13.   RESOLUTION NO. 2025-5943, ORDERING COSTS FOR CITYWIDE LMAD AND CONFIRMATION OF ASSESSMENTS FOR FY 2025/26 OVERRULING ALL PROTESTS, AND LEVYING THE ASSESSMENTS CONFIRMED HEREIN

1. FY25-26 Engineer's Report - CC-PW-25-020.pdf

2. Attachment 1 - Resolution No. 2025-5943.pdf

3. Attachment 2 - FY 2025-2026 Engineer's Report.pdf
City Attorney Litfin stated that because the LMAD assessments affect the entire City and each Councilmember owns property in the City, there may be a potential conflict of interest due to their real property interests per FPPC Regulation Section 18702.2(a)(3). However, under Section 18705(a), a public official may participate only if there exists no alternative source of decision for that legislative body.  Here, approval of the Engineer’s Report and levying of assessments for LMAD is required by City Council per Landscaping and Lighting Act (Sts. & Hwy Code, Section 22623); therefore, the minimum number of Councilmembers can participate to reach quorum.

He further stated that under the Public Generally exception in Section 18703(e)(1), this could be perceived as not a conflict; however, the City is being cautious of the potential conflict.  The Councilmembers’ real property interests at issue, which include each of the Councilmembers’ personal residence, are located in the following LMAD zones:

Mayor Lim – Arterial Landscaping Zone A-3, Local Landscaping Zone L2V, and Local Lighting Zone A, Arterial Lighting Zone, and Traffic Signal Zone TS-2; Councilwoman Peggy Huang – Arterial Landscaping Zone A-6, Local Landscaping Zone L5B, and Local Lighting Zone A, Arterial Lighting Zone, and Traffic Signal Zone TS-2; Mayor Pro Tem Rodriguez – Arterial Landscaping Zone A-5, Local Landscaping Zone L2G, and Local Lighting Zone A, Arterial Lighting Zone, and Traffic Signal Zone TS-2; Councilman Singh – Arterial Landscaping Zone A-7, Arterial Lighting Zone, Traffic Signal Zone TS-2, and is not in a Local Landscaping or Local Lighting Zone; and Councilwoman Tara Campbell – Arterial Landscaping Zone A-7, Local Lighting Zone B, Arterial Lighting Zone, Traffic Signal Zone TS-2, and is not on a Local Landscaping Zone.

Mayor Pro Tem Rodriguez and Councilwoman Huang recused themselves from the meeting at 7:12 p.m. a. Open Public Hearing - Mayor Lim opened the public hearing. b. Staff Report
Public Works Director / City Engineer Jamie Lai provided a PowerPoint presentation on the FY 2025-26 Engineer's Report, highlighting what the LMAD is, the timeline since 1979, zones, updates since last year, including before and after landscape projects and Proposition 218 updates. She said one landscape zone, Zone L-1A, is projected to require Proposition 218 actions as it has budgeted expenditures exceeding projected available fund balances. She said this deficiency is projected to be addressed in the upcoming Fiscal Year. c. Take Testimony
Peter Meng, resident, expressed his opposition on the item and spoke about trees that he believes should be removed as they pose a hazardous fire risk. d. Close Public Hearing - Mayor Lim closed the public hearing. e. Make Determination

Micaela Lubben, resident, spoke about issues she is experiencing with her neighbor on Shaw Lane. She spoke of difficulties with her neighbor's trash and overgrown trees and rubbish. She said the City's code enforcement needs to inspect the lot for violations.

CITY MANAGER’S REPORT/MAYOR’S REPORT/MATTERS PRESENTED BY COUNCILMEMBERS/ OTHER AGENCY REPORTS City Manager Pulone responded to Ms. Lubben's comments and said he understands her frustration. He said he will provide her with his card so he can work with her as early as tomorrow to help address her concerns. He thanked Mr. de Bruijn for the history on Bastanchury Road and said the City does not have a plan in place for the vacant land, primarily because the City does not have funding. However, City Manager Pulone said on tonight's agenda is the City's two-year budget, which will discuss Capital Improvement Projects, and perhaps Bastanchury Road can fall under one of those categories.

