AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Connor Stack, City Planner
Agenda Title: DISCUSSION AND CONSIDERATION OF ADOPTION OF A RESOLUTION ESTABLISHING A
DOWNTOWN ENTERTAINMENT ZONE
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 30 minutes.
Summary of Request: Staff is requesting that the City Council conduct a public hearing and consider adoption of a resolution establishing an Entertainment Zone within the downtown Willits area. The proposed Entertainment Zone would allow limited and regulated consumption of alcoholic beverages within designated public rights-of-way during City-approved events, consistent with State law and Chapter 17.89 of the Willits Municipal Code.
The proposed boundary encompasses the City’s primary downtown commercial core and community gathering areas, including portions of Main Street, Commercial Street, State Street, Marin Street, and Bud Snyder Park.
Establishment of the Entertainment Zone boundary does not authorize ongoing public consumption of alcohol. Each event within the zone would require a separate Zoning Permit and approval of an Entertainment Zone Management Plan addressing public safety, security, sanitation, and operational requirements.
The City Council will also provide direction on key operational parameters of the Entertainment Zone, including days and hours of operation, types of alcoholic beverages permitted, and related conditions necessary to protect public health and safety.
Background: SB 969 (Effective Jan 1, 2025) authorizes California cities to create Entertainment Zones where regulated public alcohol consumption is allowed during permitted events. This provides new tools for cities to activate downtowns and enhance event programming while maintaining control over public safety and sanitation.
The City has received increased interest from local businesses seeking to participate in Entertainment Zones during City-approved events. In response to growing community interest and recent changes to State law, the City Council directed staff to prepare amendments to the Willits Municipal Code to establish and regulate Entertainment Zones.
While the adopted ordinance establishes the framework under which Entertainment Zones may be created, any proposal to establish a specific zone, including its boundaries, permitted days and hours of operation, and types of alcohol that may be served, is subject to approval by resolution of the City Council.
Recommended Action: Conduct a public hearing and adopt a resolution establishing an Entertainment Zone within the downtown Willits area.
Alternative(s): Provide directions to staff to modify the proposed Entertainment Zone boundary or operational parameters.
Fiscal Impact: Fiscal impacts are expected to be minimal and will vary depending on the scale and frequency of events. Costs associated with event implementation, including security, sanitation, and traffic control, will be addressed through the required Management Plan and borne by event organizers.
Personnel Impact: Coordination with Community Development, Service and Facilities, and the Willits Police Department will be required during event review and oversight.
Identified City Council Conflict of Interest: None.
California Environmental Quality Act: The proposed project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 (Existing Facilities), as it involves the use of existing public streets, sidewalks, and public spaces, including Bud Snyder Park, for temporary, City-approved events with negligible or no expansion of existing use. The project is also exempt pursuant to CEQA Guidelines Section 15323 (Normal Operations of Facilities for Public Gatherings), as it consists of the normal operation of existing public facilities for periodic public gatherings and events.

DISCUSSION AND CONSIDERATION OF ADOPTION OF A
RESOLUTION ESTABLISHING A DOWNTOWN
ENTERTAINMENT ZONE
Project is exempt from the requirements of the California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines Section 15301 (Existing Facilities) and 15323 (Normal Operations of Facilities for Public Gathering).
Conducta a public hearing and consider adoption of a
resolution establishing an Entertainment Zone within the downtown area, allowing limited and regulated consumption of alcoholic beverages in designated public spaces during City-approved events, consistent with State law.
BACKGROUND
In 2024, the California Legislature adopted Senate Bill 969, which allows local municipalities and counties to designate “entertainment zones”. An entertainment zone is a defined area where the open consumption of alcoholic beverages is allowed on public streets, sidewalks, or public rights-of-way during specified days and hours. SB 969 expanded upon a law that had previously applied only in the City and County of San Francisco (SB 76), to allow entertainment zones to be established in any jurisdiction in the state.
Key requirements of SB 969 include:
• Only licensed establishments within a Zone may sell alcohol for public consumption.
• Alcohol must be served in non-glass, non-metal containers. • No alcohol deliveries to consumers in the Zone.
• Cities must consult with law enforcement prior to designation.
