AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Connor Stack, City Planner
Agenda Title: DISCUSSION AND REQUEST FOR ADOPTION OF AN AMENDMENT TO WILLITS MUNICIPAL CODE TITLE 17 - ZONING, ADDING CHAPTER 17.89 “ENTERTAINMENT ZONES” TO ESTABLISH
REGULATIONS FOR ENTERTAINMENT ZONES
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 30 minutes.
Summary of Request: Staff is requesting the City Council to review and consider adoption of the Entertainment Zone Ordinance, which would give the city of Willits the ability to establish Entertainment Zones through resolution.
Establishing Entertainment Zones has the potential to create a positive economic impact by encouraging visitors to spend more time downtown, increasing customer traffic for restaurants, retailers, and entertainment venues, and attracting new cultural and community events. In turn, this can strengthen the local economy and generate additional sales tax revenue.
The ordinance was introduced at the February 25, 2026, City Council meeting. At that time, no revisions to the draft ordinance were identified. This item is now presented for second reading and consideration of adoption.
Background: SB 969 (Effective Jan 1, 2025) authorizes California cities to create Entertainment Zones where regulated public alcohol consumption is allowed during permitted events. This provides new tools for cities to activate downtowns and enhance event programming while maintaining control over public safety and sanitation.
The City has received increased interest from local businesses seeking to participate in Entertainment Zones during City-approved events. In response to growing community interest and recent changes to State law, the City Council directed staff to prepare amendments to the Willits Municipal Code to establish and regulate Entertainment Zones.
While the ordinance establishes the framework under which Entertainment Zones may be created, any proposal to establish a specific zone, including its boundaries, permitted days and hours of operation, and types of alcohol that may be served, is subject to approval by resolution of the City Council.
Recommended Action: Conduct a public hearing and consider adoption, reading the title of, and waiving further reading of a proposed ordinance to amend Title 17 (Zoning) of the Willits Municipal Code adding Chapter 17.89, “Entertainment Zones” to establish regulations for Entertainment Zones.
Alternative(s): Provide directions to staff to modify Ordinance Language and bring back revised Ordinance for adoption at a future meeting.
Fiscal Impact: Fiscal impacts will vary depending on scope of implementation, including logistics and enforcement needs, but are not expected to be significant. The cost to the city can be established in the management plans set in place when an Entertainment Zone is created.
Personnel Impact: Existing staff levels support ordinance implementation and oversight.
Identified City Council Conflict of Interest: None.
California Environmental Quality Act: Adoption of an Entertainment Zone Ordinance is exempt under the CEQA “common-sense exemption” (CEQA Guidelines §15061(b)(3)), as there is no possibility that the activity may have a significant effect on the environment.

DISCUSSION AND REQUEST FOR ADOPTION OF AN
AMENDMENT TO WILLITS MUNICIPAL CODE TITLE 17 –
ZONING, ADDING CHAPTER 17.89, “ENTERTAINMENT
ZONES”, TO ESTABLISH REGULATIONS FOR THE
CREATION OF ENTERTAINMENT ZONES
The Ordinance is exempt from the requirements of the
California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines, as the Ordinance is not a “project” and has no potential to result in a direct or reasonably foreseeable indirect physical change to the environment.
Adopt an Ordinance adding Chapter 17.89 to the Willits
Municipal Code to add regulations for Entertainment Zones.
BACKGROUND
In 2024, the California Legislature adopted Senate Bill 969, which allows local municipalities and counties to designate “entertainment zones”. An entertainment zone is a defined area where the open consumption of alcoholic beverages is allowed on public streets, sidewalks, or public rights-of-way during specified days and hours. SB 969 expanded upon a law that had previously applied only in the City and County of San Francisco (SB 76), to allow entertainment zones to be established in any jurisdiction in the state.
Key requirements of SB 969 include:
• Only licensed establishments within a Zone may sell alcohol for public consumption.
• Alcohol must be served in non-glass, non-metal containers. • No alcohol deliveries to consumers in the Zone.
• Cities must consult with law enforcement prior to designation.
Entertainment zones must be established through a local ordinance and follow the regulations established by the California Department of Alcoholic Beverage Control STAFF REPORT: ENTERTAINMENT ZONE
PAGE 2
(ABC). Eligible ABC licensees may participate in the entertainment zone by allowing their patrons to leave the premises with an open alcoholic beverage container for purposes of consumption within that entertainment zone. This is only allowed during the days and hours approved by the City Council. Alcoholic beverages purchased at the licensed premises may not leave the premises in an open glass or metal container. Participants cannot bring their own outside drinks; they must be purchased from participating businesses. The law requires collaboration with local law enforcement and a review of the entertainment zone every two years following its adoption.
The concept of establishing an Entertainment Zone in downtown Willits was initially suggested by the Willits Chamber of Commerce to the City Manager, who then recommended that the City Council consider the idea.
The concept of the Entertainment Zone and potential ordinance options were presented to the Willits City Council on August 27, 2025, at which time public input was received.
Following discussion, the Council directed staff to prepare a formal ordinance and agendize the item for further discussion and Council consideration.
DISCUSSION.
The proposed ordinance would add Chapter 17.89 – Entertainment Zones to the City Code, authorizing the City to designate specific areas in which public alcohol consumption may be permitted during City-approved events, subject to defined regulations and oversight.
Upon establishment of an Entertainment Zone by the City Council, members of the public may apply for permits through an administrative review process to utilize the zone for qualifying events. This ordinance establishes the regulatory framework for the creation and administration of Entertainment Zones.
Example Zone Locations: At the August 27 meeting, the Council provided input regarding the formation of an Entertainment Zone within the downtown area.
Attachment B depicts the initial proposed zone, which includes the public right-of-way and abutting sidewalks along Main Street between Wood Street and Commercial Street, and along East Commercial Street between Main Street and Humboldt Street. The City parking lot at East Van Lane and Schmidbauer Lane is also included within the proposed boundary.
Subsequently, staff received interest to consider expanding the potential zone to include businesses located along North Main Street, including those currently operating and those in the process of opening. The two maps below illustrate the originally proposed zone (left) and the updated potential Entertainment Zone boundary (right).

