AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Dusty Duley, Community Development Director
Agenda Title: DISCUSSION ON RIGHT-OF-WAY ABANDONMENT REQUEST #RA 23-01 FOR AN UNIMPROVED ALLEY BETWEEN WEST OAK STREET AND STATE HIGHWAY 20 IN THE CITY OF WILLITS.

Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 35 minutes.

Summary of Request: William Harris, owner of 53 West Oak Street, is requesting that the City vacate an undeveloped alley approximately 14 feet wide and 180 feet long that was originally established in the 1902 Oak Park Addition subdivision. The alley is located between properties fronting West Oak Street and State Highway 20 and currently abuts twenty-one parcels. Further, if approved, the applicant is requesting that the vacated right-of-way be conveyed from its centerline to adjoining property owners. The applicant cites concerns regarding illegal camping, fire hazards, and maintenance issues. While some adjacent owners support the request, others have noted that they rely on the alley for backyard access and oppose its abandonment. The alley does not contain City or utility infrastructure and appears to serve only adjoining properties. This item is presented for discussion only, and no formal action will be taken at this meeting.

Background:
• The alley was platted with the Oak Park Addition subdivision in 1902 and currently abuts the rear yards of 21 parcels fronting West Oak Street and State Highway 20 (APNs: 006-131-01, -02, -03, -09, -10, -11, -15, -16, -17, -18, -19, -20, -23, -24, -25, -26, -27, -33, -34, -39, -40). • The applicant intends, if the alley is vacated, to extend his lot lines to the centerline and use the additional area consistent with R-1 Single-Family zoning.
• The applicant raised public safety and maintenance concerns (illegal camping, fire risk during high vegetation). The City previously installed a fence at the alley’s east end, but City locks have been repeatedly replaced or broken, creating enforcement and maintenance issues. • Local utility providers were contacted and no utilities are located in the alley. The alley appears to provide no broader public function beyond access for adjacent owners. • Staff is unclear when the City first assumed regular alley maintenance (vegetation removal typically occurs at least twice per year).

Discussion:

This item was before the Council at the December 10, 2025 meeting for discussion. Public comment reflected mixed views, with some speakers opposing abandonment due to concerns about property expectations, neighborhood impacts, and access, while others supported abandonment citing safety, maintenance, and nuisance issues. Council members also expressed differing perspectives regarding precedent, City priorities, and potential cost savings and private use benefits. No formal action was taken, and Council directed that the item return for further discussion at the February 11th City Council meeting.

This item is presented for discussion only, and no formal action will be taken. Should the City Council direct staff to initiate the easement and alley abandonment process, staff will return at a future meeting with a resolution to abandon the public easement for Council consideration and formal action.

Recommended Action: Receive public input regarding the request to vacate the alley between West Oak Street and State Highway 20 and provide direction to staff on whether to prepare a resolution for City Council consideration to abandon the alley.

Alternative(s): None
Fiscal Impact: The vacation of the alley will have no negative impact on the City’s General Fund. These actions will provide a minimal beneficial impact as it allows the new property owners to move forward with any development of the property consistent with zoning and building code and eliminate the need for City resources and responsibility for the maintenance of the alley being vacated.

Personnel Impact: Vacation of the alley would result in a reduction in City staff time to maintain the alley.

Identified City Council Conflict of Interest: None.
2021 Adopted Goals: None
California Environmental Quality Act: Discussion item only. Future approval of alley vacation would be Categorically Exempt from CEQA, pursuant to Section 15305 (Class 5 – Minor Alterations in Land Use Limitations) of the CEQA Guidelines.

LOCATION:

RIGHT-OF-WAY ABANDONMENT #RA 23-01

WILLIAM HARRIS
Applicant is requesting that the City of Willits vacate an undeveloped alley approximately 14 feet wide and 180 feet long, oriented east–west. The alley was originally established as part of the Oak Park Addition subdivision in 1902. The request also includes conveyance of the vacated alley from its centerline to each of the twenty-one adjoining parcel owners.

Alley is located between residential homes that front West Oak Street and State Highway 20 including the following described parcels:
006-131-01, -02, -03, -09, -10, -11, 15, -16, -17, -18, -19, -20, -23, -24, -25, -26, -27, -33, -34, -39, and -40.

ENVIRONMENTAL
DETERMINATION:

Categorically Exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15305 (Class 5 – Minor Alterations in Land Use Limitations) of the CEQA Guidelines.

RECOMMENDATION: Receive staff presentation and public input regarding the request to vacate the alley between West Oak Street and State Highway 20. This is a discussion item only and no formal action will be taken.

BACKGROUND
The property owner of 53 West Oak Street, William Harris, is requesting that the City vacate a 14-foot wide by 180-foot long strip of land currently available for use by adjacent property owners as an alley.

Upon City approval to vacate the alley, the owner intends to extend his existing property lines to the centerline of the alley and utilize the additional area consistent with the Single-Family Residence (R-1) zoning designation. The applicant has also expressed concerns regarding illegal camping as well as fire hazards posed by the alley, particularly during periods of high vegetation growth.

