WHEREAS, in 2001 the National Sexual Violence Resource Center launched the first Sexual Assault Awareness Month campaign and in 2009 the Obama Administration officially recognized April as National Sexual Assault Awareness Month, enshrining our Country’s commitment to promoting education of sexual violence, promoting consent, ending victim-blaming, and showing support for victims and survivors; and
WHEREAS, Sexual Assault Awareness Month is about promoting safety, respect and equality, and standing up and speaking out against harmful cultural norms and attitudes that allow sexual violence to persist. This year’s national campaign of “Drawing Connections: Prevention Demands Equity” calls on all individuals, communities, organizations, and institutions to change ourselves and the systems surrounding us to build racial equity and respect.

Statistics from the U.S. Center of Disease Control shows that over half of women and almost 1 in 3 men have experienced sexual violence involving physical contact during their lifetimes; and, that 1 in 4 women and about 1 in 26 men have experienced completed or attempted rape. Sexual violence disproportionately affects women, minors, and racial and ethnic minority groups who experience a higher incidence of sexual violence; and WHEREAS, by observing April as Sexual Assault Awareness Month we show that our community is committed to supporting survivors and working toward the prevention of sexual violence across generations; and
WHEREAS, in Fiscal Year 2021/2022 NEWS provided services to over 1,700 of our Napa County community members—of which 232 were survivors of sexual abuse, and half of those were minors— including 24-hour response and crisis intervention, financial aid, and advocacy, accompaniment and assistance of civil and criminal justice proceedings, referrals, and support completing victim compensation applications; and
WHEREAS, in Fiscal Year 2021/2022, NEWS served 9 clients from the Town of Yountville, including children, 1 of whom experienced sexual assault. The NEWS Help Line received 28 calls for assistance from Yountville residents. NOW, THEREFORE LET IT BE RESOLVED, that I, Margie Mohler, Mayor of the Town of Yountville, on behalf of the Yountville Town Council, join NEWS, advocates, and communities across the country in taking action to prevent sexual violence. I do hereby proclaim April 2023 as Sexual Assault Awareness Month, in Yountville, and ask the entire community to join in the effort, not only in April, but all year long, to end sexual violence.

DISCUSSION/BACKGROUND
In October 2022, the prior Town Council approved Resolution Number 22-4155 authorizing $50,000 of Fiscal Year 2021/2022 General Fund Unassigned Fund Balance to be Assigned for Parks and Recreation Community Use. The actual usage of this funding was to be determined at a later time.

At the Parks & Recreation Orientation meeting held February 14, 2023, the current Town Council indicated unanimous support toward the idea of this $50,000 being utilized for the installation of a permanent shade structure at the Community Center.

To initiate this plan, staff recommends that the Town Council approve a budget adjustment to transfer the $50,000 out of General Fund (01) and into Capital Projects Fund (50).

Subsequently, staff recommends the Town Council approve a budget of $50,000 in Fiscal Year 2022/2023 for CF-0022 Community Center Shade Structure Project.

According to the Public Works Department, total project costs for installation of this shade structure are estimated to be $150,000.

This $50,000 will be used to initiate the project in the current fiscal year and the remaining project cost of $100,000 will be presented in the proposed Fiscal Year 2023/2024 Budget.

Yountville Town Council Staff Report
DATE: April 4, 2023
TO: Mayor and Town Council
FROM: Celia King, Finance Director
PREPARED BY: Kyle Batista, Financial Analyst
SUBJECT:

Annual Administrative Update of the Master Fee Schedule.

DISCUSSION/BACKGROUND
The Master Fee Schedule was initially established by Resolution Number 2973-11 and has been updated annually thereafter in accordance with the Yountville Municipal Code. The annual update of the Town’s Master Fee Schedule is an administrative function completed by the management team.

The practice in place, as adopted by Town Council, is for staff to increase fees annually based on the February Consumer Price Index (CPI) for San Francisco-Oakland-Hayward, CA. The February 2023 CPI increase of 5.3% will be applied to all applicable fees.

Town staff will also be correcting the following clerical errors to stay in compliance with the related government codes:
• Increase the Administrative Services Notary Fee from $11.00 to $15.00 per Government Code 8211(a). • Decrease the Notice of Intent to Circulate Petition Fee from $242.00 to $200.00 per California Election Code 9202(b).
• Decrease the Political Reform Act Copies of Documents Fee from $0.12 to $0.10 per Government Code 81008(a).

