City of Yreka City Council
Regular Meeting April 05, 2022
61 CITY OF YREKA INVESTMENT POLICY ‐ Dated 4/05/2022
2 CITY OF YREKA

INVESTMENT POLICY
Dated 4/05/22
I. PURPOSE
This statement is intended to provide guidelines for the prudent investment of the City's surplus money in its treasury (hereinafter “Investment Cash”) and to outline policies for maximizing the efficiency of the City's Investment Cash management system. The ultimate goal is to enhance the economic status of the City while protecting its pooled Investment Cash.

II. POLICY
It is the policy of the City of Yreka to invest public funds in a manner which will provide a sound investment return with maximum security while meeting the daily cash flow demands of the entity and conforming to all state and local statutes governing the investment of public funds. The City of Yreka’s investment policy has three objectives: (1) protect principal, (2) provide for liquidity needs, and (3) obtain the most reasonable rate of return possible within the first two objectives. The City operates its investment activities under the “prudent investor” standard (see discussion below). This affords a broad spectrum of investment opportunities so long as the investment is deemed prudent and is permissible under current state and local law.

III. SCOPE
This investment policy applies to all liquid financial assets of the City of Yreka.

IV. PRUDENT INVESTOR STANDARD
The City Council and all persons authorized to make investment decisions on behalf of the City are trustees and therefore fiduciaries subject to the prudent investor standard. When investing, reinvesting, purchasing, acquiring, exchanging, selling, or managing public funds, a trustee shall act with care, prudence, and diligence considering existing circumstances, general economic conditions and the anticipated needs of the City, to safeguard the principal and maintain the liquidity needs of the City. Within the limitations of this section and considering individual investments as part of an overall strategy, investments may be acquired as authorized by law.

It is the City's full intent, at the time of purchase, to hold all investments until maturity to ensure the return of all invested principal dollars. However, it is realized that market prices of securities will vary depending on economic and interest rate conditions at any point in time. It is further recognized, that in a well-diversified investment portfolio, occasional measured losses are inevitable due to economic, bond market or individual security credit analysis. These occasional losses must be considered within the context of the overall investment program objectives and the resultant long term rate-of-return.

The City Treasurer and other individuals assigned to manage the investment portfolio, acting within the intent and scope of the investment policy and other written procedures and exercising due diligence, shall be relieved of personal responsibility and liability for an individual security's credit risk or market price changes, provided deviations from expectations are reported in a timely manner and appropriate action is taken to control adverse developments.

V. OBJECTIVES
The City's cash management system is designed to accurately monitor and forecast expenditures and revenues, thus enabling the City to invest Investment Cash to the fullest extent possible. The City strives to obtain the most reasonable yield possible as long as investments meet the criteria for safety and liquidity.

Safety
Safety of principal is the foremost objective of the investment program. Investments of the City shall be undertaken in a manner which seeks to ensure the preservation of principal in the overall portfolio. To attain this objective, diversification is required in order that potential losses on individual securities do not exceed the income generated from the remainder of the portfolio. Risk associated with an investment refers to the potential loss of principal, interest or a combination of both. The City shall seek to preserve principal by mitigating the two types of risk - credit risk and market risk.

Credit risk - Defined as the risk of loss due to failure of the issuer of a security. Credit risk shall be mitigated by investing in investment grade securities and by diversifying the investment portfolio so that the failure of any one issuer does not unduly harm the City's cash flow.

Market Risk - Defined as market value fluctuations due to overall changes in the general level of interest rates. Market risk shall be mitigated by limiting the weighted average maturity of the City's investment portfolio to three and one-half years, the maximum maturity of any one security to five years, and structuring the portfolio based on historic and current cash flow analysis eliminating the need to sell securities prior to maturity.

Liquidity
The City's investment portfolio shall remain sufficiently liquid to enable the City to meet all operating requirements which might be reasonably anticipated. This goal shall be achieved by maintaining a prudent portion of the City’s portfolio in liquid, short-term instruments which can readily be converted to cash if necessary.

