ON A MOTION BY MARTINEZ SECOND BY WALLACE IT WAS VOTED TO
ADOPT THE RESOLUTION AND APPOINT RUDY MENDOZA AS MAYOR
AND FRANCES ORTIZ AS VICE-MAYOR. APRROVED UNANIMOUSLY BY ROLL CALL VOTE.
C. Action: Adoption of Resolution: Approve the 1-Month Uncle Green Conditional Use Permit Extension Request with Conditions - PUBLIC HEARING Community Development Director Llamas reported the following: The Woodlake Municipal Code allows for 3 maximum extensions per Conditional Use Permit. The City requires an Extension Application for any Conditional Use Permit which has not met conditions of approval and would like to apply for an extension to meet the conditions. The City may choose to extend CUPs to allow a business time to fully meet all the conditions listed in the CUP. A CUP permit extension request can be denied by the Planning Commission. An applicant who had their CUP extension denied may appeal the decision to City Council per Woodlake Municipal Code procedures set in Chapter 17.70 Permits and Applications.
For Cannabis businesses, in order to maintain a CUP in good standing the business must also not fail to pay their regulatory fees and cannabis taxes in a timely manner, as stated in Woodlake Municipal Code Chapter 5.48 – Suspension and Revocation of Regulatory Permit or Employee Permit
Uncle Green had a renewed CUP application approved on February 21, 2024, subject to a 3-month expiration in order to complete the following conditions:
CUPs 18-001 Cultivation, 18-002 Manufacturing, 18-003 Distribution, and 21-006 Non-Storefront Retail - Uncle Green. Meet all City Development Standards and State Building Code Requirements. Meet all State Requirements, laws, and regulations for cannabis businesses in the State of California. Construct curb, gutters, sidewalks, streetlights on Naranjo (SR-216) and Road 196 need to be installed to meet design standards established by the City. All sidewalk areas and parking shall have ADA access and meet the design standards established by the City. Construction and install landscaping and irrigation in compliance with City’s design standards.
Uncle Green was granted a 6-month extension on May 15, 2024, to continue progress towards the outstanding conditions required of the Conditional Use Permit as detailed in the paragraph above. At the time of the 6-month extension, Uncle Green’s cannabis business license was in good standing regarding City taxes and regulatory fees owed to the City.
Uncle Green’s 6-month extension was expiring in November 2024. During November 2024 Uncle Green’s cannabis business license was no longer in good standing, as the City cannabis taxes and regulatory fees were outstanding, with cannabis taxes and regulatory fees being three quarters delinquent. Due to Uncle Green’s taxes and regulatory fees outstanding balance, their conditional use permit extension request at the November Planning Commission was denied by the Planning Commission.
The City staff met with Uncle Green ownership the week of January 6th 2025 to discuss the businesses plan to remedy the delinquent taxes and fees. On 1/10/2025 Uncle Green made a payment towards their regulatory fees balance, paying for one full quarter of regulatory fees and making a partial payment to another quarter of regulatory fees.
PUBLIC HEARING OPENED 7:08 PM
Dorothy Brazelle, 248 N. Valencia Blvd, Apt 213, Woodlake – Ms. Brazelle asked why the local businesses offer senior discounts.
PUBLIC HEARING CLOSED 7:11 PM
ON A MOTION BY ORTIZ, SECOND BY WALLACE IT WAS VOTED TO ADOPT THE RESOLUTION AND APPROVE A 2-MONTH CONDITIONAL
USE PERMIT EXTENSION REQUEST WITH CONDITIONS. APPROVED
UNANIMOUSLY BY ROLL CALL VOTE.
2 D. Action: Adoption of Resolution: Approve the 2-Month GreenBean Conditional Use Permit Extension Request with Conditions – PUBLIC HEARING City Administrator Lara reported the following: The Woodlake Municipal Code allows for 3 maximum extensions per Conditional Use Permit.
GreenBean was issued its first Conditional Use Permit in January of 2018. Since that date, GreenBean was subject to a 3-month extension in September 2020, a 6-month renewal in January of 2022, a 6-month extension on July 2022, a 6-month extension on February 2023, a 3-month extension on August 2023, a renewed CUP in November 2023, a 3-month extension on February 21,2024, and a 1-month extension on May 15, 2024.
GreenBean was lastly subject to a 3-month extension on August 21, 2024, subject to the same conditions required from the 2018 CUP, which are listed below:
CUP 17-011 Retail - GreenBean. Complete all off-site improvements including, but not limited to, the construction of curb, gutters, sidewalks, drive approaches, and completed landscaping along Naranjo Blvd (SR-216).
At the August 21, 2024, Planning Commission meeting the staff had no formal recommendation for the Planning Commission, but instead presented in the staff report options for Planning Commission to consider on the potential extension of the CUP per the newly available information GreenBean had provided at the meeting, and their updated plan for completion of the pending improvements outlined since the 2018 CUP was issued. At the August 21, 2024, meeting, Planning Commission granted a 3-month CUP extension in agreement with GreenBean that their next milestone would be securing of the Caltrans Encroachment Permit to continue the work on the frontage of their property, which GreenBean agreed to and concurred its feasibility.
GreenBean failed to secure their Caltrans Encroachment Permit in due time, therefore at the November Planning Commission meeting the Planning Commission decided to deny the extension request.
As of today’s meeting, GreanBean has submitted a successful Caltrans Encroachment Permit package and has secured the necessary performance and payment bonds to complete the pending improvements listed above.