The Master Fee Schedule was created to consolidate all of the Town’s fees and charges in one comprehensive document. The purpose of the Master Fee Schedule is to make it easier for those doing business with the Town to understand the costs associated with the services provided and allow Town staff to update and more efficiently manage the collection and administration of these revenues.

The Master Fee Schedule document is comprised of the following sections:
• Overview/Purpose Statement
• Administration
• Parks and Recreation Department
• Planning and Building Department
• Public Works and Engineering
• Water and Wastewater Rates
• Contract Services
• Fee Adjustment History
• Appendix with an index of prior Resolutions and Ordinances related to Town fees Each section includes a brief description of the services provided and identifies the fee, unit, or measure of service, and if a deposit is required.

A number of fees are set at actual cost to provide and require the applicant to pay an initial deposit towards those costs. If the cost to deliver the service is less than the deposit, the user receives a refund and if more than the deposit the user owes the outstanding balance. Actual costs include the calculation of the fully loaded staff costs (salary and benefit costs and administrative overhead) for the employee involved in providing the service and any consumable products used. The actual costs methodology is primarily used in the Planning and Building Department, Public Works and Engineering, and other applications where it is not possible to establish a fee, as the cost to provide the service is variable based on the project.

Where a set cost is established that fee is determined by the following criteria:
• Maximum fee as determined by applicable state law.
• Governed by Ordinance or Resolution in effect which would require Proposition 218 process (water and wastewater utility enterprise rates).
• Governed by Ordinance or Resolution which would require a vote of the public to change (such as business license which is a tax and not a user fee).
• A calculation based on the cost of the staff involved with the service delivery using fully loaded salary and benefits cost with administrative overhead, direct consumables used, and any equipment or vehicle costs involved with service delivery.

In accordance with California state law, the Town is not able to make an overall profit on the fees and charges collected, however the Town is able to fully recover the costs incurred to deliver the service.

The complete updated Master Fee Schedule, including the legislative history of all fees in the MFS, and copies of the Consumer Price Index are attached for reference.

MASTER FEE SCHEDULE

OVERVIEW
The Town Council of the Town of Yountville desires to comply with both the letter and the spirit of the California Constitution and limit the growth of taxes, by shifting, where possible, the burden of special regulatory programs and services and products directly to applicants and the recipients of the benefits thereof; and
In accordance with the Yountville Municipal Code, the Town Council further desires to continue its established policy of recovering costs reasonably borne of providing special services and programs of a voluntary and limited nature, and regulatory services deemed necessary to protect the public health, safety or welfare, such that general taxes are not diverted from general services of a broad nature and thereby utilized to subsidize unfairly and inequitably such special services.

PURPOSE
The Master Fee Schedule is hereby established in accordance with the Yountville Municipal Code and the Fiscal Year 2017‐2022 Strategic Plan elements related to Responsible Fiscal Policy: the Town Council further desires to continue its policy regarding charges to be recovered from users of certain Town services, and beneficiaries of certain Town programs, which the Town Council has determined are particularly important to protection of the public health, safety, and welfare, and to direct Town staff as to the methodology for implementing this direction to encourage certain users of Town services to obtain permits and inspections.

Yountville Town Council Staff Report
DATE: April 4, 2023
TO: Mayor and Town Council
FROM: John Ferons, Public Works Director
PREPARED BY: John Ferons, Public Works Director
SUBJECT:

Continue the Emergency Declaration for the Town of Yountville Recycled Water Transmission Main Repair pursuant to Yountville Municipal Code 3.32.390

DISCUSSION/BACKGROUND
Pursuant to Town of Yountville Municipal Code 3.32.390, Town Staff shall continue to make reports to Town Council at each regularly scheduled Town Council meeting until the emergency action is terminated by the Town Council. Town Council heard an Administrative Report at the February 21, 2023, Council meeting and determined the need to declare the emergency.

As a reminder, the Town owns and operates a Recycled Water Transmission Main that delivers treated wastewater to the golf course and various vineyard pond customers located on both the east and west sides of the Napa River. That transmission main is a 6-inch PVC pipe that traverses the floor of the Napa Valley from the treatment plant on the west side of the valley to various recycled water customers located on the east side of the valley. It was installed in 1977 and has been in continuous use since its inception. In one location the pipe crosses underneath the Napa River in a direct bury format, it is not installed within a casing pipe or encased in any protective concrete. It is at this location, underneath the Napa River, that a leak has been discovered.