Return on Investment
The City’s investment portfolio shall be designed with the objective of attaining a sound rate of return throughout budgetary and economic cycles, commensurate with the City’s investment risk constraints and the cash flow characteristics of the portfolio. The City will attempt to obtain the most reasonable yield possible when selecting an investment, provided the criteria for safety and liquidity are met.

VI. DELEGATION OF AUTHORITY
In accordance with California Government Code Section 53607, the Yreka City Council has authorized the City Treasurer to invest on behalf of the City, to manage the City’s investment program consistent with this investment policy, and to maintain a system of internal controls to regulate investment activities.

VII. PUBLIC TRUST
All participants in the investment process shall act as custodians of public funds. Investment officials (City Manager and City Treasurer) shall recognize that the investment portfolio is subject to public review and evaluation. The overall program shall be designed and managed with a degree of professionalism that is worthy of the public trust. In a diversified portfolio it must be recognized that occasional measured losses are inevitable, and must be considered within the context of the overall portfolio's investment return, provided that adequate diversification has been implemented.

VIII. ETHICS AND CONFLICTS OF INTEREST
Officials involved in the investment process shall refrain from personal business activity that conflicts with proper execution of the investment program, or impairs their ability to make impartial investment decisions. Additionally the City Treasurer (Finance Director) and other key personnel are required to annually file applicable financial disclosures as required by the Fair Political Practices Commission (FPPC).

IX. QUALIFIED BROKER/DEALERS
The City shall transact business only with qualified banks, savings and loans, and broker/dealers.

Investment staff shall investigate dealers who wish to do business with the City to determine that they are adequately capitalized, have no pending legal action against the firm or the individual broker and that they participate in markets appropriate to the City's needs.

The City shall send a copy of the current investment policy to all broker/dealers approved to do business with the City. Confirmation of receipt of this policy shall be considered evidence that the dealer understands the City's investment policies and intends to sell the City only appropriate investments authorized by this investment policy.

Within the context of code limitations, the following investments and their respective additional limitations are authorized:

When structuring the maturity composition of the portfolio, the city shall evaluate current and expected interest rate yields and necessary cash flow requirements. It is recognized that in normal market conditions longer maturities produce higher yields. However, the securities with longer maturities also experience greater price fluctuations when the level of interest rates change.

XVIII. PERIODIC TREASURY REPORTS
The City Treasurer shall review and render monthly reports to the City Manager and City Council which shall include the par value and cost of the investment, the type of investment, the name of the issuer, the coupon rate of interest, the maturity date, and the current market value.

XIX. LEGISLATIVE CHANGES
Any State of California legislative action, that further restricts allowable maturities, investment type or percentage allocations, shall be incorporated into the City of Yreka's Investment Policy and shall supersede any and all previous applicable language.

XX. INTEREST EARNINGS
All interest earned and collected from investments authorized in this policy shall be allocated monthly to all pooled cash funds based on the cash balance in each fund as a percentage of the entire pooled portfolio.

XXI. LIMITING MARKET VALUE EROSION
It is the general policy of the City to limit the potential effects from erosion in market values by adhering to the following guidelines:
 All immediate and anticipated liquidity requirements shall be addressed prior to purchasing investments.
 Maturity dates for investments shall coincide with significant cash flow requirements, where possible, to assist with cash requirements at maturity.  All securities shall be purchased with the intent to hold all investments to maturity. However, economic or market conditions may change, making it in the City's best interest to sell or trade a security prior to maturity.

XXII. STATEMENT OF INVESTMENT POLICY
The City of Yreka's Investment Policy shall be adopted by Resolution of the City Council. This investment policy shall be reviewed at least annually to ensure its consistency with the overall objectives of preservation of principal, liquidity and yield, and its relevance to current law and financial and economic trends. Any amendments to the policy shall be forwarded to the City Council for approval.

XXIII. GLOSSARY OF TERMS

Diversification - Dividing investment funds among a variety of securities offering independent returns and risk profiles.

The mission of the FHLBs is to liquefy the housing related assets of its members who must purchase stock in their district Bank.

