SUBJECT:

Action: Adoption of Resolution: Approval of March 2025 Monthly Report of Investments BACKGROUND:

Pursuant to Section 3.24.050 of the Woodlake Municipal Code the Finance Department prepares a report listing all investments of the City of Woodlake. The second objective is to match the availability (liquidity) of the funds to the cash flow needs of the organization. The third objective, that is only considered after the first two objectives have been met, is yield, or the earnings rate.

RECOMMENDATIONS:

Staff recommends that the Council approve the March 2025 Monthly Report of Investments as submitted.

SUBJECT:

Action: Adoption of Resolution: Authorize the City Administrator to File the Regional Surface Transportation Program (RSTP) Exchange Program Fund Claim for Fiscal Year 2024-2025 on Behalf of the City of Woodlake and Allow the City Administrator to Sign Necessary Documentation
BACKGROUND:

Annually, Caltrans and the Tulare County Association of Governments enter into a Standard Agreement contract that includes an RSTP Exchange Program. The contract allows for the exchange of unobligated balances of federal Regional Surface Transportation Program funds with non-federal State Highway Account funds. TCAG then applies a RSTP population-based distribution formula using current Department of Finance (DOF) population estimates (January 2025) to the RSTP apportionment to determine the amount of RSTP Exchange funds to be distribution to TCAG member jurisdictions.

DISCUSSION:

For Fiscal Year 2024-2025 the City of Woodlake has an estimated RSTP Exchange Program fund apportionment amount available to claim in the amount of forty-nine thousand six hundred and fifty dollars and sixty-one cents ($49,650.61). The funds are to be accounted for in the STP Fund and the City uses them for rehab and maintenance projects.

RECOMMENDATIONS:

Authorize the City Administrator to sign and file the FY 2024-2025 RSTP Exchange Program fund claim on behalf of the City of Woodlake in the amount of forty-nine thousand six hundred and fifty dollars and sixty-one cents ($49,650.61). The funds are to be accounted for in the STP Fund to be used by the City for rehab and maintenance projects.

FISCAL IMPACT:

There is no fiscal impact to the City of Woodlake General Fund. The funds, when received, will be accounted for in the STP Fund and the City will use them for rehab and maintenance projects as budgeted.

Councilmember ________, offered the following resolution and moved its adoption. Authorize the City Administrator to File the Regional Surface Transportation Program Exchange Program Fund Claim for Fiscal Year 2024-2025 on behalf of the City of Woodlake.

WHEREAS, the Tulare County Association of Governments (TCAG) and the California Department of Transportation (Caltrans) have entered into a Standard Agreement contract to exchange unobligated balances of federal Regional Surface Transportation Program (RSTP) funds with non-federal State Highway Account funds; and
WHEREAS, Caltrans Division of Programming releases a 5-year ESTIMATE of RSTP Exchange Program apportionments for inclusion in the Federal Transportation Improvement Program (FTIP) Programming document every 2-years to California Metropolitan Planning Organizations (MPOs); WHEREAS, TCAG is the designated MPO for Tulare County;
WHEREAS, the Annual RSTP Exchange Program fund apportionment is an ESTIMATE and subject to change during the fiscal year (2024-2025) due to many Federal Surface Transportation Bill variables including the annual appropriations act as well as other Congressional action (i.e. rescissions);
WHEREAS, a FINAL RSTP Exchange apportionment amount is published at the end of the FY 24- 25 and can be different than the ESTIMATE RSTP Exchange apportionment figure; WHEREAS, Annually, Caltrans sends TCAG a Standard Agreement contract that includes an RSTP Exchange Program apportionment figure;
WHEREAS, TCAG applies a RSTP population based distribution formula using current Department of Finance (DOF) population estimates (January 2025) to the RSTP apportionment to determine the amount of RSTP Exchange funds to be distribution to TCAG member jurisdictions; WHEREAS, the City of Woodlake has an ESTIMATE RSTP Exchange Program fund apportionment amount available to claim in FY 24-25 is forty-nine thousand six hundred and fifty dollars and sixty-one cents ($49,650.61).

WHEREAS, payment of the ESTIMATE RSTP Exchange fund claim will be subject to all conditions specified in the fully executed standard contract agreement between TCAG and Caltrans, as well as the TCAG RSTP Exchange Claim form requirements: Projects to be funded with this 124
claim are only those projects that are defined under Sections 133(b) and 133(c) of Title 23, United States Code and Article XIX of the California State Constitution, implemented in accordance with the requirements of Section 182.6(d)(1) of the Streets and Highways Code.

