CITY OF YREKA
CITY COUNCIL AGENDA MEMORANDUM
To: Yreka City Council
From: Matthew Bray, Public Works Director
Prepared by: Cynthia Lynch, Municipal Projects Manager
Agenda title: Discussion/Possible Action: Adopt Resolution Approving an Amended and Restated Agreement Concerning Property at Assessor Parcel Number 014- 421-310 and Authorizing Acceptance of Easements and Grant in Fee Certain Property from Judith Anderson; Adopt Resolution Authorizing Acceptance of Easements from Brett Duncan (APN 062-181-010) Meeting date: January 20, 2026
Recommendation and Requested Action:
That Council adopt resolutions
1. Approving an Amended and Restated Agreement concerning property at Assessor Parcel Number 014-421-310 (formerly APN 014-410-340) and authorizing acceptance of easements and a 1.32 acre parcel in fee from Judith Anderson; and
2. Authorizing Acceptance of Easements from Brett Duncan (APN 062-181-010) .
Discussion:
On September 16th the City Council awarded the construction contract for the City of Yreka’s Water Supply and Storage Improvements Project, which will allow the City of Yreka to better endure short term outages in the event of a failure in the Fall Creek water transmission main. One portion of this project involves constructing a new 0.2 million gallon (MG) water tank northwest of and above the three existing, insufficient tanks (the “Shasta Belle tanks”), which are located on property owned by Judith Anderson.
In 2007, the City entered into an agreement whereby the owners of the property now known as APN 014-421-310 (formerly APN 014-410-340) agreed to provide certain easements for the City to locate water tanks and pipelines, and to maintain such tanks and pipelines, and in exchange the City would make certain improvements to provide water service to the property. (“the 2007 Agreement”, included here as Attachment A, “Agreement Regarding Provision of Water by the City of Yreka to Certain Real Property and Creating Certain Interests in Favor of the Parties Regarding the Real Property”.) Such 2007 Agreement with Ms. Anderson details the present easements on her property for the water tanks, water pipelines and access roads, and refers to allowing the development of further easements on her property to accommodate this new project.
It also contemplates certain “Future Grants” for the relocation of water storage facilities as identified in the 2007 Agreement, including a 1.32 acre parcel to be dedicated to the City in fee for a future water storage facility and other associated easements for access and installation of pipelines. (See 2007 Agreement, Section 3.) At this time, the City and Judith Anderson desire to Yreka City Council Agenda
January 20, 2026
431583.1 Page 2 of 2
amend the 2007 Agreement by creating a new agreement to finalize the easements, address the future grants and amend the 2007 Agreement to make certain easements permanent.
Property necessary to complete the access routes in the area is now owned by Brett Duncan (APN 062-181-010). Mr. Duncan is agreeable to providing an access easement. Resolution No. 2026- 02 addressing accepting such easement is provided for approval.
The City Attorney has drafted the attached Agreement between the City and Ms. Anderson and Resolution 2026-01 approving the execution of the agreement and authorizing the City to accept the property easements and dedications. Ms. Anderson has reviewed the draft agreement and is willing to proceed with these amendments to the 2007 Agreement.
Authority requested approves Mayor to execute all documents necessary to cause the property transfers to occur, and staff to cause all required non-substantial amendments to be undertaken.
Fiscal Impact:
There are no immediate financial impacts resulting from these transactions. The agreement must be executed and recorded to allow the City to complete this project.

