RECOMMENDATION
Adopt Resolution Number 26-4411 appointing and approving an employment agreement with Ken MacNab as Interim Town Manager.
DISCUSSION/BACKGROUND
The Town of Yountville is in the process of recruiting to fill the vacant position of Town Manager and during such recruitment, desires to appoint a person with specialized skills qualified to fill the position on an interim basis in order to prevent stoppage of public business and continue Municipal operations during recruitment for a permanent appointment.
Mr. Ken MacNab has had a long career in public service, including as a former City Manager, Community Development Director, and Planning Manager for local municipalities in Northern California. Notably, Mr.
MacNab has previously served as Interim Planning and Building Director for Yountville. Mr. MacNab is the ideal candidate, with the necessary skills, expertise, and background to be a strong fit for the Town.
Mr. MacNab is a retiree under the California Public Employees’ Retirement System (CalPERS) and his postretirement employment with CalPERS agencies is subject to the provisions of Government Code Sections 7522.56 and 21221(h). State law requires that an individual receiving a pension benefit from a public retirement system may only be employed by a public agency in the same retirement system for certain specified reasons, including to fill a vacant position during recruitment for a permanent appointment and deemed by the Council to require specialized skills or during an emergency to prevent stoppage of public business. Also, there is a limit of 960 hours worked in a fiscal year, and the annuitant’s hourly rate must be no more than the hourly rate for comparable employees. As outlined in the attached CalPERS Annuitant Employment Agreement, Mr. MacNab will begin on May 5, 2026 until the hiring of a Town Manager or through September 30, 2026, whichever occurs first, at an hourly rate of $137.7118. Finally, the Town’s governing body, the Town Council, must approve the appointment as an action item at a public meeting, and attached is a Resolution for the Town Council’s consideration.