Federal Home Loan Mortgage Corporation (FHLMC) - The FHLMC was created under the Federal Home Loan Mortgage Act, Title III of the Emergency Home Finance Act of 1970 as a stockholder owned government-sponsored enterprise. Freddie Mac, as the corporation is called, is charged with providing stability and assistance to the secondary home mortgage market by buying first mortgages and participation interests and reselling these securities in the form of guaranteed mortgage securities. Although agency obligations are not explicitly guaranteed by the federal government, the rating agencies believe that in the unlikely event of financial difficulties, the federal government will support the agency to the extent necessary to provide for full and timely payment on their securities.

Federal National Mortgage Association (FNMA) - FNMA, like GNMA was chartered under the Federal National Mortgage Association Act in 1938. Interest Rate - The annual yield earned on an investment, expressed as a percentage.

Liquidity - Refers to the ability to rapidly convert an investment into cash with minimal risk of losing some portion of principal and/or interest.

Master Repurchase Agreement - A written contract covering all future transactions between the parties to repurchase and/or reverse repurchase agreements that establish each party’s rights in the transactions. The purchase of municipal securities is a loan to the bond issuer in exchange for regular interest payments and the return of the original investment.

Prudent Investor - An investment standard. In some states the law requires that a fiduciary, such as a trustee, may invest money only a list of securities selected by the custody state - the so-called legal list. In other states the trustee may invest in a security if it is one which would be brought by a prudent person of discretion and intelligence who is seeking a reasonable income and preservation of capital.

Rate of Return - The yield obtainable on a security based on its purchase price or its current market price. This may be the amortized yield to maturity on a bond or the current income return.

Repurchase Agreement (RP or REPO) - A holder of securities sells these securities to an investor with an agreement to repurchase them at a fixed price on a fixed date. The security “buyer” in effect lends the “seller” money for the period of the agreement, and the terms of the agreement are structured to compensate him for this. Dealers use RP extensively to finance their positions.

Exception: When the Fed is said to be doing RP, it is lending money, that is, increasing bank reserves.

Reverse Repurchase Agreement (Reverse REPO) - A transaction where the seller (City) agrees to buy back from the buyer (bank) the securities at an agreed upon price after a stated period of time.

Risk - Degree of uncertainty of return on an asset.

Discussion/Possible Action: Continuation of Urgency Ordinance 864.

April 5, 2022
Discussion:

The drought, prevailing climatic temperatures, and the allocation of Yreka Fire Resources to mutual aid to suppress wildfires was found to constitute an immediate threat to the public safety.

Ordinance 864 delays the sale of fireworks and the use of fireworks and public displays of pyrotechnics until the threat to public safety is abated.

Recommendation:

That the Council continue Urgency Ordinance 864.

City of Yreka City Council
Regular Meeting April 05, 2022
78 SUMMARY OF ADOPTED URGENCY ORDINANCE No. 864
Please take notice that the Yreka City Council adopted, at an emergency meeting held on July 29, 2021, a temporary urgency ordinance, number 864, entitled: “AN UNCODIFIED URGENCY

ORDINANCE OF THE CITY OF YREKA DECLARING A LOCAL EMERGENCY, AND AUTHORIZING THE

DELAY OF THE SALE AND USE OF FIREWORKS WHICH MAY CREATE A THREAT TO PUBLIC SAFETY

DEEMED TO BE ARISING FROM THE INCIDENCE OF THE LAVA FIRE AND SETTING FORTH THE FACTS CONSTITUTING SUCH URGENCY AND FINDING THE ORDINANCE EXEMPT FROM CEQA REVIEW” This urgency ordinance generally provides:

1. The factual background of the Lava Fire, the drought, the prevailing climatic temperatures and the fact that Yreka’s Fire Resources are engaged in mutual aid to suppress the Lava Fire as well as the allocation of law enforcement resources in traffic control and the fact that without Yreka’s normally available police and fire resources, the use of fireworks and pyrotechnics fire may not be able to be suppressed which was found to constitute the basis for the urgency nature of the ordinance and the City Council determined that there existed an immediate threat to the public health, safety and/or welfare and a need for immediate preservation of the public peace, health, or safety that warrants the adopted urgency measures.