CITY OF YREKA
CITY COUNCIL AGENDA MEMORANDUM
To: Yreka City Council
From: Matthew Bray, Public Works Director
Prepared by: Cynthia Lynch, Municipal Projects Manager
Agenda title: Discussion/Possible Action: Adopt Resolutions Approving an Easement Agreement Concerning Property at Assessor Parcel Number 062-051-140 and Authorizing Acceptance of Easement from Siskiyou Credit Union Meeting date: January 20, 2026
Recommendation and Requested Action:
That Council adopt resolutions approving an easement agreement concerning property at Assessor Parcel Number 062-051-140 and authorizing acceptance of an easement from Siskiyou Credit Union.
Discussion:
The City of Yreka’s current Water Supply and Storage Improvements Project will allow the City of Yreka to better endure short term outages in the event of a failure in the Fall Creek water transmission main. One portion of this project involves drilling a production well at 1400 Fairlane Road, which is the site of the Yreka Police Department. To have power to run the well and appurtenances the City needs to extend a trench for powerline conduit on the site of the Siskiyou Credit Union at 1420 Fairlane Road. A new easement agreement is required to extend the existing easement on that property and make it permanent. The agreement also states that the City will restore the existing landscaping after the conduit and powerline are properly installed.
The City Attorney has drafted the attached Easement Agreement between the City and Siskiyou Credit Union and Resolution 2026-03 approving the execution of the agreement and authorizing the City to accept the property easement. The credit union has discussed the project with the City and reviewed the easement exhibits, and is willing to proceed.
Fiscal Impact:
There are no immediate financial impacts resulting from these transactions. The agreement must be executed and recorded to allow the City to complete this project.

Dear Mayor Baker and Members of the City Council,
Thank you for considering Peckham & McKenney to assist with the City of Yreka’s City Manager recruitment. We would be honored to represent you in this important search, helping identify the right candidate to work effectively with the Council, serve residents, and advance your community’s goals.
As a mid-sized, long-standing boutique firm, Peckham & McKenney is recognized for successful, lasting placements. Four qualities set us apart and explain why cities choose us:
• We actively and personally recruit candidates. Rather than relying solely on advertisements, we leverage our extensive network, direct outreach by phone, email, and LinkedIn, and promote the opportunity with enthusiasm.
• We limit the number of concurrent searches, ensuring focused attention on each client. • We prioritize clear, consistent communication with both clients and applicants. • Your recruiter is directly responsible for every aspect of the search, serving as your single point of contact.
As an executive recruiter, I am proud of our work because our values emphasize supporting public agencies in furtherance of good government, placing quality above quantity, and building enduring relationships with those who serve the public.
Our team is composed of retired city executives who are deeply committed to the public sector. For example, I have 27 years of experience in California local government, including 15 years as City Manager for the Town of Los Altos Hills. I understand the responsibilities and expectations of a smalltown City Manager, and I know what it takes to identify strong candidates. Over the past 24 months, I have successfully completed City Manager recruitments for the small Northern California Cities of Weed, Anderson, Corning, Ione. I have completed the City Attorney recruitment for the City of Redding and also currently in progress with the City Manager recruitment for Redding.
Yreka City Council Agenda
January 20, 2026
Enclosed with this proposal is a sample City Manager recruitment brochure that I prepared with input from the City Council and designated representatives. Also enclosed is our detailed proposal outlining our process, timeline, resources, references, experience, and fee.
I am prepared to launch the recruitment immediately after January 1, 2026. Peckham & McKenney is excited to implement a process that will lead to the successful placement of a candidate who truly “fits” the City’s interests. I reside in northern California, within 4.5 hours of Yreka, and will attend the key meetings in person—including the presentation of candidate résumés to the Council and the City Manager candidate interviews.
Please feel free to contact me at (650) 504-3515 with any questions.
Sincerely,
Carl Cahill, Executive Recruiter

OUR COMMITMENT TO YOU
Time and again, we receive unsolicited comments from clients and candidates relating to our integrity and high ethics.
We believe in honesty. No client should ever appoint an individual without being fully knowledgeable of the candidate’s complete background and history. Additionally, no candidate should ever enter into a new career opportunity without full disclosure of any organizational “issues”.
We keep everyone involved in the recruitment process informed. Not only do we provide regular updates to our clients, we also have a reputation for keeping our candidates up to date. We do not recruit staff from our client agencies for another recruitment during an active engagement nor do we “parallel process” a candidate.
We do not recruit our placements – ever. Should a placement of ours have an interest in a position for which we are recruiting, they may choose to apply. If they become a finalist, we ask that they speak to their supervisor to alert them of their intent. We are retained only by client agencies an only serve cities, counties and special districts. We do not commit ourselves to too many searches. Your recruiter maintains a small, limited number of concurrent searches in order to focus specifically and diligently on recruiting qualified candidates for your vacancy.
We commit to diversity in its broadest possible definition in every aspect of each executive recruitment.

