12. SECOND READING AND ADOPTION OF ORDINANCE NO. 2025-1114, REGARDING OPERATION OF REGULATED MOBILITY DEVICES SUCH AS E-BIKES
1. Ordinance No. 2025-1114 E-Bikes Final.pdf
2. Green Sheet - Ordinance No. 2025-1114 E-Bikes Corrected.pdf Councilmember Singh said he was not in attendance at the last meeting but watched the broadcast and asked questions about the ordinance to staff. He inquired if it is permissible to limit the use on dirt trails for responsible riders who are senior citizens or individuals with health conditions, and seniors riding with children on e-bikes. City Attorney Litfin said it is not legal to exclude certain groups, both under the Constitution and State law. He asked Captain Wigginton about the enforcement points included in the ordinance and how the 10-miles-per-hour speed limit could be enforced on dirt trails. Captain Wigginton said the current ordinance, as written, focuses on behavior and spoke of enforcement challenges, trail safety concerns, and the dangers of young e-bike riders on the street.
A lengthy conversation ensued regarding adopting the ordinance as is and revisiting it in 6 months versus amending it to exclude e-bike use on earth, unpaved dirt trails, and the additional resources needed if e-bikes were prohibited on those trails. Council discussed the fiscal impact of the additional resources that would be needed and the projected budget surplus.
City Attorney Litfin said any changes to the ordinance would make this a first reading, and the item would need to return later for a second reading, further delaying adoption. Council spoke about developing e-bike best practices and revisiting the ordinance at the time that the budget is discussed.
