expected to sign the agreement at their May 28th County Board of Supervisors meeting.

Fiscal Impact:

Currently, the total project cost is estimated at $4,030,481.30, with the City's share of cost being $400,045.32. An additional $60,006.80 (15%) is recommended to cover City costs for construction management and contingencies. Actual project cost reimbursements will be paid through CIP Account Number 1051 (Road Rehabilitation). The account currently has approximately $1.541M available. The County will be reimbursed for the amounts estimated in the background section for the project. Actual dollar amounts may vary slightly based on actual quantities placed in the field during construction.

Alternatives:

Do not enter into the agreement with the County of Sutter. Failure to enter into this agreement would force the County to revise its project to eliminate areas within City right-of-way, resulting in partially paved street segments.

Recommendation:

Adopt a Resolution authorizing the execution of a Cooperative Agreement with the County of Sutter for the roadway and roadway component improvements associated with the FY 2023-24 Sutter County Road Overlay Project

CITY OF YUBA CITY

STAFF REPORT
Date: May 7, 2024
To: Honorable Mayor & Members of the City Council;
From: Public Works
Presentation By: Joshua Wolffe, Associate Engineer
Summary
Subject: Police Department Evidence Storage Building (1545 Poole Blvd, Yuba City, CA 95993) - Contract Award
Recommendation: Adopt a Resolution which takes the following actions:

A. Awards a construction contract to Frank Webb Construction of Wheatland, CA in the amount of their total base bid of $797,110.89, and adopts a CEQA Class 3 Categorical Exemption

B. Authorizes the City Manager to execute the contract on behalf of the City, subject to review and approval as to legal form by the City Attorney

C. Authorize the Finance Director to make a supplemental appropriation in the amount of $155,000.00 from unallocated General Funds to CIP Account No. 901278 (Police Department Evidence Storage Building)
Fiscal Impact: $925,000 – Account No. 1278 (Police Department Evidence Storage Building) $797,110.89 - Contract Award Amount
$ 79,711.09 - Construction Contingency (10%)
$ 48,178.02 - Construction Management and Inspection (6%) Purpose:

To construct a building to handle unmet evidence and bulk storage needs at the Police Department.

Council Strategic Goal:

This project addresses City Council’s Strategic Goal of Public Safety, as the construction of the evidence building is essential to the Police Department's operations.

Background:

In December 2017, the plans and specifications for the Police Department Facility Expansion (CIP No. 1238) were approved to provide additional areas for building improvements, parking, and storage at the Police Department. The location to store and protect evidence from environmental contamination was identified and prepared for future build-out.

The new Police Department Evidence Storage Building was designed to include a new building pad, a 40’ x 60’ climate-controlled metal building on a 6” reinforced concrete slab, four (4) automatic roll-up

Page 918 of 931 ends

doors, two personnel-doors, electrical panels and lighting, two (2) 5-ton heat pumps, an eye-wash station, an interior chain-link fence with a rolling gate, hardscape around the building and ADA compliant access to the accessible parking areas.

Analysis:

The Project was advertised for bids beginning March 15, 2024. On April 9, 2024, four (4) bids were received and opened by the City Clerk Administrator. A list of the bids received, and the Engineer's Estimate are shown below:

Company Base Bid Amount
Frank Webb Construction, Inc. $797,110.89
Hilbers, Inc. $808,629.13
D.G. Granade Construction, Inc. $811,080.38
ABS Builders, Inc. $854,969.71
Engineer's Estimate: $692,607.00
Frank Webb Construction, Inc. is the low, responsible, and responsive bidder. Contract administration, construction management, and quality assurance inspection will be performed by Public Works Department and Community Services Department staff. Project construction is expected to begin in late June 2024 and continue through late August 2024.

Since this is an emergency services building, special inspections will be required for certain construction components. The special inspections will be provided by a qualified special inspection firm.

Staff is currently developing a Request for Proposals (RFP) to procure a contract with a qualified special inspection firm.

Fiscal Impact:

The estimated total construction cost for the project is approximately $925,000.00, which consists of the following components:

Construction Contract: $797,110.89
Construction Contingency (10%): $ 79,711.09
Construction Management and
Inspection (6%):
$ 48,178.02
Total Project Cost: $925,000.00
Staff requests a construction contingency of $79,711.09, which equates to 10% of the construction cost, to ensure that the project will have all necessary funds to complete construction. A portion of contingency funds are anticipated to be used to fund the purchase and installation of storage racking, which was not included in the bid documents, but will be necessary for the facility's functionality. Staff also requests $48,178.02, which equates to 6% of the construction cost, for construction management and inspection. Construction management, and general inspection will be completed by City staff, though required special inspections will be performed by a qualified firm.

Currently, Capital Improvement Program (CIP) Account No. 1278 (Police Department Evidence Storage Building) has a balance of $770,000, which is $155,000 less than what is estimated to be necessary to fund the project. Staff recommends authorizing the Finance Director to make a supplemental appropriation from unallocated General Funds to CIP Account No. 901278-65501. As of 03/31/2024, the unallocated General Fund balance was $2,677,790.75.

Environmental:

Staff has performed a preliminary environmental assessment of this project and has determined that it

Page 919 of 931 ends

falls within the Class 3 Categorical Exemption set forth in CEQA Guidelines, Section 15303 as this contract is for an accessory (appurtenant) structure at the site. The proposed structure does not exceed 2,500 square feet in floor area, does not involve the use of significant amounts of hazardous materials, and all necessary public services and facilities are available and the surrounding areas are not environmentally sensitive. Furthermore, none of the exceptions to Categorical Exemptions set forth in the California Environmental Quality Act (CEQA) Guidelines, Section 15300.2 apply to this project.

Alternatives:

1. Direct staff to utilize different funding source(s) to fund the project.

2. Reject the bids and do not construct the project. Delays with construction will impact the Police Department's ability to protect various evidence from environmental contamination. Additionally, a majority of the project's funding is through American Rescue Plan Act (ARPA) funds. The ARPA funds must be encumbered no later than December of 2024, therefore if the Council elects to reject the bids, the ARPA funds may need to be reallocated to another eligible project.

Recommendation:

Adopt a Resolution which takes the following actions:

A. Awards a construction contract to Frank Webb Construction of Wheatland, CA in the amount of their total base bid $797,110.89, and adopts a CEQA Class 3 Categorical Exemption B.