Councilwoman Campbell also told Ms. Lubben that she can always email her whenever she needs assistance with an issue and she will work with staff to assure it is taken care of promptly. She said she attended the Best and Bravest OCFA Awards on May 30th, where local Yorba Linda public safety employees were recognized.

Councilman Singh said he spoke with Starlink and asked City Manager Pulone to provide an update on fiber services. City Manager Pulone said since the City adopted microtrench guidelines, no firm has moved forward in the process, and spoke of Starlink's business plan and reduced costs. He said as things move forward, he will keep the Council apprised on the developments. Councilman Singh said there was recently a residential burglary where residents were home and sleeping, he asked Chief of Police Services Captain De Anne Wigginton to advise what to do under these circumstances. She said she cannot provide details of the case, but urged residents to immediately call 911 when someone enters their home and spoke of the importance of Flock cameras. Councilman Singh asked Parks and Recreation Director Mike Kudron for an update on upcoming summer events. Director Kudron spoke about Adventure Playground Summer Camp, and said the department offers over 150 summer camps which range from sports, theatre, science and more.

Mayor Pro Tem Rodriguez said the Air Quality Management District (AQMD) will be holding a public hearing Friday June 6th to discuss Rules 1111 and 1121 and spoke about the potential impacts of these rules.

6. Attachment 5 - Seven Year CIP Project List.pdf
Finance Director Sunny Han shared a PowerPoint presentation for this item. Her presentation included updates on the FY 2024-25 Third Quarter General Fund and FY 2025-2027 Operating Budget Review. She said that the General Fund Budget is structurally balanced, with a projected $114k surplus in FY25/26 and $34k surplus in FY 26/27. She spoke of key drivers of the increases to the General Fund, anticipated General Fund Reserve Balance, the Library and LMAD Fund budgets, requested personnel changes, the Black Gold Golf Club budget and concluded with an overview of Capital Improvement Projects. Parks and Recreation Director Kudron spoke specifically about CIP projects for his department, along with their estimated costs. Those projects included the Arroyo Park Turf Renovation, and Significant Building and Facilities Projects. Director Lai spoke about the significant projects for Public Works which include Significant Street Improvement Projects, the Ongoing Street Maintenance Program, Traffic Control Projects, and LMAD Landscaping Projects.

Richard de Bruijn, resident, said he understands that personnel and contract services account for a significant portion of general fund expenditure and inquired if the projects for those contracts are listed anywhere. He said Black Gold Golf Club used to be a financial liability for the City and asked for clarification as to whether it is now considered a source of revenue, he also spoke about the library loan. He concluded his comments by talking about tariffs and their potential impact on the City's sales tax.

City Manager Pulone responded to Mr. de Bruijn's comments and said when the Black Gold Golf Club was first constructed, the City had debt service that it was paying off, however, that debt was paid off about ten years ago, and its revenues can be used to help pay for projects. Similarly, the library receives separate funding through a property tax levy which covers operating costs, maintenance and future improvements. With respect to sales tax, he said the City worked with third party companies to determine sales tax projections. Tariffs are one of many factors considered in the forecasts, and the companies are conservative with their estimates. City Manager Pulone said with respect to contract services, all contracts entered into by the City are through outside contract vendors, and they are competitively bid.

A lengthy conversation ensued among Council regarding the budget, capital improvement projects, as well as Shop Dine Support Yorba Linda and how to best bring sales tax to the City. They discussed the possibility of holding a special study session / workshop to discuss sales tax.

Susan Wan-Ross, Yorba Linda Chamber of Commerce Chief Executive Officer, spoke about the Chamber's efforts to bring business and statistics on store openings and closures.

Councilwoman Huang recommended a Council workshop before the end of the third quarter with Jones Lang LaSalle (JLL) and HdL Companies projections, as well as the Chamber and local businesses. Councilwoman Campbell suggested inviting the City's top sales tax-generating businesses.
