Agenda Item #8c
_____________________________________________________________________ Date: September 8, 2026
To: Honorable Mayor and Councilmembers
From: Marti Brown, City Manager
Karleen Price, City Clerk/Assistant to the City Manager Subject: Social Media Policy
Recommendation:

Approve the City of Willows Social Media Policy establishing standards for the use and management of official City social media accounts and employee use of social media in connection with City business.

Rationale for Recommendation:

Adoption of a formal Social Media Policy will establish consistent standards for the administration of official City’s social media accounts, appropriate employee use, public comments, protection of City information, and retention of public records.

Background:

The City uses social media as an important communication tool to provide information to the public regarding City programs, services, meetings, events, and other matters of community interest. Social media provides the City with an efficient way to distribute timely information, promote City programs and events, and support transparency and community engagement.

The use of social media by a public agency also presents considerations that differ from personal or private-sector social media use, including public records retention, First Amendment protections, appropriate moderation of public comments, protection of confidential information, and the need to distinguish official City communications from employees' personal speech.

The proposed Social Media Policy establishes Citywide standards governing official City social media accounts and employee use of social media in connection with City business.

Discussion & Analysis:

The proposed policy applies to all City employees, official City social media accounts, and employees using social media while acting in an official capacity.

Page 35 of 110 ends

Under the policy, official accounts representing the City or a City department must be authorized by the City Manager or designee, and account credentials must be maintained by the City rather than solely by an individual employee.

Key provisions of the policy include:
 Official City Accounts: Establishes authorization and administrative requirements for official City and departmental social media accounts.
 Public Notice: Requires official accounts to provide notice that social media is not the City's primary method for receiving official notices, claims, service requests, or other formal communications and directs members of the public to appropriate City communication methods.
 Content Standards: Requires official City content to relate to City-sponsored, City-endorsed, or City-related programs, services, and events and to be accurate, professional, and compliant with applicable law.
 Public Comments: Establishes guidelines for public comments when commenting is enabled on an official City social media page. The policy recognizes such pages as limited public forums and establishes content-neutral categories of material that may be removed in accordance with the policy and applicable law. Comments may not be removed solely because they express disagreement with the City.
 Employee Personal Use: Recognizes employees' rights to lawful off-duty speech while establishing appropriate limitations regarding confidential City information, unauthorized representations on behalf of the City, use of City logos or insignia, and conduct that violates City workplace policies.
 Public Records: Recognizes that content created, received, or maintained through official City social media accounts may constitute public records and requires employees responsible for official accounts to coordinate with the City Clerk regarding applicable records retention requirements.
 Enforcement: Provides that violations may result in corrective action consistent with applicable laws, due process requirements, and collective bargaining agreements while expressly providing that the policy shall not be applied in a manner that restricts protected speech.

Approval of the policy will provide consistent Citywide standards for the City's use of social media while supporting transparency, appropriate public engagement, records management, and responsible administration of official City accounts.

Consistency with Council Priorities and Goals:

The proposed Social Media Policy supports the City's commitment to transparency, accountability, effective communication, and responsible municipal operations. Establishing clear standards for official social media use helps ensure that information provided to the public is accurate and professional while supporting consistent administration across City departments.

Page 36 of 110 ends

Fiscal Impact:

There is no fiscal impact associated with approving the City of Willows Social Media Policy.

• Disclose confidential or non-public City information; • Represent themselves as speaking on behalf of the City without authorization; • Use City logos or insignia in a manner implying official endorsement; and • Engage in conduct that violates City workplace policies.

Limited personal use of social media during breaks or non-work time (or minimally during work hours) may be permitted as long as it does not interfere with job duties and does not use government resources.

Should employees reference their City employment on social media sites, they should also clarify that their views are personal.

VI. PUBLIC RECORDS

Employees managing official accounts shall coordinate with the City Clerk to ensure compliance with records retention requirements.

Agenda Item #8d
_____________________________________________________________________ Date: September 8, 2026
To: Honorable Mayor and Councilmembers
From: Marti Brown, City Manager
Karleen Price, City Clerk/Assistant to the City Manager Subject: Artificial Intelligence Use Policy
Recommendation:

Approve the City of Willows Artificial Intelligence (AI) Use Policy to establish guidelines for the responsible and appropriate use of artificial intelligence tools by City employees.