Entertainment zones must be established through a local ordinance and follow the regulations established by the California Department of Alcoholic Beverage Control (ABC). Eligible ABC licensees may participate in the entertainment zone by allowing their patrons to leave the premises with an open alcoholic beverage container for purposes of consumption within that entertainment zone. This is only allowed during the STAFF REPORT: ENTERTAINMENT ZONE

days and hours approved by the City Council. Alcoholic beverages purchased at the licensed premises may not leave the premises in an open glass or metal container. Participants cannot bring their own outside drinks; they must be purchased from participating businesses. The law requires collaboration with local law enforcement and a review of the entertainment zone every two years following its adoption.
The concept of establishing an Entertainment Zone in downtown Willits was initially suggested by the Willits Chamber of Commerce to the City Manager, who then recommended that the City Council consider the idea.
On March 11, 2026, the City Council adopted Ordinance No. 2026-01, adding Chapter
17.89 (“Entertainment Zones”) to the Willits Municipal Code. Chapter 17.89 establishes the regulatory framework for entertainment zones and authorizes the City Council to designate specific geographic boundaries by resolution.
The proposed resolution would establish an Entertainment Zone within the downtown area, consistent with the framework established in Chapter 17.89.
DISCUSSION.
The proposed resolution represents the next step in implementing Chapter 17.89 of the Willits Municipal Code by establishing a defined Entertainment Zone within the downtown area. As outlined in the adopted ordinance, the designation of a zone boundary by resolution allows the City to activate downtown public spaces for community-oriented events while maintaining regulatory control over the consumption of alcoholic beverages.
Consistent with the requirements of Chapter 17.89, notice of the public hearing was provided to all property owners and businesses located within and adjacent to the proposed Entertainment Zone boundary. This outreach is intended to ensure that directly affected stakeholders are informed and have the opportunity to provide input prior to Council action
The proposed downtown boundary is intended to encompass the City’s primary downtown commercial core and recreation area, including portions of Main Street, Commercial Street, State Street, Marin Street, and Bud Snyder Park (Attachment A).
These areas currently serve as the focal point for community events. Establishing an Entertainment Zone in this area is consistent with the City’s goals of supporting local businesses, enhancing community events, and activating public spaces in a controlled and well-managed manner.
Policy Considerations for Council Directions
Pursuant to Section 17.89.030 of the Municipal Code, the City Council must establish key operational parameters for the Entertainment Zone through the adopting resolution.
These include:
• Days and hours of operation (e.g., limited to specific events, weekends, or defined timeframes);
STAFF REPORT: ENTERTAINMENT ZONE
PAGE 3
• Types of alcoholic beverages permitted (e.g., beer and wine only, or inclusion of distilled spirits where appropriate);
• Open container requirements, including container types and labeling; • Identification and age verification measures (e.g., wristbands or stamps); and • Any additional conditions necessary to protect public health, safety, and welfare.
These policy decisions will directly influence how the Entertainment Zone functions and the level of activity permitted within the downtown area. Staff is seeking Council direction on these items to ensure that the program aligns with community expectations and public safety considerations.
Zoning Permit and Management Plan Process
Establishment of the Entertainment Zone boundary does not, in itself, authorize alcohol consumption in the public right-of-way. Rather, the ordinance requires that each event within the zone be subject to a separate approval process through a Zoning Permit and an associated Entertainment Zone Management Plan.
As outlined in Chapter 17.89, any event proposing to utilize the Entertainment Zone must submit a Management Plan for City review and approval. The Management Plan must include, at a minimum:
• Identification of a Zone Operator responsible for compliance; • A security and public safety plan, subject to review by the Willits Police Department;
• Trash collection and cleanup procedures;
• Boundary controls, including signage or physical demarcation; • Age verification procedures;
• ABC compliance protocols; and
• Incident reporting procedures.
The Community Development Director (or designee) is responsible for reviewing and approving the Management Plan prior to issuance of a Zoning Permit. The City retains the authority to impose conditions, require modifications, or deny a permit if the proposed event does not adequately address public safety or operational concerns.
Additionally, all Entertainment Zone activities are subject to revocation authority, and the City may suspend or terminate use of the zone at any time if necessary to protect public health and safety or if the event fails to comply with the approved Management Plan.
RECOMMENDATION
Adopt a resolution establishing an Entertainment Zone within the downtown area, allowing limited and regulated consumption of alcoholic beverages in designated publicspaces during City-approved events, consistent with State law.
