What did entity or emptoyee do to cause this [oss, damage or injury? On December 24,2025, at approximatety 6:00 p.m., claimant Adan Rios was tawfutty riding a bicycte on Cypress St. at or near 370 N Cypress St in the City of Woodlake, County of Tutare. The drainage opening was missing its cover and had been altowed to remain uncovered, unsecured, and unrepaired. As a resutt, ctaimantwas thrown forward from the bicycte and fett face-first onto the pavement.

The uncovered drainage opening constituted a dangerous condition of publ.ic property within the meaning of Government Code sections 830 and 835. The condition created a substantiat risk of injury to bicycLists and other members of the pubtic using the roadway with due care, and it created a reasonabty foreseeabte risk of the kind of injury claimant in fact sustained.

The City of Woodtake is tiabte pursuant to Government Code sections 815, 830, 835, and 835.2. The City owned, controlted, maintained , and/or was responsibte for the roadway and drainage system where the incident occurred. Code S 835(a)); and/or the City had actuaI and/or constructive notice of the dangerous condition a sufficient time prior to the incident to have taken measures to protect against it (Gov. Code SS 835(b), 835.2). The City negl.igentty and wrongf utl,y faited to inspect, cover, secure, maintain, repair, or replace the drainage cover, and faited to warn the pubtic of the dangerous condition.

As a direct and proximate resutt of the dangerous condition, claimant sustained severe faciaL injuries, inctuding fractures of the inferior orbitat watt, laterat orbitat wat[, maxitlary sinus, nasal bone, pterygoid ptate, and zygomatic arch, together with faciat tacerations.

Ctaimant required surgical intervention and continues to undergo treatment. Ctaimant has incurred and witt continue to incur medical and retated expenses, loss of earnings andlor earning capacity, and generaI damages for pain, suffering, and disabitity, in amounts to be determined. Because the amount of this ctaim exceeds $10,000, no specific dol,tar amount is stated pursuant to Government Code section 910, subdivision (f). Jurisdiction would rest in untimited civiI court.

AGENDA ITEM V-D
September 28, 2026
Prepared by Emmanuel Llamas, City Staff
SUBJECT:

Action: Adoption of Resolution: Revocation of Conditional Use Permit for the Uncle Green Cannabis Business and Property Per Noncompliance with Required Conditions. – Public Hearing
BACKGROUND:

For a Cannabis business to maintain their City-issued regulatory permit, it must abide by Woodlake Municipal Code Chapter 5.48 Cannabis Businesses. Specifically, Section 5.48.140 Suspension and Revocation of Regulatory Permit or Employee Permit outlines the requirements to avoid suspension or revocation of the regulatory permit.

The cannabis business regulatory permit may be suspended or revoked by City Council if any of the following occur.

1. The Cannabis Operation is conducted in violation of any provision of this section, State Law, or any other applicable State law.

2. The Cannabis Operation is conducted in such a manner as to create a public or private nuisance.

3. A failure to pay the Regulatory Fee or Revenue Raising Fee required by this section.

4. A failure to take reasonable measures to control patron conduct, where applicable, resulting in disturbances, vandalism, or crowd control problems occurring inside of or outside the Premises, traffic control problems, or obstruction of the operation of another business.

5. A failure to comply with the terms and conditions of the Regulatory Permit or any conditional use permit issued in connection therewith.

6. Any act which would be considered grounds for denial of the Regulatory Permit in the first instance.
(See, Woodlake Municipal Code section 17.74.080).

For Cannabis businesses, in order to maintain a CUP in good standing the business must also not fail to pay their regulatory fees and cannabis taxes in a timely manner, as stated in Woodlake Municipal Code Chapter 5.48 – Suspension and Revocation of Regulatory Permit or Employee Permit.

DISCUSSION:

Uncle Green had a conditional use permit issued to the cannabis business originally on November 26, 2018. The CUP has renewed and extended multiple times to allow the business to work towards getting their business established in the market, and to allow the business time to complete the following conditions:
77 CUPs 18-001 Cultivation, 18-002 Manufacturing, 18-003 Distribution, and 21-006 NonStorefront Retail - Uncle Green. Meet all City Development Standards and State Building Code Requirements. Meet all State Requirements, laws, and regulations for cannabis businesses in the State of California. Construct curb, gutters, sidewalks, streetlights on Naranjo (SR-216) and Road 196 need to be installed to meet design standards established by the City. All sidewalk areas and parking shall have ADA access and meet the design standards established by the City.

Construction and install landscaping and irrigation in compliance with City’s design standards.

During November 2024 Uncle Green’s cannabis business license was no longer in good standing in accordance with Woodlake Municipal Code Chapter 5.48 Cannabis Businesses, as the City cannabis taxes and regulatory fees were outstanding, with cannabis taxes and regulatory fees being three quarters delinquent. Due to Uncle Green’s taxes and regulatory fees outstanding balance, their conditional use permit extension request at the November 2024 Planning Commission meeting was denied by the Planning Commission.

Uncle Green appealed the denied extension from the Planning Commission, and the extension request was considered at the January 13, 2025, City Council Meeting. City Council at the January 13, 2025, meeting agreed to extend the CUP for 3 months, and once again agreed to a 3- month extension at the April 14, 2025, Council Meeting. These extensions were granted due to Uncle Green making some progress payments on their outstanding balances, and due to the incidents, which caused hardship for Uncle Green during the Spring of 2025.

On November 24, 2025, the City was made aware, via email, by Ryan Baker, the CEO and President of Verax Business Group that he was appointed by the Superior Court of California as Receiver over Uncle Green and Mogul Investments. A copy of the signed and filed court order by the Superior Court of Tulare County was sent to the City via email by Mr. Baker.

Mr. Baker from Verax Business Group has been in constant communication with City staff to inform staff on progress made to bring the property into compliance for a business to operate at the location. Since the last extension was granted to Verax Business Group, the receivership organization has:
• Entered into an agreement with Mell & Associates engineering firm to complete the civil off-site plans for the pending offsite improvements at the property, Mell & Associates have submitted revised civil plans for this task.
• Entered into an agreement with a brokerage group, Green Life Business Group, to do the marketing and sale process for the property to secure a new business owner to occupy the property.
• Renewed the State Cannabis Medium Indoor License #CCL19-0002610. • Re-established utility services at the property with all utility owners, including City services.
• Restored fire protection monitoring services at the property.

Since summer of 2026, the property has been taken into control and ownership by the lender on the property, Pelorus Fund LLC. Since Pelorus Fund LLC has taken control of the property, there has been insufficient progress made on the pending conditions, specifically any progress on the pending off-site civil improvements.
78 Due to the lack of progress on the required off-site civil improvements, and no clear path to substantial compliance with the permit requirements, City staff is recommending the CUP be revoked from the Uncle Green business and property.

RECOMMENDATIONS:

City staff is recommending that City Council revokes the Conditional Use Permit from the Uncle Green Cannabis Business and Property Per Noncompliance with Required Conditions.

FISCAL IMPACT:

Currently Uncle Green should pay approximately $132,000 annually in cannabis taxes to the City of Woodlake General Fund; however, Uncle Green has not generated tax revenue nor payments on taxes of fees since 2024.