2. The ordinance delays the sale of fireworks and the use of fireworks and public displays of pyrotechnics until the threat to public safety is abated and the urgency ordinance is terminated.

3. The city council determined that a local emergency now exists and shall continue to exist until its termination is ordained by the City Council. The need for continuance of the urgency measures will be regularly reviewed by City Council until it is terminated. The ordinance will be terminated at the earliest possible time.

4. The ordinance vests in the City Manager, Chief of Police and the Fire Chief with the discretion to take such acts as may be necessary to effectuate the intent of the ordinance.

5. The Council determined that the ordinance complies with a categorical exemption from CEQA review.

By roll call vote the following councilmembers voted in favor of the ordinance: Duane Kegg, Deborah Baird, Paul McCoy and Corey Middleton.

This summary is not intended to be a comprehensive statement of all of the provisions of the Ordinance, but constitutes only a fair summary of the Ordinance. The complete text of the Ordinance and the minutes of the emergency session is available for review online in Yreka’s City Council Agenda section or through a public records request as an in-person review of it is not available because City Hall is not currently open to the public.

79 BUSINESS OF THE COUNCIL OF THE CITY OF YREKA

AGENDA REPORT
For meeting of: April 5, 2022
TO: Honorable Mayor and City Council
FROM: Dohn Henion, Yreka City Attorney
TITLE: RESOLUTION TO CONTINUE HOLDING PUBLIC MEETINGS REMOTELY (AB 361) RECOMMENDATION:

In accordance with Assembly Bill 361, adopt a resolution to continue conducting the City’s Council, Commission, and Committee meetings remotely due to health and safety concerns to the public due to COVID-19.

FISCAL IMPACT:

There is no fiscal impact associated with this item.

BACKGROUND:

On March 4, 2020, Governor Newsom declared a State of Emergency to make additional resources available, formalize emergency actions already underway across multiple state agencies and departments, and help the state prepare for a broader spread of COVID-19.

Thereafter, on March 17, 2020, Governor Newsom issued Executive Order N-2920, which suspended certain provisions of the Ralph M. Brown Act to allow local legislative bodies to conduct meetings telephonically or by other means. Additionally, the State implemented a shelter-in-place order, requiring all non-essential personnel to work from home.

Staff quickly worked to set up remote meetings via Zoom for all City Council and Planning Commission meetings. The Zoom meetings have allowed the Council, Commissions, and Committees to continue to conduct City business from the safety of members’ homes. The City has been utilizing Zoom for the past 18 months to conduct nearly all public meetings. The usage of Zoom for public meetings has allowed the City to ensure the public’s continued access to government meetings while also ensuring the public’s safety.

On June 11, 2021, Governor Newsom issued Executive Order N-08-21, which extended the ability of agencies to hold remote meetings through September 30, 2021, after which agencies anticipated transitioning back to public meetings held in full compliance with the Brown Act. In preparation for the return to in-person meetings, staff has been working on acquiring audio and visual upgrades for City facilities to conduct hybrid meetings. Although hybrid meetings would help to keep the public safe by allowing them to continue accessing the meetings from their own home, Councilmembers, Commissioners, Committee members, and staff would need to meet in person.

City of Yreka City Council
Regular Meeting April 05, 2022
80 Since the Governor issued Executive Order N-08-21, the Delta variant has emerged, causing a spike in cases throughout the state.

On September 16, 2021, Governor Newson signed Assembly Bill 361 (AB 361), which allows cities to continue to meet remotely during proclaimed states of emergency under modified Brown Act requirements that are similar but not identical to the rules and procedures established by the previous Executive Orders.

AB 361 authorizes local agencies to use teleconferencing without complying with the teleconferencing requirements imposed by the Ralph M. Brown Act during a declared state of emergency, when state or local health officials have imposed or recommended measures to promote social distancing during the proclaimed state of emergency, or when there is an imminent risk to the health or safety of attendees.

