 563 calls for service.

Informational
Reminder. Extremely important to have a visible addresses posted. The Wildfire & Insurance Forum from that was held on October 9th was very informational. With the current transition into the winter months expect rain and icy conditions. Please give yourself ample time to get to your destination and with upcoming holidays means more traffic on the road. Again we are a fire department but our number 1 calls for service are traffic collisions due to the location of our response area and the three major highways that run though it.

Willits City Council Meeting - November 12, 2025
 The Board of Supervisors voted unanimously to approve the first reading of an ordinance to de-consolidate the Auditor Controller Treasurer Tax Collector positions back to an Auditor/Controller position and a Treasurer/Tax Collector position. It was a relief to see this return to the way it was since I was the lone vote against it in 2021 and proudly sponsored this item along with Supervisor Norvell and ACTTC Chamise Cubbison. There will be an election for these positions in June, 2026. Filing dates for candidates is coming soon.
 The County closed its books for 2024-2025 and has a carry forward of over $11 million.

This is mostly one-time only money, and we still need to deal with structural deficit problems.
 The Board passed a resolution supporting the agreements made by the IWPC to ensure ongoing water diversions to the Russian River. We also recognize the urgency of building new water storage facilities from Potter Valley south and the need for state and federal funding for these projects. The IWPC and Board of Supervisors will hold a community workshop on Monday, Nov. 24, from 1:00-4:00 at the Ukiah Conference Center.  Forecast Informed Reservoir Operations (FIRO) had a ribbon cutting event on Oct. 22 at Lake Mendocino. FIRO enables water managers to use the latest technology and weather forecasts in the Lake Mendocino watershed to guide their decisions. This is the first time in the U.S. that this approach has been used. This will allow for 20% more storage, which is the equivalent amount of water for approximately 22,000 homes for a year.
 There is increased concern in the County about food insecurity. With the federal government shutdown, CEO Antle reported that the Supplemental Nutrition Assistance Program (SNAP) funding will be cut off for 16,000 Mendocino County residents. The County is looking at some options.
 There will be a Talk with the Supervisor on November 13 at 10:00 in Brickhouse Coffee.

 Council Member Burton and Vice Mayor Alaniz expressed concern over why this charge was not in the initial quote provided by Syserco Energy Solutions.  Vice Mayor Alaniz inquired as to why we did not have this amount before the budget was passed. Walter Kolon, Services and Facilities Director responded that the original price that SES quoted was $250,000 and it was felt that was an unfair price. The amount they finally gave of $125,000 was not until after the budget was passed.
 Mayor Allman inquired if the project was still on schedule to be completed by the Spring of 2026. Mr. Kolon responded that yes, it is.

 Deborah Muchmore, Human Resources Advisor, presented Council with a PowerPoint presentation on selecting a New City Manager.  Mayor Allman stated that the new City Manager will not have a salary at the same level as the previous City Manager.
 Council Member Burton expressed his interest in looking into having a Strong Mayor as opposed to a City Manager.

Public Comment:
 Nicole Caldwell feels that the City just wasted seven months where a search for a City Manager could have been happening. Ms. Caldwell expressed concern over the City entering into a contract with an outside source to complete a task that she feels could be done in house with City of Willits Employees. Ms. Caldwell continued that she feels that Rod Wilburn has been good for the city but feels that Mr. Wilburn and the current city HR Analysis the search for a new City Manager could have been done without spending City funds on an outside source to do the search.  Deborah Muchmore responded to Ms. Caldwell’s comments stating that the PowerPoint is an example of what a search would be and that the Council had not outsourced anything. In order to take the next action, the staff needs direction to have an active recruitment to keep a retired annuitant safe from losing their retirement.
 Mayor Allman responded that Council would like to have a recruitment package put together and have it returned to the Council for an agendized public discussion. c. Approve the Employment Agreement with Robert Richardson to Perform Specialized and Temporary Services as Interim City Manager.  Mayor Allman announced that Rod Wilburn is the Interim City Manager until November 12, 2025.
 Deborah Muchmore explained that this item is in regard to a candidate that the Council has interviewed to take on the roll of Interim City Manager until a permanent City Manager is found or until they have worked 960 hours. A retired annuitant cannot take any benefits, they have to work within the salary schedule and cannot have collected unemployment in the last year. This option costs less than if the City had an employee in place while trying to find a permanent City Manager.
 Council Member Burton questioned how Mr. Wilburn found Mr. Richardson.