January 27, 2025
Prepared by Irene Zacarias, City Staff
SUBJECT:
Action: Adoption of Resolution: Approval to Appoint Armando Villegas as the Representative for the City of Woodlake for the Measure R Citizens’ Oversight Committee BACKGROUND:
In November 2006, the voters of Tulare County approved Measure R. Measure R is a ½ cent sales tax that addresses the major regional, local and transit/bike/environmental transportation needs in Tulare County. The implementation of the Measure began in 2007 and will continue through the year 2037.
Measure R is administered by the Tulare County Association of Governments (TCAG).
DISCUSSION:
The Measure’s bylaws called for the establishment of a Citizens’ Oversight Committee. The purpose and duty of the committee is to inform the public, provide input on implementation of the Measure R Expenditure Plan, to advise the TCAG Board if and when the plan needs to be augmented, and to ensure that the funds are being spent in accordance with the plan.
The City of Woodlake was previously represented on the Measure R Citizens’ Oversight Committee by Mike Navarro. The City placed a recruitment notice in the Foothill Sun-Gazette and the City of Woodlake website. An application was submitted by Armando Villegas. The term will run from January 1, 2025 to January 1, 2027.
RECOMMENDATIONS:
City staff recommends that council accept the application and appoint Armando Villegas FISCAL IMPACT:
There is no fiscal impact.

AGENDA ITEM IV-D
January 27, 2025
Prepared by Ramon Lara, City Staff
SUBJECT:
Action: Adoption of Resolution: Approval of the Certificate of Acceptance, Grant Deed and Legal Description for the Property with APN NO. 060-290-067 BACKGROUND:
The property owner(s) of APN No. 060-290-067 are finalizing the design of a future gas station on the southeast corner of Naranjo Blvd. (SR-216) and Mulberry St. The project will include a full-service gas station and shop, landscaping, drainage, lighting and offsite improvements such as curb, gutters, sidewalks and streetlights.
DISCUSSION:
The offsite improvements will be compatible with the City’s Mulberry St. and Naranjo Blvd. (SR216) Roundabout Project. As part of the offsite improvements the developer will need to dedicate those improvements and right-of-way to the City of Woodlake. The City will later dedicate those same improvements and right-of-way to Caltrans as part of the roundabout project as they sit on the Naranjo Blvd. (SR-216) alignment. Please note that a discrepancy was found with the APN No. for the property and the old APN No. is shown in the attachments. That will be fixed before final signature.
RECOMMENDATIONS:
Staff recommend that the City of Woodlake City Council approve the attached Certificate of Acceptance for the Property with APN NO. 060-290-067 and authorize the City Administrator to sign all necessary documents.
FISCAL IMPACT:
There is no direct fiscal impact to the City of Woodlake.
ATTACHMENTS:

Each Agency shall cooperate with VFD in collection efforts for incidents that occur within their respective jurisdictional boundaries. All cost recovery revenue shall be reimbursed to the Agency that incurred the expense. In is recommended Agencies account for Haz-Mat Team expenses incurred by their respective agency in an account separate from other revenues and expenditures.

Agencies agree such reimbursement may be made over a period of up to one year.
Agencies agree that VFD, as the lead agency (and primary location for Haz-Mat Team equipment) shall establish an administrative per incident fee of $300.00 that will be applied to reimburse VFD the administrative costs of assembling the specific personnel that will be responding to each specific hazardous material incident. This per incident fee will only apply when the VFD coordinates a response by the Haz-Mat Team to a request for assistance.
3. REVISION TO DUTIES ON TERMINATION
Parties agree that Section 8 – Termination of the MOU shall be replaced with the following:
TERMINATION
A Party to this Agreement may voluntarily terminate participation upon one hundred eighty (180) calendar days written notice to all other Parties.

This provision does not include the credit received by the City of Hanford for the contribution of the 2007 Pierce Hazardous Materials Unit, which has specific terms applicable in Exhibit “A” should the City of Hanford terminate participation under this MOU.
Notwithstanding a Party’s withdrawal or termination, that Agency may continue to receive cost recovery reimbursements as provided under this Agreement for costs incurred while the Agency operated under this Agreement and provided personnel or equipment to a hazardous material incident prior to termination.