The alley was originally established as part of the Oak Park Addition to Willits subdivision in 1902 (Attachment A). While staff is unclear about the original intended use of the alley, alleys of that era commonly served functions such as garbage collection. The alley presently abuts the rear yards of twenty-one properties, most of which support single-family residences (Attachment B). Staff is also unaware of when the City first assumed responsibility for alley maintenance, which typically includes vegetation removal at least twice per year.

Summary of Prior Council Discussion December 10, 2025, Meeting At the prior meeting, Council considered a discussion item regarding the subject Right-of-Way Abandonment Request #RA 23-01. City staff provided an overview of the request, including the alley’s history, physical characteristics, and the proposed abandonment and conveyance framework. 2 Public comment reflected mixed opinions. Several speakers expressed opposition to abandoning the alley, citing concerns related to property ownership expectations, neighborhood impacts, and public access. Other speakers supported abandonment, noting ongoing maintenance and safety issues within the alley, including fire risk and illegal activity, and expressing interest in incorporating the area into adjoining private properties.

Council discussion similarly reflected differing perspectives. Some Council members expressed reluctance to proceed with abandonment, indicating concerns about precedent and whether abandonment should remain a City priority. Other members noted that abandonment could reduce City maintenance responsibilities, save public resources, and allow adjacent property owners to make productive use of the land, including potential future residential improvements.

No formal action was taken. Council directed that the matter return for further discussion at the February 11th City Council meeting.

DISCUSSION
Several adjacent property owners have expressed opposition to the proposed vacation, noting that they rely on the alley to maintain convenient access to their backyards, while several other owners have expressed their support for the request.

In response to past neighborhood concerns about non-residents entering the alley, the City installed a fence at the east end of the alley corridor. However, the City’s lock on this gate has been repeatedly replaced with non-City locks or broken entirely, creating ongoing access and maintenance challenges for staff.

Aside from providing access to the rear yards of adjoining parcels, the alley does not appear to serve a broader public benefit. Both the applicant and the City have contacted local utility providers, all of whom have confirmed that they have no facilities within the alley. The City similarly has no utilities located in this area subject to vacation request.

RIGHT-OF-WAY ABANDONMENT PROCESS
Willits City Code
A property owner may request the abandonment (vacation) of a public right-of-way by submitting an application to the City Clerk. Any request must be approved by the City Council at a public hearing after considering comments from City staff, affected utilities, and the public. A request for the abandonment of a public right-of-way may be granted subject to conditions, or denied by the City Council, pursuant to Public Streets, Highways, and Service Easement Vacation Law (California Streets and Highways Code, Section 8300, et seq).

Further, before granting a right-of-way abandonment, the City Council must make all of the following findings (Willits Municipal Code §12.10.040):

1. Jurisdiction and Need
The abandonment is within the City’s jurisdiction and is determined to be unnecessary for present or prospective public use;

2. General Plan Consistency
The abandonment is in conformity with and does not adversely affect the General Plan and any adopted special or area plan applicable to the project location;

3. Public Interest / Improved Land Use
The abandonment is in the public interest through the improved utilization of land;

4. No Detrimental Impact to Original Purpose
The public interest for which the public right-of-way was originally acquired will not be detrimentally affected by the abandonment.
3 5. Conditions Protect Public Welfare
The conditions established by the Council for the abandonment are deemed necessary to protect the public health, safety and general welfare.

State Law
The proposed alley vacation is governed by the Public Streets, Highways, and Service Easements Vacation Law (California Streets and Highways Code §§8300–8363). This law establishes the procedures and standards that cities must follow when considering the abandonment (“vacation”) of a public street, alley, or public service easement.

Under the law, a city may vacate all or part of a public right-of-way either on its own initiative or in response to a request or petition from an interested party. Prior to acting on a vacation request, the City must publish and post required notices and hold a public hearing where all interested persons may provide testimony.

At the hearing, the City Council must consider whether the right-of-way is unnecessary for present or prospective public use, which is the core legal standard for granting a vacation (§8324). If the Council makes this finding, it may adopt a resolution formally vacating all or part of the alley. The resolution may include conditions that must be satisfied prior to recordation.

The law also requires the City to consider consistency with the General Plan (§8313) and to notify any public bodies or utilities that have requested advance notice of vacation actions (§8347). Existing public utility facilities in use generally must be preserved unless the utility determines otherwise (§8340, §8334.5).

Upon recordation of the resolution of vacation by the City Clerk, the vacation becomes legally effective (§8325). Once vacated, public rights in the alley are extinguished unless the City expressly reserves easements needed for utilities or future public access.

CONCLUSION
The request to vacate the unimproved alley between West Oak Street and State Highway 20 appears to present a balance of competing neighborhood interests. While several adjoining property owners support the applicant’s desire to incorporate the unused right-of-way into their lots, others rely on the alley to maintain functional access to their backyards and have expressed clear opposition. The alley does not appear to serve any broader public purpose beyond adjacent-owner access, and no public utilities are located within the corridor. However, the historic and ongoing use of the alley by neighboring residents remains a central consideration.