CITY OF YREKA
CITY COUNCIL AGENDA MEMORANDUM
Prepared by: Alia Roca Lezra, Planning Manager
Agenda Title: Cannabis Business Permit Fee Schedule
Meeting date: January 20, 2026
Suggested Motion:
Motion to approve Resolution 2026-04 “A Resolution of the City Council of the City of Yreka Adopting a Comprehensive Cannabis Business Permit Fee Schedule and Adopt the Finding that the Project is Statutorily Exempt from CEQA” Summary:
City staff prepared a fee schedule for Cannabis Business Permits (“CBP”). These fees are intended to recover costs for staff time spent processing and issuing CBPs for non-storefront retail cannabis operations within the City of Yreka.
Background:
On October 21, 2025, the City Council adopted Ordinance No. 885, adding Chapter 5.30 (Cannabis Business Activities) to the Yreka Municipal Code. This ordinance regulates nonstorefront retail cannabis businesses and establishes a regulatory program requiring all commercial cannabis operators to obtain a City-issued CBP before beginning operations.
Administering this program requires the City to incur costs associated with processing permit applications and ensuring that applicants and businesses comply with the Municipal Code and all related regulations and policies.
Cannabis Business Permit Fees:
Staff proposes the establishment of three new fees to support the administration of the City’s CBP program.
First, the “Application Review Fee” is designed to recover the costs associated with reviewing a CBP application and, for qualified applicants, issuing the permit. This fee reflects the staff time and resources required to evaluate application materials, verify eligibility, and complete the initial permitting process.
Second, the “Cannabis Business Permit Fee” would apply to all permitted cannabis businesses and is intended to fund the ongoing administration of the cannabis regulatory program. This includes compliance monitoring, routine inspections, enforcement activities, and other Yreka City Council Agenda
January 20, 2026
regulatory functions necessary to ensure continued adherence to local and state cannabis requirements. The fee is due upon the initial issuance of a CBP.
Finally, the “Cannabis Business Permit Renewal Fee” recovers the costs of reviewing renewal applications and issuing renewed permits. This fee supports the administrative review process by covering staff time dedicated to evaluating compliance history, verifying required documentation, and confirming that the business remains in good standing with all applicable regulations. Payment of the renewal fee is required at the time a renewal application is submitted and must be made in full for the permit to be renewed.
Environmental Review:
The proposed action has been determined to meet the guidelines for a statutory exemption pursuant to Section 15273(a)(1) “Rates, Tolls, Fares, and Charges” of the State California Environmental Quality Act (CEQA) Guidelines. The establishment, modification, structuring, and approval of rates or other charges by public agencies are exempt from CEQA under this section. The possible adoption of the proposed master fee schedule would not result in a project that would directly or indirectly impact the environment.
Outside Agency and Public Review:
The city noticed a public hearing regarding the proposed fee schedule pursuant Government Code Section 6062(a). This section requires that a notice be placed in the newspaper and online for a minimum of 10 days ahead of the public hearing. No comments have been received at this time.
City Staff Recommendation
Staff recommend that the City Council approve the attached resolution adopting the proposed Cannabis Business Permit Fee Schedule and determine that its adoption is exempt from the California Environmental Quality Act (CEQA).

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF YREKA ADOPTING A COMPREHENSIVE