At present the recycled water line has been valved off so, regardless of pump status, no water will enter the pipe with the leak. We will continue to deliver water to our customers on the west side of the river while communicating status to those on the east side of the river.

Update:

Public Works and Utility Staff are in actively working on the following:

1. Continued close conversation with our permit regulators.

2. Developing a temporary solutions to deliver the recycled water while permanent fix is designed.

3. Executing a contract with the Civil Engineer & Geotechnical Engineer to design permanent fix.

4. Negotiating a contract with an Environmental Consulting Firm to acquire environmental permits

5. Meeting with an underground contractor to evaluate directional boring alternatives.

Based on the continued weather and the runoff in the Napa River staff is estimating +/- two months to develop plans after the regular rains cease before the Town gets into the discharge/dilution prohibitions.

Exceptional Town Services and Staff: The Town supports its talented staff who deliver high quality municipal programs and services while maintaining public infrastructure for the benefit of the community. Responsible Fiscal Policy: The Town maintains its fiscal health through policies designed to maximize economic opportunities, manage expenses, and ensure prudent reserves.

The Recycled Water Transmission Main is necessary for the delivery of recycled water to our contract customers. A quick response facilitated by declaring an emergency is responsible fiscally because it reduces the time and cost associated with performing the repair which will reduce the Town’s exposure to any fines for regulatory non-compliance.

Yountville Town Council Staff Report
DATE: April 4, 2023
TO: Mayor and Town Council
FROM: Celia King, Finance Director
PREPARED BY: Celia King, Finance Director; Kyle Batista, Financial Analyst SUBJECT:

Consider adoption of Resolution Number 23-4197 modifying the Fiscal Year 2023/2024 Master Fee Schedule and conduct a public hearing regarding proposed fee increases and additions.

DISCUSSION/BACKGROUND
In accordance with the Yountville Municipal Code, the Town of Yountville desires to continue its established policy of recovering costs reasonably borne of providing special services and programs of a voluntary and limited nature, and regulatory services deemed necessary to protect the public health, safety or welfare, such that general taxes are not diverted from general services of a broad nature and thereby utilized to subsidize unfairly and inequitably such special services.

The Master Fee Schedule (MFS) was initially established by Resolution Number 2973-11 and has been updated annually thereafter in accordance with the Yountville Municipal Code.

The purpose of this staff report is to provide an explanation for fees that are increasing above the Consumer Price Index (CPI), new proposed fees to be added, and obsolete fees that should be removed from the MFS. All fees in the MFS accompanying this staff report include the CPI adjustments reflected in the Annual Administrative Update of the Master Fee Schedule, as well as the changes discussed below.

Existing fees to increase above the CPI adjustment
• Increase to Camp Program Fees above the annual CPI adjustment as needed to recover costs associated with successfully administering the Camp Program, including Indirect Administrative Overhead costs and Program and Instruction Costs that vary from program to program. • Increase in the Veterans Memorial Park Rental Fee due to increasing the capacity of the park from 50 to 90 people and the increased maintenance costs associated therewith. • The Town contracts out for Security Guard Services for special events held at the Community Center that require these services. The fee proposed is the rate charged by the contracted company of $60 per hour, per guard, and stipulates a 6-hour minimum for services as required by the vendor.

New fees to be added
• Previously established Parks & Recreation Event Fees that are outlined in the Town’s Recreation Guide.

Staff is proposing to include these fees in the MFS as this follows the historical practice of including all fees in the MFS which serves as the Town’s comprehensive list of fees and charges. • Previously established Parks & Recreation Sports Fees that are outlined in the Town’s Recreation Guide.

Staff is proposing to include these fees in the MFS as this follows the historical practice of including all fees in the MFS which serves as the Town’s comprehensive list of fees and charges. • Pickleball Court Rental Fee which would separate this rental from other court rental fees by listing it specifically in the MFS.
• Yountville Municipal Code Section 13.24.080 authorizes the Town to install a flow restricting device on the meter of any customer whose water use violates the provisions of Chapter 13.24 regarding Water Shortage Emergencies. Staff proposes adding Meter Installation – Water Flow Restrictive Meter Fee of $236 plus the cost of the meter.
• Tree Removal Public Hearing Required deposit of $1,500 which would provide for cost recovery of the actual costs of staff time spent preparing for a Public Hearing at a Town Council meeting regarding a tree removal application.
• Solar Permit Fee of $450 per permit for Town-issued solar installation permits. This fee is in accordance with California Government Code 66015.