Rationale for Recommendation:

Establishing a Citywide policy provides employees with clear expectations regarding the appropriate use of these technologies while protecting confidential City information, requiring independent verification of AI-generated information, and maintaining employee accountability for City work products.

Background:

Artificial intelligence tools are increasingly available for use in the workplace and may assist City employees with routine tasks such as research, drafting, editing, summarizing information, and analysis. Artificial intelligence technologies, including generative AI, are increasingly being incorporated into commonly used workplace applications and are available through a variety of online platforms.

These tools can assist employees in performing certain administrative and analytical tasks more efficiently; however, their use also presents considerations related to accuracy, confidentiality, privacy, records retention, and appropriate reliance on AI-generated information.

The City currently uses ChatGPT as an artificial intelligence tool to assist with certain administrative functions. As artificial intelligence technologies become increasingly integrated into workplace applications and City operations, establishing clear guidelines for their use is important to ensure that employees understand appropriate uses and limitations and that City information is adequately protected
The proposed Artificial Intelligence (AI) Use Policy establishes a consistent framework governing the use of AI tools for City business. The policy recognizes AI as an assistive tool and makes clear that it is not a substitute for employee judgment, supervisory review, or established City procedures.

Page 42 of 110 ends

Discussion & Analysis:

The proposed policy applies to all City employees and departments using artificial intelligence tools in connection with City business, regardless of whether the technology is accessed through a City device, City network, or personal device.

Under the policy, employees may use AI tools to assist with routine work such as research, drafting documents, preparing outlines, improving writing clarity, summarizing information, and brainstorming ideas. AI-generated material may serve as a preliminary draft or reference; however, employees are required to review, verify, and edit the information before incorporating it into an official City document, communication, or decision-making process.

Key elements of the policy include:
 Appropriate Use: AI may be used as an aid for routine work activities, but employees remain responsible for the accuracy, quality, and appropriateness of the resulting work product.  Human Review and Decision-Making: AI may not be used to make official decisions on behalf of the City or replace employee judgment or professional review. Employees may not rely upon AI as the sole source of legal, financial, or policy guidance.  Confidentiality and Data Protection: Employees are prohibited from entering confidential, privileged, or sensitive City information into AI systems, including personnel records, protected personal information, information related to ongoing investigations or litigation, and sensitive infrastructure or security information.
 Accuracy and Verification: Because AI systems may generate inaccurate, incomplete, or fabricated information, employees must independently verify AI-generated information before using it in City documents, communications, reports, or decisions.  Public Records and Records Retention: Materials created or used through AI tools in connection with City business may constitute public records and must be maintained and retained in accordance with the City's records retention requirements and applicable law.  Employee Accountability: Employees remain responsible for work products created with AI assistance. Use of an AI tool does not relieve an employee of responsibility for ensuring that City work is accurate, appropriate, professional, and consistent with City policies and procedures.
 Departmental Oversight: Departments may establish additional restrictions or guidance when appropriate based upon operational, regulatory, or other department-specific requirements.

The policy also provides for periodic review as artificial intelligence technology and applicable legal requirements continue to evolve.

Adoption of the proposed policy will provide employees with consistent Citywide guidance while allowing the City to make appropriate use of emerging technology and establish safeguards for City information and work products.

Page 43 of 110 ends

Consistency with Council Priorities and Goals:

The proposed AI Use Policy supports the City's efforts to maintain efficient, effective, and responsible municipal operations. Establishing clear guidelines for emerging technologies supports organizational accountability, protects City information, and provides employees with appropriate tools to assist in the delivery of City services.

Fiscal Impact:

The City currently maintains a subscription to ChatGPT for authorized City use. Adoption of the Artificial Intelligence Use Policy does not, by itself, authorize any new expenditure or require an additional appropriation. Any future acquisition or expansion of artificial intelligence software, subscriptions, or related services would be subject to available budget appropriations and the City’s established purchasing and approval procedures.

