CITY OF YREKA

CITY COUNCIL AGENDA MEMORANDUM
YrekaCity Council
Jason Ledbetter, City Manager
Jason Ledbetter, City Manager
Discussion/Possible Direction: Discussion and Direction on the proposed design for replacing Ringe Pool. A motion to approve the Ringe pool design as presented, or with Council modifications.

February 4, 2025
In 2017 the infrastructure at Ringe Pool failed and the pool was no longer accessible to the public. A facility condition report was drafted in 2018 by a 3rd party that stated the cost to replace was nearly identical as the cost to fix Ringe pool. The community and City Council engaged public input with multiple community workshops to develop a grant application to replace Ringe pool. A 2019 grant to the State of California Parks Department was applied for by the City of Yreka but was not chosen for funding by the State.

An alternative grant proposal from the community for a different location on Foothill Blvd was submitted. This project did receive $8.5 million in grant funding in December of 2021 from the California Parks Department but was sent back to the State after discussion at City Council concerning the cost of the project and the concern of not having engineered plans and a cost estimate in order to move forward, a critical first step in all publicly funded projects.

At the January 3rd, 2023, Yreka City Council meeting the Yreka City Council voted to move forward on funding a 95% completion study for preliminary design and engineering of the Ringe pool complex, not to exceed $750,000. After the competitive bid process of a Request for Proposal (RFP) Nichols, Melburg & Rossetto entered into contract with the City of Yreka. The community input from the 2019 grant process was used to guide staff and NMR on the design we will see this evening.

This evening staff is requesting the Yreka City Council review the proposed design for replacing Ringe pool. Take public input from the citizens of Yreka on any alterations that the council deems imperative to be made. Review the cost of those alterations with NMR this evening or if the alterations require, have them brought back at a future meeting for possible approval. If the Council and public are satisfied, staff is requesting approval of the proposed Yreka City Council Agenda

design in order for NMR to continue forward with a 95% engineered design. At which point staff will begin to seek funding options with the State and will reach out to our local representatives in order to convey our interest in resolving our current pool closure and our need to provide swimming lessons to our public, exercise options for our public, as well as a community engagement location for our public to enjoy.

It is important to note that no current funding stream is available to the City of Yreka for the Ringe pool replacement project. A grant will need to be received in order to bring this project to construction. The priority for the City remains the construction of a new Fire Hall and bringing paid fire staff to our Yreka Volunteer Fire Department. The Ringe pool project is continuing forward and will require engaging our local representatives at the state level and tasking them with guiding staff toward the appropriate funding requests via grant applications to bring this project to the construction phase.

Fiscal Impact:

N/A
Recommendation and Requested Action:

Discussion and Direction on the proposed design for replacement of Ringe Pool. If necessary, alterations can be made to the design and brought back at a future City Council meeting to review the proposed changes to the design and cost of the project.

A motion to approve the Ringe pool design as presented, or with Council modifications.

CITY COUNCIL AGENDA MEMORANDUM
TO: Yreka City Council
FROM: Andrew Jared, City Attorney
AGENDA TITLE: Introduction and First Reading of an Ordinance Amending Chapter 2.04 of the Yreka Municipal Code Concerning
Procedures for Appointment of Mayor and Mayor Pro Tem
MEETING DATE: 02/04/2025
Recommended Action:
(1) Move to introduce and waive the full reading of the proposed ordinance; and (2) Direct city staff to take all actions required for adoption of the proposed ordinance.

Background
Elections Code section 36801 provides that, following the declaration of election results and installation of elected officials, the City Council shall choose one Councilmember to serve as Mayor and one Councilmember to serve as Mayor Pro Tem. Under state law, the offices of Mayor and Mayor Pro Tem have no fixed terms, but serve at the pleasure of the City Council which selects them. (67 Op.Cal.Atty.Gen. 405 (1984).) State law does not provide any specific procedure to nominate, select, replace, or remove Councilmembers to or from the offices of Mayor or Mayor Pro Tempore. City staff has not identified any policy or procedure adopted by the City of Yreka governing the selection process. Pursuant to Section 1.24.150 of the Yreka Municipal Code (YMC), the City Council has adopted that the procedures of the City Council shall be governed by the latest edition of Rosenberg’s Rules of Order. Rosenberg’s Rules of Order, except as otherwise provided in the Municipal Code, state law, or by other rules adopted by the City Council.

There is no process described in Rosenberg’s Rules of Order on this subject other than to specify that a motion to close nominations of the chair requires a 2/3’s supermajority of the legislative board:
“Motion to close nominations. When choosing officers of the body (such as the chair), nominations are in order either from a nominating committee or from the floor of the body. A motion to close nominations effectively cuts off the right of the minority to nominate officers and it requires a twothirds vote to pass.” (Rosenberg’s Rules of Order, p. 5, 2011, League of California Cities).

