CITY COUNCIL AGENDA MEMORANDUM
TO: Yreka City Council
FROM:

PREPARED BY:

Jason Ledbetter, City Manager
John Elsnab, Human Resources Director
AGENDA TITLE: Discussion/Possible Action – Adopt Resolution 2024-27 by the City Council of the City of Yreka Adopting a Catastrophic Leave Policy to be Included in the Personnel Policies and Procedures Manual.

MEETING DATE: May 21, 2024
Recommended Action:

Motion to Adopt Resolution 2024-27 by the City Council of the City of Yreka Adopting a Catastrophic Leave Policy for the City to be included in the Personnel Policies and Procedure Manual.

Municipal Code Section 2.10.060 allows for the adoption and amendment of personnel rules and regulations by resolution of the City Council.

Background
During collective bargaining in 2022, the bargaining groups had a catastrophic leave policy that was located in each Memorandum of Understanding (MOU). After re-evaluating MOU’s, the bargaining team and represented units agreed to remove the catastrophic leave policy in order to re-write a policy that is accessible for employees across the City to utilize.

In the last ten years, the previous catastrophic leave policy had not been used due to specific terms in the policy that prevented employees from being eligible. The intent of removing the catastrophic leave language from the individual MOU’s is to make one universal City policy that is available through the Personnel Rules for all full-time employees.

Summary
In March of 2023, City staff revised the prior catastrophic leave policy and completed the meet and confer process with the represented units. The bargaining groups agreed on a catastrophic leave policy where full-time employees can donate vacation and sick leave hours to benefit an employee and direct family during a serious health condition. In order to utilize the policy, there are eligibility requirements, leave donation limits, and benefit conversion factors to acquire the donated leave. By having a catastrophic leave policy employees may be able to continue paying for their portion of the medical insurance premium thus allowing them to continue benefits while off work for a catastrophic event.

Catastrophic Leave Donations
Employees who have exhausted all paid leave may request catastrophic leave donations through the City for a serious illness or injury to the employee or the employee’s spouse or child. Employees may only donate accrued vacation and sick leave hours to qualifying employees.

Eligibility
To be eligible for a catastrophic leave donation, the receiving employee must: (1) Be a full-time employee who has passed their initial probationary period, (2) Have sustained a serious illness or injury to the employee or employee's spouse or child which requires certification by a physician, (3) Have exhausted all accumulated paid leave, (4) Be unable to return to work for at least thirty (30) calendar days from the date of injury, and (5) Have applied for a Leave of Absence Without Pay for medical reasons if it affects the employee.

Donations
Employees who meet the eligibility requirements may request that the City send the request for donations upon request, but no earlier than two weeks prior to the exhaustion of their paid leaves.

Accrued vacation and sick leave may be donated by any full-time employee who has completed their initial City probationary period. The total amount of time donated to one employee by another employee may not exceed one hundred and sixty (160) hours per year.

Donations made by employees are forfeited once made. In the event that the receiving employee does not use all transferred leave for the catastrophic illness/injury, any balance will remain with that employee until that employee's separation from City service.

In accordance with IRS Ruling 90-20, leave donated will not be considered wages for the employee who surrenders the leave and will therefore not be included in gross income or subject to withholding. An employee who donates leave incurs no deductible expense or loss either upon the donation or use by the recipient.

Benefit
Vacation hours donated by employees will be converted to sick leave and credited to the receiving employee's sick leave bank on an hour-for-hour basis and will be paid at the rate of pay of the receiving employee. The total leave received by an employee will not exceed six (6) months.

CITY OF YREKA

AGENDA MEMORANDUM
Prepared by: Juliana Lucchesi AICP, Community Development Director Agenda Title: Competitive Permanent Local Housing Allocation (CPLHA) Application Meeting date: May 21, 2024
Recommended Action:

Motion to adopt Resolution No. 2024-28 “A Resolution of the City Council of the City of Yreka Authorizing the Application for the Permanent Local Housing Allocation Program Non-Entitlement Local Government Competitive Component” Summary:

The DANCO Group responded to the City of Yreka’s Request for Qualifications to assist the city with development, construction, and management of housing for workforce, low-income, and special populations. The DANCO Group has negotiated a preliminary agreement to purchase 10- acres along Deer Creek Way to stand up 45-units of housing. The DANCO Group has identified another state grant program to compliment the HOME Investment Partnerships to help the development and construction of the project. The Competitive Permanent Local Housing Allocation Program (CPLHA) requires an eligible jurisdiction to submit the application and receive the funds. If selected, the City of Yreka would act as a pass-through for the DANCO group and a subsequent pro forma for managing the project would be drafted for City Council approval. The CPLHA funds would be used in tandem with several other funding measures managed by DANCO.

