AGENDA SUMMARY REPORT
To: Honorable Mayor and Council Members
From: Dusty Duley, Community and Economic Development Director Agenda Title: CONSIDERATION OF CITY SUPPORT FOR THE RELOCATION OF THE MARK WALKER SCULPTURES TO HIGHWAY 20 PARK
Type: Presentation Consent Regular Agenda Public Hearing Urgent Time: 15 minutes.

Summary of Request: The County of Mendocino, through the Mendocino County Museum, is requesting feedback from the City Council regarding the potential relocation of seven sculptures donated by folk artist Mark Walker from their current location south of Willits to Highway 20 Park. The proposed location would provide significantly greater public visibility while enhancing a prominent public space within the City.

The County has reached a point where additional staff time and resources will be required to prepare relocation plans, negotiate agreements, and pursue implementation. Before investing those resources, the County is requesting confirmation that the City Council supports locating the sculptures within Highway 20 Park. If the Council supports the proposed location, staff will work with the County to develop the necessary agreements for future City Council consideration.

According to County Museum staff, the project would include:
• An engineered pad and any armature needed to secure the Ox Cart, Man, Ox, and Mule • The concrete pad would extend to a 4-foot-high wood and hog-wire style fence with a mow pad (fence style optional with cost in mind)
• The sculpture repair, painting, and coating
• The physical move and installation of the sculptures
• A five-year maintenance plan with the County taking care of the sculptures and fence The Museum is prepared to utilize endowment funds designated for this project and will work with their non-profit and community partners to secure any additional funds needed to complete this effort. The opportunity to locate the sculpture at Highway 20 Park is presented to the City with no request or need for City funds.

Staff has identified a preferred location within Highway 20 Park for placement of the sculptures should the City Council support relocation to the park. The proposed location is shown in Attachment A and was selected to maximize visibility from Highway 20 while minimizing conflicts with existing park amenities and future park use. The specific placement of the sculptures may be refined during the final design and agreement process.

Background: In 1988, Mendocino County received a donation of seven sculptures from folk artist Mark Walker.

These sculptures were accepted by the Mendocino County Board of Supervisors along with the parcel of land on which they currently reside, as well as a small endowment intended for their ongoing care and maintenance. Since that time, the Mendocino County Museum has been entrusted with responsibility for their preservation.

The sculptures are currently located just off Highway 101 on the grade south of Willits. Museum staff has expressed concern that due to their limited visibility and difficult access, the sculptures cannot be fully appreciated by the community nor easily maintained. The current site does not provide adequate opportunity for public engagement or stewardship.

As part of long-term planning efforts, the Museum has identified the City of Willits as a potential partner for relocating the sculptures to a more suitable and publicly accessible location, specifically within a visible area near Highway 20.

Relocation to such a location would significantly enhance community access, visibility, and cultural enrichment opportunities for local residents and visitors.

Discussion: Should Council agree to move forward with developing an agreement with the County to place sculptures in the City park, key agreement provisions for Council consideration include:
• Agreement Structure and Risk Allocation: What direction does Council wish to provide regarding how liability and insurance responsibilities should be allocated in the agreement for the sculpture’s placement on City property, including responsibility for vandalism, damage, or potential total loss? • Ownership and Long-Term Responsibility: Should the agreement be structured to reflect City ownership of the sculpture, continued ownership by the County/Museum, or a conditional or future transfer of ownership, in order to address long-term maintenance, care, and liability? • Insurance and Indemnification Provisions: What level and type of insurance and indemnification should be required in the agreement to adequately protect the City while allowing the project to proceed? If the City Council is interested in supporting this effort, the Museum proposes to work collaboratively with the City to develop a formal loan or transfer agreement, along with a defined maintenance contract. These documents would be presented for review and consideration by the City Council and the County Board of Supervisors.

This item is being presented for discussion only, and no formal action is required at this meeting. However, the project has reached a point where the County must determine whether to invest additional time and resources in developing agreements and relocation plans. Accordingly, the County is requesting the City Council determine whether Highway 20 Park is an acceptable location for the sculptures before proceeding further.

Recommended Action: Receive the presentation from staff and representatives of the Mendocino County Museum and provide direction regarding whether the Council supports Highway 20 Park as the location for the Mark Walker sculptures. If supported, direct staff to work with the County to develop the necessary agreements for future City Council consideration.

Alternative(s): Request additional information from staff before determining whether Highway 20 Park is an appropriate location for the sculptures.

Fiscal Impact: There is no immediate fiscal impact associated with this action. Any agreement authorizing placement of the sculptures on City property shall require the County of Mendocino to be solely responsible for all costs associated with transportation, installation, maintenance, repair, insurance, relocation, or removal of the sculptures.

No City funds are available to support these activities. Any future agreement will be presented to the City Council for approval.

Personnel Impact: If the City Council approves Highway 20 Park as the proposed location, existing staff resources will be used to coordinate with the County, negotiate and prepare the necessary agreements, and return those agreements to the City Council for future consideration.

Identified City Council Conflict of Interest: None
California Environmental Quality Act: Discussion item only. Any future action related to installation of the sculptures may be subject to CEQA review and would be evaluated at the time of formal application This Item Relates to the following General Plan Element: N/A Land Use Circulation Conservation and Open Space Noise Housing Public Services and Facilities, Parks and Recreation Economic Development
