RECOMMENDATION
Introduce and waive first reading of Ordinance Number 25-537 amending Chapter 13.18 to comply with new regulations from the State Water Resources Control Board for the Town’s Water Enterprise to administer and operate a cross-connection control program for the potable water distribution system.
DISCUSSION/BACKGROUND
The Town of Yountville is required by the State Water Resources Control Board (State Board) to administer and operate a cross-connection control program, often referred to as a backflow program. The primary objective of the cross-connection control program is to protect the public potable water supply system from contamination or pollution by isolating the Water User’s internal distribution system(s) or the Water User’s private water system(s), contaminants or pollutants which could backflow into the public water system. Cross-connections or backflow can occur when water that has passed through a customer’s meter flows back into the distribution system, usually through a customer’s meter.
In December 2023, the State Board adopted the Cross-Connection Control Policy Handbook (CCCPH) that replaced requirements of Title 17 of the California Code of Regulations governing backflow prevention and crossconnection control.
The State Water Resources Control Board have set an effective date of July 1, 2024, for the regulations of the CCCPH with a requirement that public water system agencies submit a written Cross-Connection Control Plan for State Board review and approval by July 1, 2025. The Town has received an extension from the State Board and has a revised deadline of October 31, 2025. This extension provides sufficient time required for Town Council approval and completion of the cross-connection plan.
Town staff have consulted with the Town Attorney and this Staff Report is presenting to Town Council the attached amended municipal Ordinance 13.18.010, 13.18.020, 13.18.030, 13.18.040, and 13.18.060 prepared to comply with the above requirement. The Cross-Connection Control Plan will be submitted to the State Water Resources Control Board for their approval and staff will continue to ensure compliance with ongoing backflow prevention assemblies testing, site inspections and enforcement.