Mr. Wilburn responded that his discussions with Mr. Richardson have been very good. He has a long history of being a City Manager and has experience with dealing with similar financial issues as the City of Willits. Mr. Burton asked again how he came to the attention of the City. Mr. Wilburn responded that Mr. Richardson has worked with Patrick Clark, the City’s Labor Negotiation Consultant and has also worked with Andy Heath, the City’s Finance Consultant.
 Mr. Burton feels that the community needs to know that the City Council Members, separately, have all met with Mr. Richardson, and feels that Mr.

Ricardson has the skills. The Job warrants a full-time person to fill the position.
 Vice Mayor Alaniz thanked Mr. Wilburn for helping the City during his tenure as Interim City Manager and that it speaks a lot to his character and Willits City Council Minutes of September 10, 2025 Page 4 of 6 professionalism to bring see an individual like Mr. Richardson and realize what is best for the City is for Mr. Wilburn to step aside and have other people come in and help the City.

Public Comment:
 Nicole Caldwell mentioned that when she said outsourced the City Manager Search, she is sure that Ms. Muchmore is being paid for the work she is doing.

Ms. Muchmore then stated that she was not being paid. Ms. Caldwell thanked Council Member Burton for asking where Mr. Wilburn found Mr. Richardson, she feels this is important and that know this is all about transparency. Ms.

Caldwell stated that she would have appreciated it if Mr. Richardson had been in attendance at the City Council Meeting.

Moved by Burton/Seconded by Stranske and carried unanimously with Gonzalez absent to approve the Employment Agreement with Robert Richardson to perform specialized and temporary services as Interim City Manager.

10. DEPARTMENT MONTHLY REPORTS – (presented at the second meeting of each month)
a. Airport - Nothing to add.
b. Community Development Department
 Dusty Duley added that the City is currently accepting applications through the City’s Housing Rehabilitation Loan Program through November 14, 2025. This is an opportunity for homeowners within the City of Willits to apply for loans at zero interest ranging from $25,000 to $50,000 to support rehabilitation projects that would prevent the deterioration and promote dwelling life span. The program is supported by State Funding that the City received. c. Finance Department
 Mr. Orozco added that the Auditors are currently working on the Financials for the FY 23/24 audit, he expects them to ask for more clarifying documents.  Vice Mayor Alaniz asked is the issue with the funds that the city received when payments are made with credit cards has been figured out. Mr. Orozco explained there was a step of drawing down the funds into the city bank account, that staff was unaware of, and that this has been solved.  Staff has discovered that there is a charge when customers pay their bills with credit cards at City Hall, when the card is swiped, but when bills are paid online there is no charge. Mr. Orozco states that the city will have to look into recouping this charge.
 Council Member Burton asked for fund balances in city Bank Accounts. Mr.

Orozco responded that there is approximately $2,100,000 in the City Checking Account, $5,400,000 in the CD investment, about $500,000 in the LAIF account, $38,000 in the savings account and $240,000 in the payroll account.

Mr. Burton asked how this compares to last month. Mr. Orozco responded that the City is drawing down on funds from the main account, last month the City had about $3,400,000 in the main account. This is due to some large payouts. If the City gets below $1,400,000 Mr. Orozco informed the Council, he may need to make a drawn down from the CD Investments if there is no Willits City Council Minutes of September 10, 2025 Page 5 of 6 revolving loan secured by then. The revolving loan would be for the solar project.
d. Police Department – Nothing to add.

AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Swetha Hiranya Venuturupalli, Senior City Planner Agenda Title: DISCUSSION AND POSSIBLE INTRODUCTION OF AN AMENDMENT TO WILLITS MUNICIPAL CODE TITLE 17 – ZONING, REVISING CHAPTER 17.66, “SUPPLEMENTAL PROVISIONS”, AND ADDING CHAPTER 17.87, “MOBILE VENDORS”, TO ESTABLISH REGULATIONS FOR MOBILE AND SIDEWALK

VENDING
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 35 minutes.