Competitive Permanent Local Housing Allocation Grant Background:

CPLHA is a program within the California Department of Housing and Community Development “HCD” and is funded under the Building Homes and Jobs Act (SB 2, 2017 or “Bill”), which established a $75 recording fee on real estate documents to increase the supply of affordable homes in California. This Bill will provide a permanent source of funding to all local governments in California to help cities and counties implement plans to increase the affordable housing stock.

Funding will help cities and counties:
• Increase the supply of housing for households at or below 60% of area median income • Increase assistance to affordable owner-occupied workforce housing • Assist persons experiencing or at risk of homelessness Yreka City Council Agenda
May 21, 2024

Page 43 of 129 ends

• Facilitate housing affordability, particularly for lower- and moderate-income households • Promote projects and programs to meet the local government’s unmet share of regional housing needs allocation
• Ensure geographic equity in the distribution of the funds HCD released a NOFA (Attachment 1) for the CPLHA Program on March 6, 2024, with applications due June 6, 2024. The eligible activities are:

1. Development of new multifamily rental housing that is affordable to households at or below 60 percent of AMI or substantial rehabilitation of multifamily rental housing that will be affordable to households at or below 60 percent of AMI, but which is not currently restricted as affordable housing. In order to be eligible as “substantial rehabilitation”, a project must complete a minimum of $40,000 per unit in hard construction costs; or

2. Assistance to persons who are experiencing or at risk of homelessness, including, but not limited to, through rapid rehousing, rental assistance, supportive services, and case management services that allow people to obtain and retain housing, operating and capital costs for Navigation Centers, or new construction, rehabilitation, or preservation of permanent or transitional rental housing The maximum application amount, including administrative costs, for the development of new multifamily rental housing or substantial rehabilitation of a multifamily rental housing project, or development of a Navigation Center is $5 million. The minimum application amount shall be $500,000. Administrative expenses may be incurred to implement the project or program activity, up to a maximum of 5% of the grant amount.

Project Description:

THE DANCO Group project is in the preliminary phase of planning. The project proposed 45- units of housing on Deer Creek Way on approximately 10-acres. This would serve as a starting point for development in that area with the possibility of adding units as more funding becomes available. The development will offer a mix of one-, two-, and three-bedroom apartments. The Area Median Income (AMI) levels will be 30-60%. The project will still be subject to a site plan application and subsequent Community Development applications.

Project Location: A portion of Assessor’s Parcel Number 053-591-560-000 Fiscal Impact:

The city would serve as the fiscal sponsor for the CPLHA with The DANCO Group serving as the developer. This fiscal sponsor mirrors the previously approved HOME Investment Partnerships.

The city serving as the fiscal sponsor would operate similar to other grants held by the city like the EDA Highway 3 Business Support program managed by Siskiyou Economic Development Council (SEDC). The City would incur nominal costs associated with the grant application due to Yreka City Council Agenda
May 21, 2024

Page 44 of 129 ends

DANCO preparing the grant application. The City will incur staff time to review and submit the grant.

If awarded, staff will return to the City Council with a proposed pro forma defining roles, costs, and reimbursements associated with the project. There is a portion of the grant funds that can be used to reimburse staff time for grant administration and reporting.

TO: Yreka City Council
FROM: Chief Mark Gilman
AGENDA TILTLE: FLOCK Cameras
MEETING DATE: May 21, 2024
Discussion:

The Yreka Police Department has been given the opportunity to receive five FLOCK cameras.

The Siskiyou County OES, Office of Emergency Services, has voted to purchase five FLOCK cameras. The cameras would benefit Siskiyou County Law Enforcement agencies. This purchase is from funding for anti-terrorism projects through OES.

The Siskiyou County OES would purchase the lease for the first two years of use. After that the Yreka Police Department would continue the yearly lease. The future goals of OES and Siskiyou County agencies are to expand the camera system with other agencies leasing additional cameras.

A FLOCK camera system is a camera that reads license plates and recognizes vehicles in real time.