DISCUSSION:

AB 361 will allow local legislative bodies to continue to meet remotely after the September 30, 2021 expiration of the Governor’s executive orders. A local agency will be allowed to continue to meet remotely when:
• The local agency holds a meeting during a declared state of emergency • State or local health officials have imposed or recommended measures to promote social distancing
• Legislative bodies declare the need to meet remotely due to present imminent risks to the health or safety of attendees
The City meets the requirements to continue holding meetings remotely to ensure the health and safety of the public due to the following:
• The City is still under a local state of emergency;
• County health orders require that all individuals in public spaces maintain social distancing and wear masks;
• The City can’t maintain social distancing requirements for the public, staff, Councilmembers, Commissioners, and Committee Members in their meeting spaces; The City cannot ensure social distancing requirements are met inside City facilities where the City Council, Planning Commission, Parks and Recreation Commission, Redistricting Advisory Committee, Bicycle and Pedestrian Advisory Committee, and Main Street Bridge Advisory Committee meet.

Moreover, the indoor mask order is still in effect, making it difficult to hear what Councilmembers, Commissioners, Committee Members, staff, and public speakers are saying.

Furthermore, while speaking through masks may be understandable in person, picking up speech on microphones for those attending remotely and those watching any livestreams would be difficult.

City of Yreka City Council
Regular Meeting April 05, 2022
81 Per AB 361, the City Council would need to declare every 30 days that the City’s legislative bodies must continue to meet remotely to ensure the health and safety of the public. Staff recommends that the City Council declare these findings are true so these bodies can continue to meet remotely. Staff will return with this resolution for re-ratification at the Council’s 1st Tuesday meeting each month, at which time the Council can reassess as various health orders and COVID-19 parameters change.

Background:

In 2019, the City of Yreka applied for an $8.5 million-dollar Statewide Park Development and Community Revitalization Program grant through the California Department of Parks and Recreation. The City did not receive the grant due to the highly competitive nature of the program.

On March 19, 2020, Council directed City Manager Steven Baker to schedule the public hearing and bring back a Resolution Initiating Proceedings for the Formation of a Recreation and Park District (Yreka Recreation and Park District), for consideration at the meeting on April 2, 2020.

On April 2, 2020, Council considered an Application to the Siskiyou Local Agency Formation Commission requesting initiation of proceedings to form a Recreation and Parks City of Yreka City Council
Regular Meeting April 05, 2022
87 District to provide recreational and Park Services in the greater Yreka area. Following Council discussion, the item was tabled.

On September 17, 2020, an Application for Statewide Park Development and Community Revitalization Program Grant Funds for the Yreka City Pool Project was brought before the City Council for discussion and possible direction.

New parks were more competitive under the program, which means the City of Yreka would need to create a new park in a location where there is no other park space, in a lowincome area. An exploratory committee reviewed the data citywide and determined that the property owned by the County on Foothill Drive would be the best location for this project.

Following Council discussion, Council authorized staff to continue working with the pool committee, and to move forward with the grant application process.

On October 15, 2020, Council approved a supplemental appropriation in the amount of $15,000.00 for professional services to design schematics, preliminary site grading and site plans, to complete the grant application.

On February 16, 2021, Council adopted Resolution #2021-7 Approving the Application for Statewide Park Development and Community Revitalization Program Grant Funds to fund the Yreka City Pool Project.

The City of Yreka was notified by the State of California, Department of Parks and Recreation in a letter dated December 8, 2021, of the City’s selection for a grant award for the cooperative community and City application for the construction of an $8.5 million Yreka Swim Center and Native Park project, located on Foothill Drive, hereafter referred to as the complex. The project includes acquiring approximately 7.8 acres, construct a new pool with retractable cover, a swim center building, parking lot, and support facilities, construct a native park with a sculpture garden, a meditation garden and butterfly viewing area, a playground, a picnic area, pathways with vista points of the mountains, and public art, along with landscaping and lighting throughout the park. On City Council on December 21, 2021, the City Council accepted the grant.

As part of this volunteer grant application process from Spring of 2019, to grant submittal on February 2021, it was identified early in the process that a revenue stream, of a special assessment or park and recreation district formation would be required to support the ongoing maintenance costs of the complex. During the April 2, 2020 meeting amidst the coronavirus pandemic, the ballot measure initiative to apply to the Local Agency Formation Commission requestion initiation of proceedings to form a recreation and park district did not move forward from the City Council, whereas the grant application did continue to move forward and was submitted in February of 2021 to the California Department of Parks and Recreation Proposition 68 Grant.

