B. Action: Adoption of Resolution: Approval of the City of Woodlake’s Fee Schedule Effective January 1, 2024
City Administrator Lara reported the following: City of Woodlake currently collects fees for services provided to the public, such as: administration, utilities, planning, building, development, airport and police. Some of the fees are out of date, and do not provide sufficient revenues for the City to recover the cost of providing services to the public. The fee schedule is reviewed annually to assure that appropriate revenues are being collected to cover the expenditures associated with services provided to the public.
The purpose of developing a uniform fee schedule is to provide the public with a better understanding of the current fee structure and to update those fees that are not providing enough revenues for services delivered by the City of Woodlake. The goal of developing an updated fee schedule is not to create a profit for the City, but to ensure that the City is covering its expenditures for services provided.
Please note that not all fees on the attached City of Woodlake Fee Schedule are being amended. The only fees being amended are those for services provided.
Summary of Changes:
1. Update Water, Sewer and Refuse fees to reflect previous Council actions.
2. Update Planning Fees

C. Action: Adoption of Resolution: Approve the Note Modification Agreement and Allonge for the Property with APN No. 060-020-081-000 and Approve the Separate Consent to the Final Map for the Kaweah Subdivision
City Administrator Lara reported the following: Over the last few years, the City has acquired properties and marketed them to potential developers. The property, APN No. 060-020-081-000 was acquired by the City of Woodlake to attract future development on the North side of the City. The property sits north of the City of Woodlake on Kaweah Ave. and Valencia Blvd.
2 After acquiring the property and developing conceptual maps, the property was marketed for future housing development. The City received interest from multiple developers on the property. Efrain Yanez from Yanez Construction worked with City staff on a mutual concept where both staff and the developer agree with the final product of the development. The development will offer much-needed single-family housing in the City of Woodlake.
The City entered into a Purchase and Sale Agreement with Efrain Yanez for the sale of the property. The overall sale price of the property was five hundred thousand dollars ($500,000.00). As noted in the Purchase and Sale Agreement and the attached Promissory Note, the City temporarily carried a portion of sale price in the amount of ($450,000.00) four hundred and fifty thousand dollars that is due and payable January 1, 2024. The maker of the note Efrain Yanez has requested to modify the current Promissory Note through the attached Note Modification Agreement and Allonge.
The maturity date on loan would be extended to January 1, 2025, for all unpaid principal and accrued interest. The developer would pay the City 1/25th of the note plus accrued interest each time that a lot was sold. The remainder of the note and interest for any unsold lots would be due and payable January 1, 2025.

The proposed subdivision is located at the intersection of North Valencia Boulevard (SR 245) and West Kaweah Avenue on APN 060-020-081. The Tentative Subdivision map was originally approved by the Planning Commission on November 25, 2020. An extension was approved at a Planning commission meeting on February 15, 2023. The Final Subdivision map will subdivide an 8.5-acre parcel near the intersection of North Valencia Boulevard (SR 245) and West Kaweah Avenue on APN 060-020-081. The proposed map would result in a 25- unit single family (R-1-7) residential subdivision. The subdivision street access would continue North Palm Street from Kaweah Avenue to Cajon Avenue and create a culde-sac along Yokut Ct. The remainder, shown as lot 26, would be developed for future improvements. All services will be connected to City utilities.
Lot sizes will range from approximately 7,054 square feet to 10,341 square feet, with most lots ranging from 7,000 to 8,500 square feet.