Summary of Council Direction From The First Reading On February 25th 2026:
At the previous City Council hearing, staff presented the proposed Entertainment Zone Ordinance, including the addition of Chapter 17.87 to the Zoning Code. The presentation outlined the ordinance’s purpose: to establish clear regulatory standards for potential Entertainment Zones, safeguard public health and safety, support local economic activity, and align the City’s regulations with SB 969, while preserving the character and accessibility of public events.
During the discussion, staff clarified that the ordinance itself does not create an Entertainment Zone. Rather, it establishes the regulatory framework under which a Zone could be created in the future by separate City Council resolution. It was also clarified in response to public questions that the use of an Entertainment Zone would be entirely optional and at the discretion of event organizers.
Following these clarifications, no modifications have been made to the proposed Entertainment Zone Ordinance for this second reading.

Example Operational Requirements: To ensure that Entertainment Zones are managed safely and effectively, the following operational requirements may be applied to permitted events. These measures are designed to promote public safety, maintain compliance with state and local regulations, and provide clear expectations for event organizers.
1. City-issued zoning permit required for each event. A planned event like “First Friday” could be approved under one zoning permit.
2. Defined hours (e.g., Fridays 12–9 PM; Saturdays 12–9 PM; City approved festivals).
3. Boundaries clearly marked with signage, barriers, and staff checkpoints
4. Non-glass, non-metal containers only; branded wristbands or cups may be required for age verification.
5. ABC compliance measures
6. Security and post event cleanup plans tailored to each event Entertainment Zone Management Plan: The Management Plan is intended to serve as a practical guide for all events utilizing an Entertainment Zone. It would outline the minimum elements that event organizers must address to ensure public safety, regulatory compliance, and effective communication with the community. The plan is intended to provide consistency across events while allowing flexibility for organizers to tailor details to their specific operations. Required elements may include:
1. Zone Operator designation with 24/7 contact;
2. Security and public safety plan (subject to FBPD review);
3. Trash and cleanup plan;
4. Boundary markings (signage, fencing, decals);
5. Procedures for age verification;
6. ABC compliance protocol;
7. Incident reporting procedures.
Public Survey Data: During open public events where the city held a booth and online through the Community Development Facebook page, a survey open to the public was given. The results of the questions addressing Entertainment Zones are provided as Attachment F.
RECOMMENDATION

1. The ordinance is consistent with the City’s General Plan as it would promote economic development, activate Main Street as a vibrant commercial and cultural core of the city, and support community use of public space.