WHEREAS, if the FINAL RSTP Exchange apportionment figure is higher for FY 24-25 than the ESTIMATE RSTP Exchange apportionment figure, Caltrans would have to revise the RSTP Exchange Standard Agreement contract with the higher RSTP figure before TCAG could instruct the Tulare County Auditor Controller’s Officer to distribute a greater amount of RSTP Exchange Program funds to member agencies, than identified in this resolution; WHEREAS, if the FINAL RSTP Exchange apportionment figure is lower for FY 24-25 than the ESTIMATE RSTP Exchange apportionment amount, Caltrans does not have to revise the RSTP Exchange contract with the lower amount before TCAG could recalculate the available RSTP Exchange Program funds using the same population-based formula and then instruct the Tulare County Auditor Controller’s Officer to distribute the lower FY 24-25 FINAL RSTP Exchange Program fund amount to member agencies;
WHEREAS, the City of Woodlake has established special gas tax street improvement fund as a requirement to receive the RSTP Exchange Program funds; and WHEREAS, it is deemed in the best interest of the City of Woodlake the City Administrator is authorized to sign the FY 24-25 RSTP Exchange Program fund claim form and to submit said claim form to TCAG for processing.

NOW THEREFORE, be it resolved that the City Administrator of the City of Woodlake is authorized and directed to sign and file the FY 24-25 RSTP Exchange Program fund claim on behalf of the City of Woodlake in the amount of forty-nine thousand six hundred and fifty dollars and sixty-one cents ($49,650.61)

At the Planning Commission meeting on March 19, 2025 the Planning Commission approved the Tentative Subdivision Map with Conditions of Approval in accordance with Subdivision Ordinance Chapter 16.04.

DISCUSSION:

The tentative subdivision map is planning to subdivide approximately 80 acres into 271 parcels for a subdivision consisting of medium density residential (approximately 183 lots), low density (approximately 88 lots), and four green park spaces. The lots range in size from 5,036 sf – 11,295 sf.

The site is currently vacant land but formerly was an olive and citrus orchard. The site is surrounded by farming to the east and north. On the southeast portion of the site lies the community of Wells Tract. There is housing and a school to the west plus industrial to the south.

All services will be connected to City utilities. A storm drain system will be developed to convey stormwater throughout the subdivision into two (2) stormwater retention basins. Any stormwater overflow may eventually be conveyed into the City stormwater system.

The applicant supported the tentative subdivision map submission with a Drainage Study, Biological Resources Evaluation, Traffic Impact Study, and a Cultural Resources Investigation.

The City will also require the applicant to enter into a subdivision improvement agreement with the City that further outlines the development standards of the subdivision.

ENVIRONMENTAL DOCUMENT:

A focused environmental analysis was conducted and a CEQA 15183 Streamlined Exemption Compliance Memo has been completed for this project; the project is consistent with the Woodlake General Plan Environmental Impact Report.

April 14, 2025

SUBJECT:

Action: Adoption of Resolution: Approve the 3-month Uncle Green Conditional Use Permit Extension Request with Conditions – PUBLIC HEARING
BACKGROUND:

The Woodlake Municipal Code allows for 3 maximum extensions per Conditional Use Permit. The City requires an Extension Application for any Conditional Use Permit which has not met conditions of approval and would like to apply for an extension to meet the conditions. The City may choose to extend CUPs to allow a business time to fully meet all the conditions listed in the CUP. A CUP permit extension request can be denied by the Planning Commission. An applicant who had their CUP extension denied may appeal the decision to City Council per Woodlake Municipal Code procedures set in Chapter 17.70 Permits and Applications.

For Cannabis businesses, in order to maintain a CUP in good standing the business must also not fail to pay their regulatory fees and cannabis taxes in a timely manner, as stated in Woodlake Municipal Code Chapter 5.48 – Suspension and Revocation of Regulatory Permit or Employee Permit.

DISCUSSION:

Uncle Green had a renewed CUP application approved on February 21, 2024, subject to a 3-month expiration in order to complete the following conditions:

CUPs 18-001 Cultivation, 18-002 Manufacturing, 18-003 Distribution, and 21-006 Non-Storefront Retail - Uncle Green. Meet all City Development Standards and State Building Code Requirements.

Meet all State Requirements, laws, and regulations for cannabis businesses in the State of California.