CITY OF WILLOWS

ARTIFICIAL INTELLIGENCE (AI) USE POLICY
Policy No.: [To Be Assigned]
Effective Date: [Insert Date]
Approved By: [City Council]
I. PURPOSE
The City of Willows recognizes that artificial intelligence (AI) technologies may assist employees in performing certain work tasks more efficiently, including research, drafting, editing, and analysis. The purpose of this policy is to establish guidelines for the responsible use of AI tools by City employees while protecting confidential information, ensuring accuracy in public communications, maintaining compliance with applicable laws, and preserving the integrity of City operations.

AI technologies are intended to assist employees in their work but do not replace professional judgment, supervisory review, or established City procedures.

II. SCOPE
This policy applies to all City employees and departments when using artificial intelligence tools in connection with City business. AI tools include generative artificial intelligence systems and automated technologies capable of producing written, visual, audio, or analytical content based on user prompts or data inputs.

Examples of such systems may include AI writing assistants, research tools, automated summarization systems, and image or media generation tools. This policy applies regardless of whether the AI system is accessed through a City device, a City network, or an employee’s personal device when used for City work.

III. APPROPRIATE USE OF AI
Employees may use artificial intelligence tools as an aid for routine tasks such as research, drafting documents, preparing outlines, improving writing clarity, summarizing information, or brainstorming ideas. AI-generated content may be used as a preliminary draft or reference tool but must always be reviewed, verified, and edited by the employee before being used in any official City document, communication, or decision-making process.

Employees remain responsible for the accuracy, quality, and appropriateness of all work products produced with the assistance of artificial intelligence tools.

IV. LIMITATIONS ON USE

Page 45 of 110 ends

Artificial intelligence tools shall not be used to make official decisions on behalf of the City or to replace employee judgment or professional review. Employees shall not rely on AI systems as the sole source of legal, financial, or policy guidance.

Artificial intelligence tools shall not be used in any manner that violates City policies, applicable laws, or ethical standards. Employees must ensure that the use of such tools does not result in misleading, deceptive, or unauthorized communications on behalf of the City.

V. CONFIDENTIALITY AND DATA PROTECTION
Employees shall not enter into artificial intelligence systems any confidential, privileged, or sensitive City information. This includes but is not limited to personnel records, protected personal information, information related to ongoing investigations or litigation, sensitive infrastructure or security information, or any information protected by privacy laws.

Many AI systems store or process information entered by users. Because such information may be retained or used by the AI provider, employees must exercise caution and avoid entering any information that could result in unintended disclosure of confidential City data.

VI. ACCURACY AND REVIEW
Artificial intelligence systems may generate inaccurate, incomplete, or fabricated information.

Employees must independently verify the accuracy of information produced by AI tools before incorporating it into City documents, communications, reports, or decisions.

AI-generated content should be treated as a drafting or research aid and must be reviewed to ensure it meets the City’s standards for accuracy, professionalism, and legal compliance.

VII. PUBLIC RECORDS
Materials created or used in connection with artificial intelligence tools during the course of City business may constitute public records under the California Public Records Act. Employees shall maintain and retain records in accordance with the City’s records retention policies and applicable laws.

VIII. EMPLOYEE RESPONSIBILITY
Employees remain accountable for all work products created with the assistance of artificial intelligence tools. The use of AI does not relieve employees of their responsibility to ensure that work products are accurate, appropriate, and consistent with City policies and procedures.

Departments may establish additional guidance or limitations regarding the use of artificial intelligence tools where appropriate for operational or regulatory reasons.

Page 46 of 110 ends

IX. ENFORCEMENT
Failure to comply with this policy may result in corrective action in accordance with applicable personnel policies, collective bargaining agreements, and relevant laws.

X. POLICY REVIEW
Because artificial intelligence technologies are evolving rapidly, the City reserves the right to review and amend this policy as necessary to address technological developments, legal requirements, and operational needs. This policy does not create a contractual right or entitlement.

Agenda Item #8f
_____________________________________________________________________ Date: September 8, 2026
To: Honorable Mayor and Councilmembers
From: Nathan Monck, Fire Chief
Marti Brown, City Manager
Subject: Federal Excess Personal Property
Recommendation:

Adopt Resolution XX-2026 approving continued participation in the Federal Excess Personal Property (FEPP) Program; approve Cooperative Agreement No. 992509 between the California Department of Forestry and Fire Protection (CAL FIRE) and the Willows Fire Department; and authorize Fire Chief Nathan Monck to execute the agreement and related program documents on behalf of the City.

