13. RESOLUTION NO. 2025-5925 APPROVING YORBA LINDA-PLACENTIA ACTIVE

TRANSPORTATION PLAN AND GENERAL PLAN AMENDMENT TO UPDATE

CIRCULATION ELEMENT AND OPEN SPACE AND RECREATION ELEMENT a. Open Public Hearing - Mayor Lim opened the public hearing. b. Staff Report
City Manager Pulone said there is no conflict on tonight's item and all of Council can participate. However, as the item moves forward and the City discusses particular projects, that may change.

Jamie Lai, Public Works Director/City Engineer, provided background on the item and introduced Les Brown, Alta Planning & Design, who shared a PowerPoint presentation that included a high-level overview of the collaborative project. He said the Active Transportation Plan (ATP) incorporated needed pedestrian and bicycle improvements, Safe Routes to School (SRTS) improvements and updated Master Plan of Trails (including equestrian trails). He said the bi-city ATP is needed to add and to connect infrastructure for safer, more accessible walking and biking for school children, families, residents and visitors. He discussed the project schedule, goals, the updated riding, hiking and bikeway trails component, existing conditions, outreach events, recommended phases and e-bikes.
c. Take Testimony
Giovanni Chiarella, resident, said he and his neighbors did not find out about this project until November and their main concern is the intentions for Sunset Lane with the horse trails and said he and his neighbors do not want sidewalks on their private street. He expressed concern over what would happen if someone were injured on their private street, and if residents living on that street would be indemnified by the City. He concluded his comments by inquiring if his neighborhood could be involved in the planning.

Sheryl Anderson, resident, said she also lives on Sunset Lane and spoke specifically about the Concept Plan for Segment 51 pertaining to Ohio Street and effects on Sunset Lane.

Pat Nelson, resident, said she does not believe e-bikes belong on any of these trails with people and horses.
d. Close Public Hearing - Mayor Lim closed the public hearing. e. Make Determination

Page 72 of 141 ends

10 Mayor Pro Tem Carlos Rodriguez inquired how many more meetings there are before this needs to be approved. Director Lai said the item would need to be approved today in order to meet grant deadlines. He further inquired if the item could be adopted, and later amended to address the concerns raised by residents.

Director Lai responded and said that anything that needs to be amended would go through a separate process and go before the Planning Commission, therefore approval today does not affect adjustments that could be needed after meeting with residents.

A lengthy conversation ensued among Council and staff regarding modifications to the plan and the process to do so. Councilwoman Campbell asked if the City would need to obtain permission from the residents of the private street in order to place a sidewalk on their private street, staff and the City Attorney responded and indicated that their permission would be needed. Councilwoman Campbell shared that the sidewalk in their area is considered a Tier 3 project, so it is not a priority capital improvement project, however, she asked that as part of staff's recommendation, that staff meet with the residents to hear and address their concerns. Mayor Pro Tem Rodriguez agreed and seconded the motion.

Moved by Campbell
Seconded by Rodriguez
It is recommended that the City Council: 1.) Approve the Yorba Linda-Placentia Active Transportation Plan; and 2.) Approve General Plan Amendment to update Circulation Element and Open Space and Recreational Element to implement the Yorba Linda Active Transportation Plan and Update of the Riding, Hiking, and Bikeway Trails component of the General Plan.

Councilwoman Huang said many have received a text indicating that it is from the Toll Roads, warning recipients that they need to pay their toll fines. She said this text is a scam and law enforcement is investigating the fraudulent messages.

Councilman Shivinder Singh expressed his thoughts and prayers to those affected by the LA fires and reminded the community that there is still a wind advisory in effect until tomorrow.

