B. Action: Adoption of Resolution: Formally Dissolve the Successor Agency and Request that the Countywide Oversight Board for the Tulare County Approve the Dissolution of the Woodlake Successor Redevelopment Agency
City Administrator Lara reported the following: On December 29, 2011, the California Supreme Court upheld Assembly Bill 1x 26 (the “Dissolution Act”) and directed all redevelopment agencies in the state be dissolved effective February 01, 2012. On January 09, 2012, the City Council of the City of Woodlake elected to serve as the governing board of the Successor Agency to the dissolved Redevelopment Agency. 1 Pursuant to Health & Safety Code Section ("HSC") 34187(b ), when all enforceable obligations have been retired or paid off, all real property has been disposed of pursuant to HSC 34181 or 34191.4, and all outstanding litigation has been resolved, a successor agency shall, submit to the oversight board a request, with a copy of the request to the County Auditor-Controller, to formally dissolve the successor agency. The Oversight Board is to approve the request and submit it to the State Department of Finance ("DOF").
Pursuant to Health and Safety Code Section 34179(j), the locally established Woodalke Oversight Board was dissolved and the Tulare County Oversight Board took over this role.
The Successor Agency to the Dissolved Redevelopment Agency of the City of Woodlake (the "Successor Agency") received its final funds for Enforceable Obligations on December 20, 2024 for the period of July 2024 to December 2025. These funds along with earned interest, were sufficient to cover the final debt service payment to USDA for the Woodlake Airport. The final debt service payment, in the amount of $44,907.50 was made on July 17th 2025. The remaining cash amounted to $318.31 and was remitted to Tulare County Auditor/Controller. Once that payment had been made, all enforceable obligations have been paid off and all real property has been disposed of pursuant to HSC 34181 or 34191.4. Finally, there is no outstanding litigation for the Woodlake Successor Redevelopment Agency.
ON A MOTION BY MARTINEZ SECOND BY VALERO IT WAS VOTED TO
ADOPT THE RESOLUTION AND FORMALLY DISSOLVE THE SUCCESSOR
AGENGY AND REQUEST THAT THE COUNTYWIDE OVERSIGHT BOARD
FOR THE TULARE COUNTY APPROVE THE DISSOLUTION OF THE
WOODLAKE SUCCESSOR REDEVELOPMENT AGENCY. APPROVED
UNAIMOUSLY BY ROLL CALL VOTE.
C. Action: Adoption of Resolution: Approve the 3-month GreenBean Conditional Use Permit Extension Request with Conditions – PUBLIC COMMENT Community Development Director Llamas reported the following: The Woodlake Municipal Code allows for 3 maximum extensions per Conditional Use Permit. The City requires an Extension Application for any Conditional Use Permit which has not met conditions of approval and would like to apply for an extension to meet the conditions. The City may choose to extend CUPs to allow a business time to fully meet all the conditions listed in the CUP. A CUP permit extension request can be denied by the Planning Commission. An applicant who had their CUP extension denied may appeal the decision to City Council per Woodlake Municipal Code procedures set in Chapter 17.70 Permits and Applications.
GreenBean was issued its first Conditional Use Permit in January of 2018. Since that date, GreenBean was subject to multiple extensions and a renewed Conditional Use Permit after exhausting the allowable extensions under one CUP.
At the August 21, 2024, meeting, Planning Commission granted a 3-month CUP extension in agreement with GreenBean that their next milestone would be securing of the Caltrans Encroachment Permit to continue the work on the frontage of their property, which GreenBean agreed to and concurred its feasibility.
GreenBean failed to secure their Caltrans Encroachment Permit in due time, therefore at the November Planning Commission meeting the Planning Commission decided to deny the extension request.
At the time of the City Council meeting on January 13, 2025, GreanBean had submitted a successful Caltrans Encroachment Permit package and has secured the necessary performance and payment bonds to complete the pending improvements listed above; therefore, at the January 13, 2025, Council meeting GreenBean’s request for an appeal to the CUP extension request decision by Planning Commission was approved by City Council.
GreenBean was lastly subject to a 3-month extension on April 14, 2025, subject to the same conditions required from the 2018 CUP, which are listed below:
2 CUP 17-011 Retail - GreenBean. Complete all off-site improvements including, but not limited to, the construction of curb, gutters, sidewalks, drive approaches, and completed landscaping along Naranjo Blvd (SR-216).
GreenBean was on schedule to complete their off-site improvements as shared on their schedule at the April 14, 2025, City Council meeting, however do to an issue identified in the field by the Caltrans Inspection team the GreenBean engineering consultant was requested to resubmit a section of their design which pertained to the cross slopes along the roadway shoulder of the projects on State Route 216. This issue was not identified by the Caltrans Encroachment Permit department when the previous Caltrans permit was issued, therefore it was an unforeseen issue for the GreenBean design engineer and contractor to address once brought to their attention by the Caltrans Inspector. This situation caused the schedule to be delayed, and required the GreenBean contractor to remove curb and gutter forming work which was installed, and is now required to reinstall to accommodate the issues identified in the field.
As of today’s meeting, GreenBean has received an extension to their Caltrans Encroachment Permit, has received their Southern California Edison plans for their street light conduit work, and their contractor is scheduled to complete the pending improvements within 3 months. The GreanBean team’s design engineer, contractor, City’s Capital Projects Director, and Caltrans inspection team all met in the field on July 21st and have identified a solution moving forward.