Rationale for Recommendation:

Approving participation in the FEPP Program will allow the Willows Fire Department to retain access to federally owned excess property that supports wildland and rural community fire protection. CAL FIRE requires a signed City Council resolution and cooperative agreement in order to complete the renewal process.

Background:

The USDA Forest Service administers the FEPP Program under the Cooperative Forestry Assistance Act of 1978. Through the program, eligible local fire agencies may receive custody and use of federal excess personal property for wildland and rural community fire protection. CAL FIRE serves as the State's administering agency for participating California fire departments.

On July 8, 2026, CAL FIRE provided the Willows Fire Department with a renewal cooperative agreement and requested a signed agreement, an approving resolution from the City Council, and a completed GSA Property Management System property-search request form. The Department currently has one FEPP asset listed under the agreement: a 2007 International 7400 4x2 Type 3 wildland engine, property number PP0000070632.

Discussion & Analysis:

Cooperative Agreement No. 992509 establishes the terms under which the Department may retain, use, and acquire FEPP property. Title to all FEPP property remains with the federal government.

Property must be used primarily for wildland and rural community fire protection.

Page 56 of 110 ends

The City is responsible for transportation, retrofit, modification, maintenance, repair, operation, insurance, registration, training, security, storage, record retention, and required inventories for any FEPP property in its custody. Equipment is accepted as-is. The agreement has a five-year term from the date of the last signature, is subject to compliance reviews, and may be terminated by either party with 60 days' written notice. Upon termination, assigned FEPP property must be returned to the State.

Adoption of the attached resolution will approve the City's continued participation and authorize the Fire Chief to sign the agreement. The completed GSA request form will provide the Fire Chief propertysearch-only access so the Department can identify equipment that may meet future operational needs.

Consistency with Council Priorities and Goals:

Continued participation in the Federal Excess Personal Property (FEPP) Program is consistent with Council Priority #1: Fiscal Stability and Priority #3: Public Safety by supporting the City Council’s goals of improving public safety, maintaining fiscal responsibility, and pursuing outside resources that reduce reliance on General Fund revenues. The FEPP Program allows the Fire Department to obtain and use federal excess equipment at little or no acquisition cost, improving operational capabilities while maximizing the efficient use of City resources.

Fiscal Impact:

There is no anticipated negative fiscal impact associated with approval of this item.

To: Honorable Mayor and Councilmembers
From: Marti Brown, City Manager
Mike Maloney, Law Enforcement Consultant
Subject: Police Officer – Job Classification & Salary Schedule Recommendation:

Approve the Police Officer job classification and salary schedule as part of the reestablishment of the Willows Police Department.

Rationale for Recommendation:

Establishing the Police Officer job classification and salary schedule is a necessary step in reestablishing the Willows Police Department. Approval of the classification, job description, and salary schedule establishes the position’s responsibilities, qualifications, and compensation structure.

Background:

In 2017, the City discontinued operation of the Willows Police Department and entered into an agreement with the County of Glenn for contracted law enforcement services. Effective June 30, 2026, the agreement expired and no new agreement has replaced it.

The City Council seeks to reestablish the Willows Police Department and develop the organizational structure needed to provide municipal law enforcement and public safety services. This process includes establishing personnel classifications, policies and procedures, POST requirements, equipment and facility requirements, and other operational components. A foundational step in this process is also adopting Police Department job classifications and salary schedules.

Discussion & Analysis:

The Police Officer job classification (Attachment 1) is an FLSA non-exempt, entry- to journey-level law enforcement classification responsible for protecting life and property, maintaining public order, enforcing applicable laws, responding to emergencies, conducting investigations, and maintaining positive relationships with the community.

The proposed job classification requires a high school diploma or equivalent and successful completion of a California POST-accredited Police Academy. Prior law enforcement experience is desirable but not required. The proposed nine-step annual salary range is $69,161 to $84,266 (Attachment 2).

Page 59 of 110 ends

Consistency with Council Priorities and Goals:

The proposed action is consistent with Council Priority #3: Public Safety, Goal #1: Invest in the Startup of the Willows Police Department (WPD).