Summary of Request: Staff is requesting that the City Council review and provide direction on the draft Mobile Vendor Ordinance, which establishes updated regulations for mobile and sidewalk vending within the City of Willits.

The draft ordinance incorporates input from community meetings, stakeholder engagement, and the Ad Hoc Committee, and is intended to modernize the City’s outdated regulations, ensure consistency with state law, and balance the economic opportunities provided by mobile vendors with the protection of public health, safety, and neighborhood character. Based on Council feedback, staff will make any necessary revisions and return with a finalized ordinance for consideration of formal adoption. If the Council identifies significant changes, staff will revise the draft accordingly and return at a future meeting for formal introduction of the ordinance.

Background: The City has received increased interest from mobile vendors seeking to operate on private property and within the public right-of-way. Existing sections of the Willits Municipal Code (Chapters 5.04, 5.28, 17.66, and

17.82) provide limited guidance. In response to growing community interest and recent updates to State law, the City Council directed staff to prepare amendments to the Municipal Code to better regulate and accommodate mobile and sidewalk vendors.

Previous Discussions:
• In 2014, the Revitalization and Economic Development Committee recommended updates to mobile vendor regulations, including a 100-foot buffer from Main Street, but the changes were never formally adopted. • A memorandum from ten years prior reviewed similar concerns, which remain relevant.

Public Outreach:
• A citywide survey received 548 responses, with 78.27% expressing interest in having more mobile vendors operate within the City.
• Stakeholder engagement included mobile vendor meetings, brick-and-mortar business meetings, and Ad Hoc Committee meetings in 2025, providing extensive input on locations, operational standards, and zoning considerations.

Key Considerations from Ad Hoc Committee:
• Location & Zoning: Mobile vendors limited to commercial and industrial zones; Mobile Vending prohibited upon Main Street to preserve downtown character; potential sites evaluated with property owner permission. • Buffers & Safety: Suggested 50-foot buffer from residential areas; school buffer to be determined in coordination with Willits Unified School District.
• Operations & Equipment: Compliance with noise regulations; generators positioned to minimize impacts; proper trash management and area cleanliness required.
• Permit Process: Zoning permit required, followed by a business license; operational details, proposed locations, and compliance with state law reviewed.
• Sidewalk Vending: Defined as non-motorized vending on sidewalks; regulated under City ordinance consistent with SB 946, which decriminalizes street vending statewide and requires regulations to focus on health, safety, and welfare.

Following review of mapping analysis, comparable city ordinances, and stakeholder input, the Ad Hoc Committee directed staff to prepare a draft Mobile Vendor Ordinance for Council consideration. The draft ordinance incorporates recommendations related to zoning, buffer requirements, operational standards, and allowable locations, with the goal of balancing economic opportunities for mobile vendors with support for existing businesses, preservation of downtown character, and compliance with state law.

Staff is requesting Council input on the proposed Mobile Vendor Ordinance including the regulations governing mobile vending on private property, within the public right-of-way, and sidewalk vending operations, as well as any additional policy or regulatory considerations.

Recommended Action: Conduct a public hearing and Introduce, reading the title of, and waiving further reading of a proposed ordinance to amend Title 17 (Zoning) of the Willits Municipal Code revising Chapter 17.66, Supplemental Provisions”, and adding Chapter 17.87, “Mobile Vendors”, to establish regulations for mobile and sidewalk vending.

Alternative(s): Provide directions to staff to modify Ordinance language and bring back revised Ordinance for introduction at future meeting.

SIDEWALK VENDING AND MODIFYING CHAPTER

ENVIRONMENTAL
DETERMINATION:

This is an information item for discussion only and is not subject to the California Environmental Quality Act (CEQA). Future adoption of a mobile vendor ordinance is anticipated to be exempt from CEQA review.

RECOMMENDATION: Introduce an Ordinance adding Chapter 17.87 of the Willits Municipal Code to update regulations for mobile vendors and sidewalk vendors.