Construct curb, gutters, sidewalks, streetlights on Naranjo (SR-216) and Road 196 need to be installed to meet design standards established by the City. All sidewalk areas and parking shall have ADA access and meet the design standards established by the City. Construction and install landscaping and irrigation in compliance with City’s design standards.

Uncle Green was granted a 6-month extension on May 15, 2024, to continue progress towards the outstanding conditions required of the Conditional Use Permit as detailed in the paragraph above. At the time of the 6-month extension, Uncle Green’s cannabis business license was in good standing regarding City taxes and regulatory fees owed to the City.

Uncle Green’s 6-month extension expired in November 2024. During November 2024 Uncle Green’s cannabis business license was no longer in good standing, as the City cannabis taxes and regulatory fees were outstanding, with cannabis taxes and regulatory fees being three quarters delinquent. Due to Uncle Green’s taxes and regulatory fees outstanding balance, their conditional use permit extension request at the November Planning Commission was denied by the Planning Commission. 144
The City staff met with Uncle Green ownership on April 4th, 2025, to discuss the businesses plan to remedy the delinquent taxes and fees. Uncle Green made a payment in April 2025 towards their regulatory fees balance and cannabis taxes balance.

RECOMMENDATIONS:

City staff is recommending that City Council approve a 3-month Conditional Use Permit extension due to Uncle Green submitting payment in April 2025 towards their delinquent regulatory fees and taxes, and for passing their annual compliance inspection on April 4th, 2025. Uncle Green has a business plan in place to catch up on their outstanding balance payment plan by the end of the fiscal year 2024/2025.

FISCAL IMPACT:

Currently Uncle Green should pay approximately $132,000 annually in cannabis taxes to the City of Woodlake General Fund.

AGENDA ITEM V-E
April 14, 2025
Prepared by Emmanuel Llamas, City Staff
SUBJECT:

Action: Adoption of Resolution: Approve the 3-month GreenBean Conditional Use Permit Extension Request with Conditions – PUBLIC HEARING

DISCUSSION:

GreenBean was issued its first Conditional Use Permit in January of 2018. Since that date, GreenBean was subject to a 3-month extension in September 2020, a 6-month renewal in January of 2022, a 6-month extension on July 2022, a 6-month extension on February 2023, a 3-month extension on August 2023, a renewed CUP in November 2023, a 3-month extension on February 21,2024, and a 1-month extension on May 15, 2024.

GreenBean was lastly subject to a 3-month extension on August 21, 2024, subject to the same conditions required from the 2018 CUP, which are listed below:

CUP 17-011 Retail - GreenBean. Complete all off-site improvements including, but not limited to, the construction of curb, gutters, sidewalks, drive approaches, and completed landscaping along Naranjo Blvd (SR-216).

At the August 21, 2024, Planning Commission meeting the staff had no formal recommendation for the Planning Commission, but instead presented in the staff report options for Planning Commission to consider on the potential extension of the CUP per the newly available information GreenBean had provided at the meeting, and their updated plan for completion of the pending improvements outlined since the 2018 CUP was issued. At the August 21, 2024, meeting, Planning Commission granted a 3- month CUP extension in agreement with GreenBean that their next milestone would be securing of the Caltrans Encroachment Permit to continue the work on the frontage of their property, which GreenBean agreed to and concurred its feasibility.

GreenBean failed to secure their Caltrans Encroachment Permit in due time, therefore at the November Planning Commission meeting the Planning Commission decided to deny the extension request.

At the time of the City Council meeting on January 13, 2025, GreanBean had submitted a successful Caltrans Encroachment Permit package and has secured the necessary performance and payment bonds to 148
complete the pending improvements listed above; therefore, at the January 13, 2025, Council meeting GreenBean’s request for an appeal to the CUP extension request decision by Planning Commission was approved by City Council.

As of today’s meeting, GreenBean has received their Caltrans Encroachment Permit, has received their Southern California Edison plans for their street light conduit work, and their contractor is scheduled to complete the pending improvements by June 2025.

RECOMMENDATIONS:

At this time, City staff is recommending that City Council approve a 3-month Conditional Use Permit extension due to GreenBean securing their Caltrans Encroachment Permit, securing the necessary performance and payment bonds, and securing the new Southern California Edison facilities design map in order to proceed with the completion of the pending conditions of their CUP. GreenBean is in good standing regarding their tax payments and regulatory fees.

FISCAL IMPACT:

Currently GreenBean pays approximately $190,000 annually in cannabis taxes to the City of Woodlake General Fund.