AND ADOPTING THE FINDING THAT THE
PROJECT IS STATUTORILY EXEMPT FROM
CEQA
WHEREAS, on October 21, 2025, the City Council of the City of Yreka (“the City”) adopted Ordinance No. 885 adding Chapter 5.30 (Cannabis Businesses Activities) to the Yreka Municipal Code to regulate non-storefront retail cannabis businesses within the City and establish a regulatory program requiring all commercial cannabis businesses to obtain a Cannabis Business Permit issued by the City prior to commencing operation; and WHEREAS, the administration of the cannabis business regulatory program requires the City to incur costs to process permit applications and to ensure applicants and businesses comply with the City' s Municipal Code and related regulations and policies; and WHEREAS, the City Council is empowered to impose reasonable fees, rates, and charges for municipal services. California Government Code Section 66000 et seq. authorizes public agencies to adopt fees for municipal services, provided such fees do not exceed the cost to the agency for providing the services.
WHEREAS, in connection with such review, the City Staff and SCI Consulting Group conducted a cost analysis to determine the reasonable costs for the operation and administration of the cannabis regulatory program, including the costs for processing Cannabis Business Permit applications and compliance activities.
WHEREAS, based on the analysis, City Staff is now recommending the fees, charges, and rates associated with the operation and administration of the cannabis regulatory program, including the costs for processing Cannabis Business Permit applications and compliance activities.
WHEREAS, the City Council desires to establish policy of recovering the full costs reasonably borne of providing special services and programs of a voluntary and limited nature, and regulatory services deemed necessary to protect the public health, safety, and welfare, such that general taxes are not diverted from general services of a broad nature and thereby utilized to subsidize unfairly and inequitably such special services; and WHEREAS, notice of public hearing has been given pursuant to Government Code Section 6062a, and the required public hearing was held January 20, 2026.
NOW, THEREFORE, BE RESOLVED that the City Council of the City of Yreka hereby finds, resolves, and determines as follows:
Section 1. Adoption and Incorporation of Recitals. The recitals set forth above are true and correct and are incorporated herein.
Yreka City Council Agenda
January 20, 2026
Section 2. Environmental Exemption. The City Council finds that the adoption of this Resolution is exempt from the California Environmental Quality Act (“CEQA”) pursuant to a statutory exemption for “Rates, Tolls, Fares, and Charges” pursuant to Section 15273(a)(1) of the State California Environmental Quality Act (CEQA) Guidelines.
Section 3. Findings.
A. The City Council finds that the fees and charges increased pursuant to this Resolution are set at the estimated costs reasonably borne by the City in providing the regulations, services, and products to which each such fee or charge applies and in no case do they exceed the estimated cost of the service.
B. The City further finds that the City conducted an analysis of its services, the costs reasonably borne by the City in providing its services, the beneficiaries of such services, and the revenues produced by those paying fees and charges for such services. The review and analysis set forth a mechanism to ensure that fees adopted by the City do not exceed the reasonable estimated cost for providing the services for which the fees are charged.
C. After conducting a duly noticed public hearing on January 20, 2026, and satisfying all applicable provisions of California Government Code Sections 66016 and 66018, the City Council hereby determines that the fees, rates, and charges proposed to be increased should cover the costs reasonably borne or a substantial portion of the actual costs of the services provided by the City and that the certain fees, rates, and charges identified on Attachment 2 to the staff report, satisfy this requirement.
Section 4. Adoption of Fees and Charges. Pursuant to applicable provisions of the California Constitution and the California Government Code, the City Council hereby approves and adopts the adjusted fees and charges for regulations, services, and products set forth in the excerpt attached as Exhibit “A” to this Resolution.
Section 5. Effective Date. The fees and charges increased pursuant to this Resolution shall take effect no sooner than 60 days following the adoption of this Resolution, pursuant to Government Code Sections 66017(a) and 66019(b).
Section 6. Severability. If any section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Resolution or any part hereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of this Resolution or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause, or phrase be declared invalid or unconstitutional.
Introduced and adopted at a regular meeting of the City Council held this 20th day of January, 2026, by the following vote:

Discussion/Possible Action: Approval to apply for the AFG Radio Equipment Grant in the Amount of $25,000
January 20, 2026
In fire service, communication is paramount to safety and efficiency. The Yreka Fire Department is in need of new radios to replace obsolete equipment and to accommodate the most up to date California State Fire frequencies during fires and other emergency events.
This proposed grant would be written by Lexipol, which we have utilized and were recently successful on another grant unrelated to this request. Should we be successful in obtaining this grant, we will be able to replace many of our old, unrepairable radios and increase our ability to communicate during fires and other emergencies for the foreseeable future. This will also standardize our radios for ease of operation.
Per the Grant Management Policy of the City of Yreka, we are seeking approval of our pursuit of this grant in the amount of $25,000, for the purchase of new radio equipment and accessories. (20 handheld radios, charging units, antennas, microphones etc.) Fiscal Impact:
$5,400 grant writing fee which will come from the fire department budget.
Recommendation and Requested Action:
That the Council approve the Yreka Fire Department’s request to apply for the AFG Radio Equipment Grant in the amount of $25,000.00; assisted by Lexipol.