BACKGROUND
Over the last few years, the City has received several inquiries from mobile food vendors regarding the regulations for operating on private property and within the public right-of-way. Willits Municipal Code Chapters 5.04, 5.28, 17.66, and 17.82 specifically regulate peddlers, including mobile vending and food trucks. City of Willits Municipal Code Section 5.28.010, cited below as established in 1929, restricts peddlers from operating upon Main Street or Commercial Streets or any side street within one block of these streets. However, it does not prohibit operations on private properties adjacent to these streets.

Other relevant Willits Municipal Code sections require mobile vendors to obtain a zoning permit and comply with temporary land use regulations, sign restrictions, and location limitations. The Planning Director has the authority to approve or deny zoning permits, with an appeal process available through the City Council acting as the Planning Commission.

Section 5.28.010 – Prohibited – Where
It is unlawful for any person to sell or offer for sale any merchandise of any description from either stationary or portable stands or from vehicles upon either Main or Commercial Streets, or upon any side street within one block distant from either Main or Commercial Streets in the city.

Section 17.66.070(E) allows peddlers to operate in all zoning districts and permits display signs, consistent with the City sign code. Further, this Section also limits the duration that peddlers may operate within the City and states,
Section 17.66.070 - Temporary land uses.

E. Peddlers and hawkers shall be permitted business uses in all zoning districts by the planning director.

Further, such businesses shall:

1. Be permitted for no more than four nonconsecutive seven-day periods in a calendar year;

2. Such uses shall be permitted to display signs only in accordance with the provisions of the Willits sign ordinance.
2 Section 17.82.030 requires peddlers to obtain a zoning permit and states,

17.82.030 - Zoning permit required.

Unless a conditional use permit, variance, or site plan review permit has been approved in accordance with the provisions of this chapter, no owner of property in the city of Willits shall move a building, conduct a temporary land use or use or permit the use of any legally nonconforming structure, building, or land or part thereof until a zoning permit application has been issued by the planning department.

Due to increased interest in mobile food vendors and the City’s existing regulations being outdated, as well as recent updates to State law, the City Council directed staff to prepare amendments to the municipal code to better regulate and accommodate mobile vendors operating on both private property and within the public right-of-way.
2014 Mobile Food Vendor Discussions
Staff recognizes that the topic of regulating mobile food vendors was subject to previous discussion at both the Committee and Council level approximately ten years ago. In 2014, the City’s Revitalization and Economic Development (Revit-Ed) Committee recommended updates to mobile vendor regulations, including deleting and replacing Section 5.28.010. Key recommendations included:
• Restricting mobile vendors from operating within 100 feet of Main and Commercial Streets including private properties.
• Limit mobile vendors to commercial and industrial zoned properties as well as special events. • Allowing vendors during major construction projects with a 90-day limit and exceptions for nonprofits.

The City Council directed staff to amend the Code accordingly in May 2014, but there is no record of these modifications being formally adopted. The agenda summary report of the May 14, 2014 Council meeting (Attachment B) is attached to this report.

MOBILE VENDOR OVERVIEW
A mobile vendor is an individual or business that operates from a temporary or mobile structure, such as a food truck, cart, or trailer, offering goods or services for sale. Unlike traditional brick-and-mortar businesses, mobile vendors do not have a fixed location and instead operate in designated areas, such as commercial and industrial zones, private property, public spaces, public right-of-way, or special events.

Food trucks have become increasingly popular and prevalent as part of the food and beverage industry over the past decade. Food trucks are popular with consumers due to the convenience and novelty of being located in different places at different times (often at festivals or special food truck events), and the unique types of cuisine that may be served. Food trucks can also be beneficial for local economic development as they can provide low-cost and low-barrier business opportunities for food entrepreneurs, bring diverse dining options to areas that may have few or no brick-and-mortar restaurants, and generate foot traffic and customers who may also support other nearby local businesses. However, the permitting of mobile vending, including food trucks, should also account for prospective impacts to brick-and-mortar businesses as well as address issues related to neighborhood compatibility, and public safety Mobile vendors in California must comply with both state regulations and local zoning laws, which govern where and how they may operate. Vendors are typically required to operate only in areas permitted by local zoning ordinances, such as commercial or mixed-use zones, and some jurisdictions may impose distance requirements from brick-and-mortar businesses due to fair competition concerns. Participation in special events often requires event-specific permits, and vendors must avoid obstructing pedestrian or vehicular traffic in accordance with the California Vehicle Code and local public safety rules. Operations involving open flames or cooking equipment must meet California Fire Code standards, and vendors must follow locally defined operating hours to minimize disturbances. While the state sets broad guidelines, specific zoning, location, and operational restrictions vary by city and county. 3 Permitting Requirements for Mobile Vendors in California To legally operate within the State of California, mobile vendors must obtain the following permits and comply with state regulations:

1. Mobile Food Facility Permit – Required for food vendors, issued by the local county environmental health department, ensuring compliance with California Retail Food Code (CalCode).

2. Business License – Vendors must obtain a business license from the city or county where they intend to operate.

3. Seller’s Permit – Issued by the California Department of Tax and Fee Administration (CDTFA) for vendors selling taxable goods.

4. Certificate of Insurance (COI) – Proof of liability insurance may be required, depending on the jurisdiction and nature of operations.

5. Alcohol Beverage License – Required if selling alcoholic beverages, issued by the California Department of Alcoholic Beverage Control (ABC).

6. California Fire Code Compliance – Vendors using cooking equipment with open flames or propane must comply with state fire safety regulations.

7. Local Land Use and Zoning Compliance – Vendors must adhere to local zoning laws that regulate where and how mobile vending is permitted.

8. Special Event Permits – Additional permits may be necessary for vendors operating at public events, fairs, or festivals regulated by local jurisdictions.

Mobile Vendors must ensure compliance with all applicable California state laws, as well as local city and county regulations where they plan to operate.

PUBLIC OUTREACH
Citywide survey on mobile vendors
City staff conducted a citywide survey, circulated on Facebook, to gauge public interest in mobile vendors and food trucks. Staff also went door-to-door to speak with business owners, encouraging them to complete the survey and extending an invitation to attend the upcoming public meeting. The survey aimed to gauge general public interest, preferred locations, benefits, and potential concerns regarding mobile vendors and food trucks in Willits.

The survey received 548 responses. For the first question, 78.27% of respondents expressed interest in having mobile vendors operate in Willits.

Survey questions covered a range of topics, including:
• Levels of public interest and visitation frequency
• Preferred locations (e.g., Main Street, parks, events) • Concerns such as traffic, noise, competition, and cleanliness • Perceived benefits like variety, vibrancy, and support for entrepreneurship • Importance of regulations related to parking, distance from businesses, noise, and health standards
• Willingness to allow vendors at special events and preferred food types 4 These responses informed development of the draft Mobile Vendor Ordinance, which seeks to balance the community’s interest in supporting additional mobile vendors with the need to protect local businesses, public safety, and neighborhood compatibility.

Over the course of 2025, the City of Willits conducted a series of stakeholder meetings, public meetings and Ad Hoc Committee discussions to engage community members, business owners, and stakeholders in shaping a new Mobile Vendor Ordinance. These meetings were designed to gather input, review existing regulations, analyze comparative examples, and develop recommendations to guide policy updates.

Mobile Vendor Stakeholder Meetings – November 13 and December 12, 2024 Staff held two stakeholder meetings to solicit feedback from the mobile vendor community. Only one mobile vendor attended the November 13 meeting, and although staff scheduled a second meeting on December 12 to encourage additional participation, no mobile vendors attended that session.

Brick and Mortar Stakeholder Meeting – January 28, 2025 The stakeholder meeting with brick and mortar businesses was held on January 28, 2025, in the Council Chambers at City Hall. The discussion focused on the economic and regulatory impacts of mobile vending on the community and local businesses. Brick-and-mortar business owners raised concerns related to tax audits, regulatory oversight, parking availability, and equitable enforcement between fixed and mobile businesses. Employment considerations were also discussed, with questions about whether mobile vendors would hire locally or bring in employees from outside the community. The community also asked whether mobile vendors from outside Willits would be allowed to set up in town.

Participants emphasized the ongoing economic leakage in Willits and the struggles faced by existing businesses, noting the importance of attracting more residents to support the local economy. Maintaining downtown aesthetics and preserving the city’s historic character were recurring themes, as were strategies for revitalizing vacant buildings. Stakeholders also highlighted the need for compliance with ADA requirements for mobile vendors.