It is not a facial recognition camera. The benefits are real time updates for possible suspected criminal vehicles in our jurisdiction. An example would be that an outside agency, such as Medford Oregon, places a BOLO on a vehicle that is wanted for a kidnapping. They would place an alert for that vehicle in the FLOCK system. If that vehicle pulls into Yreka to get fuel, one of the cameras could spot it and notify YPD in real time. That is just one example, there are plenty of others.

FLOCK cameras are used by many law enforcement agencies throughout the US. This is a very important tool to protect citizens and apprehend suspects. The yearly lease cost is based on the number of cameras. The additional cost would be factored into future budgets. The lease cost per year after the initial OES purchase is $15,500. I will be cutting a few items out of my budget to fund this. One item has already been cut. This will not affect the YPD budget for two years, 26/27 budget.

Of the five cameras leased one will be a mobile camera that can be utilized on a mobile trailer system, such as a speed trailer. This can be moved to locations that are in need due to traffic issues or special events. The four fixed cameras will be placed at entry areas into the city of Yreka.

Fiscal Impact:

None for two years. After two years the YPD budget will be reduced in some areas to cover the yearly lease of $15,500.

Recommended Action:

Authorization of the Yreka Police Department to accept FLOCK cameras.

Although a specific drone operator has not been secure, the two businesses that have been contacted are Fire Fly Drone Shows or Sky Elements. Both businesses are fully FAA compliant and will provide the city with any documents needed.

Thank you, Jason – I really appreciate the quick response.

Alia, I’m copying you in here so you can see the communication strand. Please let me know if you need anything more from us to enact this request for City Council.

Best,
Jim

Jim,
I understand your perspective on the matter from your input below. The City of Yreka City Council creates the "laws" locally via ordinance that become part of the municode you can view online Code of Ordinances | Yreka, CA | Municode Library My job, along with staff, are to enforce the municode and daily operations based off that municode. Our understanding with our attorney firm is that our current municode requires a temporary use permit for this type of an event, I believe that is 16.45.010 C. I am not authorized to waive your fee on this item, but the City Council can waive your fee.

Last I spoke with Alia we were planning on taking your request to City Council to have your fee waived for the Temporary Use Permit (TUP).

In 2018 the City had a different administrative staff and different legal representation and may not have been following the requirements of their municode.

I can't tell you how the Council will vote on waiving your fees, but this is a very common thing we bring to them when someone would like their fees waived. As an example, at our 5.7.24 meeting we will have an event coordinator putting on a Civil War Reenactment on private property requesting the same fee waiver. This is just a normal part of our process and I suggest you advocate with Alia to request the fee waiver from the city council on the 5.21.24 meeting.

Subject: Bicycle tour in Yreka in June
Hi, Jason—
I’m following up on conversations we’ve had with Alia about our event in Yreka this summer. She has indicated that we’re required to have a city permit, and I’d like to ask you to reconsider that. (I called your office today, but didn’t realize the city offices aren’t open on Fridays.) I’m pretty sure you’ve got bigger things to work on, so I’ll keep it concise. Here are the reasons we’d like you to remove the permit requirement.

Our event is being held solely on school district property. It does not involve any city resources other than bike traffic on the streets, which we will mitigate by staying off main roads, providing our own professional signage and monitoring with support vehicles. In essence, we’re just riding out of town Sunday, June 23, early in the morning, and riding back in Saturday, June 29, mid-day.

This is not a public event. While we’re not putting up fences to keep people away (you should come by and say hi, have a cold beverage, join us for dinner ), it’s not “open to the public,” or selling admission or anything else besides our own T-shirts and such.

The school district has told us that no one using their grounds for an event has been required to have a city permit. I can’t verify that, but this requirement came as a surprise to them.

We’re a small nonprofit org (I’m the only full-time employee), but one of our missions is to enhance the communities we visit. We’re paying the school district $1,200 for site use, giving a $1,000 community grant to a local cause/project, and offering a fundraising opportunity for schoolkids to provide baggage transfer for our riders.

We had originally planned this tour for 2018, but we had to cancel it one week out because of the wildfires that year. We had not been required to have a city permit then.

We’re not trying to weasel out of anything; it’s that another nearly $1,000 for a permit makes a big impact on a small organization and budget if it’s not completely necessary.

Would you reconsider the permit requirement? I’m very glad to discuss this over the phone, and I’m Yreka City Council Agenda

also going to be in Yreka for a final event recon, and could meet with you or another city rep on the afternoon of Monday, May 13, or late morning on Thursday, May 16, if that would be helpful.

Thanks for your consideration, and best regards,
Jim
