CITY OF YREKA

CITY COUNCIL AGENDA MEMORANDUM
To: Yreka City Council
Prepared by: Emily Aldrich, Finance Director
Agenda title: Adopt a Resolution of the City Council of the City of Yreka Approving the Destruction of Certain City Records Identified by the Finance Director
Meeting date: July 16, 2024
Discussion:

Itemized below are records that the Finance Director has identified for destruction.

Records containing confidential data, such as payroll information, will be shredded by an appropriate vendor or organization. The California Secretary of State has issued guidelines for records destruction, and the City is generally more conservative in its records retention destruction. Those guidelines can be found online, http://archives.cdn.sos.ca.gov/local-gov-program/pdf/records-management-8.pdf .

And though, the City could adopt a blanket policy of following the Secretary of State guidelines, it is the Finance Director’s preference to annually request the City Council’s authority to destroy such records.

Identified records, where the Finance Director is requesting destruction:
• Accounts Payable: Records older than July 1, 2017, includes copies of invoices, checks and AP batch reports.
• Cash Receipts: Cash receipt daily batches older than July 1, 2017, includes copies of daily detail and summary ledger reports, and cash receipt for utility billing (water, sewer and landfill), building permits, animal and business licenses, and all other cash receipts received by the City.
• Payroll records: Payroll timecards, payroll bi-weekly cycle reports, registers and other payroll related and timecard processing information older than July 1, 2017. • Payroll annual and quarterly registers: Quarterly summary reports older than December 31, 2014, includes quarterly tax and gross wages summaries. • General ledger reports: Detail ledger listing of transactions, includes various sorts, periods and aggregations, older than July 1, 2017. Ledger data active and retained electronically on database server through 2010. Does not include summary trial balances.

Note that the trial balance, the permanent records of City’s total transactions for a fiscal year are being retained, however detail transaction records that arrive at those balances are being identified for destruction.
• General ledger journal entries: Journal entry posting of adjustments to the general ledger older than July 1, 2017, does not include sub ledger interface posting from payroll, accounts payable, accounts receivable, cash receipts, utility billing, dog and business licensing.

Yreka City Council Agenda
July 16, 2024

Page 63 of 116 ends

• Electronic backup media: Historical backup tapes and diskettes data from legacy financial systems, where restoration tape drives are no longer in place, or active, and where software updates have made the data obsolete to restore. • Bank reconciliation: Bank statements, detail reconciliation work papers, cancelled checks and treasurer’s monthly and quarterly reports older than July 1, 2017. • Dog license: Dog license records older than July 1, 2017, includes receipts, registration tickets, sub ledger registers list, billing and adjustments batches pertaining to dog licensing
• Business license: Business license records older than July 1, 2017, includes receipts, registration tickets, sub ledger registers list, billing and adjustments batches pertaining to business licensing
• Water Accounts: Billing registers, customer correspondences, and other collection related information older than July 1, 2017
• Accounts Receivable: Invoice registers, collection receipts, aging lists and customer correspondences older than July 1, 2017; receivable collections includes landfill invoicing records and TOT tax records.

Fiscal Impact:

Estimated $200 for destruction of confidential information, in departmental budget.

CITY OF YREKA

CITY COUNCIL AGENDA MEMORANDUM
To: Yreka City Council
Prepared by: Emily Aldrich, Finance Director
Agenda title: Adopt Resolution 2024-34 Setting Forth the Appropriations Limit for the City of Yreka for Fiscal Year 2024-2025
Meeting date: July 16, 2024
Discussion:

Article XIIIB of the California Constitution (Article 4) and related implementing legislation provide for an annual "appropriations limit" for each entity of local government and require the governing body of each local jurisdiction to establish its appropriation limit by resolution each year.

The appropriation limit does not apply to the entire City budget but only to the appropriation of "proceeds of taxes" in the City's "general government" type funds.

From 1980-81 to 1989-90, each year's appropriation limit was based on the previous year's limit, multiplied by the percentage change in population and the percentage change in the United States Consumer Price Index or the change in California per capita income, whichever was less. Proposition 111, which was approved by the voters in June 1990, amended the factors used in the calculation of each year's limit. The factors to be used now are:

Population Factor - At the City's option, either the annual change in City or County population.

Price Factor - At the City's option, either the change in California per capita income or increase in non-residential assessed valuation due to new construction.

The formula to be used in calculating the growth rate is:
% change in population + 100.00
100
times either
% change in per capita income + 100.00
100.00
or
Change in non-residential assessments + 100.00
100.00
The resultant rate times the previous appropriation limit equals the new appropriation limit.