Frequently Asked Questions
Frequently asked questions about entertainment zones.
What is an entertainment zone?
An entertainment zone is a defined public area (e.g., public roadway, sidewalk, etc.) within a local jurisdiction that allows for the open consumption of specified alcoholic beverages during specified days and hours.
How are entertainment zones established?
Entertainment zones are established by a city, county, or city and county ordinance.
How does the establishment of an entertainment zone affect ABC licensees? Eligible ABC licensees may participate in the privileges associated with an entertainment zone by allowing their patrons to leave the premises with an open alcoholic beverage container for purposes of consumption within that entertainment zone.
What licensees may participate in an established entertainment zone? Unless statutory restrictions or certain operating conditions dictate otherwise, beer manufacturers, winegrowers, and on-sale licensees whose premises are located within the defined boundaries of an established entertainment zone are eligible to participate.
What do licensees need to do prior to participating in an entertainment zone? Licensees should ensure their license type is eligible and that the premises is located within the defined boundaries of the established entertainment zone.
Additionally, licensees must notify ABC of their intent to participate in an established entertainment zone annually.
Are there restrictions on the types of alcoholic beverages allowable within an entertainment zone?
The ordinance establishing an entertainment zone will specify which alcoholic beverages are allowable. Additionally, licensees may only sell or allow consumption of those alcoholic beverages specified by their license type.
Are there restrictions on the types of containers licensees use for purposes of participating in an established entertainment zone?
Yes. Alcoholic beverages purchased at the licensed premises may not leave the premises in an open glass or metal container.
Are there restrictions on the days and hours that licensees may participate in an established entertainment zone?
The ordinance establishing the entertainment zone will specify the days and hours of the entertainment zone. Participating licensees may only exercise their entertainment zone privileges during these specified days and hours and only if they do not conflict with any operating conditions that are contrary to the specified days and hours.
I have an operating condition that limits my sales and/or consumption of alcoholic beverages to 10:00 P.M. each day of the week. But the entertainment zone allows for consumption of alcoholic beverages until midnight. May I participate up until midnight due to the entertainment zone’s privileges? No. You must still abide by the operating condition which restricts the sales and/or consumption of alcoholic beverages at your premises to 10:00 P.M. You may be able to request a modification of your conditions. Please reach out to your local ABC office for additional information on that process.
I have an operating condition that prohibits me from selling alcoholic beverages for off-site consumption. Does this prohibit me from participating in an established entertainment zone?
No. An exception was provided in the new law which allows a licensee with an operating condition impacting their off-sale privileges to participate in an established entertainment zone. However, this exception only applies to the removal of open alcoholic beverage containers from the licensed premises for purposes of consumption within the entertainment zone.
May a participating licensee deliver alcoholic beverages to consumers located within the entertainment zone?
No. The sale and removal of alcoholic beverages for purposes of consumption within the established entertainment zone must occur at the participating licensed premises.

9. Department Recommendations (Action Items)
a. Presentation of Audit Conducted by Moss, Levy & Hartzheim Regarding Audited Financial Report for Fiscal Year Ending June 30, 2024.
Manual Orozco, Finance Director and Bin Zing, Auditor for Moss, Levy & Hartzheim, presented the council with the Fiscal Year 2023/2024 Audit and answered questions of the Council.
Public Comment:
Nicole Caldwell stated that the Transportation Tax covered more employees in 2023, why does it not now? Ms. Caldwell mentioned that the City should be adjusting water and sewer rates annually to keep pace with inflation, rising operation cost, maintenance etc.
Bear Kamoroff commented on the processes being used to perform the Audit. Saprina Rodriguez expressed concern over the lack of discussion about Measure K Funds and concern over the transactions being entered as a lump sum rather than being detailed, she states that the Finance Manager was given sufficient staff. Mrs.
Rodriguez inquired if the City has been paying a consultant to work in the finance department over the past year.
Stewart Handte inquired if the City was on the verge of bankruptcy. Is it a fixable situation. Mr. Handte commends the City Council for trying to fix it. Councilmember Burton inquired if the City has to pay out staff at the end of each year for time accrued, ie. sick and vacation time and how much is the amount for this now.
Willits City Council Minutes of February 25, 2026 Page 3 of 4 Ben Zing, responded that the total of the combination of vacation time and sick time that has accrued and owed to employees is about $880,000.
Vice Mayor Alaniz asked Mr. Zing to clarify the difference between cash receipts and receipts. Mr. Zing responded that any time that someone pays the system generates a cash receipt to verify that the City receives cash, this is not like a physical receipt. Council member Burton inquired if the City is maintaining minimum balances for the City’s obligations for their borrowings? Ben responded that there are 3 long term debts that the City has and that this question would be for the City’s Bond Council. b. Discussion and Possible Introduction of an Amendment to Willits Municipal Code Title 17 – Zoning, Adding Chapter 17.89, “Entertainment Zones”, to Establish Regulations for the Creation of Entertainment Zones.
Connor Stack, City Planner, presented a PowerPoint presentation of the project.
Public Comment:
John Kvasnicka, Chamber of Commerce, stated that the entire map that was in the packet does not indicate the Entertainment Zone that will be used for each event. Saprina Rodriguez stated that she believes it is not the best use of City’s Tax dollars to create an entertainment zone so people can walk around and drink alcohol. The City has businesses that have the licenses and the space for the consumption of alcohol.
Nicole Caldwell asked who would be paying for the insurance and security for the events and is the City liable if anything happens? Mr. Stack commented that the insurance and security requirements will be unchanged from the past.
Moved by Alaniz/Seconded by Gonzalez a motion to introduce and waive further reading of a proposed ordinance to amend Title 17 (Zoning) of the Willits Municipal Code adding Chapter 17.89, “Entertainment Zones” to establish regulations for Entertainment Zones, carried unanimously.

AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Connor Stack, City Planner
Agenda Title: DISCUSSION AND POSSIBLE ADOPTION OF A RESOULTION APPROVING CONDITIONAL USE PERMIT APPLICATION #U-26-01 FOR AN ACCESSORY CARETAKERS UNIT AT AN EXISTING STORAGE FACILITY LOCATED AT 325 ROBERT DRIVE OWNED BY MR. CURTIS LYON.
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 30 min Summary of Request: To consider a Use Permit (U-26-01) to allow for construction of a 400 sq. ft. single-family residence to serve as an accessory caretaker unit to an existing storage facility at 325 Robert Drive. Two (2) new parking spaces will be designated onsite – one (1) located by the residence adjacent to an existing ADA-accessible parking space, and one (1) located near the ADA-accessible restroom facility approximately 55 feet west of the residence. The prefabricated modular home will be constructed upon an engineered foundation. The caretaker residence will utilize the existing driveway to the storage facilities for access. No other improvements are proposed as part of this project.
The Heavy Industrial (MH) zone requires a conditional use permit for establishing a single-family residence as an accessory use to a primary industrial use. To ensure that establishment of the residence does not present future land use incompatibilities or conflict, staff recommends that the project is subject to specified conditions related to caretaker housing.
The proposed size and location of the residence adheres to all development requirements as presented in the Willits Zoning Code (Chapter 17). Thus, the project as proposed is consistent with the General Plan Designation and zoning restrictions for the property.
Recommended Action: Adopt a resolution approving Conditional Use Permit #U-26-01 subject to the conditions of approval recommended by staff.
Alternative(s): None.
Fiscal Impact: None.
Personnel Impact: Minimal staff time to process paperwork related building permits and ensure ongoing project compliance with Use Permit conditions and applicable City Code.

BACKGROUND
RELATED APPLICATIONS:
BLA 18-03: In September 2019, Curtis Lyon applied for a Boundary Line Adjustment to merge two separate legal parcels (APNs 006-200-07 and 006-200-10) into one 3.01-acre parcel. Staff approved the application, and the new deed and parcel description for APN 006-200-12 were recorded.
U 22-01: In March of 2023, Curtis Lyon successfully applied for a very similar Use Permit, however by the time he was ready to build, the two year expiration on the use permit had come to pass, and as such a new Use Permit is being brought in front of council again.
PROJECT DESCRIPTION:
The applicant is requesting a Use Permit (U-26-01) to allow for construction of a 400 sq. ft. singlefamily residence to serve as caretaker housing, associative and directly supportive of an existing mini-storage facility.
PROJECT SETTING
SITE CHARACTERISTICS AND SURROUNDING LAND USES:
The project parcel is approximately 3.01 acres and is bordered on the north by Robert Drive in a predominantly industrial area of town. The parcel is fully paved and is approximately 39% developed with industrial business operations, storage units, equipment storage, and supportive business offices. A fence line running north to south separates the legal parcel into 2 fully fenced sections each containing their own separate gated access. An equipment rental and automotive facility is located east, and a fence equipment storage facility is located west of the parcel. Across the road due north is a large lot zoned MH, used for locomotive and railway equipment storage.
The southern property boundary abuts a densely wooded 7-acre parcel zoned MH, with a singlefamily residence and access off Cropley Lane. Establishment of the residence likely predates the establishment of the MH zoning designation, as no use permit was found on record for the parcel.
The site is surrounded by the following land uses:
APN GENERAL PLAN ZONING LOT SIZES USES