City Administrator Lara reported the following: The City of Woodlake undergoes an annual independent audit of its basic financial statements of its governmental activities, its business-type activities, each of its major funds, and its aggregate remaining fund information. For Fiscal Year 2022/2023, the City of Woodlake in conjunction with the Tulare County Association of Governments contracted Brown Armstrong Certified Public Accountants to perform the audit.
3 The audit is conducted with auditing standards generally accepted in the United States of America and the standards applicable to financial audits contained in Government Auditing Standards, issued by the Comptroller General of the United States. Those standards require that the audit is performed to obtain reasonable assurance about whether the City financial statements are free of material misstatement. The audit includes examining, on a test basis, evidence supporting the amounts and disclosures in the financial statements. The audit also includes assessing the accounting principles used and the significant estimates made by management, as well as evaluating the overall financial statement presentation. The audit will also consider the City’s internal controls over financial reporting and test its compliance with certain provisions of laws, regulations, contracts, and grant agreements and other matters. Staff has reviewed the independent auditor’s report for the year ended June 30, 2023, and concurs with the report. With the PER completed, the City can formally adopt the report in order to leverage the data and recommendations for future water system infrastructure funding grants.
Overall, the PER stated that the water system is currently adequate and able to support the City’s water demands. January 22, 2024
Prepared by Ramon Lara, City Staff
SUBJECT:
Action: Adoption of Resolution: Project Update and Approval of Change Orders for the Design/Construction Engineering, Resident Engineer, Materials and Construction of the City of Woodlake Stormwater Phase II Project
BACKGROUND:
The City has a three phase project to pump stormwater to a new basin, instead of pumping the water into Bravo Lake. The first phase of the project has been completed and consists of constructing a new stormwater pump near Bravo Lake. The second phase is fully funded by a 2018 CDBG grant and consists of building a new stormwater line that will move the water from the newly constructed pump location to the proposed stormwater retention basin at Ropes and Mulberry. The third phase of the project consists of designing and constructing the new stormwater retention basin at Ropes and Mulberry.
Since the project began the City and its contractors have had to deal with unforeseen issues related to groundwater within the project trench. These issues have extended the schedule of the project and increased its budget. Thet original budget for the project in 2018 when the grant was awarded was $3,700,000 dollars. When the project was fully designed and awarded the overall project budget was increased to $4,813,540.54. Delays in design pushed the project schedule back. This led to increases in the costs of materials and labor combined with unforeseen issues that have raised the current budget to $5,820,484.58.
DISCUSSION:
The construction of the City of Woodlake Stormwater Phase II Project is now at approximately eighty percent. The project is now moving east through the Woodlake Botanical Garden and will soon connect to the vault at the Bravo Lake Lift Station.
1. Design/Construction Engineering – QK, Inc.
a. Approved Budget - $229,100.00
b. Revised Budget - $395,558.00
i. An additional request of $30,000 is being made due to additional work being done because of job site conditions which have extended the duration of the project and added other design elements. 51 2. Resident Engineer – 4 Creeks
a. Approved Budget - $249,672.00
b. Revised Budget - $347,236.00 with CO1 – CO3
i. Budget requests are being made due to additional Resident Engineer and Labor Compliance Services on the project. Project duration has been extended due to job site conditions.
3. Materials – Old Castle, Raint for Rent United Rentals, etc. a. Approved Budget - $1,366,711.83
b. Revised Budget - $1,393,035.03
i. Due to additional work and materials because of job site conditions which have extended the duration of the project and added tasks (bypass, pumping, etc.).
4. Construction - JT2 Inc.
a. Approved Budget - $2,878,132.00
b. Revised Budget – $3,675,846.65
i. Due to additional work and materials because of job site conditions which have extended the duration of the project and added tasks (manholes, asphalt, trucking, pumping, etc.).
RECOMMENDATIONS:
That Council approves the Change Orders for the construction of the City of Woodlake Stormwater Phase II Project. The project will allow the City to transfer stormwater to its future regional stormwater basin.
FISCAL IMPACT:
All expenditures associated with construction will be covered by CDBG, SLFRF, Stormwater and General Funds. Please note that funding what was previously budgeted for the City of Woodlake Olive Lane Stormwater Project will be moved to this project. 52 ATTACHMENTS:

Consultqnl Conlrocl Amendmenl #3 - Exlension of RE & Lobor Complionce Services
Dear Ramon,
Enclosed is our fee proposal for the extension of RE & Labor Compliance services. During the course of construction there has been a significant amount of extra work brought on by the contractor. As you are aware there are currently over 90 potential change orders submitted to date and 131 letters issued by JT2 to the City for review and response. This is a unique case with an unusual amount of additional coordination, review time and management and it is difficult to predict the type of scenario during the proposal phase of a project. The project was originally expected to be completed around the end of October 2023 and it is currently looking like construction will extend into early 2024. 4Creeks has completed an internal audit of the project and compiled an change order estimate that we think will be sufficient to continue to provide CM/RE services through project completion assuming construction is completed by the end of January 2024.
Alliant Consulting group has reached out to 4Creeks with a change order request as they have also performed an internal audit of the project and they expect needing additional time to complete the tasks needed to ensure labor compliance for the remainder of the project. I have included their audit in this change order request for your review.
Thank you for the opportunity to propose our services to assist you with this project.
Sincerely,

