B. Action: Adoption of Resolution: Approval of Certification for the Woodlake Holdings Industrial Park Final Environmental Impact Report – PUBLIC HEARING Community Development Director Llamas reported the following: The City of Woodlake circulated an Initial Study (IS) and Notice of Preparation (NOP) (referred to collectively as “NOP”) of the EIR for the proposed Project from May 4, 2022, to June 3, 2022 to trustee and responsible agencies, the State Clearinghouse (State Clearinghouse #2022040640), and the public. Following publication of the original NOP, changes were made to the proposed Project that consisted of an increase in project acreage and a change in Land Use Designation. The IS/NOP was recirculated to the public, trustee and responsible agencies, and the State Clearinghouse from October 12, 2022, to November 14, 2022.

The Draft EIR was properly noticed and circulated for public review and comment for 45 days, from May 10, 2023, through June 26, 2023. The Notice of Availability was published in the Sun Gazette on May 10, 2023. The Draft EIR and Appendices were sent to the State Clearinghouse for distribution and notices were mailed to local agencies and other interested individuals. The City received two comment letters on the Draft EIR within the public review period. Each letter is reproduced in its entirety in Chapter Two of this Final EIR and responses are shown after each comment.

Under CEQA, the Lead Agency must prepare and certify a Final EIR prior to a proposed project being approved.
1 The City of Woodlake is the Lead Agency on the project and has prepared a Final environmental Impact Report on the Woodlake Holdings Industrial Park which includes expanding an existing industrial area by developing a 1.5 million square foot industrial center on a 113-acre site that will house various industrial uses. The complete Project description, location and the potential environmental effects are contained in the Final Environmental Impact Report.

The Final EIR allows the public and the City an opportunity to review revisions to the Draft EIR and the responses to comments received during the Draft EIRs public review period. The Final EIR serves as the environmental document to inform the City of the environmental consequences of the proposed project, either in whole or in part, or one of the alternatives to the project discussed in the Draft EIR.

If the City approves the Project, and as part of that action adopts mitigation measures, the City will also adopt a Mitigation Monitoring and Reporting Program (see Public Resources Code Section 21081.6), and will also provide a Facts, Findings, and Statement of Overriding Consideration (see California Code of Regulations Title 14 Section 15093).

Horton CA3, Inc. The subdivision will consist of one hundred and thirty-three residential units and four lots that have been dedicated to the City. The four lots consist of a park and three landscaping strips that will be maintained by the City.

At the February 12, 2024, City Council meeting, the City Council approved the City Engineer’s report of costs needed to maintain the assessment district and on March 11, 2024 initiated the District. As part of the Landscape and Lighting Act of 1972, over 50% of the property owners have voted in favor of the Greenwood Subdivision Phase I and II Landscape and Lighting Assessment District 22-02. E. Action: Adoption of Resolution: Solicit and Consider Input on Possible Competitive and Supplemental Activities to Include in a 2023 CDBG NOFA Amendment #1 Application and Authorize Staff to Proceed with the Application

PUBLIC HEARING
City Administrator Lara reported the following: CDBG Program regulations require that the City conduct a public hearing on all CDBG-related matters to provide for and encourage citizen participation, particularly by low and moderate income persons who reside in areas in which CDBG funds are used. Therefore, when the public hearing is opened, the public will be invited to comment on possible competitive and supplemental activities to include in a 2023 CDBG NOFA Amendment #1 Application.

Public notices in both English and Spanish will be published in the February 21, 2024 and February 28, 2024 issues of The Sun-Gazette Newspaper notifying the public of public hearings on both March 11, 2024 and March 25, 2024 regarding the 2023 CDBG NOFA Amendment #1 Application.

On January 31, 2024, the California Department of Housing and Community Development (Department) is announcing the release of Amendment #1 to the 2023 CDBG Notice of Funding Availability (NOFA). The original NOFA was for approximately $19 million in federal funds for the Community Development Block Grant (CDBG) program only for applications from projects that remain on the waitlist established for Over-the-Counter projects after the 2019-2020 NOFA. This amendment makes another $19 million for Housing, Community Development and Economic Development Projects in an Over-the-Counter process.

