Public Hearings: If you wish to challenge in court any of the matters on an agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. Any person seeking to challenge a City Council decision made as a result of a proceeding in which by law a hearing is required to be given, evidence is required to be taken, and the discretion in the determination of facts is vested in the City Council, shall be required to commence that action 90 days following the date on which the decision becomes final as provided in Code of Civil Procedure Section 1094.6. Please refer to Code of Civil Procedure 1094.6 to determine how to calculate when a decision becomes “final.”
"CHALLENGING DECISIONS OF CITY ENTITIES The time limit within which to commence any lawsuit or legal challenge to any quasi-adjudicative decision made by the City of Yreka is governed by Section 1094.6 of the Code of Civil Procedure, unless a shorter limitation period is specified by any other provision, including without limitation Government Code section 65009 applicable to many land use and zoning decisions, Government Code section 66499.37 applicable to the Subdivision Map Act, and Public Resources Code section 21167 applicable to the California Environmental Quality Act (CEQA). Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. Government Code section 65009 and 66499.37, and Public Resources Code section 21167, impose shorter limitations periods and requirements, including timely service in addition to filing. If a person wishes to challenge the above actions in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Yreka, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies." CITY COUNCIL AGENDA MEMORANDUM
TO: Yreka City Council
FROM:

PREPARED BY:

Jason Ledbetter, City Manager
John Elsnab, Human Resources Director
AGENDA TITLE: Request Direction to Publish Request for Proposals (RFP) to Conduct a Compensation Study for the City of Yreka
MEETING DATE: February 20, 2024
Discussion:

The City is in need of a comprehensive compensation study to review full-time classifications within the represented and unrepresented units of the City. The purpose of having a compensation study conducted is to assist with compiling salary and benefit data for full-time classifications that include data points for top-step pay, education incentives, uniform allowance, employer medical contributions, and other pensionable retirement benefits that can be analyzed to make informed recommendations during bargaining. The study would also compare the City’s compensation between six and eight agencies across northern California to understand the total compensation relationship between similar municipalities.

There are approximately twenty-eight full-time classifications within the Public Works Department, Police Department, Fire Department, and City Hall that need to be included in the study. Of those positions, nine are exempt, and nineteen are non-exempt for purposes of the Fair Labor and Standards Act. Additionally, since 2021 at least six positions have been reclassified from previous salary schedules that need to be included in the study. Having a comprehensive review of all full-time positions before bargaining will also assist the Council when considering the correct level of authority to provide to the bargaining team during negotiations. All of the compensation data in the study should reflect a July 1, 2025, effective date, so the most accurate information from comparable cities can be taken into consideration.

A proposed Request for Proposal (RFP) is attached with an expected cost of $40,000.

This estimate is based on similar studies prepared by other cities. The City is seeking funding and authority to issue the RFP. Once the RFP closes, successful respondents will be evaluated and a recommendation to enter into a professional services agreement will be brought back to the City Council for approval. The RFP has been reviewed and approved by the City Attorney.

Yreka City Council Agenda February 20, 2024 Page 99 of 118 Fiscal Impact:

The fiscal impact will be determined by the Request for Proposals, and services are estimated at $40,000.

Recommendation and Requested Action:

Direct staff to publish the proposed Request for Proposals (RFP) to conduct a Compensation Study for the City of Yreka.

Agenda title: Discussion/Possible Action: Conduct Public Hearings Regarding Three (3) Community Development Block Grant (CDBG) Projects and Adopt Resolution 2024-09 Approving Planning Grant Documents
Meeting date: February 20, 2024
Recommendation and Requested Action:

That Council conduct public hearings regarding three (3) Community Development Block Grant (CDBG) projects and adopt Resolution 2024-09 approving Planning Grant documents.

Discussion:

The State Department of Housing and Community Development (HCD) administers the Community Development Block Grant (CDBG) program, which authorizes the use of grant funds to assist low- and moderate-income persons, households, and communities. Since February of 2020 the City of Yreka has applied for and received a total of $4,750,000 in CDBG grants.

Three of the City’s CDBG projects are now complete, and the grant contracts with HCD may be closed out.

To close out a CDBG grant contract with HCD the City is required to conduct a public hearing for each grant project to solicit input regarding expenditures and accomplishments of the funding received under the contract, and then to submit required closeout documents to HCD. A Planning Grant closeout also requires a Council resolution accepting the grant deliverable documents.

The three completed projects are:
• Historic Carnegie Building Rehabilitation Planning Project (Community Development Planning Grant)
• Yreka Main Street Water System Improvement Project (Non-Housing Over-the-Counter Grant)
• Yreka Madrone Hospice Bus Purchase PI Waiver Project (PI-Only Grant) Further details about these projects will be read into the record during the public hearings. The Public Hearing Notice and the Carnegie Building Planning Grant documents are linked below, and Resolution No. 2024-09 for Council to approve the documents is attached.

Fiscal Impact:

There is no fiscal impact from these recommended and requested actions.