A memorandum from ten years prior (Attachment B), addressing similar concerns, was reviewed, and stakeholders agreed that its principles remain relevant. The matter was discussed at the March 12th, 2025 City Council meeting, where the Council emphasized the importance of developing balanced regulations that support both established businesses and mobile vendors. Following this discussion, the Council directed staff to form an Ad Hoc Committee, composed of two Council members, to work with the Community Development Department and continue the policy development process through additional community engagement.

Ad Hoc Committee Meeting – August 12, 2025
The first Ad Hoc Committee meeting took place on August 12, 2025, with approximately 16 members of the public in attendance. The purpose of this meeting was to provide business owners and community members the opportunity to express their concerns directly to City officials and to help determine the direction of future mobile vendor regulations.
5 Community Development Department staff presented an overview of the City’s existing mobile vendor regulations:
• City Code Section 17.66.070 (1985) allows peddlers and hawkers as temporary land uses in all zoning districts for no more than four nonconsecutive seven-day periods per calendar year. • City Code Section 5.28.010 (1929) prohibits vending on Main and Commercial Streets and within one block of these streets.
• 2014 Council direction to establish a 100-foot buffer from Main and Commercial Streets for mobile vending activities. Note that this Council direction was never codified.

Key topics included the number of operating days permitted under current code, location restrictions, potential for buffer zones, as well as new state law (Senate Bill 946), which governs sidewalk vending in California. Questions were raised about how “one block off of Main or Commercial” is defined, the extent of existing Main Street restrictions, and how mobile vendors would operate during special events.

The Committee emphasized the importance of collaboration between mobile vendors and brick-andmortar businesses and directed staff to prepare mapping and analysis showing potential vending locations 100 feet off Main Street. Staff were also instructed to research approximately six ordinances from comparable California cities. The Committee identified location regulations as the primary focus of the ordinance update, with operational standards and licensing to primarily follow state requirements. The next meeting was scheduled for September 23, 2025.

Ad Hoc Committee Meeting – September 23, 2025
The second Ad Hoc Committee meeting was held on September 23, 2025, with 15 community members in attendance. Planning staff presented:
• Six example ordinances from Ukiah, Santa Rosa, Windsor, Calistoga, Arcata, and Fort Bragg. • Maps of the downtown area, illustrating parcels that meet parking standards and could potentially host mobile vendors with property owner permission.

The Ad Hoc Committee provided guidance on the operation of mobile vendors, emphasizing site selection, buffers, operational standards, and zoning requirements. Committee members noted that potential sites should be evaluated with property owner permission and a review of parking availability and recommended that food trucks could share sites during the operating and non-operating hours of primary businesses to maximize flexibility. Building on this direction, staff outlined the regulatory framework and considerations necessary to implement these guidelines effectively.

Regulatory Framework
Staff outlined key California Health & Safety Code requirements, including the need for mobile food facilities to operate within 200 feet of an approved restroom and handwashing facility, for benefit of employees, if operating for more than one hour. If seating is provided, restrooms must also be accessible to customers, and local jurisdictions may establish additional buffer requirements.

Location & Site Considerations
• Potential sites may be considered with property owner permission and review of parking requirements.
• Food trucks could share sites during operating and non-operating hours of primary businesses. • Direction by previous City Council in 2014 to establish a 100-foot buffer from Main Street was acknowledged, recognizing that this restriction may push vendors toward residential areas. • The Committee recommended prohibiting food trucks on Main Street to preserve the architectural character of downtown.
6 • No cap was recommended on the number of mobile vendors to operate citywide or per parcel. • Direction to limit mobile vending to properties in the commercial and industrial zoning districts Buffers & Safety
• Potential buffers discussed included approximately 50 feet from residential areas and a buffer from schools, with consultation from the Willits Unified School District.

Operations & Equipment
• Generators: Mobile vendors must comply with City noise regulations. Generators should be properly maintained and positioned to minimize noise and air quality impacts on surrounding properties.
• Trash & Cleanliness: Vendors are required to provide adequate trash receptacles for customers, maintain a clean area within a ten-foot radius around their cart during operation, and ensure the area is left trash-free at the end of each day.

