SECTION 3. ZONING ORDINANCE AND MAP AMENDMENT FINDINGS. The Town Council hereby makes the following findings required by YMC Section 17.184.060 and the evidence contained in the Record which is herein incorporated by reference:

1. The proposed amendments would further the goals, objectives, policies and programs and is consistent with the intent of the General Plan in that repealing Ordinance No. 26-539 would return the zoning designations of the subject property to what existed before the Ordinance was adopted.

2. The proposed amendments would not be detrimental to the public interest, health, safety, convenience, or welfare of the Town in that repealing Ordinance No. 26-539 would return the zoning designations of the subject property to what existed before Ordinance No. 26-539 was adopted and would therefore not be detrimental to the public interest, health, safety, convenience or welfare of the Town.

3. For amendments involving a zoning or land use map amendment, the site is physically suitable, including consideration of physical constraints, access, Ordinance No. 26-540
compatibility with surrounding land uses, and provision of utilities, for the requested or potential land uses. Repealing Ordinance No. 26-539 would return the zoning designations of the subject property to what existed before Ordinance No. 26-539 was adopted and would therefore not be detrimental to or inconsistent with the General Plan, other land uses, or the provision of utilities.

SECTION 4. CEQA. The Town Council has considered all of the evidence in the Record, including the staff reports, the testimony received during the meeting on the matter held by the Town Council, and hereby determines that this Ordinance is exempt from review under the California Environmental Quality Act (CEQA). Pursuant to CEQA Guidelines Sections 15183 and 15162, no subsequent environmental impact report or negative declaration is necessary to repeal Ordinance No. 26-539. The repeal of Ordinance No. 26-539 will restore prior zoning regulations and designations previously in effect which are consistent with the Environmental Impact Report for the Envision Yountville General Plan (SCH # 2018082008) adopted by Town Council Resolution 19-3551 on May 7, 2019.

There are no peculiar environmental impacts, significant effects, substantial new information, or substantial changes in circumstances that would necessitate the preparation of additional environmental documentation. The repeal of Ordinance No. 26- 539 is also exempt pursuant to CEQA Guidelines Section 15061(b)(3) as it can be seen with certainty that reverting to a prior version of the Yountville Municipal Code and Zoning Map, in the absence of any changed physical or environmental conditions, will not have a significant effect on the environment.

SECTION 5. ORDINANCE REPEAL. Ordinance No. 26-539 is hereby repealed in its entirety.