At this time, staff is seeking additional public input and direction from the City Council regarding whether to proceed with alley abandonment procedures. This item is presented for discussion only, and no formal action may be taken. Should the City Council direct staff to initiate the alley abandonment process, staff will return at a future meeting with a resolution for Council consideration and formal action.

AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Dusty Duley, Community Development Director
Agenda Title: DISCUSSION OF POTENTIAL COLLABORATION BETWEEN THE CITY OF WILLITS AND THE

COUNTY OF MENDOCINO TO RELOCATE DONATED SCULPTURES TO A PUBLIC LOCATION WITHIN THE CITY HIGHWAY 20 PARK
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 20 minutes.

Summary of Request: The County of Mendocino, through the Mendocino County Museum, is seeking City Council support to explore the relocation of seven (7) sculptures (Attachment A) donated by folk artist Mark Walker from their current location just off Highway 101, south of Willits, to a highly visible, publicly accessible location within the City Highway 20 Park. The intent of this discussion is to determine if the City is interested in collaborating with the Museum to pursue a potential loan or transfer agreement and long-term maintenance plan.

According to County Museum staff, the project would include:
• An engineered pad and any armature needed to secure the Ox Cart, Man, Ox and Mule • The concrete pad would extend to a 4-foot-high wood and hog-wire style fence with a mow pad (fence style optional with cost in mind)
• The sculpture repair, painting, and coating
• The physical move and installation of the sculptures
• A five year-maintenance plan with the County taking care of the sculptures and fence The Museum is prepared to utilize endowment funds designated for this project and will work with their non-profit and community partners to secure any additional funds needed to complete this effort.

Background: In 1988, Mendocino County received a donation of seven sculptures from folk artist Mark Walker.

These sculptures were accepted by the Mendocino County Board of Supervisors along with the parcel of land on which they currently reside, as well as a small endowment intended for their ongoing care and maintenance. Since that time, the Mendocino County Museum has been entrusted with responsibility for their preservation.

The sculptures are currently located just off Highway 101 on the grade south of Willits. Museum staff has expressed concern that due to their limited visibility and difficult access, the sculptures cannot be fully appreciated by the community nor easily maintained. The current site does not provide adequate opportunity for public engagement or stewardship.

As part of long-term planning efforts, the Museum has identified the City of Willits as a potential partner for relocating the sculptures to a more suitable and publicly accessible location, specifically within a visible area near Highway 20.

Relocation to such a location would significantly enhance community access, visibility, and cultural enrichment opportunities for local residents and visitors.

Discussion: Should Council agree to move forward with developing an agreement with the County to place sculptures in the City park, key agreement provisions for Council consideration include:
• Agreement Structure and Risk Allocation: What direction does Council wish to provide regarding how liability and insurance responsibilities should be allocated in the agreement for the sculpture’s placement on City property, including responsibility for vandalism, damage, or potential total loss? • Ownership and Long-Term Responsibility: Should the agreement be structured to reflect City ownership of the sculpture, continued ownership by the County/Museum, or a conditional or future transfer of ownership, in order to address long-term maintenance, care, and liability? • Insurance and Indemnification Provisions: What level and type of insurance and indemnification should be required in the agreement to adequately protect the City while allowing the project to proceed? If the City Council is interested in supporting this effort, the Museum proposes to work collaboratively with the City to develop a formal loan or transfer agreement, along with a defined maintenance contract. These documents would be presented for review and consideration by the City Council and the County Board of Supervisors.

This item is being presented for discussion only, and no formal action is required at this meeting Recommended Action: Direct staff to continue discussions with the County and return to Council with proposed agreement options addressing liability, ownership, maintenance, and insurance for consideration prior to proceeding.

Alternative(s): Direct staff to proceed with development of an agreement with the County for placement of sculptures in a City park, consistent with Council direction regarding liability and risk allocation, ownership and long-term maintenance responsibilities, and insurance and indemnification requirements, and to return to Council with a proposed agreement for consideration and approval.

Fiscal Impact: There is no immediate fiscal impact associated with this discussion item. Future costs related to site preparation, installation, or maintenance would be evaluated and presented to the City Council if a formal agreement is pursued. Potential funding sources, shared costs, and long-term obligations would be identified at that time.

Personnel Impact: No immediate personnel impact. Future impacts related to maintenance responsibilities may be identified in a proposed maintenance agreement.

Identified City Council Conflict of Interest: None.
2021 Adopted Goals: None
California Environmental Quality Act: Discussion item only. Any future action related to installation of the sculptures may be subject to CEQA review and would be evaluated at the time of formal application This Item Relates to the following General Plan Elements: N/A Land Use Circulation Conservation and Open Space Noise Housing Public Services and Facilities, Parks and Recreation Economic Development