Permit Process
• Each food truck business would be required to obtain a zoning permit, followed by a business license, with review of business details, operating times, and proposed locations.

SIDEWALK VENDING OVERVIEW
A sidewalk vendor is any person who sells food or merchandise from a push-cart, stand, display, pedaldriven cart, wagon, showcase, rack, or other non-motorized conveyance, or from one’s person, upon a public sidewalk or other pedestrian path. Sidewalk vending is regulated under the City’s Mobile Vendor Ordinance but is distinct from Mobile Vending Units (MVUs), which are motorized vehicles such as food trucks and trailers that require separate permits and zoning considerations.

State Law
Sidewalk vending in California is governed by the Sidewalk Vending Act (SB 946), passed in 2018. SB 946 decriminalized street vending statewide and sets regulations for how cities can manage sidewalk vendors. The law prohibits local governments from banning street vending outright and requires any restrictions to be based on public health, safety, or welfare concerns, rather than economic competition.

Cities may impose reasonable regulations, including requiring business licenses, health permits for food vendors, and limits on vending in high-traffic or sensitive areas. SB 946 aims to promote economic opportunities while ensuring public spaces remain safe and accessible. (Legislation provided as Attachment C.)
Draft Mobile Vendor Ordinance Key Provisions: The City’s Mobile Vendor Ordinance incorporates sidewalk vending standards, including:

Permit Requirements
• Sidewalk vendors must obtain a Zoning Permit and City Business License before operating. • A California Seller’s Permit and proof of insurance are required. • Permits expire annually on December 31 and must be renewed.

Location & Hours of Operation
• No more than two stationary carts per block face in commercial or industrial areas. • Stationary vending is prohibited in residential areas; mobile carts must keep moving except while making a sale (up to 10 minutes).
• No vending in parks or facilities with exclusive vendor agreements or between 9 p.m. and 8 a.m.

Design & Operating Standards
7 • Carts must not exceed 72" L × 54" W × 78" H and may not be left unattended or chained to public fixtures.
• Vendors must maintain a clean 10-ft radius, provide customer trash bins, and comply with ADA access requirements.
• Only one cart per vendor per permit; permits are non-transferable. • No more than two (2) stationary carts with approved permits may be used to vend on the sidewalk of a single block face within commercial and industrial area sidewalks of the town.

Enforcement & Exemptions
• Violations are misdemeanors and may be deemed a public nuisance subject to enforcement. • Exemptions apply to charitable, religious, educational, youth, and political organizations or those protected under state or federal law.

Together, these regulations balance economic opportunity for sidewalk vendors with public health, safety, and the character of downtown and residential areas.

CONCLUSION
Following extensive community engagement, including stakeholder meetings, a citywide survey, and two Ad Hoc Committee meetings, staff has prepared a draft Mobile Vendor Ordinance for City Council consideration. The draft ordinance incorporates community and committee recommendations on zoning, buffers, operational requirements, and location regulations, while striving to protect public health and safety.

The proposed framework is intended to modernize the City’s mobile vending regulations, align them with current state law, and balance the community’s interest in supporting new business opportunities with the need to maintain fairness for existing brick-and-mortar establishments, preserve neighborhood character, and ensure public safety.

Staff is requesting direction and feedback from the Council on the proposed regulations governing mobile vendors operating on private property, within the public right-of-way, and under the sidewalk vending provisions. Input from the Council will guide refinement of the draft ordinance prior to bringing it back before Council for consideration of adoption.

AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Alan Falleri, City Planner
Agenda Title: DISCUSSION AND POSSIBLE DIRECTION TO STAFF REGARDING AMENDMENTS TO THE WILLITS MUNICIPAL CODE PERTAINING TO MOBILE VENDORS.

Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 45 min.

