A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF YOUNTVILLE APPROVING
A SUBDIVISION IMPROVEMENT AGREEMENT, A FINAL MAP FOR A MAJOR SUBDIVISION, AND AN AFFORDABLE HOUSING AGREEMENT FOR THE “OAK + VINE” SUBDIVISION PROJECT LOCATED AT 1980 YOUNTVILLE CROSS ROAD (APN 031-260- 026).
Recitals
A. WHEREAS, on January 17, 2025, Crossroad Circle, LLC/Terry MacRae (the “Applicant”) submitted an application for a Major Subdivision Final Map for (the “Application”) for the residential subdivision project located at 1980 Yountville Cross Road.
B. WHEREAS, on July 16, 2024, the Town Council adopted Resolution 24-4292, which conditionally approved the Application for Vesting Tentative Map for a Major Subdivision, Preliminary and Final Master Development Plan, Density Bonus Waivers and Concessions, Major Design Review, Tree Removal Permit, and Fence Extension Request for a residential development project located at 1980 Yountville Cross Road named Oak + Vine Subdivision (the “Project”), and found the Project to be exempt from the California Environmental Quality Act under CEQA Guidelines Section 15332 for Infill Development Projects.
C. WHEREAS, the Project is subject to the State of California Subdivision Map Act (Gov.
Code § 66410), the Yountville Municipal Code (YMC), including Title 16 Subdivisions and Chapter 17.160, and the Project Conditions of Approval contained in Resolution 24-4292.
D. WHEREAS, the Town of Yountville determined the Application to be complete on February 10, 2025.
E. WHEREAS, the Town of Yountville approved the Subdivision Improvement Plans, received the Improvement Securities required from the Applicant, and issued the building permit for these improvements on October 9, 2025.
F. WHEREAS, approval of the Final Map is contingent upon the conformance of the Final Map with the requirements listed in YMC §§ 16.16.030, review and approval by the Town Engineer, and approval by the Town Council. The Final Map approval is also contingent on the approval and execution of a Subdivision Improvement Agreement and an Affordable Housing Agreement to meet the conditions of the Project approval and the Yountville Municipal Code §§ 16.32 and 17.160.
G. WHEREAS, the Applicant has requested to enter into the required Subdivision Improvement Agreement with the Town of Yountville to ensure the timely completion of the Subdivision Improvements.
H. WHEREAS, pursuant to YMC § 116.16.030(G) and (H), the Town Council is the authority responsible for approving the Final Map, as well as approving and authorizing the execution of the Subdivision Improvement Agreement and the Affordable Housing Agreement.
I. WHEREAS, on June 23, 2026, in accordance with YMC § 16.16.030, the Town Engineer found the Final Map and associated documents to be in conformance with the Subdivision Map Act and Yountville Municipal Code and received the map in its final form and signed by all parties required by the Map Act and the Yountville Municipal Code to execute the certificates on the map.
J. WHEREAS, on July 7, 2026, the Town Council conducted a duly noticed public meeting in accordance with YMC § 16.16.030 to consider the Application.
NOW, therefore, the Town Council of the Town of Yountville does resolve as follows:
SECTION 1. RECITALS: The foregoing recitals are true and correct and are incorporated into the findings herein.
SECTION 2: RECORD: The Record of Proceedings ("Record") upon which the Town Council bases its decision includes, but is not limited to: (1) staff reports, Town files and records and other documents prepared for and/or submitted to the Town relating to the Application and Project, including Resolution 24-4292, (2) the evidence, facts, findings and other determinations set forth in this resolution, (3) the Town of Yountville General Plan and its certified final EIR and the Yountville Municipal Code, (4) all designs, plans, studies, data and correspondence submitted to the Town in connection with the Application, (5) all documentary and oral evidence received at public workshops, meetings, and hearings or submitted to the Town, and (6) all other matters of common knowledge to the Town Council including, but not limited to, Town, state, and federal laws, policies, rules, regulations, reports, records and projections related to development within the Town of Yountville and its surrounding areas.
The location and custodian of the records is the Town of Yountville Planning and Building Department at 6550 Yount St, Yountville, CA 94599.
SECTION 3: DETERMINATION
The Town Council hereby approves the Subdivision Improvement Agreement, Final Map, and Affordable Housing Agreement, instructs the Mayor to execute the Subdivision Improvement Agreement on behalf of the Town, authorizes the Interim Town Manager to execute the Affordable Housing Agreement and side letter. The Town Council further authorizes the Town Clerk to execute the appropriate certificates on the certificate and forward the documents, or have an authorized agent forward the map and organization documents including the Covenants, Conditions and Restrictions, to the Clerk of the County Board of Supervisors for transmittal to the County Recorder, to be recorded in the following order: (1) Subdivision Improvement Agreement; (2) Final Map and organization documents; (3) Affordable Housing Agreement on Lot 1 of the recorded Final Map; (4) Stormwater Maintenance Management Plan.
SECTION 4: CERTIFICATION: The Town Clerk shall attest and certify the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.
SECTION 5. EFFECTIVE DATE: This Resolution shall become effective immediately upon its adoption.
