DISCUSSION/BACKGROUND
Town of Yountville Municipal Code Chapter 3.40 allows the Town to charge Development Impact Fees on commercial and residential development projects. California Government Code Section 66000 et seq. (“Mitigation Fee Act” also known as AB 1600) requires local agencies to provide a report of these fees charged to development projects. The reporting requirements include an annual report, and a five-year findings report.
The annual report, which must be made available to the public within 180 days after fiscal year end (June 30), must provide the following information:
• Brief description of the impact fee.
• The amount of each fee.
• The Impact Fee Fund beginning and ending balance.
• The amount of fees collected into, and the interest earned in each impact fee fund. • Identification of each improvement the fees were used towards, the total amount of funds from all sources spent on that improvement, and the percentage of that total funded with impact fees. • An estimated date of when the construction of an improvement will begin • Brief description of interfund transfers or loans made from impact fee funds. • The amount of any refunds processed pursuant to Government Code Section 66001.
In addition, the five-year findings report must include the following:
• The purpose of each impact fee.
• Demonstration of a reasonable relationship between the fee and the purpose for which it was charged.
• Identification of all sources and amounts of funding anticipated to complete financing of incomplete improvements.
• Estimated dates of when these funding sources can be expected to be received into the appropriate impact fee fund.
The Town’s annual report for Fiscal Year 2023/2024 was made available to the public on November 15, 2024. The report is included as an attachment to this staff report for the Town Council’s review and acceptance, which must be completed at its first regular meeting, that is at least 15 days after the report is made available to the public.