Mayor Pro Tem Rodriguez echoed the comments made by Councilman Singh and thanked the first responders who have battled the fires and stressed the importance of clearing brush from properties. He said he served as the City's representative on the Governing Board for the Southcoast Air Quality Management District and spoke of the District's proposed mandatory transition to zero-emission appliances under Rules 1111 and 1121. He said he and his AQMD colleagues expressed concerns with the effects and need for outreach, and prevailed in having AQMD pause the proposed transition. Council expressed their concerns with the monetary impacts to the community. Councilwoman Huang suggested that the item be brought to Council for discussion at a future meeting.

Mayor Lim expressed the City's condolences and prayers to those in Los Angeles County who have suffered devastating losses and expressed their deep gratitude to all public safety partners. A lengthy conversation ensued among Council and staff regarding the City's projected property and sales tax.

PUBLIC WORKS DEPARTMENT
DATE: FEBRUARY 4, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JAMIE LAI, P.E., DIRECTOR OF PUBLIC WORKS/CITY ENGINEER PREPARED BY: COLIN TSUI, P.E., ASSISTANT CIVIL ENGINEER SUBJECT: AMEND THE FISCAL YEAR 2023-2024 ANNUAL PAVEMENT

PRESERVATION PROJECT PROFESSIONAL SERVICES AGREEMENTS

WITH FOUNTAINHEAD FOR CONSTRUCTION

MANAGEMENT/INSPECTION SERVICES AND WITH NINYO & MOORE

FOR GEOTECHNICAL/MATERIALS TESTING SERVICES

RECOMMENDATION
It is recommended that the City Council:

1. Amend the Professional Services Agreement with Fountainhead Consulting Corporation (Fountainhead) in the amount of $20,000 to provide additional Construction Management and Inspection Services; and

2. Amend the Professional Services Agreement with Ninyo & Moore Geotechnical and Environmental Services Consultants (Ninyo & Moore) in the amount of $10,258 to provide additional Geotechnical and Materials Testing Services.

BACKGROUND
The treatment area for Zone 5 of the Annual Pavement Preservation Project (APPP) includes cul-de-sacs along the Stonehaven Drive loop. The treatment area for Zone 7 of the APPP includes La Palma Avenue from the western City Limits to Camino de Bryant and the cul-de-sacs along Brush Canyon Drive. The Professional Services Contracts for this APPP project were awarded to Fountainhead and Ninyo & Moore on June 18, 2024.

DISCUSSION
The contractor for the FY 2023-2024 APPP has experienced challenges in the delivery of this project. Delays in the schedule were incurred due to various reasons including materials shipment delays and equipment failures. Quality assurance testing performed by Ninyo & Moore have revealed that there are some sections of asphalt overlay and slurry seal that do not meet project specifications.

The City has relied on its consultants to facilitate construction in the field and ensure the quality of the end product is satisfactory. The circumstances during construction have resulted in additional hours for Fountainhead as well as additional testing and field investigations for Ninyo & Moore. Consequently, when contractor activities result in additional inspection time on behalf of the City, our contract allows for the assessment of liquidated damages which have been tracked for this project which would go towards offsetting project costs.

FISCAL IMPACT
Funding for this project comes from a combination of the Ongoing Street Maintenance Program Capital Improvement Program budget (Project Account No. SI241004) and the La Palma Avenue Improvement Project (Project Account No. SI231002). Funding for the amendment will come from the existing project appropriations for the additional expenditures summarized in Table 1 below.

A contract amendment for Fountainhead was previously approved in the amount of $24,500.

This amendment amount was within the 15% project contingency when the initial contract was awarded. The subsequent amendment amount of $20,000 exceeds the 15% project contingency. Ninyo & Moore’s proposed contract amendment in the amount of $10,258 exceeds the 15% project contingency. Therefore, both contracts require City Council authorization for the additional funds required. The total authorization request for both contracts amounts to $30,258. A summary of the expenditures for both consultants is tabulated below.