Fiscal Impact:

There is no immediate cost associated with approving the Police Officer job classification and salary schedule.

Agenda Item #9a
_____________________________________________________________________ Date: September 8, 2026
To: Honorable Mayor and Councilmembers
From: Marti Brown, City Manager
Mike Maloney, Maloney Consulting
Subject: Chapter 2.65 of the Willows Municipal Code
Recommendation:

Hold a public hearing and adopt Ordinance XX-2026 acknowledging the re-establishment of the Willows Police Department and amending Chapter 2.65 of the Willows Municipal Code, by title only and waive the full reading of the text.

Rationale for Recommendation:

Provisions of the California Government Code, the California Penal Code and administrative rules of the California Commission on Peace Officer Standards and Training (POST) require and provide the authority for certain steps to be taken by local legislative bodies in the furtherance of establishing, or re-establishing, a new police department. The proposed Chapter of the Willows Municipal Code would formally codify the re-establishment of the Willows Police Department.

Background:

Prior to 2017, the City of Willows maintained and operated its own municipal police department. In 2017, the City ceased operation of its police department and contracted with the Glenn County Sheriff’s Office to provide law enforcement and police services in the City limits for a total of nine years.

Effective June 30, 2026, the law enforcement agreement between the City of Willows and the County of Glenn expired. Concurrently, the City Council pursued re-establishing the Willows Police Department. According to California State law and POST administrative regulations, the Council is required to adopt an ordinance to re-establish the Willows Police Department.

Discussion & Analysis:

The proposed ordinance (Attachment 1) would amend the current Chapter 2.65 of the Willows Municipal Code (Attachment 2) to formally codify the re-establishment of the Willows Police

Page 87 of 110 ends

Department. This action represents an important step toward establishing the legal and administrative framework necessary for the City to resume operation of its own municipal police department.

With the new police department, the City of Willows will have greater local control over law enforcement policies, staffing, service levels, and community priorities. Establishing the department in full compliance with State law and POST administrative regulations will provide a strong foundation for professional, accountable policing while building public trust and establishing a respected organizational reputation.

Consistency with Council Priorities and Goals:

Adoption of the ordinance is consistent with Council Priority #3: Public Safety, Goal #1: Invest in the Startup of the Willows Police Department (WPD).

Fiscal Impact:

There is no fiscal impact by adopting this ordinance.

Ordinance XX-2026

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WILLOWS ACKNOWLEDGING

THE REESTABLISHMENT OF THE CITY OF WILLOWS POLICE DEPARTMENT AND AMENDING CHAPTER 2.65 OF THE WILLOWS MUNICIPAL CODE WHEREAS, the City of Willows historically maintained and operated its own municipal police department to provide law enforcement and public safety services within the City; and WHEREAS, on May 16, 2017, the City Council approved an agreement with the County of Glenn for the Glenn County Sheriff’s Office to provide law enforcement services within the City, effective July 1, 2017, and the City discontinued operation of its municipal police department in connection with the commencement of those contracted services; and
WHEREAS, the agreement between the City of Willows and the County of Glenn for the provision of law enforcement services terminated effective June 30, 2026, and the Glenn County Sheriff’s Office has not provided contracted law enforcement services to the City pursuant to that agreement since that date; and
WHEREAS, following the termination of the agreement with the County of Glenn, the City Council has determined that reestablishing a municipal police department is necessary and appropriate to provide municipal law enforcement services and address the public safety needs of the City; and WHEREAS, the City Council on August 25, 2026, adopted Resolution 39-2026 to reestablish the Willows Police Department to provide law enforcement, crime prevention, emergency response, community policing, and related public safety services within the City of Willows; and WHEREAS, the reestablishment of the Willows Police Department will provide for a municipal law enforcement agency under the administrative authority of the City Manager and the command of a Police Chief appointed by the City Manager; and
WHEREAS, the City Council desires that the Willows Police Department be organized and operated in accordance with applicable federal and state law and the standards established by the California Commission on Peace Officer Standards and Training (“POST”); and WHEREAS, the reestablishment and implementation of the Willows Police Department will require the recruitment and appointment of personnel, acquisition and assignment of equipment and facilities, establishment of policies and procedures, coordination with POST and other law enforcement and

Page 89 of 110 ends

governmental agencies, and other administrative actions necessary to establish and maintain an operational municipal police department; and
WHEREAS, the City Council desires to authorize the City Manager to undertake those administrative actions reasonably necessary to establish, implement, and maintain the Willows Police Department, subject to the City Council’s budgetary and legislative authority and applicable law; and WHEREAS, the City Council finds that reestablishing the Willows Police Department is in the best interests of the City and will promote the public health, safety, and welfare of the community.