At the City Council meeting held on December 17, 2024, after seven motions to close the nominations for the position of Mayor, there were not the 4 votes required to fulfill the two-thirds (super majority) vote necessary to close nominations. In light of this impasse, the Council considered a motion to suspend the rules in order to close nominations with a simple majority vote. However, Rosenberg’s Rules of Order requires that a motion to suspend the rules also be approved by a two-thirds vote (4 members), which the Council failed to achieve. The Council then moved to table the selection of Mayor and Mayor Pro Tem to a later date. The matter was again taken up at the City Council meeting on January 21, 2025. A motion to close nominations for appointment of Mayor again failed to obtain the required 4 votes. A motion was passed to table the issue of nominations and to bring back an ordinance to specify the process for selection of the Mayor and Mayor Pro Tem based on a simple majority to close nominations.

Discussion:

Following the recent meetings, staff surveyed how other cities appoint a Mayor and Mayor Pro Tem, and to provide options that may enable the Council to move past this impasse.

The following table summarizes the nomination procedures followed in other jurisdictions:

provide a term (1 or 2 years), while others provide for a rotation of the mayor seat where all parties have the ability to serve as mayor based on seniority.

Proposed Ordinance
The proposed ordinance addresses the issues which came to the attention of not having a process for nomination and selection of the offices. Additionally, several statements in existing code and policy were left without explanation and are addressed here. The proposed ordinance cleans up several issue that are present in the current code and policies, including “serving at the pleasure of the council” but not specifying a procedure for removal, processes for nomination, and term of office.

The proposed ordinance would add sections 2.04.010, 2.04.020, and 2.04.030 to Chapter

2.04 of the Municipal Code to specify:
(1) The offices of Mayor and Mayor Pro Tem are appointed offices, with each office being a two-year term.
(2) The duties of Mayor and Mayor Pro Tem (as stated in the Code of Conduct) are codified here.
(3) Specifies a selection process: Nominations can be made by any member. One member can specify multiple candidates. Council closes nominations by a simple majority vote. Selection is by simple majority of the Council. Tabulation done by ballot and announced to the public.
(4) Provides provision for tie breaker after successive failed rounds. If impasse is reached, new officer is selected by lot from those willing to serve in an interim position. Item returns after 6 months to choose permanent officer for remainder of term.
(5) Provides procedure for removal and replacement of Mayor and Mayor Pro Tem by a simple majority vote of the total membership of the Council. Question is added to the agenda at a subsequent meeting and simple majority is needed for action.

Other cities have addressed these issues in other ways. Some alternative options include:
(1) Adopt an “opt-out” nomination procedure: all members are automatically nominated as candidates for consideration of office with each member not wanting to be considered having the option to opt-out; and
(2) Establish a procedure that closes nominations automatically when it becomes apparent that no further nominations are forthcoming and all members have had the opportunity to nominate themselves or another member.

Both of these alternatives provide the policy goals of allowing everyone to have the option of being nominated without being blocked by the remainder of the board.

Amending the terms of the proposed ordinance at first reading does not require an additional first reading. Amending the terms and introducing “as amended” would result in no delay to adopt an ordinance at the next regularly scheduled meeting for second reading.

Elected Mayor
As an alternative to the mayor being appointed by the City Council, California law allows for cities to have a directly elected mayor. Under this form of government, the electorate votes on mayoral candidates as a specific office, apart from other general City Council positions. To adopt this process of an elected mayoral position, Government Code section 34900 provides, in relevant part:

At any general municipal election, or at a special election held for that purpose, the city council may submit to the electors the question of whether electors shall thereafter elect a mayor and four city council members, and whether the mayor shall serve a two-year or four-year term.

Such question can be placed on the ballot at a future election by the city council. The next election the question could likely be considered would be November 2025. If a majority of the voters in Yreka voted “Yes,” on this ballot question, then at the next following general municipal election in November 2026, one of the offices of City Councilmember would be designated as the office of Mayor and filled at that election. (Gov. Code, § 34902.) The person elected as mayor at that election would hold office for a 4 year term.

State law does not provide an equivalent process to convert the office of Mayor Pro Tempore to an elected position. The Council would still need to choose one of its members to serve as Mayor Pro Tem at the City Council meeting at which it declares general municipal election results. (Gov. Code, §§ 34906, 36801.) The proposed ordinance would require minor amendment to address these issues.

CEQA:

Any action stemming from adoption of the attached ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to the CEQA Guidelines, as the adoption of a procedure for nominating and selecting the offices of Mayor and Mayor Pro Tempore is not a “project,” as general policy and procedure making that has no potential to result in a direct or reasonably foreseeable indirect physical change to the environment. (14 Cal. Code Reg. § 15378.) Furthermore, to the extent the adoption of the attached ordinance constitutes a “project” for purposes of CEQA, the ordinance is exempt from CEQA as there is no possibility that the ordinance or its implementation would have a significant effect on the environment. (14 Cal. Code Reg. § 15061(b)(3).) Fiscal Impact:

None.

Recommendation:

Motion to introduce and waive full reading of the attached ordinance as presented, and direct staff to take all actions required for adoption of the proposed ordinance.

Alternatives:
(1) Motion to introduce and waive first reading of the attached ordinance with modifications.
(2) Do not introduce and waive first reading of the attached ordinance. (3) Direct staff to return with an ordinance to call for a special election asking the electorate whether the electors shall elect a Mayor and four Councilmembers. (4) Direct staff to return with an resolution to submit to voters, at the next general municipal election, the question of whether the electors shall elect a Mayor and four Councilmembers.