AGENDA ITEM V-D
January 22, 2024
Prepared by Ramon Lara, City Staff
SUBJECT:
Action: Adoption of Resolution: Extension of a Declaration of Local State of Emergency by the City of Woodlake
BACKGROUND:
On March 14, 2023, the City of Woodlake declared a Local State of Emergency due to the excessive rainfall and snowmelt that resulted in uncontrolled water coming in from local rivers, streams and creeks. The City had extreme flooding citywide and both public facilities and private structures were damaged.
City of Woodlake’s Public Works, the Woodlake Fire District and Cal Fire spent weeks removing water, debris and mud from streets, sidewalks, and the exteriors of homes. Public works spent weeks helping residents remove damaged materials and furniture from residences.
DISCUSSION:
With continued work on local stormwater systems the City wishes to extend its Local State of Emergency to better prepare the City and its residents. The City has concerns that future rain or snowmelt could overwhelm local rivers, streams, creeks, stormwater lines and basins throughout the City. This could lead to additional damage to public facilities and private structures and contribute to health and safety concerns.
The City has worked with FEMA to help local residents receive much needed assistance and in getting the City reimbursed for damage, caused citywide by extensive flooding. The process of getting the City reimbursed is ongoing. The City continues to wrap up other maintenance and upgrade projects such as stormwater and sewer lift station projects.
RECOMMENDATIONS:
Staff recommends that Council extend the Local State of Emergency for the City of Woodlake in response to past storms and to continue prepare for future storms and runoff.
FISCAL IMPACT:
The fiscal impact of this emergency declaration is not known at this time. 74 ATTACHMENTS:

AGENDA ITEM V-E
January 22, 2024
Prepared by Ramon Lara, City Staff
SUBJECT:
Action: Adoption of Resolution: Award the Construction of the City of Woodlake Sewer System Improvements Project to the Lowest Responsible Bidder Sierra Construction & Excavation Inc.
BACKGROUND:
The City of Woodlake received grant funding from the State Water Resources Control Board for the planning, engineering, design services and construction of capacity improvements and replacement/rehabilitation of aging sewer system assets. The project consists of constructing an alternative trunk alignment parallel to the main trunk on South Valencia Boulevard (SR-245) instead of upsizing the trunk. In addition to the capacity improvements the City will repair or replace up to 22,469 linear feet of aging sewer pipes that are close to the end of their useful life.
DISCUSSION:
The City of Woodlake put out to bid, the construction of the City of Woodlake Sewer System Improvements Project. The City received three total bids. All bids were below the engineers estimate. The bid package was then submitted to State Water Resources Control Board (SWRCB) staff for review. At this point SWRCB staff has directed the City to proceed with the award for the construction of the project.
RECOMMENDATIONS:
Staff recommends that Council award the construction for the City of Woodlake Sewer System Improvements Project to Sierra Construction & Excavation Inc. The project will be fully funded by the Clean Water State Revolving Fund Program. The project is pending a final budget approval from the State Water Resources Control Board. The final budget approval would increase the grant funding from $5,500,000.00 to $11,016,954.00. The City is requesting an additional $5,516,954.00 in funding. The project will be partially awarded until the full grant amount is granted.
FISCAL IMPACT:
All expenditures associated with the project will be covered by the Clean Water State Revolving Fund Program.

AGENDA ITEM V-F
January 22, 2024
Prepared by Ramon Lara, City Staff
SUBJECT:
Action: Adoption of Resolution: Award Construction Management/Resident Engineer Services for the City of Woodlake Sewer System Improvements Project to 4Creeks BACKGROUND:
The City of Woodlake received grant funding from the State Water Resources Control Board for the planning, engineering, design services and construction of capacity improvements and replacement/rehabilitation of aging sewer system assets. The project consists of constructing an alternative trunk alignment parallel to the main trunk on South Valencia Boulevard (SR-245) instead of upsizing the trunk. In addition to the capacity improvements the City will repair or replace up to 22,469 linear feet of aging sewer pipes that are close to the end of their useful life.
DISCUSSION:
The City of Woodlake put out a request for proposals for the construction management and resident engineer services for the project. The City received three proposals. Proposals were submitted by Interwest Consulting Group, 4Creeks, and Ghirardelli Associates.
City staff reviewed the proposals from those interested firms and held interviews. All three firms performed well during the process and were deemed qualified by City staff. After final scoring of all the firms, staff determined that 4Creeks would be the most qualified to perform construction management and resident engineer services for the project. Please see Attachment No. 1 for project reference. Please see Attachment No. 2 for budget.
RECOMMENDATIONS:
Staff recommends that Council award the construction management/resident engineer services for the City of Woodlake Sewer System Improvements Project to 4Creeks Inc.
FISCAL IMPACT:
All expenditures associated with the project will be covered by the Clean Water State Revolving Fund Program.