Table 1 – Summary of Project Costs
Item Cost
Construction Management & Inspection (Fountainhead) $169,635 Previously Approved Amendment $24,500
Proposed Contract Amendment $20,000
REVISED CONTRACT AMOUNT (FOUNTAINHEAD) $214,135
Materials Testing (Ninyo & Moore) $37,665
Proposed Contract Amendment $10,258
REVISED CONTRACT AMOUNT (NINYO & MOORE) $47,923

ALTERNATIVES
The City Council may choose to not award the proposed contract amendments to Fountainhead and Ninyo & Moore. Staff does not recommend this alternative because it will limit the City’s ability to close out the project and negotiate a satisfactory remedy.

ADMINISTRATION DEPARTMENT
DATE: FEBRUARY 4, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: DAVID ALBAUGH, ADMINISTRATIVE SERVICES DIRECTOR
SUBJECT: TERMS OF EMPLOYMENT FOR MISCELLANEOUS EMPLOYEES

RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 2025-5928 relating to the terms of employment for Miscellaneous employees.

BACKGROUND
Pursuant to Chapter 2 of the Yorba Linda Municipal Code, the classification, compensation, and terms of employment for City employees are established by resolution of the City Council. In accordance with the Myers-Milias-Brown Act, the City of Yorba Linda (City) met and conferred with the Yorba Linda Chapter of the Orange County Employees Association representing Miscellaneous employees (Association) to negotiate and approve a Letter of Understanding (LOU) modifying the terms and conditions of employment contained the Association’s Memorandum of Understanding (MOU) pertaining to leave time accrual and use.

DISCUSSION
The City initiated the meet and confer process with the Miscellaneous bargaining group at the Association’s request on October 1, 2024, to discuss the consolidated Annual Leave accrual option available to Management and Mid-Management Employees. While the Association did not propose adopting annual leave for their Miscellaneous members during contract negotiations in 2024, they were not aware that the City was open to extending the option to the Association’s members and asked to reopen the contract on this single issue.

Currently, the Association’s MOU allows employees to accrue separate banks of sick and vacation leave based on years of service and time worked during the year. Alternatively, annual leave time is an accrual that replaces separate sick and vacation leave banks with a single leave bank that can be used for any reason, including sick days, personal necessity leaves, and vacations. By switching to annual leave, employees’ long-term accruals are generally reduced in exchange for greater flexibility of use.

Page 95 of 141 ends

TERMS OF EMPLOYMENT FOR MISCELLANEOUS EMPLOYEES
P a g e | 2
The City met with the Miscellaneous bargaining group to identify the existing policies and practices pertaining to annual leave accrual and use by other groups, and to draft language applying annual leave provisions to employees represented by the Association. The Association has ratified the proposed LOU. All other terms and conditions of employment are proposed to remain the same.

If adopted by City Council resolution, the amended language in the LOU modifies the terms of employment in the existing MOU pertaining to leave accrual and will be included in successor MOUs between the parties unless otherwise amended or modified in future negotiations.

FISCAL IMPACT
There is no notable fiscal impact associated with these changes. The impact of these changes in the short term is cost-neutral and may result in modest savings for the City over time.

LETTER OF UNDERSTANDING
between the

THE YORBA LINDA CHAPTER OF THE

ORANGE COUNTY EMPLOYEES ASSOCIATION
and the CITY OF YORBA LINDA
The Yorba Linda Chapter of the Orange County Employees Association (“Association”) and the City of Yorba Linda (“City”), herein referred to collectively as the “Parties,” have met and conferred and reached an agreement regarding Annual Leave and the modification of the Memorandum of Understanding (MOU) between the Association and the City for the term of July 1, 2024, to June 30, 2027. The Parties herein agree to the following terms:

1. Effective upon the Adoption of this Letter of Understanding (LOU) by the City Council of the City of Yorba Linda, Article A shall be added to the MOU and will be titled and indexed as a numbered article in the successor MOU. Article A will be read in its entirety as follows:

MISCELLANEOUS EMPLOYEES ANNUAL LEAVE
All regular employees hired before April 1, 2025, may make a one-time, irrevocable election by March 3, 2025, to transition to Miscellaneous Annual Leave under this article.