Yreka City Council Agenda
July 16, 2024

Page 67 of 116 ends

Both the California per capita personal income price factor and the population percentage change factors are provided by the State Department of Finance (DOF) to local jurisdictions each year. Population percentage change factors estimate changes in the City’s population between January of the previous fiscal year and January of the current fiscal year. These numbers provide the factor to be used in the City’s calculation of the Gann limit.

In April 2024, the State Department of Finance notified each city of the population changes and the per capita personal income factor to be used in determining appropriation limits.

The Finance Director, using the change in per capita income method, has made the following calculation as applied to the City of Yreka for 2024-25 is: The population at January 1 of the previous year compared to January 1, 2024 (DOF Estimates 7,8025) is a

0.19% decrease. The increase in the California per Capita Income for 2024-25 is 3.62% The factor for determining the year-to-year increase computed as:
-0.19 + 100.00 x 3.62 + 100.00 = 1.03423122
100.00 100.00
Applying this year’s factor of 1.03423122 to last year’s limit of $22,520,293, the Gann limit for Fiscal Year 2024-25 is $23,291,190. With appropriations subject to the limit totaling approximately $10,187,767, the City of Yreka is not at risk of exceeding the Gann limit.

Fiscal Impact:

The Gann Limit sets to restrict budgeting expenditures by subjecting an appropriations limit to no more than $23,291,190. The City is budgeting $10,187,767 for expenditures that are subject to the appropriations limit. The City is not at risk of exceeding the limit.

AGENDA TITLE: Discussion/Possible Action – Adopt a Resolution by the City Council of the City of Yreka Approving the Agreement for Services Between the City of Yreka and Q Consulting Group and Authorize the City Manager to Execute the Necessary Agreements for the Compensations Study
MEETING DATE: July 16, 2024
Discussion:

On February 20, 2024, the City Council authorized City staff to publish a Request for Proposal (RFP) and appropriate funds for $40,000 to conduct a compensation study for the City of Yreka. The RFP submittal date was June 14, 2024, and the City received seven proposals from solicited firms.

Upon review of the proposals submitted along with references, staff has determined Q Consulting Group to be the best fit and most qualified consultant to perform the compensation study under the evaluation criteria. This particular compensation study will also be performed for selected full-time job classifications in preparation for 2025 bargaining.

Staff recommends accepting the proposal for Q Consulting Group as a qualified respondent to the City RFP and appropriate $42,000 to conduct the services. The professional services agreement has also been approved by the City Attorney.

Fiscal Impact:

The fiscal impact is estimated not to exceed $42,000.

Recommendation and Requested Action:

Adopt a resolution by the City Council of the City of Yreka giving the City Manager the Authority to execute the necessary agreements with Q Consulting Group for the compensation study.

Executive Summary
The goals for the City of Yreka is to attract new candidates to the city, retain talented employees through growth, incentives, and remain competitive in its market through wages and benefits. The total compensation survey will assist the city in determining how they compare to their market, which positions are below or above the market, and establish justifiable pay differential between job classes.

The survey will compare the City of Yreka to seven comparable cities and counties in the surrounding areas. There are four bargaining units to be included in the survey, including, Yreka Employee Association (YEA), Yreka Peace Officer Association (YPOA), Yreka Management Employee Unit (YMEU), and Unrepresented Employees (UE), as well as the position of City Manager. The total compensation survey will provide the city with top step salary, various incentives like education, certifications, and industry standard qualifications, POST for law enforcement, retirement, and benefits.

Our goal at Q Consulting Group is to help prepare the City of Yreka with a survey that will visualize each of the surveyed positions in a concise way to meet the goals and objectives of the city before going into negotiations.

CITY OF YREKA

CITY COUNCIL AGENDA MEMORANDUM
To:

Agenda title:

Meeting date:

Yreka City Council
Cynthia Lynch, Municipal Projects Manager
Discussion/Possible Action: Approve the Transportation Claim for the Local Transportation Fund for Fiscal Year 2024/2025 and Authorize the Mayor to Sign the Claim on Behalf of the City July 16, 2024
Recommendation and Requested Action:

That the Council approve the Transportation Claim for the Local Transportation Fund for Fiscal Year 2024/2025 and authorize the Mayor to sign the claim on behalf of the City.

Discussion:

The Transportation Development Act (TDA), passed in the late 1970’s to subsidize public transit, allows distribution from the Local Transportation Fund (LTF) to cities and counties in California. For every $7.25 the State collects in sales tax from the County, the County receives $.25. While these funds are mainly intended for local public transit, counties with a population under 200,000 are allocated a portion of the funds for local streets and roads after county transit needs are met and a Public Hearing on Unmet Needs is held.

