TOWN OF WINDSOR

AGENDA REPORT
Special Town Council Meeting Date: January 11, 2023
To: Mayor and Town Council
From: Jon Davis, Town Manager
Subject: Adopt a Resolution Ratifying the Town Manager/Director of Emergency Services Proclamation Declaring the Existence of a Local Emergency related to Severe Winter Storms
Recommendation to Council:

Adopt a resolution ratifying the Town Manager/Director of Emergency Services Proclamation declaring the existence of a local emergency in response to the severe winter storm event/series of atmospheric river systems impacting California and the Town.

Background and Discussion:

Beginning December 27, 2022, severe winter storms related to a series of atmospheric river systems struck California, bringing high winds, substantial precipitation, and river and urban flooding; these winter storms have continued throughout California and the Town. It is forecasted that additional and continuing storms related to this series of atmospheric river systems threaten California, bringing heavy rainfall, expected flooding, strong winds and wind gusts, falling debris, downed trees, and widespread power outages.

California Government Code section 8630 and Windsor Municipal Code Title III, Chapter 19, Section 3-19-120 authorize the Director of Emergency Services for the Town of Windsor to proclaim the existence of a local emergency when the Town is affected or likely to be affected by conditions of extreme peril to the safety of persons and property within the Town.

Due to the actual and anticipated impact of these storms, Governor Newsom proclaimed an emergency statewide on January 4, 2023, and the Sonoma County Director of Emergency Services likewise declared a local emergency in Sonoma County on January 3, 2023. On January 8, 2023, President Biden declared that an emergency exists in California due to the severe winter storms, flooding, and mudslides.

On January 6, 2023, the Town Manager, in his capacity as Director of Emergency Services, proclaimed the existence of a local emergency in the Town of Windsor due to conditions of extreme peril to the safety of persons and property within the Town, caused by and anticipated to be caused by the storm event.

The proclamation of a local emergency allows the Town to respond effectively to the storms, seek and utilize mutual aid, and strengthen the Town’s ability to obtain reimbursement for its efforts in dealing with the local emergency. The Town Council must ratify the proclamation within seven days, or the proclamation will not be effective thereafter.

The local emergency shall be deemed as continuing to exist until proclaimed otherwise by the ITEM NO. : 4
2 of 2
Town Manager/Director of Emergency Services and the Town Council.

Fiscal Impact:

The recommended action does not directly create a fiscal impact. The Town will be tracking costs as the event progresses and will be seeking funding to recover expenses where possible.

Environmental Review:

The recommended action is not subject to review under the California Environmental Quality Act.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WINDSOR

RATIFYING THE TOWN MANAGER/DIRECTOR OF EMERGENCY SERVICES

PROCLAMATION DECLARING THE EXISTENCE OF A LOCAL EMERGENCY IN

RESPONSE TO THE SEVERE WINTER STORM EVENT/SERIES OF ATMOSPHERIC

RIVER SYSTEMS IMPACTING CALIFORNIA AND THE TOWN
WHEREAS, Title III, Chapter 19, Section 3.19-120 of the Municipal Code of the Town of Windsor empowers the Town Manager, acting as Director of Emergency Services, to request that the Town Council proclaim the existence of a local emergency or to issue such proclamation of local emergency under his own authority with Council ratification within seven (7) days thereafter; and
WHEREAS, Section 8558 of the Government Code defines a local emergency as “the duly proclaimed existence of conditions of disaster or of extreme peril to the safety of persons and property within the territorial limits of a county, city and county, or city, caused by conditions such as air pollution, fire, flood, storm, epidemic, riot or earthquake, or other conditions … which are or are likely to be beyond the control of the services, personnel, equipment, and facilities of that political subdivision and require the combined forces of other political subdivisions to combat;” and
WHEREAS, beginning December 27, 2022, severe winter storms related to a series of atmospheric river systems struck California, bringing high winds, substantial precipitation, and river and urban flooding; these winter storms have continued throughout California and the Town; and
WHEREAS, it is forecasted that additional and continuing storms related to this series of atmospheric river systems threaten California, bringing heavy rainfall, expected flooding, strong winds and wind gusts, falling debris, downed trees, and widespread power outages; and WHEREAS, due to the actual and anticipated impact of these storms, Governor Newsom proclaimed an emergency statewide on January 4, 2023, and the Sonoma County Director of Emergency Services likewise declared a local emergency in Sonoma County on January 3, 2023; and
WHEREAS, these storms threatened and continue to threaten critical infrastructure, urban flooding due to excessive and prolonged rainfall, power outages to thousands of households and businesses due to fallen power lines, as well as other damage throughout the Town; and WHEREAS, on January 6, 2023, the Town Manager, in his capacity as Director of Emergency Services, proclaimed the existence of a local emergency in the Town of Windsor due to conditions of extreme peril to the safety of persons and property within the Town, caused by and anticipated to be caused by the storm event; and
ATTACHMENT 1

WHEREAS, on January 8, 2023, President Biden declared that an emergency exists in California due to the severe winter storms, flooding, and mudslides; and WHEREAS, said Town Council does hereby find that the conditions of peril listed in this Resolution and in the Director of Emergency Services’ proclamation dated January 6, 2023, did warrant and necessitate the proclamation of the existence of a local emergency.

NOW, THEREFORE BE IT RESOLVED that the proclamation of the existence of a local emergency issued by said Town Manager, acting as Director of Emergency Services, dated January 6, 2023, attached hereto as Exhibit A, is hereby confirmed and ratified by the Town Council of the Town of Windsor; and
BE IT FURTHER RESOLVED that said local emergency shall be deemed as continuing to exist until proclaimed otherwise by the Town Manager/Director of Emergency Services and the Town Council of the Town of Windsor of the State of California.

EXHIBIT A
additional assistance from Sonoma County in responding to the impacts from the storms; and WHEREAS, flooding along the Russian River may inundate the Town's primary water supply wells jeopardizing the Town's ability to deliver drinking water; and WHEREAS, these storms threaten the local and regional electrical power distribution system which places the Town's ability to treat wastewater at risk posing a threat to public health; and WHEREAS, these conditions of extreme peril require the provision of additional public safety, health, and emergency services; and
WHEREAS, an emergency exists due to the severe storm event and atmospheric river conditions that may result in additional flooding and damage. The current storm conditions combined with atmospheric river conditions warrant declaring the existence of a local emergency because the conditions are or are likely to be beyond the control of the services, personnel, equipment, and facilities of the Town, requiring the combined forces of other political subdivisions to combat.

NOW, THEREFORE, IT IS HEREBY PROCLAIMED by the Director of Emergency Services that pursuant to the findings described above in this Proclamation, a local emergency exists in accordance with the California Emergency Services Act and Title III, Chapter 19 of the Town of Windsor Municipal Code.

IT IS FURTHER PROCLAIMED AND ORDERED that during the local emergency, the powers and duties of the Director of Emergency Services and the Disaster Council of the Town shall be as defined in state and federal law and in the ordinances, resolutions, and approved plans of the Town of Windsor in order to mitigate the effects of said local emergency.

IT IS FURTHER PROCLAIMED AND ORDERED that this local emergency shall continue to exist not longer than seven (7)days, unless this action is further ratified by the Town Council. The Town Council shall terminate the local emergency at the earliest possible date that conditions warrant.