At this time, City staff is recommending that City Council approve a 3-month Conditional Use Permit extension due to GreenBean securing their Caltrans Encroachment Permit extension, securing the necessary performance and payment bonds, securing the new Southern California Edison facilities design map in order to proceed with the completion of the pending conditions of their CUP, and identifying the necessary correction to the field identified issues to their projects shoulder work improvements. GreenBean is in good standing regarding their tax payments and regulatory fees.
PUBLIC COMMENT OPENED: 6:51 PM
PUBLIC COMMENT CLOSED 6:52 PM
ON A MOTION BY MARTINEZ SECOND BY VALERO IT WAS VOTED TO ADOPT THE RESOLUTION AND APPROVE THE 3-MONTH GREENBEAN
CONDITIONAL USE PERMIT EXTENSION REQUEST WITH CONDITIONS.
APPROVED UNANIMOUSLY BY ROLL CALL VOTE.
D. Action: Adoption of Resolution: Approve the 3-month Uncle Green Conditional Use Permit Extension Request with Conditions and Require Uncle Green to Pay Off any Outstanding Regulatory Fees and Taxes by November 2025 – PUBLIC HEARING Community Development Director Llamas reported the following: The Woodlake Municipal Code allows for 3 maximum extensions per Conditional Use Permit.
For Cannabis businesses, in order to maintain a CUP in good standing the business must also not fail to pay their regulatory fees and cannabis taxes in a timely manner, as stated in Woodlake Municipal Code Chapter 5.48 – Suspension and Revocation of Regulatory Permit or Employee Permit.
Uncle Green had a renewed CUP application approved on February 21, 2024, subject to a 3-month expiration in order to complete the following conditions:
CUPs 18-001 Cultivation, 18-002 Manufacturing, 18-003 Distribution, and 21-006 Non-Storefront Retail - Uncle Green. Meet all City Development Standards and State Building Code Requirements. Meet all State Requirements, laws, and regulations for cannabis businesses in the State of California. Construct curb, gutters, sidewalks, 3 streetlights on Naranjo (SR-216) and Road 196 need to be installed to meet design standards established by the City. All sidewalk areas and parking shall have ADA access and meet the design standards established by the City. Construction and install landscaping and irrigation in compliance with City’s design standards.
Uncle Green was granted a 6-month extension on May 15, 2024, to continue progress towards the outstanding conditions required of the Conditional Use Permit as detailed in the paragraph above. At the time of the 6-month extension, Uncle Green’s cannabis business license was in good standing regarding City taxes and regulatory fees owed to the City.
Uncle Green’s 6-month extension expired in November 2024. During November 2024 Uncle Green’s cannabis business license was no longer in good standing, as the City cannabis taxes and regulatory fees were outstanding, with cannabis taxes and regulatory fees being three quarters delinquent. Due to Uncle Green’s taxes and regulatory fees outstanding balance, their conditional use permit extension request at the November Planning Commission was denied by the Planning Commission.
Uncle Green appealed the denied extension from the Planning Commission, and the extension request was considered at the January 13, 2025 City Council Meeting. City Council at the January 13, 2025, meeting agreed to extend the CUP for 3 months, and once again agreed to a 3 month extension lastly at the April 14, 2025 Council Meeting. These extension were granted due to Uncle Green making some progress payments on their outstanding balances, and due to the incidents which caused hardship for Uncle Green during the Spring of 2025.
The City staff met with Uncle Green ownership on July 11th, 2025, to discuss the businesses plan to remedy the delinquent taxes and fees. Uncle Green made a payment in August 2025 towards their regulatory fees balance and cannabis taxes balance.
City staff is recommending that City Council approve a 3-month Conditional Use Permit extension to allow Uncle Green to pay off their outstanding regulatory fees balance and taxes. Progress was made towards those balances as Uncle Green did submit payment in August 2025 towards their delinquent regulatory fees and taxes.
Uncle Green has assured to City staff that they have a business plan in place to catch up on their outstanding balance by November 2025.
PUBLIC COMMENT OPENED: 6:56 PM
Shirley Moran, 377 Holly, Woodlake – Ms. Moran asked this business owes money. CDD Llamas reported the fees owed are for taxes and regulatory fees owned to the City of Woodlake. These fees are outlined in their CUP and if fees are not paid, their CUP may be revoked.
PUBLIC COMMENT CLOSED: 6:59 PM

This indemnification shall extend beyond termination of employment and the otherwise expiration of this Agreement to provide protection for any such acts undertaken or committed in the City Administrator’s capacity as City Administrator, regardless of whether the notice of filing of a lawsuit occurs during or following employment with the City. This indemnity provision shall survive the termination of the Agreement and is in addition to any other rights or remedies that the City Administrator may have under the law.
(4) The City and all parties claiming under or through it, hereby waives all rights of subrogation and contribution against the City Administrator, while acting within the scope of the City Administrator's duties, from all claims, losses and liabilities arising out of or incident to activities or operations performed by or on behalf of the City or any party affiliated with or otherwise claiming under or through it, regardless of any prior, concurrent, or subsequent active or passive negligence by the City Administrator.
