Introduction of Proposed Accessory Dwelling
Unit (ADU) Ordinance Revision
To: Yreka City Council
From: Planning Department
Prepared by: Alia Roca Lezra, Planning Manager
Agenda Title: Second Reading of an Ordinance to Amend Title 16 of the Yreka Municipal Code in Compliance with State Accessory Dwelling Unit (ADU) Law
Meeting Date: April 21st 2026
Purpose
This is the second reading of an ordinance amending a portion of the recently updated Accessory Dwelling Unit (ADU) ordinance (Attachment 1) in compliance with recent State law. A public hearing and first reading of this ordinance were completed at the April 7th, 2026, City Council Regular Meeting.
Summary
On December 16, 2025, the City Council adopted a comprehensive Accessory Dwelling Unit Ordinance to align with State standards. Subsequent to this adoption, the City Attorney’s office identified Assembly Bill 1154, which went into effect on January 1, 2026. This new law introduces a specific distinction regarding the regulation of Junior Accessory Dwelling Units (JADUs) based on the unit’s sanitation facilities.
Under the provisions of AB 1154, local agencies may only impose owneroccupancy requirements on properties containing a JADU if that unit shares sanitation facilities, such as a bathroom, with the primary dwelling. In instances where a JADU includes its own separate and private sanitation facilities, the City is now prohibited by State law from requiring the owner to reside on the property. Staff have incorporated this language and recommends approval of this amendment to ensure the City’s code remains legally enforceable and fully aligned with State housing mandates.
Fiscal Impact
No direct fiscal impact by amending the City’s Municipal Code.
Environmental Review
The proposed amendments to the Accessory Dwelling Unit Ordinance (Attachment 1) are not subject to environmental review under the California Yreka City Council Agenda
April 21, 2026
Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15060(c)(2) and (3) in that the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment, and in that the activity is not a "project" as defined in Section 15378. CEQA Guidelines Section 15378(b)(2) and (5) exclude "[c]ontinuing administrative ... activities" and "administrative activities of governments that will not result in direct or indirect physical changes to the environment" from its definition of "project." Recommended Action
1. Motion to adopt Ordinance 888 “An Ordinance of the City Council of the City of Yreka, California, Amending Section 16.46.170(E) “Accessory Dwelling Units” and Finding the Ordinance Exempt from the California Environmental Quality Act (CEQA) Pursuant to CEQA Guidelines Section 15378”

CITY OF YREKA
CITY COUNCIL AGENDA MEMORANDUM
To: Yreka City Council
From: John Elsnab, Interim City Manager
Agenda title: Requested Action – Adopt a Resolution of the City Council of the City of Yreka Approving the Amended Compensation Resolution for Fire Employees
Meeting date: April 21, 2026
Discussion:
The City maintains several fire department positions, including Firefighter, Fire Engineer, and Fire Captain, that are not represented by a Memorandum of Understanding (MOU) for purposes of establishing compensation and benefits. Unlike other employee bargaining groups, the current Fire Compensation Resolution does not include provisions for cost-of-living salary adjustments.
To maintain compensation practices consistent with other City employee groups, it is recommended that the Firefighter, Fire Engineer, and Fire Captain positions receive a three percent (3%) salary increase effective July 5, 2026.
Estimated Fiscal Impact in dollars:
The fiscal impact for FY 26/27 is approximately $13,300.00 Recommendation:
Adopt a Resolution of the City Council of the City of Yreka Approving the Amended Compensation Resolution for Fire Employees

Planning Commission Retool:
Quarter 1 Update
To: Yreka City Councilmembers
From: Alia Roca Lezra, Planning Manager
Date: April 21, 2026
Summary: This is the first quarterly staff update regarding the 2026 Planning Commission Workplan. The City Council paused the Planning Commission in the Fall of 2025 due to a lack of quorum. Council subsequently directed staff to retool the Planning Commission and bring it back online by the end of 2026. During this first quarter, staff conducted a series of interviews with Councilmembers and former Commissioners, finding that while the Planning Commission serves as an important decision-making body, its previous iteration suffered from a lack of clear identity, lack of training for commissioners, inconsistent communication, and inadequate vetting of applicants. Interviewees shared that the Planning Commission should transition to a model that emphasizes professionalism, objectivity, and ample training for Commissioners.
Findings: Below is a list of staff findings from interviews with Councilmembers and former Commissioners:
• There is a perception that past members did not always understand that if a project meets city criteria, it must move forward.
• Several people interviewed believe it is important to make sure that the Commission is used for objective land-use decisions rather than personal agendas. • There is a perception that appointments were occasionally based on social ties rather than qualifications, leading to personality conflicts and revolving door memberships. • There is a perception that high vacancy rates were driven by a lack of upfront commitment. Furthermore, there is a perception that holding monthly meetings when there was no business wasn't worth it for members.
• Councilmembers reported being in the dark regarding Commission activities, specifically with regard to finding out about resignations or cancelled meetings the night of the event. • A former Commissioner felt that their role was to approve projects rather than providing input on the projects.
Discussion: Below is a list of potential solutions that were discussed during interviews to improve the Planning Commission:
• Implement a formal scoring rubric for applicants to make sure candidates are selected based on objective criteria. Prioritize candidates with backgrounds in real estate, land use, or community planning, but be open to laypeople who are committed to civic duty. • Staff should vet applicants and conduct an initial qualifications screening, and then conduct final interviews in front of the full Council.

• Establish the expectation that the role is a serious civic commitment. Potentially require a signed Expectations Agreement upon appointment.
• Staff should design trainings that frame the PC as a quasi-judicial body and emphasize that decisions are not based on Commissioners’ opinions but on findings and conditions as described in the city codes. At the same time, trainings should bridge the gap between meaningful project review and strict code adherence, making sure Commissioners feel empowered to shape outcomes within their legal mandate. • There is broad support among Councilmembers and staff for a small stipend of $50-$100 per meeting for Commissioners if they attend meetings.
• Shift to an every-other-month or quarterly meeting schedule, calling special meetings as needed to address project timelines. This respects Commissioners' time and makes sure meetings are substantive.
• Improve communication between Staff and Councilmembers regarding Planning Commission activities, including having staff inform Council about resignations or vacancies, provide meeting updates to Councilmembers, and proactively inform Councilmembers about potentially controversial items or projects. • Hold joint meetings 1-2x per year to ensure the Commission understands the Council’s vision for city growth and priorities. Councilmembers identified an opportunity to improve communication/collaboration between the two bodies. • Have staff bring Planning Commission codes and policies up to industry standard.
Next Steps: Staff will use this feedback when completing the remaining items in the work plan.
Quarter 2 activities include:
• Planning Commission Ordinance Amendments
o Staff will research other cities’ PC ordinances to incorporate industry standards and best practices.
o Staff will review changes to state regulations that govern Planning Commission actions
• Revise the PC Interview & Appointment Process
o Staff will audit the current process and present recommendations at the next quarterly update.
• Draft a PC Budget
o Planning Staff will work with the Finance Department to draft a PC budget to present at the next quarterly update.
• Reassess the PC Meeting Schedule
o Staff will assess meeting frequency, days, and times and present recommendations at the next quarterly update.