Funding for this NOFA is available to the state from the United States Department of Housing and Urban Development (HUD), pursuant to the Housing and Community Development Act of 1974, as amended, and 24 Code of Federal Regulation (CFR) Part 570 Subpart I “State Community Development Block Grant Program”. These regulations require the state to make funds available to the state’s non-entitlement Units of Local Government. Units of general local government are defined by HUD as political subdivisions of the state, which in California are towns, cities, and counties. Only nonfederally recognized Tribes can receive funding through applications submitted by nonentitlement Units of Local Government. No direct funding from the Department can be provided to Tribes, Tribal Designated Housing Entities, or nonprofits.

The Application deadline will be when funds are exhausted or Tuesday April 30, 2024, whichever comes first. Applications will be accepted on a first come, first serve basis.

Unfortunately, the City was notified that the California Department of Housing and Community Development (HCD), 2023 Community Development Block Grant Program Notice of Funding Availability – Amendment #1 funds have been exhausted. At this time the City will continue with the design of the project to be ready to submit for grant funding as soon as another funding cycle reopens.
4 PUBLIC HEARING OPENED: 7:07 PM
Joshua Diaz, 556 W. Kaweah, Woodlake – Mr. Diaz asked for the item to be translated in Spanish. City Administrator Lara translated the item and asked if anyone had any questions. No one had questions.

PUBLIC HEARING CLOSED: 7:09 PM

ON A MOTION BY MENDOZA, SECOND BY MARTINEZ IT WAS VOTED TO

ADOPT THE RESOLUTION AND SOLICIT AND CONSIDER INPUT ON A

POSSIBLE COMPETITIVE AND SUPPLEMENTAL ACTIVITIES TO
INCLUSE IN A 2023 CDBG NOFA AMENDMENT #1 APPLICATION AND AUTHORIZE STAFF TO PROCEED WITH THE APPLICATION. APPROVED UNANIMOUSLY BY ROLL CALL VOTE.

F. Action: Adoption of Resolution: Approval of a Categorical Exemption and Categorical Exclusion for the Kaweah Storm Drain Improvement Project Community Development Director Llamas reported the following: The Kaweah Street Storm Drain Improvements project entails the installation of approximately 1,350 feet of a 48" stormwater pipeline, designed to tie into the existing stormwater system. This initiative is crucial for effectively mitigating the recurrent flooding issues that Woodlake has experienced, especially during heavy rainfall periods.

This project aligns with the exemption criteria outlined in 24 CFR 58.35(a), as it involves negligible or no expansion of the existing stormwater system's capacity. The addition of the new pipeline aims to optimize the existing system's performance within its current capacity, rather than extending these limits. The project's focus is on enhancing efficiency in managing runoff volumes during peak conditions, rather than increasing the system's overall hydraulic capacity. Thus, it is consistent with 24 CFR

58.35(a), which exempts activities and projects that do not significantly alter environmental conditions or allow for significant expansions of existing facilities.

The City, with support from environmental consultants at 4Creeks Inc, has evaluated the project within the context of CEQA and has determined that the project qualifies for Categorical Exemption 15302 (c), and Categorical Exclusion as it is outlined in 24 CFR 58.35(a).

Joshua Diaz, 556 W. Kaweah, Woodlake – Mr. Diaz asked if a 60 inch culvert could be installed instead of a 48 in culvert. City Administrator Lara stated all would be done according to grant guidelines.

ON A MOTION BY MARTINEZ SECOND BY VALERO IT WAS VOTED TO

ADOPT THE RESOLUTION AND APPROVE A CATEGORICAL

EXEMPTION AND CATEGORICAL EXCLUSION FOR THE KAWEAH
STORM DRAIN IMPROVEMENT PROJECT. APPROVED UNANIMOUSLY
BY ROLL CALL VOTE.