SUMMARY OF REQUEST: Over the last couple of years, several issues regarding mobile food vendors have been brought to the attention of City staff and City officials, and more recently, this matter has been under review by the Revit-ED Committee. Because of some confusion in the regulations governing mobile vendors, The Revit-ED committee has directed that new ordinance language be considered for regulating mobile vendors within the City limits. While there were differing opinions expressed during the Revit-ED deliberations, it was the general consensus of the Committee members that some limitations be placed on mobile vendors to protect the interests of the “brick and mortar” business in town. The attached memorandum dated April 30, 2014 to the Revit-ED Committee provides some background information that provided a basis for the Committee’s review and recommendations.

At its April 14th meeting, the Committee recommended that the City Council direct staff to initiate the following amendments to the Willits Municipal Code.

1. Delete existing Section 5.28.010 (both references).

2. Add new Section 5.28.010 “Peddler definition. A person who sells merchandise, and wares including edible goods and agricultural products from portable or stationary stands or vehicles, often by traveling to different places such as along the street or from door to door; includes mobile vendor and mobile food vendor.”

3. Add new Section 5.28.020. “It is unlawful for any peddler, mobile vender, mobile food vender or other person selling or offering for sale any merchandise, goods or wares of any description from portable or stationary stands or vehicles along or within 100 feet of Main Street, West Commercial Street or East Commercial Street west of the railroad tracks except as provided in WMC Section

17.66.070(D)(7)(a).”

4. Add “Section 17.04.1046 Mobile Vendor. Mobile Vendor shall mean any peddler or person or business that sells merchandise, wares, edible goods or agricultural products from a temporary or nonstationary location. The term ‘mobile vendor’ shall include mobile food vendor. ‘Temporary or nonstationary’ shall include but not be limited to portable or temporary stands, self contained motorized vehicles, concession carts and concession trailers. ‘Sell’ shall mean the act of exchanging a good for a profit or in return for a donation.”

5. Delete Section 17.66.070(D) because seasonal produce stands are being incorporated into the Mobile Vendor sections below.

6. Change Section 17.66.070(E) to Section 17.66.070(D) and modify the text to read as follows:
(D) Peddlers and mobile vendors shall be permitted by the Planning Director upon approval of a Zoning Permit application and shall be subject to the following requirements:

1. The Zoning Permit shall be issued for a maximum of one (1) year and subject to annual renewal.

2. All mobile vendors must possess and display a valid business license.

3. Mobile food vendors must also possess and display a valid license from the Mendocino County Health Department.

4. Mobile food vendors may be operated on a parcel subject to an ongoing major construction project.

5. All mobile food vendors shall provide clearly designated trash and recycle receptacles.

6. All mobile vendors shall maintain their premises in conformance with requirements of the Little Lake Fire Protection District.

7. No mobile vendors will be allowed along or within 100 feet of Main Street, West Commercial Street or East Commercial Street west of the railroad tracks except in the instance where, during the construction or renovation of a “brick and mortar” business, a property owner may operate as a mobile vender which sells merchandise directly related to the permanent structure on the subject parcel.
a. Exceptions: Temporary sales of merchandise or edible goods by service clubs and nonprofit or charitable organizations (i.e., Girl Scout cookies, Rotary Club crab sales, school bake sales, etc.) and individuals selling only local Mendocino County grown or harvested farm and fish products in an unrefined state shall be exempt from the requirements of this Section.

8. All Mobile vendors shall be located outside of the City Street right-of-way unless an Encroachment Permit is obtained, and shall be located on paved or all-weather gravel surfaces, no closer than 15 feet from fire hydrants, 25 feet from fire lanes, and 50 feet from bus stops.

9. All mobile vendors shall be located in commercial or industrial zoned properties except they may also be permitted when they are a bona-fide participant in a permitted special event. If they are not part of a special event, they may not be located within 100 feet of a City Park when such a special event is being held.

10. No mobile vendor is permitted to provide amplified or live music.

11. All mobile vendors shall maintain the premises in a neat and orderly manner at all times.

12. All mobile vendors shall occupy a location that does not disrupt the normal function of the site or its circulation, and does not encroach upon driveways, or pedestrian walkways.

13. All mobile vendors shall be restricted to a single sign with a maximum sign area of six (6) square feet. Any signs required by law are exempt from this restriction.

7. Change Section 17.66.070(F) to Section 17.66.070(E).

8. Change Section 17.66.070(G) to Section 17.66.070(F).