The effective date for Annual Leave for employees who make the one-time election by March 3, 2025, is April 1, 2025. Thereafter, eligible employees hired before April 1, 2025, may opt into Miscellaneous Annual Leave on or before December 1 of each calendar year. Any subsequent December 1 election will become effective January 1 of the following year.

All regular employees who elect Miscellaneous Annual leave under this article and all regular employees hired on or after April 1, 2025, shall be permanently granted annual leave in place of separate sick and vacation leave, which can be used for any purpose including sick leave and vacation leave. Annual leave shall accrue on the following basis:
1 - 4 years of service 4.5 weeks/year or 6.923 hours/pay period 5 + years of service 5.5 weeks/year or 8.462 hours/pay period Part-time regular, permanent competitive service employees shall accrue Annual Leave on a pro-rata basis based on the full-time equivalent level of their position (e.g. 0.75 or

0.50).

Employees may accumulate an amount up to double their annual accrual. Once the maximum accrual is reached, any excess “carryover” must be approved by the City Manager, otherwise, the employee will be paid for the excess leave on each pay date where the maximum accrual amount is exceeded until such time as the leave balance drops below the maximum accrual.

Any unused Annual Leave time above one-half of the employee’s annual accrual may be subject to buyback in June of each year at the employee’s option. The buyback is based

COMMUNITY DEVELOPMENT DEPARTMENT
DATE: FEBRUARY 4, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: NATE FARNSWORTH, COMMUNITY DEVELOPMENT DIRECTOR
PREPARED BY: JEFF MCIVER, BUILDING OFFICIAL
SUBJECT: DEMOLITION PERMIT REQUEST FOR 5116 LOS ALTOS DRIVE

RECOMMENDATION
It is recommended that City Council approve the demolition permit request for 5116 Los Altos Drive.

BACKGROUND
The City has received a request to demolish an existing single-family dwelling located at 5116 Los Altos Drive. The existing structure is a single story, 2,192 square foot single family residence with 3-bedrooms, 2 baths, and a 480 square foot attached garage. The residence is wood framed with a stucco finish and is located on a 0.96-arce lot. This property also has a swimming pool and spa which is included in the demolition. This property is currently connected to a septic system, Southern California Edison and Southern California Gas.

DISCUSSION
In accordance with the City Council’s P-4 policy, the demolition permit has been analyzed to determine whether there is any historic significance with the existing property. The existing residence was built in 1962 and according to the 2010 Citywide Historic Property Survey, does not reflect any historical significance. Prior to permit issuance, a demolition request will be reviewed by the Engineering Division for compliance with storm water prevention as well as compliance with best management practices. Additionally, an asbestos survey will be performed, and if the findings are positive, appropriate abatement measures will be required, and the South Coast Air Quality Management District notified.

FISCAL IMPACT

ADMINISTRATION DEPARTMENT
DATE: FEBRUARY 4, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: MARK A. PULONE, CITY MANAGER
PREPARED BY: ARLENE QUINTERO, PRINCIPAL RISK AND SAFETY

ANALYST
SUBJECT: DENIAL OF CLAIM FOR DAMAGES- MINA GILL, ALBERTO ALVA AND

SETTLEMENT AUTHORITY FOR SCOTT NORMINTON

RECOMMENDATION
It is recommended that the City Council of the City of Yorba Linda deny the claims for damages filed by Mina Gill and Alberto Alva and settle the claim for damages filed by Scott Norminton.

BACKGROUND
Claims for damages filed against the City are reviewed and investigated by City staff and a third-party claims administrator with George Hills Company, Inc. George Hills Company specializes in claims management and risk management services. These services are provided through the City’s contract membership in the California Insurance Pool Authority.

City staff make recommendations to the Council for settlement or denial based on the investigatory findings. A claimant’s failure to provide evidence of and/or supporting documents to substantiate the claim for damages will also result in a recommendation for denial of the claim.