AGENDA ITEM V-B
April 22, 2024
Prepared by Emmanuel Llamas, City Staff
SUBJECT:

Action: Adoption of Resolution: Set Rates for Refuse Service in Accordance with Article XIIID of the Constitution of the State of California - PUBLIC HEARING BACKGROUND:

Proposition 218 requires the City to provide notice and allow opportunity for a written protest prior to implementing a utility rate increase; if a majority protest is received then the rate increase cannot be adopted. If protests do not represent a “majority protest”, then the City may adopt the rate increase. All property owners in the City of Woodlake were mailed a notice and the notice was published in the local newspaper.

DISCUSSION:

As part of the City’s contract for refuse services with Mid-Valley Disposal, the City is proposing a modification of Woodlake’s refuse rates for the following reasons: 1.) Comply with the agreement with Mid Valley Disposal to increase rates annually according to the Consumer Price Index (CPI) postings and 2.) To comply with CA Senate Bill 1383 tracking and reporting of organic waste. The revenue from the modified rates and charges will not be more than the funds required for the City to provide adequate refuse service to City customers. The rates would receive an increase in CPI each year for the following five years from the current rate of $30.92 to the projected rate of $32.05 in July of 2024 for residential. Please note that currently the City is only charging $27.50 as that was its cap which was approved with its 2019 Proposition 218 Process. The City has the necessary funding in the Refuse Fund to cover the current cost difference.

Pursuant to Proposition 218, the City Council set a public hearing date and will receive written protests related to the increase of refuse rates for the City of Woodlake.

If the City receives fewer protests than a majority of property owners, Council may adopt the proposed rate increase for refuse service.

As summary of the proposed rates for three can service are found below:
3 Can Residential Rates for the Upcoming Five Years (Estimated CPI Index 3.5%) Year 1 (2024) Year 2 (2025) Year 3 (2026) Year 4 (2027) Year 5 (2028) $32.05 $33.17 $34.33 $35.53 $36.78
89 RECOMMENDATIONS:

Staff recommends that Council approve the rate increase if the City receivers fewer protests then a majority of property owners.

FISCAL IMPACT:

The new rate structure will have no impact on the City’s General Fund. The rate study indicates that revenues generated by the rate increase will cover the City’s costs to provide refuse service.

CITY REFUSE SERVICES
94 What is Proposition 218?
 Article XIII D, Section 6(a) outlines the process for imposing a new property-related fee or increasing the rate of an existing propertyrelated fee.  In order to increase an existing fee, the City must complete three formally required components: (i) notice, (ii) hearing and (iii) protest.  Property owners are noticed of the fee increase, are given the opportunity to voice their concerns at a public meeting and have the ability to “protest” the fee increase.
95 Notice and Hearing
 The City has completed the noticing process and has mailed notices with the proposed fee increases to all owners that receive refuse service.
 City Council is responsible for setting a date for a public hearing and date where the Council will take action on the increase.  The date was set for tonight, April 22nd.
96 Purpose for Increase
 The reason for the fee increase for refuse service is related to the City’s contract with Mid-Valley, the City’s refuse hauler and State requirements.
 Our contract stipulates that Mid-Valley has the right to increase fees based on that year’s Consumer Price Index (CPI). CPI measures the increase in the cost of goods over a set period of time.  Essentially, CPI measures how much more expensive things get each year and Mid-Valley increases their fees because it also becomes more expensive for them to provide refuse services.
 Comply with CA Senate Bill 1383 tracking and reporting of organic waste.
97 Proposed Increase (Estimates)

Except as expressly provided in this Chapter, nothing contained in this Chapter shall be deemed to repeal, amend, be in lieu of, replace or in any way affect any requirements for any permit or license required by, under or by virtue of any provision of any other title or Chapter of this Code or any other ordinance or resolution of the City, nor be deemed to repeal, amend, be in lieu of, replace or in any way affect any tax, fee or other charge 110
