Re: Oak + Vine Project – Letter Agreement on Timing of Recordation of Affordable Housing Agreement
Dear Town Manager:
On behalf of Crossroads Circle, LLC, we look forward to the Town Council’s review of the Oak + Vine Final Map which we understand will be scheduled soon.
As you know, in accordance with the Town’s Inclusionary Housing Program, the Oak + Vine project includes one affordable housing unit. In conformance with the project’s conditions of approval, the project will rehabilitate the existing single-family dwelling unit on the property and make it available for rent to low-income households with incomes between 80% and 50% of the Area Median Income on Lot One of the nine lot subdivision. In collaboration with the Town’s counsel, we have prepared an Affordable Housing Agreement which, among other things, establishes the rent and use restrictions, eligibility requirements, and related obligations to ensure the unit remains affordable to low-income households for a 55-year term.
Section 17.160.020(H)(4) of the Town’s Municipal Code specifies that the Affordable Housing Agreement is to be recorded on the parcel or parcels designated for construction of the affordable units prior to approval of the Final Map. In this case, however, since the parcel that will accommodate the affordable unit cannot be created until after the Final Map is approved and recorded, it follows that recordation of the Affordable Housing Agreement should be deferred until after the Final Map is recorded. Otherwise, all nine parcels would be burdened by the Affordable Housing Agreement which would severely affect the marketability of the market-rate units that are not subject to the Town’s affordability restrictions.
To account for the need to obtain the Town’s approval of the Final Map before Lot One can be created for the affordable unit, and consistent with the Municipal Code requirement that the Affordable Housing Agreement applies only to the parcel that accommodates the affordable unit, we respectfully request that we or the Town record the Affordable Housing Agreement immediately after the Final Map is recorded, but no later than prior to issuance of the first certificate of occupancy for the project.