Fees to be removed
• Staff is proposing to remove all fees associated with the After School Program as this program is no longer offered by the Town.
• Similarly, staff is proposing to remove all fees associated with the Youth Subsidy Program as this program is not offered through the Town, but through Town of Yountville Community Foundation. • Staff is proposing to remove Parks and Recreation Other Facility Services Insurance Fee as customers now purchase insurance through the company used instead of through the Town. • Remove the Bocce Rental fee as this is no longer offered through the Town. • Remove the Bocce Court Lights fee as this option is no longer offered. • Remove the Yountville Arts Gallery Entry Fee as it is no longer charged. • Town of Yountville meeting agendas are now provided electronically, free of charge. The Agenda Packet Subscription Fee is no longer used and is therefore proposed to be removed. • Similarly, the Town of Yountville General Plan is available for free electronically, and the fee for a copy of the General Plan is therefore proposed to be removed. • Town of Yountville does not produce audio tapes/VHS tapes and therefore staff is proposing to remove this fee.
• Similarly, the Town of Yountville does not produce CD/DVD’s of any files, and this fee is therefore proposed to be removed.
• Bingo for profit is illegal in California, and therefore the Bingo Permit – Commercial for Profit fee is proposed to be removed.

Additional amendments to existing fees
• Parks and Recreation Heritage Room Cleaning Fee to be reduced from $338.00 to $330.00 due to decrease in agreement amount with the contractor.
• Similarly, Parks and Recreation Generation Room Cleaning Fee to be reduced from $379.00 to $330.00 due to decrease in agreement amount with contractor.
• A decrease in Yountville Community Park Sites #3 and #4 fees from $75.00 (resident) and $236.00 (nonresident) due to decreasing the capacity of these sites from 75 to 50 people. Additionally, this decrease creates consistency between fees for Yountville Community Park Sites #1 - #4. • Remove the redundant fees for Bocce Courts #2 - #4 as these fees are the same as Bocce Court #1. • Make the following changes to comply with government regulations:
o Increase the Administrative Services Notary Fee from $11.00 to $15.00 per Government Code section 8211(a).
o Decrease the Notice of Intent to Circulate Petition Fee from $242.00 to $200.00 per California Election Code section 9202(b).
o Decrease the Political Reform Act Copies of Documents Fee from $0.12 to $0.10 per Government Code section 81008.

More details on the fees, along with the description of the calculations demonstrating the fees do not exceed the cost of providing the service, are included as Exhibit A to the proposed resolution, incorporated herein by reference.

The Master Fee Schedule included for reference reflects the administrative annual update, as well as all other fee increases, additions, and removals proposed in this staff report.

ENVIRONMENTAL REVIEW
Exempt per California Environmental Act (CEQA) Guidelines, Sections 15061(b)(3) (the “common sense” exemption) and 15273 (establishing charges for operating expenses).

Yountville Town Council Staff Report
DATE: April 4, 2023
TO: Mayor and Town Council
FROM: John Ferons, Public Works Director
PREPARED BY: John Ferons, Public Works Director
SUBJECT:

Water Conservation Update

DISCUSSION/BACKGROUND
Droughtlook
After the three driest years on record, rain and snowfall in 2023 have dramatically changed water supply and drought conditions in many parts of the state. The Napa Valley is now down to the least drought designation, Abnormally Dry. The State is now moving to ease water restrictions that may no longer be needed due to water supply conditions. In Yountville for example, our water supply, Rector Reservoir is 100% full and we are waiting the State’s determination as to the drought status and what our annual water allotment will be. That allotment is due to the Town on or about April 1st.

Tracking Water Conservation
Also at the time of the writing of this Staff Report the March 2023 water usage numbers were not available as the month of March is not over, however they will be available and reported during the Town Council meeting April 4, 2023. The Staff Informational Item to Council on April 4th will include the usual presentation with the Town’s water use numbers.

A future Town Council meeting agenda will include a more in depth look at the State’s stance on easing drought restrictions and consideration of the Town’s Phase II Water Shortage Emergency Declaration based on CalVet’s annual water allocation.
