TO: Mayor and Town Council
FROM: Aaron Hecock, Planning & Building Director

RECOMMENDATION
Introduce and waive first reading of Ordinance Number 26-540 repealing Ordinance Number 26-539 which repealed and replaced Section 17.08.010, added Chapter 17.46 (C, Commons), and amended Sections

17.08.050, 17.156.030, 17.162.020, 17.176.010, 17.236.010 and Table 17.12-1 of Section 17.12.010 of Title 17 (Zoning) of the Yountville Municipal Code and amended the Yountville Zoning Map to establish the Commons (C) Zoning District.

DISCUSSION/BACKGROUND
On February 3, 2026, the Town Council adopted Ordinance Number 26-539 (Attachment “2”) amending the Zoning Ordinance and the Zoning Map related to the Yountville Commons site.

On March 4, 2026, a petition for a referendum against Ordinance Number 26-539 was filed with the Town Clerk.

On March 13, 2026, the Registrar of Voters of the County of Napa certified the referendum petition contained a sufficient number of valid signatures to qualify for consideration by the Town Council pursuant to California Elections Code section 9237.

Following certification of the referendum petition, Elections Code section 9241 requires the Town Council to either: (1) repeal Ordinance Number 26-539 in its entirety, or (2) submit Ordinance Number 26-539 to the voters at the next regular municipal election or a special election called for that purpose.

At the April 7, 2026, Town Council meeting, the Town Council unanimously directed staff to prepare an Ordinance repealing Ordinance Number 26-539 in its entirety.

Because Ordinance Number 26-539 required a recommendation from the Zoning and Design Review Board (ZDRB) before Town Council consideration and adoption, an Ordinance repealing that Ordinance must follow the same procedures under the equal-dignity rule. Following a recommendation from the ZDRB, the Town Council may then take action to introduce the repeal Ordinance at one meeting and adopt the repeal Ordinance at a subsequent regular meeting. The repeal Ordinance would take effect 30 days after adoption. Ordinance Number 26-539 would remain suspended during this process. If Ordinance Number 26-539 is repealed, the same Ordinance cannot be adopted for a period of one year after the date of repeal. The Town may, however, consider a different Ordinance.

On May 12, 2026, the ZDRB unanimously approved Resolution Number 26-032 recommending the Town Council adopt Ordinance Number 26-540 repealing Ordinance Number 26-539. Board comments centered around continuing to move forward while directly addressing issues of concern, building trust and finding solutions.

ENVIRONMENTAL REVIEW
Pursuant to CEQA Guidelines Sections 15183 and 15162, no subsequent environmental impact report or negative declaration is necessary to repeal Ordinance Number 26-539. The repeal of Ordinance Number 26- 539 will restore prior zoning regulations and designations previously in effect which are consistent with the Environmental Impact Report for the Envision Yountville General Plan (SCH # 2018082008) adopted by Town Council Resolution Number 19-3551 on May 7, 2019. There are no peculiar environmental impacts, significant effects, substantial new information, or substantial changes in circumstances that would necessitate the preparation of additional environmental documentation. The repeal of Ordinance Number 26-539 is also exempt pursuant to CEQA Guidelines Section 15061(b)(3) as it can be seen with certainty that reverting to a prior version of the Yountville Municipal Code and Zoning Map, in the absence of any changed physical or environmental conditions, will not have a significant effect on the environment.