The Siskiyou County Local Transportation Commission (LTC) determines the dollar amounts to be allocated (based on population) to Siskiyou County and its cities, and issues the Transportation Claim letters to the jurisdictions. The City Council is required to approve its annual LTF Transportation Claim at a regular City Council meeting before the LTC considers it for approval. The LTC has sent the City its Transportation Claim for FY 2024/2025, with the request that it be returned to the LTC as soon as possible.

Fiscal Impact:

The LTC staff has estimated that the allocation of streets revenue for the City of Yreka will be about $128,264 in FY 2024/2025, with another $233,946 to be allocated to County public transit needs. The amount the City will actually receive is based on receipts from the State of California and may vary from the claim amount.

CITY COUNCIL AGENDA MEMORANDUM
TO: Yreka City Council
FROM: Jason Ledbetter, City Manager
AGENDA TITLE: Second Reading of an Ordinance to Provide Informal Bidding Procedures Pursuant to CUPCCA; and Finding
Such Action Exempt from CEQA
MEETING DATE: 07/16/2024
Recommended Action:

Motion to

1. Approve Second Reading and Adopt an Ordinance Adding Chapter 3.60 to the Yreka Municipal Code addressing Uniform Construction Cost Accounting Procedures; and

2. Finding such action exempt from the California Environmental Quality Act (CEQA).

Discussion: On June 18, 2024, Staff recommended adoption of Unform Public Construction Cost Accounting Act (CUPCCA). The City Council adopted a resolution electing to adopt CUPCCA, and approved for first reading an ordinance adding section

3.60 (“Public Works Contracts”) to the Yreka Municipal Code to provide informal bidding procedures under the California Uniform Public Construction Cost Accounting Act.

As previously discussed, the adoption of this ordinance will allow the City to perform more work with in-house personnel (force account work) by raising the limit for selfperformed public works and maintenance work. It also expedites the informal bidding procedures, as more projects are completed in a timely manner because of the streamlined awards process and the reduction in paperwork related to advertising and report filing.

The California Uniform Public Construction Cost Accounting Act (“the Act” or “CUPCCAA”) provides for alternative bidding procedures when an agency performs public work and maintenance work by contract. The Act is a voluntary program available to all public entities in the State, but it applies only to those public agencies that have “opted in” to the provisions set forth by the Act using the processes outlined in the Act.

The entirety of the Act is found at Public Contract Code Sections 22000-22045.

Key provisions of the Act allows for public projects of $60,000 or less to be performed by a public agency’s force account using the public agency’s own resources, by negotiated contract, or by purchase order.

Yreka City Council Agenda
July 16, 2024

Page 106 of 116 ends

Public projects in the amount of $200,000 or less may use an informal bidding process if the City adopts an ordinance in compliance with the Act to govern contractor selection through informal bidding. Public projects at a cost of more than $200,000 must use formal bidding procedures to select a contractor.

Public projects includes
• Construction, reconstruction, erection, alteration, renovation, improvement, demolition, and repair work involving any publicly owned, leased, or operated facility.
• Painting or repainting of any publicly owned, leased, or operated facility, and • For publicly owned utility systems, the construction, erection, improvement, or repair of dams, reservoirs, powerplants, and electrical transmission lines (over 230,000 volts ).
(Pub. Contr. Code sec. 22002(c).)
Maintenance work includes routine, recurring, and usual work for the preservation or protection of any publicly owned or publicly operated facility for its intended purposes; minor repainting; resurfacing of streets and highways at less than one inch; landscape maintenance, including mowing, watering, trimming, pruning, planting, replacement of plants, and servicing of irrigation and sprinkler systems; and work performed to keep, operate, and maintain publicly owned water, power, or waste disposal systems. (Pub.

Contr. Code sec. 22002(d).)
Program benefits are: increased force account limit for public agencies; simplified bidding for projects that are $200,000 or less; reduced number of formal bids based on project size; and expedited contracting for projects under $200,000. The City will benefit from this program as it gives more leeway in the execution of public works projects under a certain dollar amount; may speed up the award process; expedite project delivery; reduce the time, effort, and expense associated with bidding projects under $200,000; and simplify administration for those projects. These processes may also be applied to maintenance work.

Business Analysis: The Finance Committee met on April 9, 2024, to review the CUPCCAA policies and procedures manual. It should be noted that when a local agency elects to become subject to the CUPCCAA the entire entity is subject to the Act and no departments are exempt. Filing of the resolution to the California State Controller is the responsibility of the Finance Director, and adherence to cost accounting principles as directed in the manual.

