Councilwoman Campbell questioned if the item also requires review from Yorba Linda Police Services, in addition to the Yorba Linda Water District and Orange County Fire Authority. Community Development Director Nate Farnsworth said he would need to verify if they were included. Public Works Director / City Engineer Jamie Lai said the item before Council is just to execute the Subdivision Improvement Agreement and post the bonds; the item will need to go to the Planning Commission and the grading plan will need to be issued, so there are still several steps to be taken. Director Farnsworth clarified that short-term rentals are not permitted in the City, rentals would need to be for a minimum of 30-days. Director Lai confirmed that the first step will be the creation of a new cul-de-sac.

The builder approached the lectern and spoke of the project. He said the development is intended for the applicant's children to live in. Councilwoman Campbell reiterated that the Tenative Parcel Map was approved by the Planning Commission as four residential homes with a cul-de-sac over a year ago. Director Farnsworth said it is likely that Yorba Linda Police Services reviewed the project at that time.

City Attorney Litfin said this item is for the approval of the Subdivision Improvement Agreement. He said the approval of this is a ministerial act but the design review of the actual homes will go back to the Planning Commission.

Councilman Singh spoke about the building of the cul-de-sac and inquired if the owner is responsible for the financing of it. City Attorney Litfin said that is something the owner/builder is financing. Mayor Lim stated the City is still in the preliminary steps with the item and inquired when the geology report will be available. The builder confirmed the report is complete and is with the City for review.

ADMINISTRATIVE REPORTS

12.   ORDINANCE NO. 2025-1114 – E-BIKE ORDINANCE

1. E-Bike Ordinance - 1st Reading - CC-PW-25-032.pdf

2. Attachment 1 - E-Bike Ordinance No. 2025-1114.pdf

3. Attachment 2 - E-Bike Ordinance No. 2025-1114 (Redlined).pdf Public Works Director Jamie Lai provided a PowerPoint presentation on proposed Ordinance No. 2025-1114 and said the presented ordinance incorporates discussion points from the July 15, 2025, Council meeting and provided a summary of changes with respect to speed limits, a DUI provision and penalties.

The following residents expressed concerns about e-bikes, the ordinance, and use on horsetrails: Kathy Wright, Rachel Severeign, Diane Kanne, Pat Nelson, DeeDee Friedrich, Charlie Chen, Larry Hines, Craig Holbrook, and Aslam Dada. Mr. Dada also spoke about the importance of educating parents on e-bike safety and suggested involving local congregations to increase attendance and awareness at e-bike safety meetings.

Maximus Charney expressed his support for e-bikes and spoke about how he personally benefits from using them.

City Manager Pulone stressed that this ordinance is primarily about behavior and said e-bikes are being ridden by a lot of people daily in a responsible manner, while certain riders do raise safety concerns. He said the goal of this ordinance is to allow people to enjoy e-bikes while limiting those who want to ride in a reckless way. City Manager Pulone said the City has conferred with other cities and incorporated the best aspects of those ordinances into the City's proposed ordinance. Chief of Police Services Captain De Anne Wigginton spoke about enforcement and said they are actively enforcing and focusing efforts currently on the illegal motorcyles that look like e-bikes and removing those from the streets. She said if this ordinance passes, it will provide deputies with 14 different enforcement sections.

A lengthy conversation ensued among Council about misdemeanors, education on the City website, and through the Placentia-Yorba Linda Unified School District. Council and staff also spoke at great length about the use of e-bikes on trails and which would and would not be prohibited. Staff assured Council that the ordinance can be amended at a later time, if necessary.
