Report to Town Council Agenda Item 1
From: Jean Savaree, Town Attorney January 6, 2023

SUBJECT: Adopt Resolution Ratifying the Town Manager’s Proclaiming of a Local Emergency Related to the Severe Wind and Rainstorms that Commenced on December 31, 2022

RECOMMENDATION
It is recommended that the Town Council adopt the attached Resolution ratifying the Town Manager’s proclamation of a Local Emergency, ratifying the Town Manager’s immediate expenditure of public funds to respond to the emergency, and authorizing the Town Manager to request financial assistance from County, State, and Federal authorities.

EXECUTIVE SUMMARY
Beginning on December 31, 2022, Northern California experienced severe wind and rainstorms, which caused culverts and bridges throughout the Town of Woodside to become blocked with vegetation and other debris, causing road closures and threating to cause damage to public and private property. The Town Center Sewer Pump also became flooded at times, requiring monitoring and a temporary bypass sewage line to minimize overflows and maintain system flow. At the time of drafting this report, emergency work to protect the safety of persons and property is ongoing. The Town Manager will provide additional details regarding the work performed during his oral staff report.

On December 31, 2022, pursuant to Chapter 33 of the Woodside Municipal Code and Government Code Section 8630, the Town Manager, acting as the Director of Emergency Services for the Town, issued an initial Resolution Proclaiming the Existence of a Local Emergency. The resolution authorized the Town Manager to expend Town funds needed to respond to the emergency and allowed the Town Manager to have damaged or destroyed public facilities such as water, sewer, storm water, streets and other facilities repaired or replaced without the necessity of using the public bid process.

Subsequently, the Town Manager issued a Second Resolution Proclaiming Existence of a Local Emergency, in which financial assistance from County, State, and Federal agencies, including the Federal Emergency Management Agency (FEMA) and California Emergency Management Agency (Cal-EMA), was requested.

Pursuant to Section 33.03(B), the Town Council must ratify the Town Manager’s proclamation within seven days. Government Code Section 8630 requires the Council to revisit the need for continuing the Local Emergency at least once every 60 days, and that the Council proclaim the termination of the Local Emergency at the earliest possible date that conditions warrant.

For this reason, the Town Manager will report on the status of the Local Emergency at each of the Council’s regular meetings until the Council proclaims its termination.