Operations Analysis: The City’s Public Work shall notice and maintain at least annually a list of qualified contractors and additionally notice to invite/solicit bids on projects as identified. Informally bid projects shall include project title, cost, site location, who is taking bids/date and time due, along with owner address and phone number, architect or engineers address and phone number, a brief description of work to be done, where plans Yreka City Council Agenda
July 16, 2024

Page 107 of 116 ends

may be obtained/deposit required as well as the percentage of bid bond/percentage of performance bond/or percentage of payment bond.

Environmental Analysis: The adoption of this resolution and ordinance does not meet the definition of a project for the purposes of the California Environmental Quality Act, under Public Resources Code Section 21065 and CEQA Guidelines Section 15378(b)(5), because it is an administrative governmental activity which will not cause a direct or indirect physical change in the environment. The City Council’s review and adoption of informal bid procedures is not a project under CEQA Guidelines mechanisms which do not involve commitment to any specific project which may result in a potentially significant environmental impact. Thus, no environmental analysis is required at this time.

Fiscal Impact: Streamlined processes are expected to result in more timely completion of public projects and lessen the administrative overhead burden on procurement of contracts involving a public work. There are no fees associated with opting into the program.

The ordinance becomes effective thirty (30) days after adoption.

3.60.050 - Informal bidding procedures.

Public projects and maintenance of $200,000 or less may be let to contract by informal procedures as set forth in the Act, including the following procedures:
(a)Contractors list. The City shall comply with the requirements of Public Contract Code Section 22034 regarding maintaining a list of qualified contractors identified according to categories of work. (b) Notice inviting informal bids.
(1) Circulation. Where a public project or maintenance work is to be performed which is subject to the provisions of this section, a notice inviting informal bids shall be circulated using one or both of the following alternatives:
(i.) Notices inviting informal bids may be mailed or emailed to all contractors for the category of work to be bid, as shown on the list developed in accordance with subsection (a) above.
(ii.) Notices inviting informal bids may be mailed or emailed to all construction trade journals as specified by the California Uniform Construction Cost Accounting Commission in
accordance with Section 22036 of the Public Contract
Code. Additional contractors and/or construction trade

(2) Proprietary products and services. Notwithstanding the foregoing requirements, if the product or service is proprietary in nature such that it can be obtained only from a certain contractor or contractors, the notice inviting informal bids may be sent exclusively to such contractor or contractors.
(3) Mailing. All mailing of notices to contractors and Construction trade journals pursuant to this section shall be completed at least ten (10) calendar days before bids are due.
(4) Contents. The notice inviting informal bids shall describe the project in general terms and how to obtain more detailed information about the project, and state the time and place for the submission of bids.
(c)Rejection of bids; bid irregularities. The city manager may, in their sole discretion, reject any or all bids presented and waive any minor irregularity or informality in such bids.
(d)Award of contract. The city manager is authorized to award and execute contracts informally bid in accordance with this section, provided that the expenditure is within the approved budget and the contract is in a form approved by the city attorney. Such contracts shall be awarded to the lowest responsible bidder.
(e) Tie bids; no bids received. If two or more bids are the same and the lowest, the city manager may accept the one he/she chooses. If no bids are received through the informal procedures set forth in this section, the project may be performed by city employees, by force account or negotiated contract without further complying with this section. (f) Acceptance of work. Upon the completion of work pursuant to a contract awarded pursuant to this section, the city manager may accept the work and may authorize the filing of the notice of completion, the release of funds retained upon such filing, and the release of any bonds upon the conclusion of their respective warranty periods.

(g)Performance bonds. The city manager may require a performance bond before entering a contract awarded pursuant to this section in such amount as the public services director or their designee finds reasonably necessary to protect the best interests of the city. If the city requires a performance bond, the form and amount of the bond shall be described in the notice inviting bids.

Section 2. If any section, subsection, subdivision, sentence, clause, phrase or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.

Section 3. The City Council hereby authorizes and directs the city manager to take any action and sign any documents necessary to implement this Ordinance.

Section 4. The Council finds that this Ordinance does not meet the definition of a project for the purposes of the California Environmental Quality Act, under Public Resources Code Section 21065 and CEQA Guidelines Section 15378(b)(5), because it is an administrative governmental activity which will not cause a direct or indirect physical change in the environment. The City Council’s review and adoption of informal bid procedures is not a project under CEQA Guidelines mechanisms which do not involve commitment to any specific project which may result in a potentially significant environmental impact. Thus, no environmental analysis is required at this time.

Section 5. The City Clerk shall certify to the passage of this Ordinance and cause the same to be posted pursuant to Government Code Section 36933.