DISCUSSION
The following claims for damages have been recommended for denial based on the investigations by City staff and the third-party claims administrator. Further details for each claim are available upon request.

Mina Gill
The claimant alleges that their vehicle sustained damage caused by a falling pinecone near Yorba Linda Boulevard and San Antonio. Upon review, City records confirm that the tree in question was within the City’s regular trimming schedule. A falling pinecone is considered a sudden and unforeseeable event, for which the City could not have had prior notice or the opportunity to mitigate the hazard. Based on these findings, the third-party claims administrator and City staff recommend denial of the claim.

Page 110 of 141 ends

DENIAL OF CLAIM FOR DAMAGES- MINA GILL, ALBERTO ALVA AND SETTLEMENT

AUTHORITY FOR SCOTT NORMINTON
P a g e | 2
Alberto Alva
The claimant alleges their vehicle was damaged by a pothole located on southbound North Rose Drive, south of Bastanchury Road. The claim has been reviewed and is deemed timely and sufficient. However, a City investigation determined that the condition resulted from spalling pavement surrounding a manhole maintained by the Orange County Sanitation District (OCSD). The third-party claims administrator and City staff recommend denying the claim and referring the claimant to OCSD for further resolution.

Scott Norminton
The following claim for damages is recommended for settlement based on investigations conducted by City staff and the third-party claims administrator.

The claimant alleges that concrete mow strips and a block wall at their property located at 5329 Vista Montana were damaged by roots from a City-owned tree. Based on the City’s investigation, the roots were confirmed to be from a City tree. The damage was caused by a tree located within two feet of the property line. Before the claim was submitted, the City took proactive action upon becoming aware that the tree roots were damaging the wall. The roots were cut and removed, a root barrier was installed on September 26, 2024, and the tree was removed on October 28, 2024.

The claimant seeks $4,800 in damages for repairs. City staff and the third-party claims administrator recommend that the City Council approve settlement authority to resolve the claim.

FISCAL IMPACT
Acceptance of the Scott Norminton claim will result in a fiscal impact of $4,800.

ALTERNATIVES
As an alternative to staff’s recommendations for the denial of the claims, the City Council has the following options:

1. Accept liability for the claims and pay the amount specified in the claim forms.

2. Grant settlement authority up to a certain amount and direct the claims adjuster to enter into settlement negotiations with the claimants.

What is Typhus ?
• Flea-borne typhus is a vector-borne disease caused by bacteria.
• The bacteria are spread to people through contact with infected fleas, typically the Oriental rat flea or the cat flea.
• Fleas infect animals such as rats, cats, and opossums with the bacteria.
• Fleas transmit the bacteria to people or animals when the flea feces are scratched into wounds, inhaled, or
rubbed into the eyes.

History of Typhus Fever in the US
•Thousands of cases of flea-borne (murine) typhus were
reported annually 1930s -1940s.
•Because the disease is rare, in 1987, the Council of State and Territorial Epidemiologists voted to remove murine typhus from the nationally notifiable disease list.

Page 119 of 141 ends

Reemergence of
Typhus in early 2000s
• Since 2004, there has been a resurgence
of flea-borne typhus in Texas, Hawaii, and
California. Nationally there are an average
of 300 human cases per year.
• In 2006 Orange County began receiving
reports of human cases for the first time
since 1991.
• Orange and Los Angeles counties are
areas where flea-borne typhus is endemic,
or always present.
• Southern California is a high-risk area for
flea-borne typhus.

CDPH Guidance on Typhus Response
The legal authority for government agencies to control vectors and vector-borne diseases is found in the California Health and Safety Code Chapter 1, Division 3, Sections 2000-2093.

Pertaining to flea-borne typhus, any property artificially altered from its natural condition that supports the development, attraction, or harborage of flea vectors may be declared a public nuisance and abated. In addition, any developed property onto which rats, opossums, skunks, raccoons, and feral cats are fed or congregate, and those animals are found to be harboring fleas, can be declared a public nuisance and abated.