REFERRAL AGENCY COMMENTS
On July 27, 2021, project referrals were sent to the following agencies having jurisdiction over the project:
REFERRAL AGENCIES NOT RETURNED NO COMMENT COMMENT
Building Department X
City Manager X
Fire Department X
Police Department X
Public Works Dept. X
City Water/Sewer X
Engineering Division X
When responding to the referral for Use Permit #26-01, the Building Department commented “The building department approves the building permit to allow a 400 sq ft single family residence. The applicant must submit plans consistent with California Building Codes and obtain building permits prior to work on site. The applicant must submit plans consistent with California building codes and obtain building permits prior to working on site. The applicant submitted partial plans, depicting a manufactured home. Manufactured homes are governed by California Department of Housing and Community Development. Approval of the use permit shall not be inferred as accepting, approval, or completeness of submitted plans or the acceptability of proposed structure.”
After receiving this feedback, staff adjusted the standard conditions or approval from their typical 2 years to 3 years to make sure there is plenty of time for any adjustments to the plans of the building. Use Permit condition of approval number 11 states any alterations to the site plan that do not substantially change the intent of the approved use, raise new issues, and avoid any issues discussed in the public meeting can be authorized by the community development department.
STAFF ANALYSIS
GENERAL PLAN AND ZONING CONSISTENCY:
The property has a General Plan land-use designation of Industrial-General (M-G) and a zoning designation of Heavy Industrial (MH). According to Section 17.28.010 of the Zoning Code, The heavy industrial (MH) zone is intended to apply to areas devoted to normal operations of industries, subject only to such regulations as are needed to control nuisances and protect surrounding areas.
The application for a use permit is being sought to facilitate construction of a single-family residence to be occupied by an employee assigned to maintain the existing mini-storage facilities.
Though not defined in the Willits Municipal Code, this type of housing is often referred to as caretaker housing, caretaker unit, or caretaker residence. The MH zone requires a conditional use permit for establishing a single-family residence as an accessory use to a primary industrial STAFF REPORT : USE PERMIT #U-26-01
PAGE 4
use. The reason for such codification is to preserve the integrity of the industrial property by controlling competing uses which may occupy valuable industrial land or conflict with adjacent industrial uses. Establishment of the caretaker residence will be associative and directly supportive of the principal industrial operations and considered in-fill on an otherwise underutilized area of the parcel. The proposed size and location of the residence adheres to all development requirements as presented in the Willits Zoning Code (Chapter 17). Thus, the project as proposed is consistent with the General Plan Designation and zoning restrictions for the property.
LAND USE COMPATIBILITY:
Land uses in the immediate area are predominately industrial and include industrial operations, storage units, equipment storage, and supportive business offices. The nearest off-site residence is approximately 515 feet south of the project site. All abutting parcels are similarly zoned Heavy Industrial (MH).
Construction of the single-family residence is considered in-fill and would not interfere with ongoing industrial operations onsite or conflict with surrounding industrial uses, subject to a number of conditions. To ensure that establishment of a residence does not present future land use incompatibilities or conflict, it is recommended that the project is subject to the following specified conditions related to caretaker housing:
• The caretaker unit must be associative and directly support the nonresidential use of the property and remain occupied by supportive staff (e.g., night watchman, security personnel, janitor, handyman, facility manager, etc.) (Condition #8). • Occupancy of the caretaker unit shall be limited to the caretaker of the associative nonresidential use of the site and his or her household (Condition #9). • The design of the caretaker unit shall be consistent and uniform with the design of the associative use (Condition #10).

ENVIRONMENTAL REVIEW
This project has been determined to be categorically exempt from the California Environmental Quality Act (CEQA) provisions under Section 15303 (Class 3 - New Construction of Small Structures) and Section 15311 (Class 11 - Accessory Structures) of the CEQA Guidelines. Under the Class 3 exemption, construction of a limited number of new, small structures including residences in urbanized area may be considered exempt from CEQA. Additionally, under the Class 11 exemption, construction of minor structures accessory to existing commercial, industrial, or institutional facilities may be also considered exempt from CEQA. The Project is defined in the Willits Zoning Code (Chapter 17) as an accessory use to a non-residential use to provide support, which is consistent with this exemption.