Regular Meeting April 05, 2022
88 Since acceptance of the Grant Award in December of 2021, City administration has been working with community applicants, City support staff, the Finance committee and knowledgeable parks and recreation managers to review options of how to proceed considering no available stream of revenue to support the construction application process. Conditions with the grant’s acceptance, are requirements that the City maintain and operate the complex for at least 30-years.

Discussions have centered around identifying what are reasonable annual maintenance and operating costs and a capital maintenance fund to sustain the complex. Consideration has been to:
(1) size and design of complex, (original specifications) (2) fabrication materials (stainless, shotcrete, other) (3) location concerns, soil pH levels and corrosive properties cost of maintenance chemicals, materials and supplies, estimates vary between $350,000- $650,000 annually – March 14th Meeting Revisions to the Pool Maintenance and Operations Spreadsheet
(4) is a compromised analyses of costs from the community group and staff meetings
(5) season length and days and hours of operation
(6) required staffing levels, and swimming programs offered Other recreation managers of park and recreation districts have been consulted to establish reasonable estimates, along with Splash, (a non-profit organization) program operators, who for many years operated the swim programs at the Ringe Pool prior to its closure.

Public Concerns
During these meetings members of the public have expressed concerns over the complex need versus want and cost versus public benefit:

Public ranking of need
Youth recreation or public safety
Homeless relocation and affordable housing
Maintenance of existing sports and recreation program vs building new Other facilities in need of capital tennis courts, community theater vs adding more Cost:

Cost per swim to build
Cost per swim to maintain
No revenue source for operations
One constituent identified that moving forward was “fiscally irresponsible without dedicated new revenue stream for operations”
Not addressing current deficit – adding more maintenance City of Yreka City Council
Regular Meeting April 05, 2022
89 Wrong location:

Some members of the public would like the pool to remain at Ringe park (note: the state grant cannot be used to redevelop the defunct Ringe Pool on Knapp Street, which is estimated to cost about $6.5 million.

Concerns of location “No Place Like Home” housing complex There exist other small recreation pools in area
Location is shaded area and windy
Children crossing I5 underpass
Soil in that area corrosive and water table high, damage liner Scope:

Overbuilt and oversized?
Capital for equipment and facility failure
Concerns over maintenance and reliability of the large pool cover City does not need more open space to maintain
Suggested Actions for Moving Forward:

From all the committees and public input at regular City Council meeting and Finance Committee meetings, staff is presenting options for moving forward.

Option (1)
This option would continue to develop the Foothill Drive pool and park project, with the caveat that there is no current plan in place to fund its maintenance and operation, but provide for a property assessment tax related ballot measure to fund the maintenance and operations, and should the ballot measure fail, release the City from the grant.

The future resolution would direct staff to prepare for the Siskiyou County November General Election, November 1, 2022, a property tax ballot measure for assessment necessary to maintain and operate the Yreka Swim Center and Native Park project, located on Foothill Drive; and (2) proceed work on and authorization to expend funds on CEQA, property acquisition and engineering pursuant to the grant award, (3) whereas should the ballot measure fail, provide direction to stop effort on project and prepare a letter to the California Parks and Recreation returning the grant award.

Option (2) would provide for the redevelopment of the pool at Ringe Park with a new pool, that also require a tax measure, approved by voters, to fund it, as well as provide for the operations.

The future resolution directs staff to prepare a letter to the California Parks and Recreation returning the grant award and direction to staff and volunteers to seek dedicated funding for Ringe Park pool development project in the future.

Option (3) would be to stop work on any public pool for Yreka at this time.

City of Yreka City Council
Regular Meeting April 05, 2022
90 The future resolution directs staff to prepare a letter to the California Parks and Recreation, returning the grant award. Staff is no longer directed to work on a pool specific recreation project, and further analysis on open space use is being addressed in the City of Yreka’s General Plan.