Agenda Item #10a
_____________________________________________________________________ Date: September 8, 2026
To: Honorable Mayor and Councilmembers
From: Karleen Price, City Clerk
Marti Brown, City Manager
Subject: Library Board of Trustee Appointments
Recommendation:

Accept the recommendation of the Library Board Subcommittee, Mayor Hutson and Councilmember Pride, and appoint Susan Domenighini, Laurel Hill-Ward, and Joyce Welch-Ksander to the Library Board of Trustees for terms ending June 30, 2029.

Rationale for Recommendation:

There are currently three Library Board of Trustee vacancies that need to be filled.

Background:

As outlined in Section 2.70 of the City’s Code of Ordinances, the Library Board of Trustees consists of five members, who are appointed by the City Council. Members are appointed for overlapping threeyear terms and serve at the pleasure of the City Council.

On June 30, 2026, the terms of Board Members Dan Gupton, Brian Ramos, and Kristel Bettencourt expired, resulting in three vacancies on the five-member Library Board of Trustees. The three positions have remained vacant since that time, leaving the Board with only two members. Filling the vacancies will restore the Board to its full five-member composition.

At its August 11, 2026 meeting, the City Council directed staff to immediately begin recruitment to fill the three vacant positions. By the August 21, 2026 application deadline, seven applications had been received by the City. Subsequently, two applicants withdrew their applications.

On August 26, 2026, the Library Board of Trustee Subcommittee consisting of Mayor Hutson and Councilmember Pride interviewed the five remaining applicants.

Discussion & Analysis:

The Library Board serves an important role in supporting the operation and continued development of library services for the Willows community. Filling the three existing vacancies will restore the Board to

Page 96 of 110 ends

its full five-member composition and provide continuity as the City continues to support and enhance library programs and services.

As the City Council’s Library Board Subcommittee, Mayor Hutson and Councilmember Pride interviewed the five remaining applicants on August 26, 2026. The interviews provided an opportunity to learn more about each applicant’s background, interest in serving on the Board, familiarity with the library and its role in the community, and ideas regarding the future of library services in Willows.

Following the interviews and consideration of the applicants, Mayor Hutson and Councilmember Pride recommend the appointment of Susan Domenighini, Laurel Hill-Ward, and Joyce Welch-Ksander.

Appointment of the three recommended applicants will fill all current vacancies and restore the Library Board of Trustees to its full membership. If appointed, Susan Domenighini, Laurel Hill-Ward, and Joyce Welch-Ksander will each serve a three-year term ending June 30, 2029.

Fiscal Impact:

There is no fiscal impact.

Agenda Item #10b
_____________________________________________________________________ Date: September 8, 2026
To: Honorable Mayor and Councilmembers
From: Laurie Loaiza, City Engineer
Joe Bettencourt, Community Development & Services Director Marti Brown, City Manager
Subject: Willows Mobility, Recreation and Beautification Project Recommendation:

Adopt Resolution XX-2026 (Attachment 1) authorizing the City Manager to execute an agreement with REM Construction, Inc. in the amount of $3,468,154.30 (base bid plus Alternates 1 and 2), with a 15% construction contingency of $520,223.00, and to execute an agreement for construction management and inspection services, provided the total project cost does not exceed the total project funding of $4,715,000.00 for the Willows Mobility, Recreation and Beautification Project at Sycamore Park and Community Pool Complex.

Rationale for Recommendation:

The Willows Mobility, Recreation and Beautification Project at Sycamore Park and Community Pool Complex was overbudget in the first round of bidding. As a result, City Council rejected all bids and directed staff to reduce the scope of work and repackage the project to satisfy the available budget, and authorized the project re-bid.