92 Exhibit A
Cost Responsibility
The Agencies agree that each agency shall be responsible for its respective share of costs to operate on an annual basis, the Haz-Mat Team.
The Agencies, by this Agreement have agreed that on an annual basis the Haz-Mat Team should be funded $85,531.71, which amount shall increase annually based on the movement of the unadjusted figures of the U.S. Department of Labor Consumer Price Index (“CPI”) for all Urban Consumers. The amount listed above shall be changed in an amount equal to the percentage of movement for the twelve-month period ending on June 30th for each year this Agreement is effect. In no instance shall the annual increase exceed 5%. Alternatively, the Agencies may agree, in a writing signed by all Agencies, to a different annual increase amount.
The Agencies agree that their share of the annual cost share shall be based on the respective populations of each jurisdiction compared to the total overall population of all participating jurisdictions. As census data is updated then the Agencies agree to update this section of this Agreement based on the most recent census data.
In consideration of the City of Hanford transferring ownership of the 2007 Pierce Hazardous Materials Unit to the City of Visalia for use by the Haz-Mat Team in 2019, the Agencies agreed that Hanford shall be credited as contributing $100,240 or ten (10) years of payments, whichever occurs first. The City of Hanford annual contribution shall be first subtracted from this amount before any additional amounts are owed. As of the date of this Amendment, signed in 2024, the City of Hanford contributions totaled $47,688.28, with $52,551.72 remaining as credits. VFD shall adopt an applicable cost recovery rate for this vehicle that shall be applied to cost recovery charges for the VFD as it will have the responsibility to maintain and operate the unit on behalf of the Haz-Mat Team. In case the City of Hanford terminates this Agreement prior to this credit ending, then the City of Visalia shall either return the 2007 Pierce Hazardous Materials Unit or pay the City of Hanford the outstanding balance of the credit listed in this paragraph to retain the vehicle.
A chart with the breakdown of the operational cost-share and the vehicle replacement is on the following page.
93 * The City of Hanford has a remaining balance on their credit from transferring ownership of the hazmat vehicle to the City of Visalia and this is why there is not an operational or a vehicle replacement cost share amount listed for the City of Hanford. ** The City of Visalia does not have a cost share amount listed for vehicle replacement given Visalia is taking responsibility for 47% of the total cost share as described in the amendment.
The City of Visalia’s cost share portion over the five years of this extension is $352,500. *** Note that if a city decides not to participate and terminates this agreement then they will be removed from the participating list and cause the applicable cost share of participating agencies to increase. If additional cities agree to participate, then the total population and corresponding share of costs will decrease.

AGENDA ITEM V-C
January 27, 2025
Prepared by Ramon Lara, City Staff
SUBJECT:
Action: Adoption of Resolution: Approval of the License Agreement Between the Woodlake Unified School District and the City of Woodlake for the Castle Rock Elementary School South Fields
BACKGROUND:
As part of the City of Woodlake’s continued effort to develop its Parks and Recreation programs it has been working the Woodlake Unified School District to partner on the construction and redevelopment of facilities. In 2018 the City entered into a license agreement with the Woodlake Unified School District for the north Castle Rock field as seen in Attachment No. 2 and added the following:
• Two regulation softball/baseball fields, which includes fencing, concrete pads, irrigation, soil conditioners, grass.
• A regulation soccer field, which may be used as two youth soccer fields and shall include irrigation, grass, goal posts.
• Restrooms and storage
• A fence separating the North and South fields.
The City maintains and operates the facility. As part of the mutually beneficial agreement, the Woodlake Unified School District has priority to the fields followed by the City of Woodlake Parks and Recreation Department. Any third-party requests to use the facility would go through the City of Woodlake.
DISCUSSION:
The City’s Park and Recreation has continued to expand, and this year had approximately six hundred kids in its youth soccer league. This has created a demand for more fields for games and practices. Attachment No. 1 would serve as the license agreement of the south fields at Castle Rock Elementary. This license agreement would also supersede previously approved Resolution No. 24-102 that was approved by Council on October 14, 2024, for the same south fields.
The fields have been rehabbed by City staff and will be maintained and operated by the City of Woodlake until the Woodlake Unified School District has the staffing to take over maintenance.
The fields provide more space for the City of Woodlake Parks and Recreation Department and Castle Rock Elementary students.
RECOMMENDATIONS:
105
Staff recommend that the City Council approve the attached license agreement between the Woodlake Unified School District and the City of Woodlake for the Castle Rock Elementary School south fields. This project will help in the continued development of the City of Woodlake’s Park and Recreation while providing more outdoor opportunities for the entire community.
FISCAL IMPACT:
The fields would be maintained by the City’s Public Works Department temporarily.
Improvements to the fields would be made with Measure R funding and WUSD funding. The total cost to the City for the field improvements is under ten thousand dollars.