Fiscal Impact:

All of these expenses, until a ballot measure passes, are not reimbursable, except for those allowed for the grant in option one, however option one opens the City to an unfunded present value cost at completion of the project for another 30 years of $380k to $500k annually, before inflation.

Option 1: Present value of 30 years of $350,000 to $500,000 of debt servicing, cost preparing a ballot measure, legal, election publication costs, unreimbursed cost of staff time, expenditures of CEQA, property acquisition, engineering designs that would be sunk costs should the ballot measure fail.

Option 2: Staff time and studies, legal, and ballot measure costs Option 3: Minimal
Staff Recommendation:

Staff is recommending option two.

A motion to:

Prepare a letter to the California Parks and Recreation returning the grant award and direct staff and volunteers to seek dedicated funding for Ringe Park pool development project in the future via a parcel tax.

Resolution No. 2022-11 Declaration of Surplus Land – Campus Drive Pg. 1 of 2 RESOLUTION NO. 2022-11

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YREKA

DECLARING TWO CITY-OWNED PROPERTIES AS SURPLUS LAND AND

AUTHORIZING THE CITY MANAGER OR DESIGNEE TO TAKE

IMPLEMENTING ACTIONS NECESSARY TO COMPLY WITH THE
SURPLUS LAND ACT (GOVERNMENT CODE SECTIONS 54220 ET SEQ.) WHEREAS, the City of Yreka, California (“City”) is the owner in fee simple of parcels of real property located on the east side of Campus Drive in Yreka, California and identifed by Assessor’s Parcel Numbers [“APNs”] 062‐031‐200 and 062‐031‐250 (“the Parcels”); and WHEREAS, each of these parcels is zoned M-1 (light industrial); and WHEREAS, effective January 1, 2020, under the Surplus Land Act (“SLA”) Government Code Section 54220-54233, surplus property is defined as land owned in fee simple by the City for which the City Council takes formal action in a regular public meeting declaring the land is surplus and not necessary for the City’s use; and
WHEREAS, under the SLA, land is necessary for the City’s use if the land is being used, or is planned to be used pursuant to a written plan adopted by the City Council, for City work or operations; and
WHEREAS, the City Council desires to declare that each of the Parcels, totaling approximately

2.96 acres, is surplus land because it is not necessary for the City’s use; and WHEREAS, the City intends to follow the provisions of the SLA in the disposition of public lands; and
WHEREAS, the process described in the SLA should take place prior to taking any further actions regarding the disposition of the Surplus Properties; and WHEREAS, this declaration of surplus land does not obligate the City to subsequently dispose of the land and the City could still decide not to move forward with disposition of specific properties.

NOW, THEREFORE, the City Council hereby resolves as follows:

SECTION 1. The above recitals are true and correct and are a substantive part of this Resolution.

SECTION 2. The above recitals and the findings in Exhibit “A” are integral to this Resolution and are incorporated herein.

SECTION 3. This Resolution has been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) (“CEQA”).

City of Yreka City Council
Regular Meeting April 05, 2022
171
Resolution No. 2022-11 Declaration of Surplus Land – Campus Drive Pg. 2 of 2 City staff has determined that the designation of this property as surplus does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because it is not a project as defined by the CEQA Guidelines Section 15378. Adoption of the Resolution does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. If and when the property is sold or leased to a purchaser and that purchaser proposes a use for the property that requires a discretionary permit and CEQA review, that future use and project will be analyzed at the appropriate time in accordance with CEQA.

SECTION 4. The City Manager or his or her designee is authorized to submit the report of declared surplus land and exempt surplus land as part of the Annual Report to the California Department of Housing and Community Development (HCD), in conformance with state law, and the City Clerk shall file a Notice of Exemption pursuant to CEQA Guidelines Section 15062.

SECTION 5. The City Manager or his or her designee is hereby authorized to do all things which are deemed necessary or proper to effectuate the purposes of this Resolution, and any such actions previously taken are hereby ratified and confirmed. Such actions include negotiating in good faith in accordance with the requirements of the SLA with any of the authorized entities that submit a written notice of interest to purchase or lease the property in compliance with the SLA.

SECTION 5. This resolution shall take effect immediately upon its passage.