Background:

On November 14, 2023, the State Department of Transportation awarded $4,038,000 of Clean California Local Grant Program (CCLGP) Cycle 2 funds to the City of Willows to upgrade Sycamore Park’s recreational amenities and to increase safe and equitable access to the park. The project also received a $200,000 contribution from the County of Glenn and $177,000 of Proposition 68 grant monies for rehabilitating the park’s community pool complex.

The project is anticipated to include new curb ramps and repair sidewalks around the perimeter of Sycamore Park. Other anticipated improvements include resurfacing the tennis court area and critical upgrades to the Community Pool complex. The Notice to Proceed and the fully executed grant package was received from the State on February 14, 2024. In August 2024, the City awarded the Design Contract to Willdan.

Page 104 of 110 ends

On December 9, 2025, the project was first circulated and bids were solicited. On February 24, 2026, the bids received were opened and all of them exceeded the City’s available budget. As a result, the bids were rejected by the City Council on March 24, 2026, with staff was directed to repackage the project to ensure it would satisfy the available budget and obtain the required approval by the grant administrator. The grant funds were reallocated within the current award by deferring the walking path replacement, related pathway lighting, and solar improvements, as well as shifting approximately $1.8 million to the pool. The remaining scope was also divided into several bid alternates, allowing for flexibility and ensuring all available monies would be spent in full.

Staff completed the revised bid package in June 2026 and obtained final grant approval on July 24, 2026. The project was then rebid on July 29, 2026, and opened bids on August 27, 2026.

Discussion & Analysis:

On August 27, 2026, three (3) bids were received ranging in base bid (plus alternates 1 and 2) from $3,468,154.30 to $4,581,206.77. The lowest responsive and responsible bid was submitted by REM Construction, Inc. of Chico, CA. Staff completed a review of REM Construction, Inc.’s bid and found that it was responsive. In addition, staff also determined that:
 the contractor’s license is active and valid;
 the prime contractor and listed subcontractors were all appropriately registered with the Department of Industrial Relations; and
 the bid contained the required information per the Notice to Bidders.

Environmentally, the project is determined to be Categorically Exempt in accordance with Section 15301 in that this project involves rehabilitation of existing facilities. Staff found that REM Construction, Inc.’s bid satisfies the bidding requirements for the project and recommends awarding the project to them. The recommended contract budget of $3,988,377.30 includes a 15% contingency of $520,223.

The funding for the overall project is approximately $4,715,000. Staff recommend authorizing the City Manager to enter into an agreement with the selected construction management and inspection firm, provided the total project cost does not exceed the project funding. Based on the construction bid received, staff anticipate the final overall project cost will be less than or equal to the project funding.

Construction management and inspection services will be solicited separately within the constraints of the overall project budget.

Consistency with Council Priorities and Goals:

The recommended action is consistent with Council Priority #2: Economic Development, Goal 5:

Improve City Appearance to Attract Businesses and Visitors; Priority #3: Public Safety, Goal 3: Improve Road and Pedestrian Safety; and Priority #4: Infrastructure Improvement, Goal 1: Invest in Deferred Maintenance and Goal 2: Implement the Capital Improvement Program.

Page 105 of 110 ends

Fiscal Impact:

The project was bid in July 2026 in accordance with both the City’s Municipal Code and the Public Contract Code. Bids were opened on August 27, 2026. The estimate for the project was $3,981,370.00 (plus 15% contingency).

The primary source of funding for this project is a Clean Cal Grant (CCLGP). Available funding is outlined below:

Available Funding:

CCLGP Grant Allocation $ 4,038,000
County Contribution $ 200,000
Park DIF $ 300,000
Prop 68 Grant Funds $ 177,000
Total Available Funding $ 4,715,000
The City bid the project with bid alternates to allow for pricing flexibility in the event bid results were higher than the available budget. Fortunately, the City has adequate funds for the base bid plus the two bid alternates. Based on the low bid, the overall estimated cost for the project is:

Design Phase $ 355,000.00
Base Bid plus Bid Alternate 1 and 2 $ 3,468,154.30
Construction contingency (15%) $ 520,223.00
Estimated Total (excluding CM/Inspection) $ 4,343,377.30 Attachment:
