TOWN OF WOODSIDE
Report to Town Council Agenda Item 2
From: Sage Schaan, Planning Director April 11, 2023
Approved by: Kevin Bryant, Town Manager
SUBJECT: RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE A CONTRACT WITH REGIONAL GOVERNMENT SERVICES (RGS) IN THE AMOUNT NOT-TOEXCEED $33,015 FOR PREPARATION OF AN INITIAL STUDY AND
SUBSEQUENT ENVIRONMENTAL REVIEW DOCUMENT PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) EVALUATING A
PROPOSAL TO DIVIDE ONE PARCEL INTO SEVEN PARCELS AND TO CONSTRUCT A NEW PRIVATE ROAD AT 1101 CAÑADA ROAD
RECOMMENDATION
Staff recommends that the Town Council adopt the attached resolution authorizing the Town Manager to execute a consultant contract to prepare the necessary California Environmental Quality Act (CEQA) documents for a project at 1101 Cañada Road.
DISCUSSION
The Town received an application for a proposed subdivision to divide one parcel into seven parcels and to construct a new private road at 1101 Cañada Road. As part of the Town review and processing of the application compliance with the California Environmental Quality Act (CEQA)is required. The Town sent out a Request for Proposal (RFP) to three firms, two of which provided proposals to the Town. While both proposals outlined work items consistent with the RFP, one firm (RGS) provided a lower cost and shorter timeline, both of which are important to the applicant. Given the lower cost and shorter timeline, the Town selected RGS to complete the CEQA review for the project.
Although the consultant services will be paid for by the property owner proposing the project, the contract needs to be secured through the Town.
Since the contract exceeds $10,000, the Town Council must authorize the Town Manager to execute the contract.
CONCLUSION
It is recommended that the Town Council adopt the attached resolution authorizing the Town Manager to execute a contract with RGS for CEQA review and processing in the amount not-to-exceed $33,015.

PROJECT UNDERSTANDING
The Town of Woodside (“Town”)isrequesting consultantservices to complete an environmental initial study for a proposed subdivision project in accordance with the California Environmental Quality Act (“CEQA”). The application requests approval of a Tentative Map to subdivide one 7.79-acre parcel into seven parcels that would each be approximately one acre in size, located at 1101 Cañada Road, Woodside, CA.
The parcel is adjacent to CañadaRoad, which is a locally designated Scenic Road. The project includes the demolition of an existing single-family residence that had previously been used as a church, and the construction of a new road. The new road and lot configurations will involve significant grading that will require Town approval of a Grading Exception. The project will also include a General Plan Amendment to change the land use designation from Institutional to Residential. The property was designated Institutional to accommodate its prior church use. The Woodside Municipal Code requires conceptual building and development envelopes to be shown as part of the application but does not include any development on any of the proposed lots.
SCOPE OF WORK
TASK 1: PROJECT MANAGEMENT
Initial Meeting and Data Acquisition
Upon receipt of a notice to proceed, a project kickoff meeting with the Consultant (RGS) advisors and Town staff will be conducted to confirm any adjustments or changes to: 1) the scope of work for the project, 2) the schedule for preparation of the Initial Study and CEQA determination, and 3) the nature of the project and/or any issues that might represent a potential environmental concern. RGS will provide continuous project oversight to keep the production, processing, and presentation of RGS assigned tasks on schedule and within budget. The RGS Team manager will assume the responsibility for all final work products and deliverables.
Project Management and Administration
RGS will coordinate with Town staff through the duration of the project. RGS will manage the scope, cost and schedule to ensure that the CEQA review is completed in accordance with the professional services agreement between RGS and the Town. Periodic check in meetings or consultations with Town staff will be incorporated into the project scope at intervals based on project deliverables, including the Administrative Draft, Public Review Draft, Response to Comments, and Final CEQA Determination/Mitigation Monitoring Program.
Item 2 Page 5

TASK 2: DATA ACQUISITION AND REVIEW
Acquire Project Data and Review Technical Studies
RGS has obtained several technicalstudiesthat the Applicant had prepared for the project, including:
• Preliminary Title Report, dated March 18, 2022
• Will Serve Letters from PG&E, FOSMD, AT&T, Comcast, and Cal Water • Historical Resource Evaluation prepared by Urban Programmers, dated February 5, 2022 • Noise Study prepared by Salter, Inc., dated February 11, 2022 • Biological Resource Assessment, prepared by Sunset Ecological Solutions, dated November 18, 2021
• Geotechnical Report, prepared by Murray Engineers, Inc., dated March 28, 2022 • Supplemental Investigation, prepared by Murray Engineers, Inc., dated November 21, 2022
• Traffic Study prepared by Hexagon Transportation Consultants, Inc., dated February 14, 2023
• Off-Site Concept Building Renderings, prepared by CJW Architecture, dated January 5 & February 22, 2023
These documents will be thoroughly which will be reviewed for adequacy and content. In addition, Town staff has requested that an Arborist Report be prepared for the project. RGS also determined that an Air Quality Study is needed to evaluate potential impacts to the environment. These studies are described below. If other additional technical studies are necessary to develop supporting data for the Initial Study, RGS will identify such studies, the approach and methodology of the study, and the scope of work. RGS will include all fees, costs, and timelines necessary to complete any technicalstudiesin its proposal.
Site Visit
RGS will conduct a site visit of the entire site for the purpose of collecting information that will be used for the CEQA Document.
Air Quality Study
The consulting firm of Illingworth & Rodkin, Inc. will conduct an air quality analysis to determine potential impacts that could result from the project. Construction impacts will be addressed by predicting emissions using the CalEEMod model and then use the AERMOD dispersion model to predict exposures to nearby residences. These exposures would be compared to BAAQMD thresholds by computing lifetime increased cancer risk and annual PM2.5 concentrations. BAAQMD thresholds also consider cumulative impacts. It is assumed that cumulative sources are not nearby or could be Item 2 Page 6
Town Council Meeting April 11, 2023
described using BAAQMD screening data. The assessment and/or recommendations will comply with BAAQMD GHG thresholds. A report will be prepared that presents results and modeling data.
2.4 Arborist Report
The Planning and Environmental Consulting firm of Denise Duffy & Associates (DD&A) will conduct a site investigation and prepare an arborist report on the project site. DD&A will coordinate with RGS and the project proponent to obtain relevant project information and maps, including GIS files, CAD files, and site plans, if available. DD&A will confirm the scope of work, schedule, and deliverable format with the project proponent.
The DD&A Certified Arborist will survey the project area in accordance with the Town of Woodside Municipal Code, Section 153.430 (Tree Protection) requirements and project plans. Data collection will include species, condition, location (using GPS equipment), and diameter at breast height (DBH) for all trees within the project area.
The arborist will identify all existing and proposed site improvements and the location, root zone drip line, or critical root zone (CRZ) of each significant tree (defined in Section 153.170) in the area. DD&A will prepare an arborist report that satisfies Woodside’s tree destruction permit application requirements (Town of Woodside Municipal Code, Section 153.435) complete a Tree Destruction Permit Application in coordination with the project proponent, which will include the following:
• A site plan that identifies the location of each tree on-site addressed by the report, including its root zone in relation to proposed development,
• The physical identification of each tree on-site by numbered or colored tag that is attached to each tree and keyed to the report,
• Photograph of existing site with the significant trees clearly marked with orange ribbon that will remain on trees throughout the permitting process, • The size, species, health, and potential impacts anticipated by the proposed development, and
• Identification of which trees are proposed for preservation and which are proposed for removal.
DD&A will submit the draft arborist report electronically to the project proponent for review and comment. DD&A will respond to two rounds of comments from the project proponent on the draft arborist report before preparing a final report. DD&A will attend meetings with project proponent, the Town of Woodside, and/or the public upon request.

TOWN OF WOODSIDE
Report to Town Council Agenda Item 3
From: Sean Rose, Town Engineer April 11, 2023
Approved by: Kevin Bryant, Town Manager
SUBJECT: RESOLUTION: (1) APPROVING A SEWER SERVICE ALLOCATION TO 1100 CANADA ROAD, PURSUANT TO MUNICIPAL CODE SECTION
51.126; (2) CONSENTING TO THE ANNEXATION OF THIS PROPERTY INTO THE REDWOOD CREEK SEWER ASSESSMENT DISTRICT; AND (3)
AUTHORIZING THE TOWN MANAGER TO EXECUTE A SUPPLEMENTAL
AGREEMENT BETWEEN THE TOWN OF WOODSIDE AND FAIR OAKS SEWER
MAINTENANCE DISTRICT FOR THE TRANSFER OF A SEWER CONNECTION
IN THE REDWOOD CREEK SEWER ASSESSMENT DISTRICT
RECOMMENDATION
It is recommended that the Town Council adopt the attached resolution, which: (1) approves a sewer service allocation for 1100 Cañada Road, pursuant to Section 51.126 of the Municipal Code; (2) consents to the annexation of this property into the Redwood Creek Sewer Assessment District; and (3) authorizes the Town Manager to execute a supplemental agreement between the Town of Woodside and Fair Oaks Sewer Maintenance District for the transfer of a sewer connection in the Redwood Creek Sewer Assessment District.
BACKGROUND
The Town’s Municipal Code provides regulations pertaining to sewer service allocations, beginning at Section 51.120. The regulations define three areas of Town that are the subject of the definitions and requirements contained in the Section. Areas I and II include parcels that are located either within the Redwood Creek Trunk Sewer Assessment District or the Town Center Sewer Assessment District (TCSAD). Area III is comprised of parcels that are located outside the two sewer districts, but which are contiguous to either of them. The parcel at 1100 Cañada Road is in Area III. Section 51.126 addresses parcels within Area III. Specifically, the section reads:
“(A) Owners of developed parcels may receive a sewer service allocation, subject to Town Council approval, with any conditions imposed, and the general conditions required by this chapter, based on finding that: (1) the Town Engineer has determined that it is a contiguous parcel, as provided in Section 51.122, (2) the allocation is consistent with the Town's General Plan and any applicable specific plan, and (3) sewer service capacity is available.”
DISCUSSION
The property at 1100 Cañada Road is a Developed Parcel with an existing residence served by a private on-site wastewater treatment system. There is a RCS sanitary sewer main located directly in front Item 3 Page 1 Town Council Meeting April 11, 2023
of the property. The current property owner has requested to connect to the Redwood Creek Sewer System. The Town Engineer finds that the parcel meets all of the conditions outlined in Section 51.126.
Because 1100 Cañada Road is contiguous to, rather than within, the boundary of the Redwood Creek Sewer Assessment District, it was not granted a sewer allocation when the District was formed.
The April 2, 1968 agreement between the Town and Fair Oaks granted connections and corresponding sewer service capacity to parcels within the District boundary at formation, up to a total of 150,000 gallons per day.
Per the terms of the agreement, in order for any contiguous parcel such as 1100 Cañada Road to connect to the Fair Oaks sewer system, sewer capacity must be transferred from a parcel with an allocation to the contiguous parcel.
Based on a review of the existing allocation roll, staff proposes to transfer the unused allocation from “excess” - assessment district number 70 to 1100 Cañada Road (APN 072-130-270).
In order to formalize the transfer of a sewer allocation to 1100 Cañada Road the 1968 agreement must be amended. The attached Supplemental Agreement would serve as said amendment. Per the terms of the Supplemental Agreement, the Town will record the transfer in its sewer assessment records.
Map of 1100 Canada Road shown as Exhibits A is to the attached Supplemental Agreement.
CONCLUSION
It is recommended that the Town Council adopt the attached resolution adopt the attached resolution, (1) approving a sewer service allocation for 1100 Cañada Road, pursuant to Section 51.126 of the Municipal Code; (2) consenting to the annexation of this property into the Redwood Creek Sewer Assessment District; and (3) authorizing the Town Manager to execute a supplemental agreement between the Town of Woodside and Fair Oaks Sewer Maintenance District for the transfer of a sewer connection in the Redwood Creek Sewer Assessment District.

SUBJECT: RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE AN
AMDENDMENT TO THE CONTRACT WITH MARINA LANDSCAPE IN AN
AMOUNT NOT TO EXCEED $19,439.17 FOR CONSTRUCTION OF THE
WOODSIDE ROAD MEDIAN ISLAND BEAUTIFICATION PROJECT
RECOMMENDATION
It is recommended that the Town Council authorize the Town Manager to execute an amendment to the contract with Marina Landscape in an amount not to exceed $19,439.17, for
construction of the Woodside Road Median Island Beautification Project.
BACKGROUND
On January 17, 2023, the Town Council authorized the Town Manager to execute a contract with Marina Landscape for the construction of the Woodside Road Median Island Beautification Project in the amount of $115,500, which included $10,000 for construction contingency.
After execution of the contract, the Contractor obtained their encroachment permit from Caltrans to complete the work within their Highway 84 right of way. One of Caltrans’ permit
conditions was that the contractor’s proposed lane closure can only be completed at night from 8pm to 5am. Because the Town’s bid documents did not envision the work would have to be completed at night, the contractor submitted a change order proposal for the additional cost associated with night work in the amount of $19,439.17. The additional cost is due to increased labor and equipment costs incurred by the contractor to complete the work at night.
Staff finds the additional cost to be reasonable and required in order to meet Caltrans’ requirement for night-only lane closures. Further, due to the proximity of the work to the Highway 84 travel lanes, lane closure is required in order to complete the work.
Currently, the total project cost is budgeted in the adopted Capital Improvement Program in the amount of $119,718, with $40,000 from the General Fund and the remaining $79,718 from the Woodside Community Foundation. With the amended Marina
construction contract, the total estimated project cost (including design, construction, and construction contingency) Item 4 Page 1 Town Council Meeting April 11, 2023
is $164,729.17. The WCF has thus far pledged to cover $96,836 of that amount, which includes $13,000 towards the cost of night work. Based on current pledges, the Town’s required contribution to the project is $67,893.17. That amount is in addition to the ongoing maintenance expense which the Town has agreed to cover after construction of the project. That cost is currently estimated to be $1,000-$3,000 per month.
Should the recommended action be approved, construction is anticipated to commence in April 2023 and be completed by May 2023.

Town Council Meeting April 11, 2023

From: Sean Rose, Town Engineer April 11, 2023