Exhibit C:

CITY OF YREKA Insurance Requirements and Evidence of Coverage For Event Sponsors (Use/Rental of City Facilities)
Renter shall procure and maintain for the duration of the rental period insurance against claims for injuries to persons or damages to property which may arise from or in connection with the rental of the facilities and the activities of the renter, his guests, agents, representatives, employees, or subcontractors.

MINIMUM SCOPE AND LIMIT OF INSURANCE
Coverage shall be at least as broad as Insurance Services Form CG 00 01 covering CGL on an “occurrence” basis, including property damage, bodily injury and personal & advertising injury with limits no less than $1,000,000 per occurrence. If a general aggregate limit applies, either the general aggregate limit shall apply separately to this project/location (ISO CG 25 03 or 25 04) or the general aggregate limit shall be twice the required occurrence limit.

If the use includes athletic activities, Renter shall provide evidence of that the CGL includes coverage for injuries to athletic participants and should also provide evidence of Participant Accident Insurance.

If the Renter maintains broader coverage and/or higher limits than the minimums shown above, the Entity requires and shall be entitled to the broader coverage and/or the higher limits maintained by the Renter. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the Entity.

Other Insurance Provisions
The insurance policies are to contain, or be endorsed to contain, the following provisions:

Additional Insured Status
The Entity, its officers, officials, employees, and volunteers are to be covered as additional insureds on the CGL policy with respect to liability arising out of the rental of the facility, work or operations performed by or on behalf of the Renter including materials, parts, or equipment furnished in connection with such work or operations. General liability coverage can be provided in the form of an endorsement to the Renter’s insurance (at least as broad as ISO Form CG 20 10 11 85 or if not available, through the addition of both CG 20 10, CG 20 26, CG 20 33, or CG 20 38; and CG 20 37 if a later edition is used).

Primary Coverage
For any claims related to this contract, the Renter’s insurance coverage shall be primary insurance coverage at least as broad as ISO CG 20 01 04 13 as respects the Entity, its officers, officials, employees, and volunteers. Any insurance or self-insurance maintained by the Entity, its officers, officials, employees, or volunteers shall be excess of the Renter’s insurance and shall not contribute with it.

Notice of Cancellation
Each insurance policy required above shall provide that coverage shall not be canceled, except with notice to the Entity.

Waiver of Subrogation
City of Yreka City Council
Regular Meeting April 05, 2022
189
Renter hereby grants to Entity a waiver of any right to subrogation which any insurer of said Renter may acquire against the Entity by virtue of the payment of any loss under such insurance. Renter agrees to obtain any endorsement that may be necessary to affect this waiver of subrogation, but this provision applies regardless of whether or not the Entity has received a waiver of subrogation endorsement from the insurer.

Acceptability of Insurers
Insurance is to be placed with insurers authorized to conduct business in the state with a current A.M. Best’s rating of no less than A:VII, unless otherwise acceptable to the Entity.

Verification of Coverage
Renter shall furnish the Entity with original Certificates of Insurance including all required amendatory endorsements (or copies of the applicable policy language effecting coverage required by this clause) and a copy of the Declarations and Endorsement Page of the CGL policy listing all policy endorsements to Entity before work begins. All certificates and endorsements are to be received and approved by the Entity at least five days before Renter commences activities.

Liquor Liability
If Renter will be supplying alcoholic beverages, the general liability insurance shall include host liquor liability coverage. If Renter is using a caterer or other vendor to supply alcohol that vendor must have liquor liability coverage. If Renter intends to sell alcohol either the Renter or vendor providing the alcohol for sale must have a valid liquor sales license and liquor liability insurance covering the sale of alcohol.

Homeowners Insurance
In some cases, the Renter’s homeowner’s liability insurance may provide coverage sufficient to meet these requirements. Renter should provide these requirements to his or her agent to confirm and provide verification to the Entity.

Special Events Coverage
Special events coverage is available for an additional fee to provide the liability insurance required by this agreement. Renter can obtain additional information and cost from Entity.

Special Risks or Circumstances
Entity reserves the right to modify these requirements based on the nature of the risk, prior events, insurance coverage, or other special circumstances.
